BENEFITS AND BASIS OF SETTLEMENT Whereas the insured by a proposal and declaration which shall be the basis of this Contract and is deemed to be incorporated herein has applied to QBE INSURANCE (SINGAPORE) PTE LTD (hereinafter called the Company ) for the insurance hereinafter contained and has paid or agreed to pay the premium as consideration for such insurance, the Company agrees to indemnify the insured as per the limits stated under the Table of Benefits and in accordance to the terms, conditions and exclusions set out in the various sections of this Policy SECTION 1 INSURANCE GUARANTEE The Guarantee granted under this Section is in accordance with the attached copy of Guarantee to the immigration Department and is subject to the insured s obligation to indemnify the Company against loss and consequently to repay any sum which the Company may pay in settlement of liability under the Guarantee including any expenses incurred. SECTION 2 PERSONAL ACCIDENT The Company will subject to the terms of this Section pay to the insured Maid if during the Period of insurance the insured Maid named in the Policy Schedule shall sustain bodily injury caused by any sudden, unforeseen and unexpected incident that result in permanent disablement or death of the insured Maid within twelve calendar months in death or disablement or expenses incurred up to the amounts stated in the Table of Benefits. The payment under Section 2B of the Table Of Benefits shall be such percentage specified in the Permanent Disablement Scale below 1 Total and permanent disablement from attending to 100% or following any employment 2 Total irremediable blindness in both eyes 100% 3 Total and irremediable blindness in one eye and loss of one hand or one foot 100% 4 Total and irremediable blindness in one eye 50% 5 loss of both hands or feet or one hand and one foot 50% 6 loss of one and or one foot 50% 7 loss of hearing or speech 50% 8 loss of hearing in one ear 15% 9 loss of arm at shoulder 75% 10 loss of arm below shoulder 65% 11 loss of leg at hip 75% 12 loss of leg below hip 65% 13 loss of thumb (both phalanges) 25% 14 loss of thumb (one phalanx) 10% 15 Loss of index finger (three phalanges) 10% 16 Loss of index finger (two phalanges) 8% 17 Loss of index finger (one phalanges) 4% 18 Loss of finger other the thumb or index finger 5% 19 loss of great toe 5% 20 loss of any other toe 1% in the event that the injury does not come within any of the items specified in Section 2 hereof, the Company shall at their absolute and sole discretion make any payment of such sum to the insured Maid, as they deem fit. Special provisions to Section 2: 1. loss of a limb or member or part thereof shall mean loss by actual physical severance or total and permanent loss of use. 2. The total sum payable for Permanent Disablement shall not exceed the sum insured specified under Section 2A of the Table of Benefits. 3. The total sum payable for Permanent Disablement in respect of injury to more than one portion of a limb or member or part thereof shall not exceed the sum payable in respect of such injury to the whole of that limb or member or part thereof. 4. Payment shall only be made under either Section 2A or 2b and not both. Such payment shall discharge the Company from any further claim under the Section except for expenses incurred under Section 12 arising from the accident. Payment for Permanent Disability under Section 2b shall reduce the maximum benefit by the percentage set against the Permanent Disablement actually sustained and as such the reduced the maximum benefit shall be the limit of the Company s liability in respect of any further loss occurring during the Period of Cover under this Section. Special Conditions to Section 2: 1. The insured shall give immediate notice in writing to the Company of any sickness or physical defect or infirmity of the insured Maid of which the insured has become aware and shall pay any additional premium that may be required by the Company. 2. Notice in writing must be given to the Company of any bodily which may give rise to a claim under this Section together with full particulars of both the occurrences and the injury immediately. in the case of death or within twenty-one day of the occurrence. All reports certificates and information required by the Company shall be furnished at the insured S EXPENSE and shall be in such form as the Company shall prescribe. The insured Maid shall from time to time submit herself to medical examination at the expense of the Company as may be required in connection with any claim. in any case of death where any reasonable doubt exists as to the cause thereof a qualified medical practitioner appointed by the Company shall be allowed to make a postmortem examination of the body of the insured Maid at the Company s expense. 