Campaign Terms and Conditions Spider-Man: Homecoming -Win a trip for 2 to New York with your new Maybank Credit or Charge Card 1. The Spider-Man: Homecoming - Win a trip for 2 to New York with your new Maybank Credit or Charge Card campaign ( Campaign ) commences from 22 May 2017 until 31 July 2017 ( Campaign Period ). 2. Eligibility 2.1 The Campaign is applicable to all new-to-bank Principal Cardmembers who have applied any of Maybank Visa, Mastercard and/or American Express Credit and/or Charge Card ( Maybank Card ) issued by Malayan Banking Berhad (Co. No. 3813-K) and/or Maybank Islamic Berhad (Co. No. 787435-M), referred to as ( Maybank ) during Campaign Period through Maybank authorized sales representative(s), Maybank Branch(s), and/or www.maybank.com.my, and all applications must be approved within the Campaign Period and the Maybank Card must be activated with at least one (1) transaction within thirty (30) days from the date of Maybank Card issuance ( Principal Cardmembers ). 2.2 All Principal Cardmembers are required to register via short messages service ( SMS ) within the Campaign Period to be successfully participated in the Campaign, as elaborated in paragraph 3 below. 2.3 New-to-bank herein refers to: a) Principal Cardmembers who are not existing Principal Cardmembers of Maybank Card; b) Whose Maybank Card was cancelled more than six (6) months prior to the Campaign Period; c) Supplementary Cardmembers of Maybank Card who are not holding any of Principal Maybank Card. 2.4 For avoidance of doubt, Maybank Card application(s) via www.maybank.com.my is limited to Maybank Visa, Mastercard and/or American Express Credit Card only. 2.5 The following persons are NOT eligible to participate in the Campaign: a) Existing Principal Cardmembers of Maybank Card; b) Principal Cardmembers whose Maybank Card account(s) are delinquent, suspended, cancelled, or in breach of any terms and conditions herein and/or Cardmember Agreement during the Campaign Period; c) Principal Cardmembers of Maybank Card who are in default of any facility granted by Maybank at any time; d) Principal Cardmembers of Maybank Commercial, Corporate, Debit and Prepaid Card. 2.6 Permanent and contract employees of Maybank, partners, representatives or agents (including vendors, suppliers, and advertising and promotion agencies for the Campaign) and their respective immediate family members (e.g. spouse, children, parents, siblings) are not eligible to win Grand Prize by participating in this Campaign. 1

3. SMS Registration 3.1 Registration is on a one-time basis via SMS using Maxis/Celcom/DiGi/U Mobile ( Telco ) number and must be made by the Principal Cardmembers only within the Campaign Period as follow: a) For Malaysian: Type SPIDEY <space> 12-digit NRIC Number and send to 66628 (E.g. SPIDEY 900826145411). b) For non-malaysian: Type SPIDEY <space> Passport Number recorded in Maybank s system and send to 66628 (E.g. SPIDEY A12346 A1). 3.2 Upon successful registration via SMS, Principal Cardmembers will receive confirmation via SMS. 3.3 Principal Cardmembers with multiple new Maybank Cards are only required to register once within the Campaign Period. 3.4 Principal Cardmembers shall be responsible to pay the standard SMS charges levied by their respective telecommunication service providers for each registration SMS sent to the designated number 66628 under the Campaign. 3.5 Principal Cardmembers are solely responsible to ensure that the details in the registration SMS sent to 66628 are complete, accurate, and within the Campaign Period; failing which, the registration SMS will not be processed and deemed invalid or unsuccessful. 3.6 Proof of SMS sent to 66628 by Principal Cardmembers shall not be deemed as successful SMS registration unless the Principal Cardmember receives a confirmation SMS from 66628 and such confirmation SMS will be sent to the same mobile phone number used for registration, subject to the SMS traffic at the respective Telco s network. The confirmation SMS is automatically generated to confirm receipt of a successful registration and shall not deemed as notification that the Principal Cardmember has been confirmed as the winner. 3.7 Cancellation and/or change of SMS Registration will not be accepted after the SMS Registration has been sent to 66628. 