TERMS AND CONDITIONS CIMB BANK RM50 Cashback for Credit Card Application via RTC Campaign Campaign Period 1. The CIMB Bank RM50 Cashback for Credit Card Application via RTC Campaign ( this Campaign ) is organized by CIMB Bank Berhad (13491-P) ( CIMB Bank ) and shall run from 1 st August 2017 to 31 st October 2017, both dates inclusive (the Campaign Period ). 2. CIMB Bank reserves the right upon giving prior notice of fourteen (14) days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 3. This Campaign is open exclusively to Targeted New-to-Card Applicants (customers who do not own a credit card issued by CIMB Bank) who applies for new CIMB Bank principal credit card(s) issued by CIMB Bank, (excluding CIMB Bank Business Cards and Partner Cards), via CIMB Retail Telemarketing Centre Team ( RTC ) during the Campaign Period (the Applicant(s) ); The following categories of persons/entities shall NOT be eligible to participate in this Campaign:- (i) (ii) (iii) (iv) Permanent and/or temporary staffs or employees of CIMB Bank (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or Representatives and/or agents (including advertising and campaign agents, third party vendors and service providers) of CIMB Bank (including its subsidiaries and related companies) and their permanent and/or contract staffs or employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or Non-individual entities including but not limited to sole-proprietorships, partnerships, charitable/non-profit organisations/societies, corporate and commercial customers, public listed and private limited companies, clubs, associations and co-operatives; and/or An existing CIMB Bank principal credit cardholder; and/or (v) A customer who had cancelled his/her CIMB Bank principal credit card within the last six (6) months before the date of approval of his/her newly applied CIMB Bank principal credit card during the Campaign Period; (vi) Individuals below the age of 21 years at the time of application. 4. CIMB Bank reserves the right to approve or reject any credit card applications and/or to request for any further supporting documents from the Applicant for purposes of the credit card application as it deems fit. For the avoidance of doubt, CIMB Bank has sole and absolute discretion to determine if the supporting 1

documents are sufficient for the purpose of processing the credit card application submitted to CIMB Bank. Campaign Mechanics 5. The Applicant(s) shall be entitled to RM50 cash back ( Gift ) if:- (i) The Applicant(s) applies for the first CIMB Bank principal credit card via RTC during the Campaign Period ( Application ); AND (ii) The Application must be successfully approved by CIMB Bank and the credit card must be activated within 60 days from the card approval date. For avoidance of doubt, card approval date refers to the date stated in the activation letter that is sent together with the CIMB Bank credit card to the Applicant(s); AND (iii) The Applicant(s) achieves a minimum Eligible Cumulative Retail Spending (as defined under Clause 6 of these Terms and Conditions) of RM500 ( Minimum Eligible Cumulative Retail Spending ) within 60 days from the card approval date. Hereinafter collectively referred to as the Qualifying Criteria. 