AmBank Visa paywave Cash Back Campaign Terms and Conditions The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad (295576-U) (collectively referred to as the Bank ) relevant credit card agreement(s) (collectively referred to as Cardholder Agreement ) which govern the use of the credit card/-i issued by the Bank. In the event of any discrepancy or inconsistency between these Terms and Conditions and the Cardholder Agreement, these Terms and Conditions shall prevail in so far as it relates to the Campaign. Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardholder Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardholder Agreement. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and viceversa. Words importing the masculine gender shall include the feminine and neuter gender. Campaign 1. The Campaign means Visa paywave Cash Back Campaign organised by the Bank in accordance with the Terms and Conditions as herein stipulated. Campaign Duration 2. The Campaign is from 1 February 2018 to 4 March 2018, both dates inclusive ( Campaign Duration ) or such other Duration(s) as may be determined at the sole and absolute discretion of the Bank with at least five (5) calendar days notice to Cardholders before the new terms and conditions take effect. Eligibility 3. Eligible Cardholders means customers of the Bank having a Principal Visa Credit Card/-i ( Card ) during the Campaign Duration as herein described but do not include:- (a) cardholders of debit card(s), other credit card(s)/-i than Visa credit card(s)/-i, prepaid card(s), corporate card(s), commercial card(s), or insurance card(s) issued by the Bank; and/or (b) cardholders whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during and up till twelve (12) weeks after expiry of the Campaign Duration. 4. For the avoidance of doubt, this Campaign does not require any registration for participation and that all related Cards of Eligible Cardholders including his/her supplementary Cards(s) shall be automatically tracked for purposes of tabulation of the Eligible Transactions throughout the Campaign Duration. Eligible Transaction and RM5 Cash Back 5. Subject to the Terms and Conditions hereinafter appearing, all Eligible Cardholders who use their Card to perform contactless ( Visa paywave ) local retail transaction(s) in Malaysia Ringgit currency of minimum RM30 and above in a single transaction ( Eligible Transaction ) Page 1 of 4 AmBank Visa paywave Cash Back Campaign

will be eligible for RM5 Cash Back ( Cash Back ) for every three (3) Eligible Transactions as recorded in the Bank s system ( Bundled Eligible Transactions ). 6. The Bundled Eligible Transactions shall each receive RM5 Cash Back on a first-come, firstserved basis, based on transaction timestamp as recorded in the Bank s system date and time, subject to availability of the daily cash back allocation of Malaysia Ringgit three thousand five hundred (RM3,500) from 00:00 hours until 23:59 hours based on Malaysian time as recorded in the Bank s system. 8. The balance from the daily cash back allocation for the respective day that is not utilized (if any) will not be brought forward to the next day. 9. The total Cash Back allocation given for the purpose of this Campaign is Malaysia Ringgit one hundred twelve thousand (RM112,000). 10. All transactions of Supplementary Credit Cards/-i shall be tracked under its respective Principal Credit Cards /-i account. 11. Each Eligible Cardholder is only entitled to a maximum cash back of RM200 for the entire Campaign Period. 