3.8 Maybank reserves the right to disqualify any SMS registration sent to 66628 due to reason(s) including, but not limited to duplicate registration, invalid NRIC/Passport Number, incorrect SMS format, unsuccessful or delayed transmission of SMS during the Campaign Period without assigning any reason thereof and shall not be liable for such disqualification. 3.9 Maybank is not responsible for nor does Maybank has any control whatsoever on the SMS traffic, network failure and/ or interruptions on the part of the respective Telco or Maybank s SMS service provider or for any other reason(s) whatsoever during the process of SMS registration sent to 66628 or SMS confirmation sent from 66628 to Principal Cardmembers which may result in the delay of the SMS registration during the Campaign Period. 3.10 SMS service is provided and supported by the service provider appointed by Maybank - Marco Kiosk Berhad. 4. Campaign Mechanics 4.1 Principal Cardmembers are required to apply a Maybank Card and register their participation in the Campaign via SMS registration within the Campaign Period. 2

4.2 Upon Maybank Card approval and successful SMS registration, Principal Cardmembers are required to perform at least one (1) qualified retail spend within thirty (30) days from the date of Maybank Card issuance to earn qualifying entry. 4.3 Qualified retail spend shall include any amount of retail and online purchases transacted locally and internationally, Auto PayBills, auto-reload for Maybank Touch n Go Zing Card and 0% EzyPay Instalment Plan ( Ezypay ) performed via Maybank Card during the Campaign Period based on local transaction time. For avoidance of doubt, EzyPay shall be treated as qualified retail spend based on the full transaction amount. All overseas transactions in foreign currency shall be converted to Ringgit Malaysia (RM) based on Maybank s prevailing in-house exchange rate. 4.4 Qualified retail spend shall exclude monthly installment of EzyPay, EzyPay Plus, cash advance, balance transfer, fund transfer, outstanding balance, reversals, fee and charges imposed by Maybank. 4.5 Qualified retail spend by Supplementary Cardmember(s) under the same Principal Cardmembers Maybank Card account(s) will not be considered as the Principal Cardmembers qualified retail spend. 5. Private Training Facility ii) Expert instruction from stunt professionals iii) Demonstration of key stunts from the movie iv) High falls, wire work and fight choreography inspired by SPIDER- MAN: HOMECOMING v) Safety requirements vi) Roundtrip transfers Unlimited Metro Passes for duration of trip (4 days 3 nights) 5.2 Grand Prize EXCLUDES the following (this list is not exhaustive): a) Travel Insurance. b) Travel Visa and other travel related expenses. c) Long distance phone calls, room service, laundry, mini bar items, room service, loss of hotel property, damage to hotel property, or any other expenses incurred in the hotel. d) Personal expenses unrelated to the scheduled program (such as but not limited to extension of stay, shopping, transportation to destinations which are not part of the tour, food expenses aside from scheduled meals and telecommunication charges, excursions, attractions, treatments, and anything not expressly stated in the Grand Prize). e) Any taxes levied by Government Authorities pertaining to the flights. f) Any personal tax that may be levied on guests with respect to their receipt of the Grand Prize or any part thereof. 5.3 The Grand Prize is not transferable or exchangeable for cash, credit or kind and shall be subject to such terms and conditions which Maybank may in its sole discretion impose. Maybank may in its sole discretion exchange or substitute the Grand Prize to another of equivalent or similar value with 21 days prior notice. 5.4 The acceptance and use of the Grand Prize shall be subject to these terms and conditions and such other conditions that may be imposed by Maybank or the relevant merchants supplying the goods or services. The Grand Prize shall be accepted at the risk and cost of the Winner. The Winner shall accept his/her Prize on an "as-is, where-is" basis. Maybank shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the Grand Prize. Notwithstanding anything herein, Maybank shall not at any time be responsible or held liable for any defect or malfunction in the Grand Prize by any person, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of the Grand Prize (or of any goods or services redeemed with the Grand Prize). 6. Selection of Grand Prize Winner 6.1 Based on the Qualifying Entry earned, Principal Cardmembers will be shortlisted by Maybank s randomizer programme. 6.2 At the point of shortlisting, all Maybank Card account(s) of the Principal Cardmembers must not be delinquent, invalid and/or cancelled; otherwise the Principal Cardmembers will be disqualified. 4