6. Eligible Cumulative Retail Spending stated in Clause 5 above includes retail and/or online purchase transactions for goods and services incurred for personal consumption and shall not include the following:- (i) Quasi Cash transactions (example: betting and/or gaming transactions); (ii) Monthly installments under any installment payment facility provided by CIMB Bank or any other financial institutions; (iii) Payment of annual fees or service charges, delivery charges, cash payments, card replacement fees, taxes including Goods and Services Tax ( GST ), dispute charges, duplicate charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB Bank or otherwise; (iv) Cash advance/withdrawal/deposit transactions; (v) Transactions made by the Applicant(s) with any merchant associated with or controlled by him/her or any of his/her immediate family members (whether as employee, employer, shareholder or director), i.e. transactions by the Applicant(s) with any corporation or business entity in which he is and/or any one of his family members is the employee or employer, or works with, or has shares or interest in, or is a director of; and (vi) Eligible Cumulative Retail Spending which is subsequently cancelled or refunded, or any other disputed, unauthorized or fraudulent transactions. 7. All Eligible Cumulative Retail Spending transactions will be automatically tracked by CIMB Bank for the purpose of meeting the Minimum Eligible Cumulative Retail Spending and is based on the transaction dates and/or time (Malaysian Time) as captured by CIMB Bank s transaction records during the Campaign Period. Any determination by CIMB Bank as to what constitutes Eligible Cumulative Retail Spending shall be conclusive and shall not be challenged in any manner whatsoever unless the same appears as grossly unfair or unjust. 8. CIMB Bank shall not be held responsible or liable for any delay in the posting of the Eligible Cumulative Retail Spending to the Applicant(s) credit card account and/or error or omission in the posting of the same due to any reasons whatsoever and howsoever arising including but not limited to the delay on the part of the merchant unless the same is due to the gross negligence and/or default of CIMB Bank. CIMB 2

Bank shall not be responsible for any failure and/or delay in the transmission of evidence of sales transactions by Visa, MasterCard, merchant establishments or any other party unless the same is due to the gross negligence or default of CIMB Bank. Gift(s) 9. Cash back is only available to Applicants whose CIMB credit card account is current, valid, subsisting and not in default of any of the terms and conditions of the CIMB Cardholder Agreement. 10. The Cash back will be credited into the Applicant s CIMB credit card account within four (4) to six (6) weeks after the expiry of the sixty (60) days from the credit card approval date and the Cash back will be reflected in the Applicant s credit card statement as Cash back. General Terms and Conditions 11. By participating in this Campaign, the Applicant(s) is deemed to have read, understood and agreed to be bound by the Terms and Conditions herein and agree that any or all decisions made by CIMB Bank shall be final and conclusive. The Applicant(s) credit card account MUST be valid and/or activated, MUST be in good standing and MUST NOT be in breach of any of the terms and conditions in CIMB Cardholder Terms and Conditions and/or CIMB Clicks Internet Banking Agreement and MUST NOT be invalid, cancelled or terminated within CIMB Bank s definition at the point of delivering the Gift(s) otherwise the Applicant(s) will be disqualified from receiving the Gift(s) and shall not be entitled to any compensation. CIMB Bank reserves the right at its sole discretion to disqualify any Applicant(s) that it determines to be tampering with the entry process or to be acting in breach or potential breach of these Terms and Conditions. 12. By participating in this Campaign, the Applicant(s) hereby irrevocably and unconditionally undertakes to fully absolve CIMB Bank of all liabilities and agrees to indemnify CIMB Bank (on full indemnity basis) and hold CIMB Bank harmless against any claim by third party, and against any loss, damage, cost and expense (including solicitor s fees and cost)that CIMB Bank may suffer or incur as a result of or in connection with this Campaign unless the same arise from and are caused directly by CIMB Bank s gross negligence or willful default. 