3. This Section is not assignable and payment of any claim under this Section shall only be made to the insured Maid or her personal representatives in respect of Section 2A and 2b and to the insured in respect of Section 12 whose receipt shall be a discharge to the Company. Special Exceptions to Section 2: No payment will be made under this Section for bodily injury consequent upon: 1. any unlawful act of the insured Maid or willful exposure to danger (other than in an attempt to save human life) suicide or attempted suicide or intentional self-injury. 2. medical or surgical treatment except where such treatment is rendered necessary by bodily injury within the scope of this Section. 3. the influence (temporary or otherwise) of alcohol or drugs not prescribed by a qualified medical practitioner. 4. pregnancy or childbirth, miscarriage, or abortion. 5. hazardous sports including but not limited to most winter sports (other than leisure skiing), mountaineering, rock climbing, water skiing, underwater activities, aerial activities and motor sports. 6. flying as a member of an aircrew or in any aircraft for the purpose of any trade or technical operation therein or thereon or air travel other than as fare-paying passenger in any properly certificated or licensed power-driven aircraft constructed to carry passengers. SECTION 3 REPATRIATION OF MORTAL REMAINS AND EXPENSES The Company will subject to the terms of this Section indemnify the Insured for the repatriation expenses (defined below) if during the Period of insurance the insured Maid shall sustain bodily injury or sickness resulting in death or permanent disablement within twelve calendar months subject to the sum insured stated in the Table of Benefits. Definition: Repatriation expenses are deemed to be reasonable charges incurred for the transportation of the remains of the insured Maid to her home country following bodily injury or sickness which results in the burial or cremation of the insured Person in the locality where death occurs following bodily injury or sickness and/or transportation of body or ashes to the insured Maid s home country, including reasonable transport expenses incurred and not to exceed the maximum amount stated in the Table of Benefits for conveyance of the Insured Maid to her country of origin if she suffers serious illness or injury which prevents her from carrying out her employment duties in the opinion of a Registered Medical Practitioner. Special Exception to Section 3: No payment will be made under this Section if death or permanent disablement of the insured Maid is caused by the deliberate act of the insured Maid. SECTION 4 HOSPITAL AND SURGICAL EXPENSES The Company will pay to the insured the expenses in respect of hospital medical or surgical nursing home and nursing fees and charges necessarily incurred during the Period of insurance as an inpatient including the cost of medicine drug and the use of diagnostic equipment and subsequent outpatient treatment related solely to the hospitalization necessarily incurred by the insured Maid named in the Table of Benefits provided such expenses are incurred in Singapore. 2. the expenses result from disease or illness declaring itself or accidental bodily injury sustained during the Period of insurance in respect of the insured Maid concerned. 3. Recurrent attacks symptoms or complications arising from the same initial cause shall be considered as one illness disease or bodily injury. 4. the liability of the Company for the Period of insurance shall not exceed the amount set out in the Table of Benefits. Special Exception to Section 4: The Company will not pay for:- 1 any disability, treatment or service incurred as a result of pre-existing conditions for which the insured Maid received medical treatment diagnosis consultation or prescribed drugs preceding the effective date of her coverage. 2 permanent medical appliances cosmetic or beauty treatment of any kind or treatment undertaken as a preventive measure including vaccination or inoculation. 