1.0 PROCEDURE FOR BID SUBMISSION Balmer Lawrie & Co. Ltd. Refinery & Oilfield Services INSTRUCTION TO BIDDERS The Tender Document comprises of two Bids viz Unpriced Part I and Priced Part II. The submission of offer can be made in two forms either through e-bidding or in physical form as follows : 1.1 BID SUBMISSION THROUGH E-BIDDING The bidders shall submit their response through bid submission to the tender on e- Procurement platform at https://balmerlawrie.eproc.in by following the procedures given below. The bidder would be required to register on the e-procurement market place https://balmerlawrie.eproc.in and submit their bids on line. The bidders shall submit offer comprising Notice Inviting Tender, pre-qualification documents, Vendors Information, List of Manpower and Equipment to be deployment, EMD and Price Bid etc., in the standard formats prescribed in the Tender documents displayed in e- Procurement web site. The bidders shall download all the above documents, upload the same along with scanned copies of all the relevant certificates, documents etc., duly stamped and signed, in support of their eligibility criteria/nit in the e- Procurement web site. However, bulky documents need not be scanned and uploaded but physical copy of the same along with Unpriced Bid (Part-I) of the Tender Document, duly stamped and signed should be sent to the Tender Inviting Authority before the tender opening date along with EMD amount. Priced Bid should be submitted in e-format only. 1.1.3 Submission of Hard copies After submission of bid on line, the bidders are requested to submit the demand draft towards EMD along with stamped and signed copy of Unpriced Bid I, prequalification Documents as required, to the Tender Inviting Authority on/before the due date of opening date. Under no circumstances Hard copy of Price Bid should be sent under e-procurement format. The bidder shall furnish the original DD and other documents either in person or through courier or by post and the receipt of the same within the stipulated time shall be the responsibility of bidder. Balmer Lawrie shall not take any responsibility for any delay or non-receipt of said documents. If any of the documents furnished by the bidder is found to be false / fabricated, the bidder is liable for black listing, forfeiture of the EMD, cancellation of work and criminal prosecution. The bidder is requested to get a confirmed acknowledgment from the Tender Inviting Authority as proof of submission of hard copies. 1.1.4 Corrigendum to tender The bidder has to keep track of any changes by viewing the addendum/ Corrigendum's issued by the Tender Inviting Authority on time-to- time basis in the e- Procurement platform. The Company calling for tenders shall not be responsible for any claims/problems arising out of this. 1.1.5 Bid Submission Acknowledgment The user should complete all the processes and steps required for bid submission. The successful bid submission can be ascertained once acknowledgment is given by the system through bid submission number after completing all the processes and steps. Balmer Lawrie & Co. Ltd. Refinery & Oilfield Services TENDER ENQUIRY ROFS/2K10/05/ENQ/15 6th May, 2015 MIs Balmer Lawrie & Co. Ltd. invites sealed tenders from competent and experienced vendors with sound technical and financial capabilities for the supply, installation and commissioning of rim seals of floating type crude storage tanks (3 nos of 30,000 m3 each) at Desalter, Nawagam, ONGC, Ahmedabad asset after replacement of the old ones. 1.0 Job Description Due Date:12.05.2015 The bidder shall have to supply rim seals and install them after the replacement of the old rim seals of the floating roof of 3 no. tanks at the Desalter, Nawagam, ONGC, Ahmedabad asset. The detailed drawing of the required rim seal is provided in Annexure II. The scope of the job will broadly include but not limited to the following a) Supply and installation of new seals b) Checking, testing, and commissioning. The following specifications should be met as a minimum during the supply of the Rim Seals. a) b) c) d) e) Rim gap: 8 inches Storage tank 10: 60 m Should be suitable for 100 aromatic service Should have a longer lifespan There should be no holes, tears or openings in the secondary seal or in the primary seal envelope surrounding the annular vapor space enclosed by the roof edge, seal fabric and secondary seal The following conditions should be met as a minimum during the supply, installation and commissioning after replacement of existing seal of the tank. The detailed drawing of the Seal and the specifications provided are to be strictly adhered to. 2.0 Pre-qualification criteria of bidders The bidder should have executed at least one contract for supply of Rim Seal for external floating roof crude oil storage tank during1 last 5 years. The five years period will be reckoned from the closing date of the present Tender. 3.0 Scope of Work (i) (ii) (iii) (iv) (v) (vi) Supply of Rim Seal at Desalter, Nawagam, ONGC Ahmedabad Asset Transportation of all materials from storage space within site to each tank roof. Removal of rim seal fire protection system if already installed. Installation of the new rim seals. Re-installation of the rim seal fire protection system. Checking, testing of the rim seals and operation test of the rim seal fire protection system

