SECTION A INFORMATION FOR APPLICANTS 1. TENDER NAME This Sidewalk Extension Tender will be referred to as the Sidewalk Extension, Request for Tender Town of Tecumseh - 2016. 2. SCOPE OF WORK The Corporation of the Town of Tecumseh (Town) is seeking tenders for sidewalk extension services to be completed at various locations throughout the Town before August 1, 2016. 3. CLOSING TIME AND DATE Tenders must be received no later than 2:00 p.m. on Thursday, June 9, 2016. GENERAL TERMS AND CONDITIONS This Sidewalk Extension Request for Tender is subject to the Town of Tecumseh s Procurement Policy and Procedures as outlined in the Town of Tecumseh Purchasing By-Law 2006-03. The Town reserves the right to reject any and all tenders without incurring any liability whatsoever. 7. EVALUATION PROCESS Each response to this Request for Tenders will be evaluated by the Town to determine the degree to which it responds to the requirements as described. 5 of 22

SECTION B SERVICES 1. GENERAL CONDITIONS 1.1 The Successful Respondent shall provide a timeline for starting and completing the said work. 1.2 The Successful Respondent shall indemnify and hold harmless the Town, its officers, council members, partners, agents and employees from and against all action, claims, demands, losses, costs, damages, suits or proceedings whatsoever which may be brought against or made upon the Town and against all loss, liability judgments, claims, suits, demands of expenses which the Town may sustain, suffer or be put to resulting from or arising out of the company s failure to exercise reasonable care, skill or diligence or omissions in the performance or rendering of any work or service, required hereunder to be performed or rendered by the company, its agents, officials and employees. Any agreement that results from this Tender will be subject to the laws of the Province of Ontario and Canada. 1.3 Successful Respondent shall employ a high standard of public relations and communication. 1.4 The Respondent agrees to submit a Certified Cheque or Bid Bond in the amount of 10% of the Total Price to the Town. This Certified Cheque or Bid Bond shall be returned no later than 60 days after date of closing unless this Tender is accepted, in which case, this Certified Cheque or Bid Bond shall be held in safekeeping by the Town until such time as the contract is executed. And also the Successful Respondent agrees to submit to the Town a Performance Bond for the work and a Labour and Materials Payment Bond of said contract in the amount of 100% of the Total Price. And also the Successful Respondent agrees that the Town has the right to accept or reject all or any portion of this Tender. The Successful Respondent to whom this Contract is awarded will be required to execute the contract and must supply prior to signing the contract documents the following items: 1.4.1. A Certificate of Liability Insurance or a certified copy of the Contractor s insurance policy. The Liability Insurance Shall: 7 of 22
i. have a limit of comprehensive general liability of not less that $5,000,000.00 inclusive for any occurrence; ii. be comprehensive liability insurance covering all operations and liability assumed under the Contract with the Town; iii. include insurance against liability for bodily injury and property damage caused by vehicles owned by the Contractor and used on the work, and in addition, shall include insurance against liability for bodily injury and property damage caused by vehicles not owned by the Contractor and used on the work. Each such insurance shall have a limit of liability of not less than $5,000,000.00 inclusive for any one occurrence. A vehicle shall be as defined in the Highway Traffic Act; iv. be endorsed to provide that the policy or policies will not be altered, cancelled or allowed to lapse without thirty days prior notice to the Town; v. name the Town and VIA Rail Canada as insured parties, if applicable. 1.4.2. A Certificate from the Workers Compensation Board stating that all assessments or compensation payable to the Board have been paid and that the Contractor is in good standing. Before start of the work and before the final payment is made, the Contractor shall furnish to the Town a certificate from Workers Compensation Board stating that the Successful Respondent is in good standing. 1.4.3. A copy of the Notice of Project to the Ministry of Labour will be required by the Town of Tecumseh. 1.4.4. A copy of Traffic Control Plan to current guidelines of the Ontario Traffic Manual is to be submitted to the Town of Tecumseh. 1.4.5. The contractor agrees to perform the whole of the work listed above and to apply all materials, labour, tools, plant and machinery, necessary to do the work. 1.4.6. Workplace Safety & Insurance: The Contractor shall furnish evidence of compliance with all requirements of the Workplace Safety and Insurance Act and the Workplace Safety and Insurance Board. Such evidence to include a certificate of good standing issued prior to the execution of the Contract, and a further certificate issued annually on or before the anniversary date of each year. 8 of 22