3 any of the expenses incurred resulting from traceable to or accelerated by a) pregnancy or childbirth miscarriage or abortion or treatment/test pertaining to infertility. b) dental treatment or non-surgical eye treatment of any kind unless necessitated by accidental injury. c) any unlawful act of the insured Maid or willful exposure to danger (other than in an attempt to save human life) suicide or attempted suicide or intentional injury. d) the influence (temporary or otherwise) of alcohol or drug addiction or drugs not prescribed by a Registered Medical Practitioner or any congenital defects of insanity or conditions related to functional disorder of the mind, rest care or sanitaria care e) Hazardous sports including but not limited to most winter sports (other than leisure skiing), mountaineering, rock climbing, water skiing, underwater activities, aerial activities and motor sports; f) flying as a member of an aircraft for the purpose of any trade or technical operation therein or thereon or air travel other than as a fare-paying passenger in a properly certificated licensed power-driven aircraft constructed to carry passengers. g) venereal disease or AIDS (Acquired Immune Deficiency Syndrome), ARC (AiDS Related Complex) or other communicable diseases. h) routine physical examinations and health checkup. Provided always that 1. the expenses are incurred in respect of treatment or service undertaken and recommended by a Singapore Government hospital or restructured hospital at standard Class C rate or Class b2 in the event of non-availability of Class C wards. SECTION 5 WAGES AND LEVY COMPENSATION The Company will subject to the terms of this Section pay to the insured the pro rata wages and Government levy imposed on foreign domestic maid up to a maximum as stated in the Table of Benefits in the event of the insured suffering the loss of service of the insured Maid s caused by the insured Maid s hospitalization due to illness or accident for which hospital expenses are insured under Section 4 Hospital & Surgical Expenses of this policy. Provided always that the Company shall not be liable for any payment beyond 30 days of the insured Maid s hospitalization. Special Exception to Section 5: No payment shall be made under this Section if hospitalization is directly caused by the deliberate act of the insured Maid. SECTION 6 ALTERNATE MAID SERVICES The Company will reimburse the Insured the expenses incurred for hiring temporary maid services, for the period when the Insured Maid is confined in a hospital in Singapore due to an illness or injury, up to the limit of benefit stated in the Table of Benefits. SECTION 7 - FUNERAL GRANT The Company will pay funeral grant expenses up to the limit of benefit stated in the Table of Benefits, if the Insured Maid dies. SECTION 8 - RE-HIRING EXPENSES The Company will subject to the terms of this Section pay to the insured up to the limit of benefit stated in the Table of Benefits, If the Insured Maid suffers serious illness or injury which prevents her from carrying out her employment duties in the opinion of a Registered Medical Practitioner. Subject to Special Conditions: i) Prior approval is required from the Company for such expenses; ii) Maid replacement is to be done within 90 days from the date of termination of the existing employment contract with the Insured Maid; and iii) The Company will also pay for this benefit when the claim is payable in relation to the Care Against Physical Abuse of Insured Maid Benefit. SECTION 9 - CARE AGAINST PHYSICAL ABUSE OF INSURED MAID The Company will subject to the terms of this Section pay for medically necessary expenses that the Insured incurs up to the limit of benefit in the Table of Benefits, if the Insured Maid physically abuses the Insured's child (up to age 15), an elderly (above the age of 65 years) or handicapped person in Insured s family Subject to Special Conditions: i) Insured will need to register a complaint against the Insured Maid with the Ministry of Manpower (Singapore) and the Police; and ii) Insured will need to terminate the employment contract with the Insured Maid. SECTION 10 - LIABILITY TO THIRD PARTY The Company will subject to the terms of this Section pay to the limit of benefit stated in the Table of Benefits, if the Insured Maid is held legally responsible for the accidental death or bodily injury to a third party and/or loss or damage to a third party's property during the Period of Insurance, The third party cannot be an interested party. Subject to Special Conditions: i) The legal costs and expenses which the Company has agreed upfront for representing the Insured Maid; and ii) The amount awarded against the Insured Maid by the court in Singapore only. SECTION 11 - DAMAGE OR THEFT OF MAID'S PERSONAL BELONGINGS The Company will pay the Insured Maid for damage or loss to her personal belongings caused by fire, flood, water (following bursting or overflowing of water tank, pipe or appliances) or burglary in the Insured s home up to the limit of benefit stated in the Table of Benefits. Subject to Special Exceptions: i) No payment if Insured or the Insured Maid did not take all reasonable precautions to safeguard her belongings; and ii) No payment for any unexplained and mysterious loss or damage. SECTION 12 - OUTPATIENT