12. Eligible retail spend transactions are all local retail spend contactless transactions as explained in Clause 5 above that are charged to any Eligible Cardholder s Principal Card(s) during the Campaign Duration for purchase of goods or services incurred for personal consumption, and not for business purposes, excluding the following transactions:- (a) quasi cash transactions for betting and/or gaming; (b) on-going monthly instalments of AmFlexi-Pay Program / Easy Payment Plan; (c) corporate Bill Payments or Corporate GIRO transactions; (d) cash advance / deposit / withdrawal transactions; (e) any fees or charges imposed by the Bank; (f) trade financing transactions; (g) transactions which are under special corporate arrangement where rebate is applicable; and (h) retail spend transactions which are subsequently cancelled, disputed, refunded, unauthorized, suspicious or fraudulent transactions of any nature. 13. Any determination by the Bank as to what constitutes Eligible Transactions and Eligible Bundled Transactions are conclusive and cannot be challenged in any manner whatsoever. All transactions as recorded by the Bank shall also be final and conclusive. 14. All Eligible Transactions and Eligible Bundled Transactions within the Campaign Duration must be based on Malaysian time as captured by the Bank s transaction records and posted to the Eligible Cardholder s Card account within five (5) calendar days from the date of the transactions. The Bank is not responsible in any manner whatsoever for any failure and/or delay in the transmission of evidence of sales transactions by Visa, merchant establishments or any other party. 15. The Cash Back will be credited into the respective Eligible Cardholder s Card account which was used to perform the Eligible Transaction within twelve (12) weeks from the end the Campaign Duration and shall be displayed in his/her statement of Card account. 16. Notwithstanding the foregoing, the Bank reserves the right to use any other medium or method, including the Bank s website at www.ambank.com.my as it deems fit in its sole and absolute discretion for the purpose of announcing the Eligible Cardholders entitled for the Cash Back. Disqualification 17. The Bank reserves the absolute right to disqualify the participation of any Eligible Cardholders for the purpose of this Campaign without having to alert him/her in the event:- (a) the Eligible Cardholder s Card account is in default of facilities granted at any time during the Campaign Duration; or (b) the Eligible Cardholder s Card account is closed within twelve (12) weeks from the expiry of the Campaign Duration; or (c) the Eligible Cardholder has provided untrue information or acted fraudulently in any manner during the Campaign Duration; or (d) the Eligible Cardholder breaches any of these Terms and Conditions stipulated herein. Liability 18. The Bank shall not be liable to any Eligible Cardholder for any damage of whatsoever nature or loss suffered (including but not limited to, loss of goodwill, income or profits or consequential, direct or indirect, exemplary, incidental, punitive or special damages) howsoever arising in relation to participation in the Campaign, or the Bank exercising its rights pursuant to any of the Terms and Conditions herein. General 19. The Bank s decision on all matters relating to the Campaign is binding and final and no further correspondence or appeal shall be entertained. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 20. All Eligible Cardholders have read and understood all the Terms and Conditions specified herein and the Bank shall have the absolute right to suspend, terminate or cancel the Campaign at any time without assigning any reason with at least 5 calendar days notice to Cardholders on the Bank s website at www.ambank.com.my before the new terms and conditions take effect. 21. All Eligible Cardholders are deemed to have expressly agreed to be bounded by these Terms and Conditions (as varied or changed), the decisions of the Bank and, to the fullest extent permitted by law, to have consented to and authorized the Bank to disclose their particulars to the third party service providers engaged by the Bank for purposes of the Campaign. The Bank warrants that the disclosure of such particulars to any third party service providers shall be limited to the Eligible Cardholders names, addresses, Frequent Flyer membership number and telephone numbers and shall be used only in relation to and for purposes of the Campaign. The Bank s decision on all matters relating to the Campaign (including the interpretation of these Terms and Conditions) shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained. 