13. CIMB Bank reserves the right to cancel, terminate or suspend this Campaign upon giving prior notice of fourteen (14) calendar days. For the avoidance of doubt, cancellation, termination or suspension by CIMB Bank of this Campaign shall not entitle the Applicant(s) or any other person whosoever to any claim or compensation against CIMB Bank for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension. 14. CIMB Bank reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to the Applicant(s) in respect of the Amendment, cancellation, termination, suspension of this Campaign or any other notices to be given by CIMB Bank to the Applicant(s) under this Campaign shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of CIMB Bank s branches or via CIMB Bank s website or by any other means of notification which CIMB Bank may select and the Amendment shall be deemed as binding on the Applicant(s) as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the 3

notification. Applicant(s) acknowledges and agrees to access CIMB Bank s website at regular intervals to view these Terms and Conditions and to ensure that he/she is kept up-to-date with any changes or variations to the Terms and Conditions herein. 15. The Terms and Conditions (as the same may be amended from time to time pursuant to Clause 14 above) shall be read in conjunction with the prevailing terms and conditions in CIMB Cardholder Terms and Conditions and/or CIMB Clicks Internet Banking Agreement and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials of the Campaign. 16. CIMB Bank does not warrant that the Campaign shall be uninterruptible and/or error free. By participating in the Campaign, the Applicant(s) hereby acknowledges and irrevocably agrees that CIMB Bank shall not in any manner whatsoever be liable for any technical or system failures of any kind, whatsoever intervention, interruption and/or any electronic or human error arising from and under the Campaign. CIMB Bank shall not be liable or held responsible to the Applicant(s) in any manner whatsoever if CIMB Bank is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any act of God, industrial dispute, war, strike, riot, technical or system failures or anything beyond CIMB Bank s reasonable control. 17. If there is any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the English and the Bahasa Malaysia versions or versions in any other languages of the Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Applicant(s) and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of these Terms and Conditions shall govern the operation of the Applicant(s) credit card account, then the Bahasa Malaysia version of the Terms and Conditions shall prevail. TERMA-TERMA DAN SYARAT-SYARAT Kempen Permohonan Kad Kredit Bagi Pulangan Tunai RM50 Melalui RTC CIMB BANK Tempoh Kempen 1. Kempen Permohonan Kad Kredit Bagi Pulangan Tunai RM50 Melalui RTC CIMB Bank ( Kempen ini ) adalah dianjurkan oleh CIMB Bank Berhad (13491-P) ( CIMB Bank ) dan akan berlangsung dari 1 Ogos 2017 hingga 31 Oktober 3017, termasuk kedua-dua tarikh ( Tempoh Kempen ). 