Terms and Conditions for Prudential-SCBSL Customer Lucky Draw (the Lucky Draw ) This Lucky Draw is jointly organized by Prudential and SCBSL but solely administered by Prudential. 1. Definitions: a) Prudential means Prudential Assurance Company Singapore (Pte) Limited. b) SCBSL means Standard Chartered Bank (Singapore) Limited. c) Promotion Period means the period 15 June 2017 to 30 September 2017 (both dates inclusive). d) Eligible Policy means any of the following Policies underwritten by Prudential and distributed by SCBSL, where the Eligible Policy has not been cancelled within the fourteen (14) days free-look period. e) Eligible Customers means customers who have purchased an Eligible Policy with minimum $500 annualized premiums during the Promotion Period through SCBSL and the Eligible Policy must have been incepted during Promotion Period. f) Lucky Draw means this Prudential-SCBSL Customer Lucky Draw. g) Winner means an Eligible Customer whose name is picked out in the Lucky Draw amongst all Eligible Customers. h) Policy means the policy issued by Prudential to the Eligible Customer for an Eligible Policy. 2. Lucky Draw Mechanisms a) The Lucky Draw is open to all Eligible Customers who participated during the Promotion Period and satisfy the requisite requirements stipulated in these Terms and Conditions. b) Qualifying Criteria: Each Eligible Customer will qualify for 1 (one) Lucky Draw entry for each Eligible Policy purchased with a minimum $500 Annual Premium Equivalent. As illustrated in (d)
below, the date of submission of the application for the Policy as well as the inception date of the Policy must fall within the Promotion Period. c) Each Eligible Customer can qualify for only 1 (one) Lucky Draw entry with the purchase of each Eligible Policy. If an Eligible Customer purchases more than one Eligible Policy, he/she can qualify for multiple entries. However, the Eligible Customer will only be entitled to win 1 (one) Prize only. d) The Promotion Period is set out in the table below. Winners will be drawn for the period as set out below. The Lucky Draw will be conducted in the presence of, and will be witnessed and audited by an employee of Prudential together with an external auditor. Once an Eligible Customer s name has been drawn, he will be disqualified from other Prizes thereafter. f) The Lucky Draw will be conducted by Prudential on 4 December 2017 at 1500 hours ("Draw Date") at 30 Cecil Street, #30-01 Prudential Tower, Singapore 049712. g) The Eligible Policy must be active and not cancelled at the time of the Lucky Draw. Cancellation of such Eligible Policy(s) will disqualify the Eligible Customer from the Lucky Draw. h) Prudential and SCBSL reserve the right to draw reserve winners to replace any winner who may subsequently be disqualified for any reason whatsoever. i) Prudential and SCBSL s decision on all matters relating to this Promotion is final and no correspondence will be entertained. 3. Prize(s) a) Each Winner will be eligible to 1 (one) Prize only. Prizes for the Lucky Draw are as follows: -

Prize Redemption/Collection a) The Winners will be announced on the Draw Date and the Winners will be notified in writing within 14 days of the Draw Date by mail to the mailing address stated in the proposal form. A redemption letter will be enclosed in the same mail. The results will also be published at Prudential s website. It is your responsibility to inform SCBSL of any change in your address and SCBSL and Prudential shall not be held responsible for any non-receipt of the notification. b) If the Prize remains unclaimed 60 days after the Draw Date, it will be forfeited and donated to any approved organisation that Prudential may select at its absolute discretion. The Winner whose Prize has been forfeited as indicated herein shall not be entitled to any compensation. 1 5. General Terms and Conditions a) By participating in the Lucky Draw, each Eligible Customer is deemed to have accepted and agreed to be bound by these Terms and Conditions and any other instructions, terms and conditions that Prudential and SCBSL may issue from time to time. b) Prudential and SCBSL assume no responsibility for incomplete, lost, late, damaged, illegible or misdirected forms or email communication, for technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed electronic transmission which may limit a Eligible Customer s ability to participate in the Lucky Draw. c) Prudential will endeavour to hold the Lucky Draw on and at the advertised date, time and venue and by the mode (manually or electronically) as advertised, but reserves the right, in its sole and absolute discretion, to conduct the Lucky Draw by another mode in such circumstances as Prudential may deem appropriate. d) The following categories of persons are not eligible to participate in the Lucky Draw: employees (including their immediate families) of Prudential and suppliers of the Gift(s)/Prize(s). Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child, step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt niece, nephew, mother, sister, step-brother, step-sister or first cousin.