22. For avoidance of doubt, cancellation, termination or suspension of this Campaign by the Bank shall not entitle the Eligible Cardholder(s) to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the Eligible Cardholder(s) as a direct or indirect result of the act of cancellation, termination or suspension. 23. To the extent permitted by law, the Bank shall not be liable to the Eligible Cardholder(s) for any losses or costs (including loss of business opportunities or profits) caused by abnormal and unforeseeable circumstances outside the Bank s reasonable control which is unavoidable, including but not limited to any accident, act of terrorist, breakdown of machinery, civil commotion, fire, industrial dispute, labour unrest, lock-out, natural disaster, riot, strike, war (whether declared or undeclared), or data processing system, electrical, telecommunication system or transmission link failure. 24. Kempen Pulangan Tunai Visa paywave AmBank Terma dan Syarat Terma-terma dan syarat-syarat di sini ( Terma dan Syarat ) adalah tambahan kepada dan untuk dibaca bersama dengan perjanjian kad kredit yang berkaitan ( Perjanjian Pemegang Kad ) AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad (295576-U) (secara kolektif dirujuk sebagai pihak Bank ) yang masing-masing mentadbir ke atas penggunaan kad kredit/-i yang dikeluarkan oleh pihak Bank. Sekiranya terdapat sebarang percanggahan atau ketidakseragaman antara Terma dan Syarat ini dan Perjanjian Pemegang Kad, Terma dan Syarat ini akan digunapakai setakat berkaitannya dengan Kempen ini. Kecuali di mana konteks memerlukan sebaliknya, atau melainkan jika Terma dan Syarat ini memperuntukkan selainnya, semua perkataan, nama dan ekspresi yang ditakrifkan di dalam Perjanjian Pemegang Kad, apabila digunakan atau dirujuk di dalam Terma dan Syarat ini, hendaklah mempunyai maksud yang sama seperti yang dinyatakan di dalam Perjanjian Pemegang Kad. Perkataan yang melambangkan orang termasuklah orang yang hidup dan, jika dan di mana berkenaan, badan atau orang yang diperbadankan atau tidak diperbadankan. Perkataan yang bererti tunggal juga hendaklah termasuk jamak dan sebaliknya. Perkataan yang bermaksud jantina lelaki hendaklah termasuk jantina perempuan dan neuter. Kempen 1. Kempen bermaksud Kempen Pulangan Tunai Visa paywave yang dianjurkan oleh pihak Bank selaras dengan Terma dan Syarat yang ditetapkan di sini. Tempoh Kempen 2. Kempen ini adalah dari 1 Februari 2018 hingga 4 Mac 2018, termasuk kedua-dua tarikh ( Jangka Waktu Kempen ) atau mana-mana tempoh lain sebagaimana yang ditentukan mengikut budi bicara tunggal dan mutlak pihak Bank dengan notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu. Kelayakan 3. "Pemegang Kad Yang Layak" bermaksud pelanggan pihak Bank yang mempunyai Kad Kredit/- i Visa Utama ( Kad ) semasa Jangka Waktu Kempen seperti yang diterangkan di sini tetapi tidak termasuk:- (a) pemegang kad debit, kad kredit/-i selain kad kredit/-i Visa, kad prabayar, kad korporat, kad komersial atau kad insurans yang dikeluarkan oleh pihak Bank; dan/atau (b) pemegang kad dengan akaun Kad yang telah digantung, diberhentikan atau dibatalkan atas apa jua sebab semasa dan sehingga dua belas (12) minggu setelah Jangka Waktu Kempen tamat. 