2. CIMB Bank menyimpan hak dengan memberikan notis terdahulu empat belas (14) hari untuk menukar jangka masa dan/atau tarikh-tarikh permulaan dan/atau penamatan Tempoh Kempen. Kelayakan 3. Kempen ini adalah terbuka secara eksklusif kepada Pemohon Baru-kepada-Kad yang Disasarkan ( Targeted New-to-Card Applicants ) (pelanggan yang tidak memiliki kad kredit yang dikeluarkan oleh CIMB Bank) yang memohon kad kredit utama CIMB Bank baru yang dikeluarkan oleh CIMB Bank, (melainkan Kad Perniagaan dan Kad Perkongsian CIMB Bank), melalui Pusat Telepemasaran Runcit (Retail Telemarketing Centre)( RTC ) CIMB semasa Tempoh Kempen ( Pemohon ); Kategori orang/entiti yang berikut TIDAK akan layak untuk menyertai Kempen ini:- (i) (ii) (iii) (iv) (v) (vi) Kakitangan atau pekerja tetap dan/atau sambilan CIMB Bank (termasuk subsidiari-subsidiari dan syarikat-syarikat berkenaannya) dan ahli-ahli keluarga terdekat mereka (iaitu pasangan, anak, ibu bapa dan adik-beradik); dan/atau Wakil dan/atau ejen (termasuk ejen pengiklanan dan kempen, penjual pihak ketiga dan pembekal perkhidmatan) CIMB Bank (termasuk subsidiari-subsidiari dan syarikat-syarikat berkenaannya) serta kakitangan atau pekerja tetap dan/atau kontrak mereka dan ahli-ahli keluarga terdekat mereka (iaitu pasangan, anak, ibu bapa dan adik-beradik); dan/atau Entiti bukan-individu termasuk tetapi tidak terhad kepada pemilik tunggal, perkongsian, organisasi/pertubuhan kebajikan/bukan keuntungan, pelanggan korporat dan komersial, syarikat-syarikat awam tersenarai dan sendirian berhad, kelab, pertubuhan dan koperasi; dan/atau Pemegang kad kredit utama CIMB Bank sedia ada; dan/atau Pelanggan yang telah menamatkan kad kredit utama CIMB Bank beliau dalam enam (6) bulan yang lepas sebelum tarikh kelulusan kad kredit utama CIMB Bank yang baru dipohon oleh beliau semasa Tempoh Kempen; Individu di bawah umur 21 tahun pada masa permohonan. 5

CIMB Bank menyimpan hak untuk meluluskan atau menolak mana-mana permohonan kad kredit dan/atau meminta apa-apa dokumen sokongan tambahan daripada Pemohon bagi tujuan permohonan kad kredit sebagaimana yang difikirkannya sesuai. Bagi mengelakkan keraguan, CIMB Bank mempunyai budi bicara tunggal dan mutlak untuk menentukan sama ada dokumen-dokumen sokongan adalah mencukupi bagi tujuan memproses permohonan kad kredit yang dikemukakan kepada CIMB Bank. Mekanisme Kempen 5. Pemohon akan layak pulangan tunai RM50 ( Hadiah ) sekiranya: - (iv) Pemohon memohon kepada kad kredit utama CIMB Bank yang pertama melalui RTC semasa Tempoh Kempen ( Permohonan ); dan. (v) Permohonan mestilah berjaya diluluskan oleh CIMB Bank dan kad kredit mestilah diaktifkan dalam 60 hari dari tarikh kelulusan kad. Bagi mengelakkan keraguan, tarikh kelulusan kad merujuk kepada tarikh yang dinyatakan dalam surat pengaktifan yang dihantar bersama dengan kad kredit CIMB Bank kepada Pemohon; dan (vi) Pemohon mencapai Perbelanjaan Runcit Terkumpul Layak minimum (seperti yang ditakrifkan di bawah Klausa 6 Terma-Terma dan Syarat-Syarat ini) sebanyak RM500 ( Perbelanjaan Runcit Terkumpul Layak Minimum ) dalam 60 hari dari tarikh kelulusan kad. Selepas ini secara kolektif dirujuk sebagai "Kriteria Kelayakan". 6. Perbelanjaan Runcit Terkumpul Layak yang dinyatakan dalam Klausa 5 di atas termasuk transaksi pembelian runcit dan/atau atas talian barangan dan perkhidmatan yang ditanggung untuk kegunaan peribadi dan tidak akan termasuk yang berikut:- (vii) Transaksi Tunai Kuasi (contoh: transaksi pertaruhan dan/atau perjudian); (viii) Ansuran bulanan di bawah apa-apa kemudahan pembayaran ansuran yang disediakan oleh CIMB Bank atau mana-mana institusi kewangan yang lain; (ix) Pembayaran yuran tahunan atau caj perkhidmatan, caj penghantaran, pembayaran tunai, fi penggantian kad, cukai termasuk Cukai Barang dan Perkhidmatan ( GST ), caj pertikaian, caj pendua, caj penipuan atau apa-apa fi, caj atau penalti lain sama ada dikenakan oleh CIMB Bank atau selainnya; (x) Transaksi pendahuluan/pengeluaran/deposit tunai; (xi) Transaksi yang dilakukan oleh Pemohon dengan mana-mana peniaga yang berkaitan dengan atau dikawal oleh beliau atau mana-mana ahli keluarga terdekat beliau (sama ada sebagai pekerja, majikan, pemegang syer atau pengarah), iaitu transaksi oleh Pemohon dengan mana-mana perbadanan atau entiti perniagaan di mana beliau adalah dan/atau salah seorang ahli-ahli keluarganya adalah pekerja atau majikan, atau bekerja dengan, atau mempunyai syer atau kepentingan dalam, atau sebagai seorang pengarah; dan (xii) Perbelanjaan Runcit Terkumpul Layak yang kemudiannya dibatalkan atau dipulangkan, atau apa-apa transaksi yang dipertikaikan, tanpa kebenaran atau penipuan. 