1.4.7. Compliance with Laws, Regulations and Policies: The Contractor shall comply with all labour, police, health, environment, sanitary and other laws and regulations imposed by public bodies having jurisdiction during the term. The Contractor shall be, or shall become, familiar with all such laws, regulations and policies which in any manner affect the performance of the Contract, those engaged or employed in the work, or affect facilities or equipment used in the work, or which in any way may affect the conduct of the work and no plea of misunderstanding will be considered on account of ignorance thereof. Without limiting the generality of the aforesaid, it shall be the Contractor s responsibility to comply with: Environmental Protection Act and Regulations; Workplace Safety and Insurance Act; Occupational Health and Safety Act; Safety or other Policies established by the Authority or the Town; Construction Lien Act and regulations; and Ministry of Transportation Regulations including the Commercial Vehicle Operating Regulations. The Contractor shall indemnify and hold harmless the Town of Tecumseh and its employees against and from all suits or actions arising from any Health and Safety violations as well as the cost to defend such charges as a result of any violation. The Contractor shall comply with all applicable municipal, provincial and federal laws pertaining to the Contractor s services provided herein to the Town including, without limiting generality, all labour, police, health, environmental, public health and sanitation laws and regulations imposed by public bodies having jurisdiction over such matters. 1.4.8. Safety and First Aid: Without limiting the generality of Paragraph 1.4.7 Compliance with Laws, Regulations and Policies, the Contractor shall provide and maintain the necessary items and equipment as called for under the First Aid Regulations of the Workplace Safety and Insurance Act and the Occupational Health and Safety Act. 1.4.9. In the event of a site visit from the Ministry of Labour and in the event this Ministry of Labour person gives written warning to any contravention to the Health and Safety Act, a written copy is to be given to the Town of Tecumseh. 9 of 22
1.4.10. The Contractor shall ensure that all its employees, agents, volunteers, or others for whom the Contractor is legally responsible receive training regarding the provisions of the goods and services contemplated herein to persons with disabilities in accordance with Section 6 of Ontario Regulation 429/07 (the Regulation ) made under the Accessibility for Ontarians with Disabilities Act, 2005 as amended (the Act ). The Contractor shall ensure that such training includes, without limitation, a review of the purpose of the Act and the requirements of the Regulation, as well as instruction regarding all matters set out in Section 6 of the Regulation. The Contractor shall submit to the Town, as required from time to time, documentation describing its customer service training policies, practices and procedures and a summary of its training program, together with a record of the dates on which training was provided and a list of the employees, agents, volunteers or others who received such training. The Town reserves the right to require the Contractor to amend its training policies to meet the requirements of the Act and the Regulation. 2. SPECIFICATION OF WORK 2.1 FOR CONSTRUCTION AND INSTALLATION OF NEW SIDEWALKS The Contractor will supply all material and labour to: 2.1.1. Layout and coordinate the new construction of sidewalk as directed. 2.1.2. Excavate 100 mm of existing material. Dispose of surplus materials at their cost. 2.1.3. Supply place and compact 100 mm minimum of Granular A. 2.1.4. Construct 1.5 m wide x 100 mm thick, 30 MPA concrete with 5% air entrainment. (or match existing width) 2.1.5. Install 12 mm x 100 mm expansion joints abutting existing concrete and at 6 m interval. 2.1.6. Install tactile plates at intersections where sidewalk meets road or as directed. 10 of 22
2.1.7. Sidewalks are to be backfilled with high quality topsoil free of weeds and to be seeded with high quality grass seed and fertilizer. Contractor to be responsible for all damaged areas. 2.1.8. Sidewalks that cross driveways will be 150 mm thick minimum of 30 MPA concrete with 5% air entrainment. 3. TIMING OF WORK All work under this Tender shall be completed prior to August 1, 2016. All work will be concluded within 30 days of starting the project. 4. TAXES Submit bid prices exclusive of any Value Added Tax (i.e. HST). 11 of 22