4. Bagi mengelakkan keraguan, Kempen ini tidak memerlukan sebarang pendaftaran untuk penyertaan dan bahawa semua Kad Pemegang Kad Yang Layak yang berkaitan termasuk Kad tambahan beliau akan dijejaki secara automatik bagi tujuan penjadualan Transaksi Yang Layak sepanjang Jangka Waktu Kempen. Transaksi Yang Layak dan Pulangan Tunai RM5 5. Tertakluk kepada Terma dan Syarat yang akan dinyatakan selepas ini, semua Pemegang Kad Yang Layak yang menggunakan Kad mereka untuk melaksanakan transaksi tanpa sentuh ( Visa paywave ) perbelanjaan runcit tempatan dalam matawang Ringgit Malaysia minimum RM30 dan ke atas dalam satu transaksi ( Transaksi Yang Layak ) akan layak untuk menerima Pulangan Tunai RM5 ( Pulangan Tunai ) bagi setiap tiga (3) Transaksi Yang Layak seperti yang direkodkan dalam sistem Bank ( Transaksi Yang Layak Terkumpul ). 6. Transaksi Yang Layak Terkumpul yang dilaksanakan oleh Pemegang Kad Yang Layak akan membolehkan beliau untuk menerima Pulangan Tunai RM5 pada dasar yang terdahulu diutamakan, berdasarkan masa transaksi seperti yang direkod dalam tarikh dan masa sistem Pihak Bank, tertakluk kepada ketersediaan peruntukan wang tunai harian sebanyak Ringgit Malaysia tiga ribu lima ratus (RM3,500) dari jam 00:00 sehingga jam 23:59 berdasarkan waktu Malaysia seperti yang direkod dalam sistem pihak Bank. 8. Baki Pulangan Tunai harian yang diperuntukkan pada hari yang tidak digunakan (jika ada) tidak akan dibawa ke hari yang seterusnya. 9. Jumlah keseluruhan peruntukan Pulangan Tunai untuk Kempen ini adalah sebanyak Ringgit Malaysia satu ratus dua belas ribu (RM112,000). 10. Semua transaksi Kad Kredit/-i Tambahan akan dijejak di bawah akaun Kad Kredit/-i Utamanya. 11. Setiap Peserta hanya berhak menerima pulangan tunai maksimum sebanyak RM200 untuk kesuluruhan Jangka Waktu Kempen. 12. Transaksi perbelanjaan runcit yang layak semuanya adalah transaksi tanpa sentuh perbelanjaan runcit seperti yang diterangkan dalam Klausa 5 di atas yang dicajkan kepada manamana Kad Utama Pemegang Kad Yang Layak semasa Jangka Waktu Kempen untuk pembelian barangan atau perkhidmatan yang ditanggung untuk penggunaan peribadi dan bukan bagi tujuan perniagaan, tidak termasuk transaksi-transaksi yang berikut:- (a) transaksi tunai separa untuk perjudian dan/atau permainan; Page 2 of 4 Kempen Pulangan Tunai Visa paywave AmBank

(b) (c) (d) (e) (f) (g) ansuran bulanan Program AmFlexi-Pay / Pelan Bayaran Mudah yang sedang berjalan; transaksi Bayaran Bil Korporat atau GIRO Korporat; transaksi pendahuluan tunai / deposit / pengeluaran; sebarang yuran atau caj yang dikenakan oleh Bank; transaksi pembiayaan perdagangan; transaksi yang berada di bawah pengaturan korporat khas yang mana rebat boleh digunakan; dan (h) transaksi perbelanjaan runcit yang kemudiannya dibatalkan, dipertikaikan, dikembalikan, tidak dibenarkan, mencurigakan atau transaksi palsu dalam apa-apa bentuk. 13. Sebarang penentuan oleh Bank mengenai apa yang dimaksudkan sebagai Transaksi Yang Layak dan Transaksi Yang Layak Terkumpul adalah muktamad dan tidak boleh dicabar dalam apa jua cara. Semua transaksi seperti yang direkod oleh pihak Bank akan juga menjadi muktamad dan konklusif. 14. Semua Transaksi Yang Layak dan Transaksi Yang Layak Terkumpul dalam Jangka Waktu Kempen mesti berdasarkan mesti berdasarkan waktu Malaysia seperti yang dirakamkan oleh rekod transaksi pihak Bank dan diposkan ke akaun Kad Peserta dalam tempoh lima (5) hari kalendar dari tarikh transaksitransaksi tersebut. Pihak Bank tidak bertanggungjawab dalam sebarang cara apa jua untuk sebarang kegagalan dan/atau kelewatan dalam transmisi bukti transaksi jualan oleh Visa, pertubuhan peniaga atau sebarang pihak lain. 15. Pulangan Tunai akan dikreditkan ke dalam akaun Kad Pemegang Kad Yang Layak yang telah digunakan untuk melaksanakan Transaksi Yang Layak dalam masa dua belas (12) minggu dari tarikh tamat Jangka Waktu Kempen dan akan dipaparkan dalam penyata akaun Kad beliau. 