7. Semua transaksi Perbelanjaan Runcit Terkumpul Layak akan dikesan secara automatik oleh CIMB Bank bagi tujuan mencapai Perbelanjaan Runcit Terkumpul Layak Minimum dan adalah berdasarkan tarikh dan/atau masa transaksi (Waktu Malaysia) seperti yang dirakam oleh rekod transaksi CIMB Bank semasa Tempoh Kempen. Apa-apa penentuan oleh CIMB Bank berkenaan dengan apa yang terdiri daripada Perbelanjaan Runcit Terkumpul Layak adalah konklusif dan tidak akan dicabar dalam apa-apa cara sekalipun melainkan jika yang sama kelihatan sangat tidak adil atau saksama. 6

8. CIMB Bank tidak akan bertanggungjawab atau dipertanggungjawabkan ke atas apa-apa penangguhan dalam pemaparan Perbelanjaan Runcit Terkumpul Layak dalam akaun kad kredit Pemohon dan/atau kesilapan atau peninggalan dalam paparan yang sama disebabkan oleh apa jua sebab dan cara apapun ia timbul termasuk tetapi tidak terhad kepada kelewatan oleh peniaga melainkan jika yang sama adalah disebabkan oleh kecuaian dan/atau keingkaran melampau CIMB Bank. CIMB Bank tidak akan bertanggungjawab ke atas apa-apa kegagalan dan/atau kelewatan dalam penghantaran bukti transaksi jualan oleh Visa, MasterCard, tempat peniagaan atau mana-mana pihak lain melainkan jika yang sama adalah disebabkan oleh kecuaian dan/atau keingkaran melampau CIMB Bank. Hadiah 9. Pulangan tunai hanya disediakan kepada Pemohon yang akaun kad kredit CIMB adalah semasa, sah, wujud dan tidak mengingkari apa-apa terma-terma dan syarat-syarat Perjanjian Pemegang Kad CIMB. 10. Pulangan tunai akan dikreditkan ke dalam akaun kad kredit CIMB Pemohon dalam empat (4) hingga enam (6) minggu selepas penamatan enam puluh (60) hari dari tarikh kelulusan kad kredit dan Pulangan tunai akan dicerminkan dalam penyata kad kredit Pemohon sebagai Pulangan tunai Terma-Terma dan Syarat-Syarat Am 11. Dengan menyertai Kempen ini, Pemohon dianggap telah membaca, memahami dan bersetuju untuk terikat oleh Terma-Terma dan Syarat-Syarat di sini dan bersetuju bahawa apa-apa dan semua keputusan yang dilakukan oleh CIMB Bank hendaklah muktamad dan konklusif. Akaun kad kredit Pemohon MESTI sah dan/atau diaktifkan, MESTI berada dalam keadaan baik dan TIDAK memungkiri mana-mana termaterma dan syarat-syarat dalam Terma-Terma dan Syarat-Syarat Pemegang Kad CIMB atau Perjanjian Perbankan Internet CIMB Clicks dan MESTI BUKAN tidak sah, ditamatkan atau dibatalkan dalam definisi CIMB Bank pada masa pengedaran Hadiah, jika tidak Pemohon akan dilucutkan kelayakan daripada menerima Hadiah dan tidak akan berhak untuk menerima apa-apa pampasan. CIMB Bank menyimpan hak di bawah budi bicara tunggalnya untuk melucutkan kelayakan mana-mana Pemohon yang ia tentukan sebagai mengganggu proses penyertaan atau bertindak memungkiri atau berpotensi memungkiri Terma-Terma dan Syarat-Syarat ini. 12. Dengan menyertai Kempen ini, Pemohon dengan ini secara muktamad dan tanpa syarat mengaku janji untuk melepaskan sepenuhnya kepada CIMB Bank ke atas kesemua liabiliti dan bersetuju untuk menanggung rugi CIMB Bank (atas dasar indemniti penuh) dan tidak mempertanggungjawabkan CIMB Bank daripada apa-apa tuntutan pihak ketiga, dan daripada apa-apa kerugian, kerosakan, kos dan perbelanjaan (termasuk fi dan kos peguamcara) yang mungkin dialami atau ditanggung oleh CIMB Bank akibat daripada atau berkenaan dengan Kempen ini melainkan