MINUTES CITY OF DELANO CITY COUNCIL REGULAR MEETING June 18, 2018 CALL TO ORDER Mayor Vallejo called the meeting to order at 5:30 p.m. in the City Hall Council Chambers, 1015 11 th Avenue. Pastor David Vivas offered the invocation. Council Member Aguirre led the flag salute. INVOCATION FLAG SALUTE ROLL CALL Council members present: Grace Vallejo, Joe Aguirre, Liz Morris Council members absent: Ruben Hill and One (1) Vacancy OFFICIALS PRESENT City Manager Reyna, City Clerk Chavez, City Attorney Richman, City Engineer Dowling, Finance Director Rios, Chief of Corrections Marshall, Interim Chief of Police Alvizo, Recreation Manager Batth, and Interim Community Development Director Keene No Items PRESENTATIONS AND AWARDS ITEMS FROM THE PUBLIC 1. Roberto Ibarra inquired about the dial-a-ride service and if it was only intended for handicap people. Mr. Ibarra also asked if City has been aware of the work being done by the Pacific Railroad and mishaps they ve caused due to blocking of the streets. 2. Yolanda Vega shared her concern about the Delano Little League fields regarding prop 68 bonds and if the City of Delano s consulting firm was aware of this and if they are applying for these funds. Also, if the City of Delano would consider

working with the county if awarding said funds. Lastly, she asked if this item will be on a future agenda. 3. Blanca Vasquez, Delano Little League, inquired when will this item be on the agenda since it was brought up to the Council a few months now. City Manager Reyna stated that she s been in contact with Ms. Vega and the County in coordinating a meeting. Mayor Vallejo consulted with Ryan Shultz and was informed that no one from the public has contacted him in respect to this matter. 4. Yolanda Vega spoke again and added that she spoke to Ryan Shultz, and David Couch and others at the County in which she was sent to the City and back to the County. 5. Janet Rabanal, Delano Chamber of Commerce, announced Community s 2 nd Free Farmer Market being hosted by Delano Chamber of Commerce, Delano Regional Medical Center, Family Health Care, Central Valley Farmworkers Foundation, and Delano Elementary School District to be held June 28, 2018. 6. Mario Sanchez, Delano Little League Board, shared the poor conditions of the baseball fields, illegal activity and he s only see to patrol vehicles in the last three months. He doesn t see any county help and nobody wants to help that s why he s hear asking for any type of help. CONSENT AGENDA 1) Authorization to waive the reading of any ordinance in its entirety and consenting to the reading of such ordinances by title only 2) Warrant Register in the amount of $2,340,972.73 3) Minutes of regular City Council meeting of June 4, 2018 4) Minutes of special City Council meeting of June 12, 2018 5) Resolution of the City Council of the City of Delano accepting the Gann Appropriations limit report for the adopted budget fiscal year 2018-2019 6) Resolution authorizing the city manager to sign, make financial decisions, enter into contract, implement the new vehicle project, and submit the application for public benefit grant program/new alternative fuel vehicle purchase with the San Joaquin Valley Air Pollution Control District (SJVAPCD) (Resolution No. 2018-42)

7) Airport hangar rental agreement with Christopher K. Combs for open bay shelter s-2 at the Delano municipal airport and authorization of the city manager to sign the agreement (Agreement No. 2018-54) 8) Authorizing the Purchase of SC3000 Asphalt Paving Material in the amount of $250,000.00 from Jaxon Enterprises dba Deer Creek Asphalt, out of Redding, CA., based on the approved 2018/2019 Budget, effective July 1st 2018 9) Approve resolution designating a mid-block cross walk on Garzoli St. near the Hyatt Place Hotel and approximately 375 feet north of the intersection of Garzoli St. and Millennium Dr. (Resolution No. 2018-43) 10) Second and Final Reading of City Council Ordinance No. 2018-1300 - An Ordinance of the City of Delano amending the Official Zoning Map from Single Family Residential (R-1) District to Planned Development (PD) District of a 7.24 acre portion of Assessor s Parcel Number 049-031-032 for Zoning Amendment Application No. ZA-2018-001 (Educational Leasing, LLC) (Ordinance No. 2018-1300) 11) Approval of the co-sponsorship to host the Kern County Elections polling sites in the total amount of $1,380 for the usage of the Civic Center and Ellington Center Gym on June 5 and November 6 Motion was made by Council Member Morris to approve agenda items 1-5,7, 9, and 11 on consent agenda; 2 nd by: Aguirre Item No. 6, Pulled by Staff and Gloria Herrera Reason for being pulled: Change on staff report. Staff Report was provided by City Manager Reyna. Instead of two vehicles, it will now be fire vehicles so the resolution will have to be changed. Item No. 8, Pulled by Gloria Herrera Reason for being pulled: What is the funding going to be used for?