16. Walau apa pun yang dinyatakan di atas, Bank berhak untuk menggunakan sebarang medium atau kaedah lain, termasuk laman sesawang Bank di www.ambank.com.my yang dianggap wajar menurut budi bicara mutlaknya bagi tujuan mengumumkan Pemegang Kad Yang Layak yang berhak mendapat Pulangan Tunai. Penyingkiran 17. Pihak Bank berhak secara mutlak untuk menyingkirkan penyertaan sesiapa Pemegang Kad Yang Layak untuk tujuan Kempen ini tanpa keperluan untuk memaklumkan beliau sekiranya:- (a) akaun Kad Pemegang Kad Yang Layak tersebut mengingkari kemudahan-kemudahan yang diberi pada bila-bila masa semasa Jangka Waktu Kempen; atau (b) akaun Kad Pemegang Kad Yang Layak tersebut ditutup dalam dua belas (12) minggu setelah Jangka Waktu Kempen tamat; atau (c) Pemegang Kad Yang Layak telah memberikan maklumat yang tidak benar atau melakukan penipuan dalam sebarang cara ssemasa Jangka Waktu Kempen; atau (d) Pemegang Kad Yang Layak tersebut memungkiri sebarang Terma dan Syarat yang dinyatakan di sini. Liabiliti 18. Pihak Bank tidak akan bertanggungjawab kepada sesiapa Peserta untuk sebarang kerosakan dalam apa jua bentuk atau kerugian yang dialami (termasuk tetapi tidak terhad kepada, kehilangan nama baik, pendapatan atau keuntungan atau kerosakan berbangkit, secara langsung atau tidak langsung, teladan, sampingan, punitif atau khas) sebagaimana yang timbul berkaitan dengan penyertaan dalam Kempen ini, atau pihak Bank melaksanakan haknya menurut sebarang Terma dan Syarat di sini. Umum 19. Keputusan pihak Bank untuk semua perkara berkaitan dengan Kempen ini adalah terikat dan muktamad. Semua Terma dan Syarat yang ditetapkan di sini adalah ditadbir oleh dan ditafsirkan selaras dengan undang-undang Malaysia dan sebarang pertikaian undang-undang akan dimulakan dan dibicarakan di mahkamah di Kuala Lumpur. 20. Semua Peserta telah membaca dan memahami semua Terma dan Syarat yang dinyatakan di sini dan pihak Bank akan mempunyai hak mutlak untuk mengantung, memberhentikan atau membatalkan Kempen ini pada bila-bila masa tanpa memberi sebarang sebab dengan memberi notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu pada laman web pihak Bank di www.ambank.com.my. 21. Semua Pemegang Kad Yang Layak dianggap sebagai telah menyatakan persetujuan untuk terikat dengan Terma dan Syarat ini (seperti yang diubah atau berubah), keputusan Bank dan, setakat yang benarkan oleh undang-undang, untuk membenarkan dan memberi kuasa kepada Bank untuk mendedahkan butiran peribadi mereka kepada penyedia perkhidmatan pihak ketiga yang digunakan oleh Bank bagi tujuan Kempen. Bank menjamin bahawa pendedahan butiran yang sedemikian kepada mana-mana penyedia perkhidmatan pihak ketiga akan terhad kepada nama, alamat, nombor keahlian Penerbang Kerap dan nombor telefon Pemegang Kad Yang Layak dan akan digunakan hanya dalam hal berkaitan dengan dan bagi tujuan Kempen. Keputusan Bank ke atas semua perkara yang berkaitan dengan Kempen (termasuk interpretasi Terma dan Syarat ini) adalah muktamad dan mengikat dan sebarang surat-menyurat selanjutnya atau percubaan untuk mempertikaikan keputusan yang sedemikian tidak akan dilayan. 22. Untuk mengelakkan keraguan, pembatalan, pemberhentian atau penggantungan Kempen ini oleh pihak Bank tidak akan memberi hak kepada para Peserta untuk sebarang tuntutan atau pampasan terhadap pihak Bank untuk sebarang dan kesemua kerugian atau kerosakan yang dialami atau ditanggung oleh para Peserta sebagai akibat langsung atau tidak langsung dari tindakan pembatalan, pemberhentian atau penggantungan tersebut. 23. Setakat yang dibenarkan oleh undang-undang, pihak Bank tidak akan bertanggungjawab kepada para Peserta untuk sebarang kerugian atau kos (termasuk kehilangan peluang perniagaan atau keuntungan) yang disebabkan oleh keadaan-keadaan yang luar biasa dan tidak dapta diduga di luar kawalan munasabah pihak Bank yang tidak dapat dielakkan, termasuk tetapi tidak terhad kepada sebarang kemalangan, tindakan pengganas, kerosakan mesin, kekacauan awam, kebakaran, pertikaian perindustrian, kekacauan buruh, sekatan masuk kerja, bencana alam, rusuhan, mogok, peperangan (sama ada diisytiharkan atau tidak diisytiharkan) atau kegagalan sistem pemprosesan data, elektrik, sistem telekomunikasi atau sambungan transmisi. 24.
