Promotional Competition Terms and Conditions: SECTION 49 CONSUMER PROTECTION ACT NO 68 of 2008 NOTICE, THE FOLLOWING TERMS ARE IMPORTANT TO NOTE: These Terms and Conditions have been varied or amended as of 5 June 2018. Clauses 1, 6.6, 6.7, 7.1.2, 7.1.13, 7.1.14, and 7.1.15 have been amended. Competition Terms and Conditions 1. Campaign: The Call Up (the Competition ) seeks to find the official Bozza who will answer the call by being the eyes and ears of the nation. The Promoter of the Competition is Mobile Telephone Networks Proprietary Limited ( MTN / the Promoter ). 2. Competition Period: The Competition opens at 10am on 10 May 2018 and will continue until 23:59 on 27 May 2018 ( the Competition Period "). 3. Who May Enter: 3.1. To be eligible to enter, the entrant must: 3.1.1. be a natural person; 3.1.2. have a valid South African bank account; 3.1.3. be 18 years or older; 3.1.4. must hold a valid passport which expires no earlier than February 2020; 3.1.5. have no criminal record in South Africa or elsewhere and willing to consent to full credit and criminal checks; 3.1.6. be a passionate South African rugby fan who is able to vlog, blog and has a social media presence as well as the ability to dedicate the time necessary to be the Bozza; and 3.1.7. be willing and able to travel with the Springbok Rugby Team for approximately 18 (eighteen) months, and dedicate no less than 5 (five) days of the week leading to rugby matches in which the Springboks are playing locally and 7 (seven) days internationally, as the Bozza as more fully set out in clause 7 below. 4. Who may not enter 4.1. Participation in the Competition excludes employees, directors, members, partners, consultants and agents of, or any other person who, directly or indirectly controls or is controlled by the Promoter or marketing service providers of the Competition, (and the spouses, life partners, immediate
family members or business partners of the people or entities listed above). This means: 4.1.1. the Promoter/s; 4.1.2. supplier/s of goods and or services in terms of the Competition; and 4.1.3. promotional partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed above during the Competition Period. 5. How to Enter: 5.1. During the Competition Period, the entrants that meet all of the criteria referred to in clause 3 above must do the following in order to stand a chance to be selected as the Bozza: 5.1.1. Entrants must enter the competition via mtncallup.mobi. 5.1.2. Entrants will need to upload a video of themselves, motivating why they are the best person to be selected to win this competition and be the Bozza. Examples of such motivations may include showing off on-camera interview skills, blogging/vlogging skills or demonstrating superior rugby knowledge. 5.1.3. The video must be submitted in MP4 format, and be no larger than 300MB and no longer than 60 (sixty) seconds. 5.1.4. Entrants can only submit one video. Entrants will be given 24 (twenty four) hours to edit their profile or load a new video on their existing profile, after the 24 (twenty four) hours the video will automatically go into moderation. 5.1.5. Entrants are solely responsible for ensuring that the videos they enter are complete and playable. Each Entrant guarantees and undertakes that they have the absolute legal right to enter the video in the Competition. 5.1.6. By entering the competition, you agree to grant MTN the right, but not the obligation to use and share your video and name on MTN s social platforms for the duration of the competition. 5.1.7. Additional details that will be needed to be provided by the entrants include the following: 5.1.7.1. their I.D. number; 5.1.7.2. their birth date; 5.1.7.3. their current home town; 5.1.7.4. their occupation; 5.1.7.5. their twitter handle; 5.1.7.6. their Instagram handle; and 5.1.7.7. their Facebook account name. 6. The Finalists
6.1. On 29 May 2018, 5 (five) videos will be shortlisted ( the Semi-Finalists ) and the Semi Finalists will be interviewed in person in JHB or Cape Town. MTN will cover the costs for flights and accommodation in the week of 30 May 2018 to 1 June 2018. 6.2. Entrants agree that it is an express condition of the Competition that in order to be eligible to be an official Semi-Finalist, the entrant shall be required to sign terms and conditions which will govern the semi-finalist round, which will be provided to the Semi-Finalists prior to 30 May 2018. 6.3. Of the 5 (five) Semi-Finalists, 3 (three) will be selected (the announcement will be made on social media) to each attend 1 (one) of the first 3 (three) South African national rugby games of the year in South Africa taking place on 9 June 2018; 16 June 2018 and 23 June 2018 ( the Finalists ), as follows: 6.3.1. the first of the 3 (three) will be announced on 2 June, to attend the 9 June match; 6.3.2. the second of the 3 (three) will be announced on 9 June to attend the 16 June match; and 6.3.3. the third of the 3 (three) will be announced on 16 June to attend the 23 June match. 6.4. The Promoter may in its sole discretion increase the number of Finalists. 6.5. The criteria that will be considered when selecting the 3 (three) Finalists shall include: 6.5.1. Personality: 6.5.1.1. Show us that you have an entertaining and interesting personality that will make people want to follow you. 6.5.2. Content Creation: 6.5.2.1. Show us that you are able to capture, edit, and broadcast content naturally, and that you can make use of a variety of formats (boomerang, photos, videos, instastories, gifs) to keep the content interesting. 6.5.3. Social following: 6.5.3.1. Show us how you will make use of social platforms to connect South Africa to the Springboks. 6.6. The 3 (three) Finalists will be required to perform the duties of the Bozza in order for the public to vote on who they think the ultimate Bozza could be. This will be open to public voting and comments. The percentage weighting of the public shall comprise of 20% (twenty percent) of the overall criteria for the selection of the final winner. MTN SA does not take responsibility for comments made by the public on any online, press or any form of media platforms. The final selection will be made by the panel of independent judges consisting of both MTN and SARU representatives, and such percentage weighting shall comprise of 80% (eight percent) of the overall criteria. 6.7. Entrants agree that it is an express condition of the Competition that in order to be eligible to be an official Finalist or winner, the entrant shall be
