REPORT TO COUNCIL DATE: January 12, 2016 REPORT NO.: 16-006 SUBMITTED BY: Tyra Henderson, FILE NO.: Bylaws 4284 & 4285 Deputy Director of Corporate Administration SUBJECT: 2015 Local Area Service Project (104 th Avenue) PURPOSE To present City of Dawson Creek Parcel Tax Roll Preparation Amendment Bylaw No. 4284, 2016 and Parcel Tax Roll Amendment Bylaw No. 4285, 2016 to Council for consideration of first three readings. SUMMARY/BACKGROUND In 2014, staff became aware that the process for authorizing charges to property owners for local area service projects had changed and Council adopted Parcel Tax Roll Preparation Bylaw No. 4209 and Parcel Tax Bylaw 4210 to authorize 2014 local area service paving projects (and earlier projects that were still subject to annual charges if not paid out at the time of the work). These bylaws serve to authorize the preparation of a specific parcel tax roll for the areas benefitting from an approved local area service, and for the City to impose charges on those properties. Each year, projects that receive the approval of the residents are added to those bylaws. In addition, this year, all of the projects from 2006 or earlier are proposed for removal as the ten year payment period is over. The attached bylaws include only the projects that are still subject to annual charges, and add the 2015 project on 104 th Avenue. ALTERNATIVES N/A IMPLICATIONS (1) Social Residents of 104 th Avenue between 8 th & 14 th Street are benefitting from a newly paved street and repaired sidewalks. (2) Environmental N/A (3) Personnel Finance Department staff will notify property owners of the finalized charges once the bylaw is adopted. Residents have the option of paying their portion of the paving project all at once, prior to the end of March, 2016, or may instead choose to have the cost spread out over ten years, assessed annually with the tax notice. Interest charges are applied if residents choose this option. Page 2 of 7

(4) Financial The residents portion and the City portion of the cost of the project are clearly identified prior to seeking resident approval of the project. 2015 paving projects were completed within allocated budgets. (5) Risk Assessment Compliance: Local Area Service Policy, Community Charter Sec. 202 & 211, Bylaws. Risk Impact: Low Internal Control Process: Council approval of all bylaws is required. If no changes are required following the Review Panel hearing, and all properties are accurately represented on the Roll, the Finance Department can then issue the invoices for the paving project including the deadline for payment, prior to transferring the charges to taxes for those who opt to pay over the ten year period. RECOMMENDATION That Report No. 16-006 from the Deputy Director of Corporate Administration re: 2015 Local Area Service Project (104 th Ave) be received; further, that Parcel Tax Roll Preparation Amendment Bylaw No. 4284, 2016 and Parcel Tax Roll Amendment Bylaw No, 4285, 2016 be given first three readings.
