ADDENDUM NO. 1 ASPHALT PAVING REPAIR PROJECTS PROJECT NUMBER TU-1849 2/19/18 Ladies and Gentlemen: The purpose of this addendum is to clarify certain portions of the above-referenced project with all prospective vendors. Procurement Towson University 8000 York Road Towson, MD 21252-0001 t. 410 704-2171 f. 410 704-8233 CLARIFICATIONS: 1) Invitation for Bids cover page solicitation title correction. The title shall read Asphalt Maintenance Repair Projects. 2) While historically rare, in the event of an emergency the University shall have the option to contact the next Contractor on rotation, or all three if time permits to respond to an emergency. Included with this addendum please find a Revised Bid/Price Proposal form that includes a request for three (3) Man Hour rates in case of such an event. The Man Hour rates shall be adjusted up or down by the percentage change in the Consumer Price Index for All Urban Consumers (CPI-U), US City average, all items, as published by the Bureau of Labor Statistics for the latest available twelve-month period at time of renewal. No annual adjustment shall exceed +/- 3%. 3) Material used during an emergency repair reimbursed to the Contractor as a "job cost" shall be based on the cost of materials to the Contractor from his usual sources of supply with all usual trade practice discounts deducted. All costs discounts shall be deducted in determining material costs. The mark-up for material, combined overhead and profit, shall not exceed 10% of material costs. Material costs shall include sales taxes or other taxes to which materials furnished under the Contract are subject by law. Market quotations, invoices or other suitable evidence from wholesalers, distributors, jobbers of the articles or materials so furnished shall be submitted by the Contractor as proof of replacement cost. The Owner reserves the right to purchase material, equipment, or job required merchandise, or to furnish such items from stock. QUESTIONS: Q1) Does Towson University recognize Baltimore City Certified Minorities or only State Certified Minorities. A1) In order to count the dollars spent with the MBE firms toward the mandated goals, the MBE must be certified by the Maryland Department of Transportation (MDOT).

A6) No, there is no guaranteed minimum or maximum usage. It depends on the needs of the University. Q7) What is the liquidated damages and are they per work day or per consecutive days?