required to sign a contract which will govern the finalist round and winner. Failure to agree to and sign the contract will lead to the immediate disqualification of the Finalists and a new Finalist or winner will be selected. 6.8. The Winner will be chosen from the Finalists by a panel of independent judges. 6.9. The Winner will be announced no later than 18 August 2018. 6.10. ENTRANTS ACKNOWLEDGE AND ACCEPT THAT THE PROMOTER/S MAY UTILIZE A THIRD PARTY (THE PROMOTERS AUTHORIZED AGENT/S) TO CONTACT THE ENTRANT, IN THE EVENT THAT THE ENTRANT IS A WINNER. IN ORDER TO EFFECT THE CONTACTING PROCESS, THE PROMOTERS SHALL PROVIDE THE ENTRANT S INFORMATION TO SUCH THIRD PARTY. 7. The Prize 7.1. The prize to be awarded to the Winner ( the Prize ) is to be selected as the official Bozza, which comprises the following: 7.1.1. The Bozza shall follow the Springbok Rugby Team from the Castle Championships tournaments commencing on 18 August 2018 until the end of the Springbok campaign at the 2019 Rugby World Cup in Japan ( the Prize Term ). 7.1.2. Prize includes all travel and accommodation expenses for all Springbok Rugby games during the Prize Term. 7.1.3. The Promoters will take out full travel insurance for the Bozza. 7.1.4. The approximate value of the total prize amounts to R2 million for the duration of the Prize Term, details of which will be specified at the time the winner is announced. 7.1.5. Social media training will be given. 7.1.6. The Bozza will be subject to MTN SA s social media policies. 7.1.7. The Bozza will be given the devices (cell phone, camera, accessories, data, and modem) in order to fulfil their duties during the Price Term. All equipment will be returned to MTN at the end of the Price Term. 7.1.8. All content or information obtained while in the capacity as the Bozza shall be the property of MTN. 7.1.9. Outside of the period in which the Bozza is required to fulfil their role, MTN reserves the right to approve all content. 7.1.10. The Bozza will be managed at each event by a chaperone. No contact with SA Rugby or its representatives will occur unless through the designated chaperone. 7.1.11. Should the Bozza have a background or occupation in media, or is a public face, at no point will the access allow the Bozza to be distributed through other channels outside of MTN SA.
7.1.12. The Prize will include tickets to all related Springbok matches. 7.1.13. MTN, can at its own discretion, require the Bozza to undergo additional training from time to time over the Prize Term. The Bozza, will need to make themselves available for these training sessions, as and when required by MTN. 7.1.14. The Bozza will be required to attend meetings with MTN, SARU and its representatives from time to time. 7.1.15. The Bozza will also be required to be available for any press functions, events and photographs/photoshoots deemed necessary by MTN. 8. General: 8.1. In the event that the Winner is unable to redeem the Prize for any reason, or is disqualified for any reason, the winner will then forfeit the Prize and the second placed name will be the winner. 8.2. No portion of the Prize is transferable or exchangeable for another prize. 8.3. The judges determination on the Winner is final and no correspondence will be entered into. 8.4. The Promoter, its respective directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage, including but not limited to physical harm or death, howsoever arising from or as a result of an entrant s participation in the Competition or the entrant s redemption of any Prize in terms of the Competition, or from any amendments to Prize details and/or the terms and conditions of the Competition. All entrants (including the winners) hereby expressly indemnify the Promoter in this regard and shall hold it harmless from all and any claims arising from or as a result of the above reasons. 8.5. The Promoter reserves the right to vary the nature of the Competition, the Prize, or these terms and conditions upon notice in this regard being published on www.mtn.co.za or in another appropriate medium. In the event that the Prize is limited or varied in this manner, the Promoter shall replace the Prize with a prize of a similar economic value. 8.6. The Winner shall be contacted on the cell phone number/ via the medium used to enter the Competition or in terms of any contact details supplied by the winner when entering the Competition. 8.7. The decision of the Promoter in respect of disputes arising out of the Competition shall be dealt with by the Promoter in terms of these terms and conditions. The decision of the Promoter in this regard shall be final. 8.8. The Promoter reserves the right to withhold the Prize until it is entirely satisfied that the claimant of the Prize is the bona fide winner, and reserves the right to call for such proof as it may deem necessary including proof of identity.
8.9. The Promoter shall request that the Finalists and the ultimate Winner consent in writing to their name, image and likeness being used and published by the Promoter in connection with the Competition for a period of 12 (twelve) months after they are announced as Finalists and the Winner respectively. The Finalists and Winner may decline the use of their name, likeness and image by the Promoter. 8.10. Where and when applicable, the winner shall be liable to pay any applicable tax related to the Prize in clause 7 above. 8.11. By entering the Competition entrants signify their consent to be bound by the terms and conditions contained herein. 8.12. By entering the Competition all entrants give their consent to receive various marketing and promotional material from the Promoter. Entrants will be provided with an opportunity to Opt Out of receiving such communications, which may be via the relevant medium that such marketing communication was received. 8.13. Winners agree that it is an express condition of the Competition that in order to be eligible to redeem the Prize, the winner shall be required to sign the appropriate acknowledgement of receipt of the Prize, as well as an indemnity and/or waiver of liability as reflected in these terms and conditions.