EXPENSES DUE TO ACCIDENT The Company will pay for the medically necessary outpatient medical expenses up to the limit of benefit stated in the Table of Benefits, if the Insured Maid suffers from an accident in Singapore. Please note that: i) Medical expenses include consultation, related medication and diagnostic tests; ii) Any visit to a Medical Specialist will need to be recommended by the Medical Practitioner; and iii) For every visit to a clinic for consultation, the Insured Maid will have to pay $10 and anything beyond that the Company will pay up to a maximum limit of $30 per visit. iv) If the Insured Maid visits any clinic on the panel of MHC, the Company will provide cashless cover above the excess and up to the limit of benefit stated in the Table of Benefits. Policy is extended to cover the expenses incurred overseas only if the Insured Maid is travelling along with the Insured. The Company will not pay: Medical expenses incurred by the Insured Maid for visits to clinics which are not on the panel of MHC. Page 7

GENERAL EXCEPTIONS (Applicable to Sections 2-12 only) The Company will not indemnify the insured and/or the insured Maid against 1 any action for compensation brought in the Court of law of any territory outside Singapore. 2 loss damage injury by accident or disease indirectly occasioned by or happening through or in consequence of a) war, invasion, acts of foreign enemies, hostilities or war-like operations (whether war be declared or not) civil war, mutiny, civil commotion assuming the proportions or amounting to a popular rising, military rising, insurrection, rebellion, revolution or usurped power. b) any act or any person or persons acting or behalf of or in connection with any organization with activities directed towards the overthrow by force of any dejure or de facto Government or to influencing of it by terrorism or violence. in any claim and in any action suit or other proceeding where the Company alleges that by reason of any of these Exceptions the loss is not covered by this Policy, the burden of proving otherwise rests on the insured Person. 3 any loss damage injury or liability directly or indirectly caused by or arising from or consequence of or contributed to by a) ionizing radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste or from the combustion of nuclear fuel; the radioactive toxic, explosive or other hazardous or contaminating properties of any nuclear installation, reactor or other nuclear assembly or nuclear component thereof; any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter. b) The radioactive, toxic, explosive or other hazardous or contaminating properties of any radioactive matter. This exclusion does not extend to radioactive isotopes, other than nuclear fuel or nuclear waste, when such isotopes are on the property insured and are being prepared, stored or used in the normal course of operations by the insured for the commercial, agricultural, medical, scientific or other similar peaceful purposes for which they were intended. 4 consequential loss or damage of any kind whatsoever. CONTRACTS (RiGHTS OF THiRD PARTiES) ACT (CHAPTER 53b) A person who is not a party to this policy contract shall have no right under the Contracts (Rights of the Third Parties) Act (Chapter 53b) to enforce any of its terms. 2. DEFiNiTiON Schedule and during which the insured Person is in the immediate employment of the insured but excluding the period when the insured Person returns to her home country. Cover ceases from the time she leaves Singapore and resumes upon her return to Singapore or seven days after cancellation of the Work Permit of the Insured Person whichever shall first occur. 3. interpretation This Policy, the Schedule and the Table of Benefits shall be read together as one contract and any word or expression to which a specific meaning has been attached in any part of this Policy of the Table of Benefits shall bear such meaning wherever it may appear. 4. ObSERVANCE The liability of the Company shall be conditional on the observance by the insured and the insured Person of the terms of this Policy. 5. PRECAUTiON The insured Person shall take all reasonable precautions to prevent accident and disease. 6. AlTERATiON This Policy shall cease to be in force if there be any material alteration in risk unless such alteration has been agreed to by the Company in writing 7. ClAiMS PROCEDURE On the happening of any accident which may give rise to a claim under the Policy the insured shall a. give immediate notice in writing to the Company stating the circumstances of the loss damage liability or injury. b. deliver to the Company as practicable a claim in writing with such particulars and proofs as may be reasonably required. 