ianya dibangkit daripada dan disebabkan secara langsung oleh kecuaian melampau atau keingkaran sengaja CIMB Bank. 13. CIMB Bank menyimpan hak untuk membatalkan, menamatkan atau menggantungkan Kempen ini dengan memberikan notis terdahulu empat belas (14) hari kalendar. Bagi mengelakkan keraguan, pembatalan, penamatan atau penggantungan Kempen ini oleh CIMB Bank tidak akan melayakkan Pemohon atau mana-mana orang kepada apa-apa tuntutan atau pampasan terhadap CIMB Bank bagi apa-apa kerugian atau kerosakan yang dialami atau ditanggung secara langsung atau tidak langsung akibat daripada tindakan pembatalan, penamatan atau penggantungan 7

14. CIMB Bank menyimpan hak dengan memberikan notis terdahulu dua puluh satu (21) hari kalendar untuk meminda (sama ada melalui penambahan, pemotongan, pengubahsuaian, pindaan atau walau apa jua selainnya) ( Pindaan ) mana-mana Terma-Terma dan Syarat-Syarat di sini. Pemberitahuan kepada Pemohon berkenaan dengan Pindaan, pembatalan, penamatan, penggantungan Kempen ini atau apa-apa notis lain yang akan diberikan oleh CIMB Bank kepada Pemohon di bawah Kempen ini akan dilaksanakan di atas budi bicara mutlak CIMB Bank melalui salah satu kaedah komunikasi berikut, iaitu, mengeposkan notis berkenaan dengan Pindaan di setiap cawangan CIMB Bank atau melalui laman web CIMB Bank atau melalui apa-apa kaedah pemberitahuan lain yang boleh dipilih oleh CIMB Bank dan Pindaan akan dianggap mengikat Pemohon dari tarikh pemberitahuan Pindaan atau dari tarikh lain yang mungkin ditentukan oleh CIMB Bank dalam pemberitahuan. Pemohon mengakui dan bersetuju untuk mengakses laman web CIMB Bank secara berkala untuk melihat Terma-Terma dan Syarat-Syarat ini dan memastikan beliau mengikuti perkembangan terkini apa-apa pertukaran atau perubahan Terma-Terma dan Syarat- Syarat di sini. 15. Terma-Terma dan Syarat-Syarat (yang mungkin dipinda dari semasa ke semasa menurut Klausa 14 di atas) akan dibaca bersama-sama dengan terma-terma dan syarat-syarat semasa dalam Terma-Terma dan Syarat-Syarat Pemegang Kad CIMB dan/atau Perjanjian Perbankan Internet CIMB Clicks dan akan mengatasi apa-apa terma, syarat, peruntukan atau representasi yang tidak konsisten yang terkandung dalam mana-mana bahan promosi Kempen lain. 16. CIMB Bank tidak menjamin bahawa Kempen akan bebas daripada gangguan dan/atau bebas ralat. Dengan menyertai Kempen, Pemohon dengan ini mengakui dan bersetuju secara muktamad bahawa CIMB Bank tidak akan dalam apa cara jua dipertanggungjawabkan ke atas apa-apa kegagalan teknikal atau sistem dalam apa jua bentuk, apa jua campur tangan, gangguan dan/atau apa-apa kesilapan elektronik atau manusia yang timbul daripada dan di bawah Kempen. CIMB Bank tidak akan dipertanggungjawabkan atau bertanggungjawab kepada Pemohon dalam apa cara sekalipun sekiranya CIMB Bank tidak dapat melaksanakan mana-mana obligasinya yang ditetapkan di sini di mana ketidakupayaan tersebut adalah disebabkan secara langsung atau tidak langsung oleh apa-apa bencana alam ( act of God ), pertikaian perindustrian, peperangan, mogok, rusuhan, kegagalan teknikal atau sistem atau apa-apa di luar kawalan munasabah CIMB Bank. 17. Sekiranya terdapat sebarang ketidaksejajaran, percanggahan, kesamaran atau kepincangan di antara versi Bahasa Inggeris dan versi Bahasa Malaysia atau versi bahasa lain Terma-Terma dan Syarat-Syarat di sini, versi Bahasa Inggeris Terma-Terma dan Syarat-Syarat ini akan mengatasi yang lain. Walau apa pun yang dinyatakan di atas di mana permintaan telah dibuat oleh Pemohon dan dicatat dan diakui oleh CIMB Bank dalam rekodnya bahawa versi Bahasa Malaysia Terma-Terma dan Syarat-Syarat ini akan mengawal operasi akaun kad kredit Pemohon, maka versi Bahasa Malaysia Terma-Terma dan Syarat-Syarat akan mengatasi yang lain.