e) Prudential and SCBSL have the sole and absolute discretion to exclude any Eligible Customers from participating in the Lucky Draw without any obligation to furnish notice and/or reason. f) Prudential and SCBSL reserve the right to disqualify or disregard any Eligible Customer who does not comply with the Terms and Conditions. g) Prudential and SCBSL may at their discretion forfeit the Prize, or, if already awarded, reclaim the Prize at the expense of the Winner without payment, compensation, or having to give any reason whatsoever in the event Prudential subsequently discovers that the Winner is not eligible to participate in the Lucky Draw and/or to receive the Prize. h) Prizes are subject to availability while stocks last. Prudential and SCBSL reserve the right to replace any Prize with items of similar value at any time without prior notice. i) Prudential and SCBSL shall not be liable for any loss of, damage to, defects, delay, mis-delivery or non-delivery of the Prize. j) Prudential and SCBSL reserve the right to deal with any unclaimed Prize in any manner it deems fit. Prudential reserves the right to request for the Winners proof of eligibility, identity and/or otherwise for the purposes of verifying the Winner s claim to the Prize at the time of prize collection. Prudential and SCBSL are under no obligation whatsoever to disclose the identity of the Winners or to publish the same for any reason at any point of time. k) The Prize is not exchangeable for cash, credit or any other items of equivalent value. The validity period of the Prize is non-extendable. Prudential and SCBSL will be under no obligation to replace or pay to Winner the value of any Prize(s) that are not utilised by the Winners before the end of the validity period of the Prize(s) as may be stipulated by Prudential or SCBSL and/or relevant merchants. l) The Lucky Draw is not valid in conjunction with other promotions carried out by Prudential or SCBSL. m) By participating in this Lucky Draw, each Eligible Customer agrees and consents under the Personal Data Protection Act (Cap 26 of 2012) to the collection, use and disclosure of any and all personal data of the Eligible Customer by and/or to Prudential and SCBSL, advertising and promotional agencies of the Lucky Draw and such other third party, in Prudential and SCBSL s absolute discretion, they consider appropriate or necessary in connection with the Lucky Draw and redemption of Prize(s). Specifically, each Eligible Customer consents to his/her name and personal data being published on Prudential s website in the event he/she wins a Prize; if an Eligible Customer does not agree to the publishing of his/her name or details, he/she will not be able to take part in this Lucky Draw and will not qualify for any Prize. n) If an Eligible Customer provides Prudential or SCBSL with personal data of any third party, that Eligible Customer hereby: a) Agrees on behalf of that third party to be bound by the Terms and Conditions contained herein; and
b) Confirms that he/she has procured the consent on behalf of that third party, to Prudential and SCBSL s collection, use, disclosure and processing of his/her personal data in accordance with the Terms and Conditions contained herein. The Eligible Customer warrants that he/she has obtained the said third party s prior consent to such collection, use, disclosure and processing of his/her personal data by Prudential and that the personal data that the Eligible Customer provides to Prudential and SCBSL is true, accurate and complete. o) Prudential and SCBSL shall not be liable for any third party s misuse of the Eligible Customer s submitted information and photograph as a result of the Eligible Customer taking part in the Lucky Draw. p) Unless prohibited by law, participation in the Lucky Draw constitutes permission for Prudential and SCBSL, its advertising and promotional agencies to use any of the Eligible Customer s names, and/or likeness for advertising and promotional purposes. Each Eligible Customer further agrees and acknowledges that the copyright and all other intellectual property rights in and to all photographs or audio-video or other recordings of the Eligible Customer taken or made in connection with the Lucky Draw shall vest solely and absolutely in Prudential and SCBSL without any compensation to the Eligible Customer. q) Prudential and SCBSL may at any time at their absolute discretion, without prior notice or assigning any reason thereof or being liable to any person, (i) suspend, cancel or terminate the Lucky Draw, or (ii) delete, vary, supplement, amend, modify any one or more of the terms and conditions of the Promotion. Prudential and SCBSL s determination of all matters in connection with the Lucky Draw and the Prize shall be final, binding and conclusive. Prudential and SCBSL are not obliged to give any reason or prior notice on any matter concerning the Lucky Draw or the Prize. No appeal, correspondence or claims will be entertained. Prudential and SCBSL have the right and discretion to determine whether a party has met the requirements of the Lucky Draw and/or to receive the Prize. Eligible Customers shall not be entitled to any damages or compensation whatsoever or howsoever arising as a result of such amendment, suspension or termination. r) By participating in the Lucky Draw, all Eligible Customers agree and undertake to, at all times, indemnify, keep indemnified, and hold Prudential and SCBSL, their employees and agents harmless against all losses (including direct, indirect, incidental and/or consequential losses), damages (including general, special, and/or punitive damages), demands, injuries (other than personal injury caused by Prudential or SCBSL s negligence), claims, costs, penalties, interest and fees (including all legal fees as between solicitor and client or otherwise on a full indemnity basis whether or not incurred in respect of any real, anticipated, or threatened legal proceedings), howsoever caused by, arising or resulting from, whether directly or indirectly, their participation in the Lucky Draw, acceptance or usage of any Prize, and/or any breach or purported breach of these Terms and Conditions and/or any applicable law. s) Prudential and SCBSL make no warranty or representation as to the quality, merchantability or fitness for purpose of the merchants goods and services in respect of the Prize(s). Any dispute about the same must be resolved directly with the merchant.
t) It is the responsibility of the Winners to ensure that they possess all necessary travel documentation (including valid passports and visas) for the purposes of enjoying the Prize. The Winners shall be responsible for their meals, transportation, travel insurance, visa fees, daily expenses, and other incidental arrangements they may make in connection with their enjoyment of the Prize. All costs incurred in connection with the aforementioned shall not be borne by Prudential or SCBSL. u) The purchase of the Policy is subject to Prudential s policy terms and conditions, and acceptance. SCBSL does not accept any responsibility regarding any statement made in, omission or inclusion of any provisions of, the Policy terms and conditions nor shall SCBSL be held liable in any manner whatsoever in respect of your application for the Policy or the Policy terms and conditions. v) In the event of any inconsistency or discrepancy between the Terms and Conditions and the contents of any brochure, marketing and/or promotional materials relating to the Lucky Draw, these Terms and Conditions shall prevail. w) Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in connection with this Lucky Draw, in particular the Prize(s), are the property of their respective owners. Prudential and SCBSL are not affiliated with, or endorsed or sponsored by, such owners and their relevant affiliates. x) Failure or delay by Prudential or SCBSL to exercise any of its right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy. y) The Terms and Conditions shall be governed by Singapore law and the Eligible Customers agree to submit to the exclusive jurisdiction of the courts of Singapore. z) A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Right of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions. Important Note: Buying a life insurance policy is a long-term commitment. An early termination of the policy usually involves high costs and the surrender value payable (if any) may be less than the total premiums paid. The PruTerm Vantage Policy has no cash value. Buying health insurance products that are not suitable for you may impact your ability to finance your future healthcare needs.