Staff Report was provided by City Engineer Dowling. Lupe Martinez asked if this will be done by our equipment and staff. Mayor Vallejo responded in the affirmative. Item No. 10, Pulled by Lupe Martinez. Reason for being pulled: Who is Educational Leasing, LLC and where is this located at? Staff Report was provided by Senior Planner Card. Council Member Aguirre asked if this is on the property of the school. Senior Planner Card responded in the affirmative. City Attorney Richman read the ordinance. PUBLIC HEARINGS 12) Request adoption of the City s 2018-2019 Annual Action Plan and review of CDBG funding allocations (Resolution No. 2018-44) Staff report was provided by City Manager Reyna. Mayor Vallejo asked if this was from the 5-year plan that has been approved by HUD. City Manager Reyna approved in the affirmative. Council Member Aguirre read into the record the following: $97,955 - Domestic Violence Center Operations, $130,606-2017-2018 Planning and Administration, $128,868.23 Section 108 Loan Repayment, $479, 084.77- Waterline and Resurfacing Street Improvements for emphasis for the public so they can know where they money is going. Mayor Vallejo opened the public comment. Lupe Martinez thanked Council Member Aguirre for that information. Asked if there was supposed to be swimming pool there. City Manager Reyna responded that Mr. Martinez is correct, but this funding doesn t pertain to the Aquatic Center, this is for repayment of the construction of the gym that is currently there now. Mr. Martinez inquired how the pool will paid for. City Manager Reyna responded through a variety of different grants to help in assistance. Roberto Ibarra suggested that this pool be indoors so it can be used year-round.

Mayor Vallejo stated that the City of Delano has to balance the cost to keep prices low for the public. Mayor Vallejo closed public comment. Ayes: Hill/Aguirre/Morris Absent: Vallejo REGULAR AGENDA 13) Reappointment of Planning Commission Members Staff report was provided by City Manager Reyna. Mayor Vallejo opened the public comment. Lupe Martinez inquired about the process for appointment of planning commissioners. City Manager Reyna explained the process by way of submitting an application and approval by the majority of council. Mayor Vallejo added that the Planning Commission recently had two vacancies and Council Member Aguirre helped in providing to applicants. Gloria Herrera shared that she was selected on the Citizens Review Committee and she kept on reaching out to Phyllis, but they never met. City Manager Reyna explained that there are various boards and commissions in which some meet regularly, where others such as the personnel board have never met. As to the committee that Ms. Herrera is referring to, that is in respect to the Measure I in which we are no longer under and is no longer active. Mayor Vallejo requested that a letter be sent to members of that particular committee to be notified and thanked for their service. Mr. Martinez shared that it is discourage in which Measure I is about money and should be transparent. The people participated, but never met because it wasn t important. Mayor Vallejo agreed with Mr. Martinez, but we need to stay on this item. Council Member Aguirre was wondering about this one commissioner that wanted to retire. City Manager Reyna responded the particular commissioner that Council Member Aguirre is referring to is Mr. Gary Langston, though he has stated that he wished to retire, he has shared his interest to stay on for another four year term. Motion was made to reappoint Gary Langston to a four year term ending June 2022 and Julio Guerra to a four year term ending in June 2022 by: Aguirre 2 nd by: Morris

14) Consideration of Co-Sponsorship with World Harvest International Church for March for Justice Staff report was provided by City Manager Reyna. Mayor Vallejo asked what the budget impact is. City Manager Reyna responded $600. Pastor David Vivas shared his support for the March for Justice and informed the City Council on some background as to why this event is being put together and its purpose to help the Delano Police Department for the entire community. Motion was made to cosponsor said event not to exceed the amount of $600 by: Aguirre 2 nd by: Morris No Items DEPARTMENTAL REPORTS COUNCIL STATEMENTS AND REPORTS Council Member Aguirre: Requested an annual report for Measure I so that the public is aware how we are handling their funds such as the aquatic center and police vehicles in respect to providing transparency via formal report. Lastly, with all due respect, Council Member Aguirre directed a statement to Mayor Vallejo, when trying to articulate and elaborate upon a message to the community, he would appreciate to be allowed to do that and not be corrected because he finds that to be offensive. Council Member Morris: Reminded the public about a public forum on June 20, 2018 at 5:30pm 7:30pm to receive comments & ideas from the public on how to keep the City of Delano National Guard Armory available for large assemblies and to remain in compliance with State of California and FAA regulations. Mayor Pro Tem Hill: (Absent) Mayor Vallejo: Mayor Vallejo apologized to Council Member Aguirre and stated that she wanted to be sure that the public understood that it was the new community center and not the Ellington Center.
