TOWN OF LAKEVILLE, MASSACHUSETTS INVITATION FOR BIDS FUEL NO. 2 OIL The Town of Lakeville, Massachusetts is seeking bids on fuel for its various Town facilities as follows. Bids may be submitted on any or all items. 1. Fuel Type and Quantities No. 2 Fuel Oil Thirteen thousand (13,000) gallons, more or less, to be delivered as needed to the Town Office Building, Fire Station, Transfer Station, Police Station; Historic Library, Public Library and Assessor s Office. In addition, please quote prices for annual cleaning and maintenance contract. 2. Term The term of the agreement shall be from October 1, 2014 through September 30, 2015. 3. Pricing The prices quoted shall be based on the JoC Oil Price Daily, Boston, Massachusetts Harbor Low for the product delivered, posted on the day of delivery. 4. Delivery Procedures The successful candidate is to deliver as needed throughout the contract period in quantities sufficient to maintain product within the tanks. Such deliveries are to be made Monday through Thursday, except holidays, on an automatic basis unless requested otherwise, in writing by the Town. Tanks are not to be allowed to drop below ¼ full. Additional deliveries are to be made as requested. All deliveries must be made by meter. One copy of meter ticket register signed by a municipal employee is to be left at time of delivery at the municipal office responsible for that location. Payment will not be made unless a municipal employee has signed for deliveries. Should the Supplier fail to make deliveries as required, the Town reserves the right to secure sufficient product of equal or better grade and from any available source, to guarantee continued operation, and to back charge the Supplier for any difference in cost from the contract price, including costs directly attributable to the interruption of supply. Repeated failure to deliver on time and/or after notifications will be cause to consider the Supplier in default of the contract. In such a case, the Town may cancel the contract and secure the product for the remaining contract period from any available source best suited to the interests of the Town and to back charge the Supplier for any difference in price. The Supplier is not to be obligated if unable to furnish products because of strikes, fires, war conditions in this country, or other causes beyond the Supplier s control (weather conditions
not included). In such cases, the Town is to be notified by telephone immediately followed by written notice within three (3) days. Drivers are to exercise care to avoid spilling product or creating other damage in making delivery. The Supplier will pay for any cleaning, repairs, or fines due to the Supplier s negligence. 5. Insurance A certificate of insurance must be presented to the Town at the time of the award, and must name the Town as additional insured on the face of the document. Insurance requirements are: general liability at $1,000,000 per occurrence/$2,000,000 aggregate, and workers compensation in accordance with Massachusetts laws. 6. Taxes The Town will pay any required taxes. 7. Payment Payment will be made within thirty (30) days after receipt of the monthly invoice. The invoice must include a copy of the published Journal of Commerce showing the prices for each date of delivery. 8. Submission of Bids Bids are to be submitted in a sealed envelope marked Fuel Oil Bid by September 10, 2014 at 3:00 P.M., at which time they will be publicly opened and read aloud, to: Town Administrator Rita Garbitt, 346 Bedford Street, Lakeville, MA 02347. General Bids must include a completed form (Addendum B) pertaining to taxes, non-collusion, and signing authority. Bidder must be able to sign a contract within thirty (30) days of the bid opening. The Town of Lakeville reserves the right to reject any or all bids deemed not in the best interest of the Town. The Town reserves the right to reject any part of any or all bids deemed not in the best interest of the Town. The Town reserves the right to waive any informalities in the bids.