4.0 (A) EARNEST MONEY DEPOSIT Bid should be accompanied by a Bank Draft of Rs 15,000.00 (Rupees Fifteen thousand only) towards earnest money deposit executed by any scheduled bank drawn in favour of M/s Balmer Lawrie & Co Ltd payable at Kolkata. If the successful tenderer is unable to accept or exercise orders when placed upon him or fails to deposit the initial security Deposit or withdraws / revises his quoted prices and quantities offered, within the validity period of his tender or after placement of the Order / Letter of Acceptance, his Earnest Money Deposit shall be forfeited. Submission of EMD is exempted for vendors registered under NSIC or coming under the definition of Micro and Small Industries and holding valid registration certificates covering the tendered items/services. However, attested/notarized copy of valid NSIC certificate or Micro and Small industry certificate must be submitted in this regard. EMD of successful bidder will be refunded after receipt of Security Deposit. However, EMDs of unsuccessful bidder will be returned after finalization of order with L1 bidder. 4.0 (B) SECURITY DEPOSIT The Tenderer, with whom the order/ contract is decided to be entered into and intimation is so given will have to make a security deposit 5% of the total order/ contract value in the form of Account payee crossed Demand Draft drawn in favor of Balmer Lawrie & Co. Ltd. Payable at Kolkata within seven (15) days from the date of intimation of acceptance of their tender, failing which the Balmer Lawrie & Co. Ltd. Reserves the right to cancel the Order/ contract. Security Deposit shall be released after submission of the Performance Bank Guarantee. 5.0 6.0 Guarantee I Warranty The contractor shall guarantee the owner and their authorized representatives against defects in their workmanship for a period of 12 months from the date of commissioning or 18 months from the date of delivery whichever is earlier. Any defect brought to the contractor's notice within the guarantee period shall be made good! replaced! changed promptly free of cost! charge. Completion Schedule Rim Seals required for three tanks are to be supplied phase wise and one at a time. First set of Seal is to be supplied within 15 days of placement of order and balance three sets are to be supplied within one month of intimation from our end. The installations of seals are to be made within two weeks from the date of intimation of changing the rim seal and getting clearance from our end. 7.0 Inspection & Testing, BL reserves the right to inspect the rim seal after the installation job is over. The bidder should obtain a completion of job certificate after inspection by the EIC at ONGC Ahmedabad after completion of the job.

8.0 General Notes I. Providing safety articles like helmets, goggles, gum boots, safety belts, safety shoes, gloves, soaps, waste cloth etc. for work men shall be under bidder's scope. II. III. IV. Manpower to be provided with all normal tools and tackles e.g. wrenches and spanners (both ring and double ended), adjustable wrenches, pipe wrenches, hacksaw frame and blades, screw drivers, tester etc. required for completion of the job. Obtaining all requisite clearances from ONGC authorities after installation including conducting police verification of all personnel engaged for the job from local police station, if any, shall be in bidder's scope. All sorts of coordination with CISF and ONGC for obtaining shift wise permits should be done by bidder. Compliance with all Safety & Environment Regulations and requirement of ONGC, Ahmedabad Asset. The bidder should ensure that the installation along with testing should be complete in the shortest possible time. V. Water, Power shall be provided at a single point within ONGC Ahmedabad asset and necessary cabling / piping required for the installation job shall be under bidder's scope. VI. VII. VIII. IX. All local issues arising during the period of installation shall be taken care of by the bidder 'and BL under no circumstances shall be dragged into these. Labour license, if required shall have to be obtained by the bidders and statutory compliance shall be met by the bidders. The rates should be quoted firm and there should be no variation in the rates quoted during the tenure of the contract. Contractor is advised to prevent pollution during any job carried out during the installation job as required by the Environment Policy of ONGC and Gujarat State Pollution Board..

9.0 Taxes and Duties Rates should include all taxes and duties as applicable. Prices should include the freight up to destination including unloading at site, applicable taxes etc. Prices should be firm till completion of the job and no escalation for whatsoever reason shall be granted. 10.0 Payment Terms I. 70% of the basic order value along with full taxes and duties for each tank shall be released after delivery of complete system at site for the tank. II. 20% of the basic order value will be released after completion of installation of rim seal and after submission of clearance of all departments of ONGC and completion certificate from them. 11.0 Liquidated Damages A reduction at 0.5% of the basic order value per week or part thereof subject to a maximum of 10% of the basic order value will be applicable for delay in completion schedule. 12.0 Legal Jurisdiction All questions, disputes, differences, arising out of and or in connection with this purchase order, shall be subject to the appropriate court(s) under the jurisdiction of the High Court at Kolkata. 13.0 Documentation Required Bidder shall submit copies of the following documents along with their bid: (i) Order copies and completion certificates for supply of Rim Seal for external floating roof crude oil storage tank executed in last 5 years. (ii) Latest income tax, sales tax clearance certificate (iii) Photocopy of PAN card (iv) Service tax. Reg. Certificate (v) PF registration certificate (vi) Tender document duly signed and company seal.

15.0 Type of Bid Bidder should submit offer on Two-part basis. However a blank copy of price schedule should be submitted along with the un-priced bid. 16.0 Tender Submission Offer should include a stamped and signed copy of the Tender Document as a token of acceptance of the terms and conditions herein should be submitted either through e bidding or physical biddingas per instruction to bidder.