8. SUbROGATiON When claim payment has been effected the Company shall be entitled to under in the name and on behalf of the insured and/or the insured Person the absolute conduct control and settlement or any proceedings and to take proceedings at its own expense and for its own benefit but in the name of the insured and/or the insured Person to recover compensation or secure indemnity from any third party. 9. SANCTiONS EXClUSiON The Company shall not provide cover nor be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose the Company or any member of the Company s group to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations or any country including but not limited to the European Union, United Kingdom and United States of America. Period of Insurance shall mean the period specified in the Page 8

10. OTHER insurance if at the time of any loss damage or liability hereby insured there be any other subsisting insurance or insurances whether effected by the insured or by other person or persons or covering such loss damage or liability the Company shall not be liable to pay or contribute more than its ratable proportion of such loss damage or liability. 11. CANCEllATiON a. The Company may at any time cancel this Policy by giving fourteen days notice in writing via Registered mail to the insured at his last known address. b. Cover automatically ceases seven days after the cancellation of the Work Permit of the insured Maid named in the Schedule. c. No refund of premium is allowed upon cancellation of this Policy. d. No endorsement will be issued upon cancellation of this Policy. e. If Policyholder/Employer cancels the Policy of coverage and Ministry of Manpower (Singapore) discharges the Company of the Security bond, the Company will refund the Policyholder/Employer of the premium paid for this Policy as long as there are no paid or outstanding claims based on the following: insurance Corporation (SDiC). Coverage for your policy is automatic and no further action is required from you. PAyMENT before WARRANTy i. The premium due must be paid to the Company/insurer (or the intermediary through whom this Policy or bond was effected) on or before the inception date ( the inception date ) or the renewal date of the coverage. Payment shall be deemed to have been effected to the Company/insurer or the intermediary when one of the following acts takes place: a) Cash or honoured cheque for the premium is handed over to the Company/insurer or the intermediary; b) A credit or debit card transaction for the premium is approved by the issuing bank; c) A payment through an electric medium including the internet is approved by the relevant party; d) A credit in favour of the Company/insurer or the intermediary is made through an electronic medium including the internet. 14 mths cover - 100% for 0 to 3 mths - 40% for 4 to 6 mths - 0% for > 6 mths 26 mths cover - 100% for 0 to 3 mths - 70% for 4 to 6 mths - 50% for 7 to10 mths - 30% for 11 to 14 mths - 0% for > 14 mths ii. in the event that the total premium due is not paid to the Company/insurer (or the intermediary through whom this Policy or bond was effected) on or before the inception date or the renewal date, then the insurance shall not attach and no benefits whatsoever shall be payable by the Company/insurer. Any payment received thereafter shall be of no effect whatsoever as cover has been attached. 12. ARbiTRATiON All disputes arising out of this policy shall be submitted to the Singapore Mediation Centre for settlement by mediation in accordance with the Mediation Procedure for the time being in force. The parties agree to take part in the mediation in good faith and undertake to honor the terms of any settlement reached. if any dispute is not referred to mediation or if mediation fails, the dispute has to be referred to arbitration before any legal action may be taken against the Company. Arbitration shall be conducted in accordance with the Arbitration Rules of the Singapore Arbitration Centre. if the Company shall disclaim liability to the insured for any claim hereunder and such claim shall not within twelve calendar months from the date of such disclaimer have been referred to mediation and/or arbitration, then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter be recoverable hereunder. 13. JURiSDiCTiON This Policy shall be governed by and construed in accordance with the laws of the Republic of Singapore and any dispute arising out of or relating to this Policy shall be determined exclusively by the courts of Singapore. 14. POliCy OWNERS PROTECTiON SCHEME This Policy is protected under the Policy Owners Protection Scheme which is administered by the Singapore Deposit Page 9