6.3 The shortlisted Principal Cardmembers will be contacted by Maybank s representatives at the mobile phone numbers registered or recorded in Maybank s system to participate in the Campaign at any time during office hours to answer one (1) question. 6.4 The shortlisted Principal Cardmember(s) will be deemed as Grand Prize Winner ( Winner ) if he/she is able to answer the question correctly. 6.5 If the shortlisted Principal Cardmember(s) is not able to answer the question correctly, the next Principal Cardmember(s) in sequence will be shortlisted and contacted to answer the question. 6.6 In the event the shortlisted Principal Cardmember(s) is not contactable after three (3) attempts on the same day for whatsoever reason(s) and/or the shortlisted Principal Cardmember(s) wish to withdraw from the Campaign upon being contacted by Maybank s representative, he/she will be disqualified from the Campaign. 6.7 Winner will be notified either in writing or by phone and announcement of Winner will be made on Maybank s website at www.maybank.com.my subject to the consent of the eligible Principal Cardmembers within ten (10) weeks after the end of the Campaign. 7. Grand Prize Redemption and Terms & Conditions 7.1 A confirmation letter will be sent to the Winner at his/her Billing Addresses recorded in Maybank s system within ten (10) weeks from the end of the Campaign Period. 7.2 Grand Prize s redemption details will be elaborated in the confirmation letter. 7.3 Winner will be required to nominate one (1) travel companion ( nominated passenger ) to be travelled together. 7.4 At least one (1) person travelling must be at the age of 18 or above. 7.5 Winner and nominated passenger must be in possession of a valid passport of 5 years and must have a minimum of 6 months validity for the duration of the Grand Prize. 7.6 All entry visas, ESTA forms, and/or travel documents are the sole responsibility of the winner and nominated passenger including visa costs if applicable 7.7 Upon winning s notification, Winner must travel within 6 months of winning his/her holiday. Winner will be requested to provide three (3) separate dates of preferred travel to the Grand Prize Supplier(s) and/or Grand Prize Fulfilment Agent(s) ( Travel Agent ), Travel Agent will work towards fulfilling at least one of winner s preferred date of travel. Winner who do not travel within 6 months will be disqualified automatically and no longer entitled to his/her Grand Prize. 7.8 Grand Prize Winner must give at least 60 days notice prior to their requested departure date. 7.9 Grand Prize is subject to availability and blackout dates will apply. Blackout dates may include peak Christmas, Easter, New Year and summer/winter holidays. 5

7.10 Winner acknowledges that the Grand Prize is developed and managed by Maybank appointed Travel Agent solely and shall not hold Maybank liable for any loss or damage or dissatisfaction caused to the Winner by the Travel Agent. 7.11 Once confirmed in writing, the flights, hotel accommodation, travelling dates and names of those travelling are not changeable. 7.12 The nominated passenger are required to travel together with the Winner from Kuala Lumpur to New York City, New York on Economy Class return flights. 7.13 Issuance of flight tickets is subject to the airline s policy and any other general terms and conditions applicable to the flight tickets. Such terms and conditions are beyond Maybank s control and are determined by the airline. 7.14 Flights cannot be re-routed to any other destination(s). 7.15 Any dispute arising from issuance/reissuance of flight ticket(s) and/or hotel accommodation shall be settled directly by the Winner with Travel Agent strictly without any recourse to Maybank whatsoever. 7.16 Hotel accommodation is based on 2 adults sharing room; a valid Maybank Card will be required to guarantee the room upon check in. 7.17 Winner and nominated passenger must be in good physical condition for the stunt experience. Maybank shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the stunt experience being part of the Grand Prize. Maybank shall not at any time be responsible or held liable for any loss, injury, damage or harm suffered or incurred by or in connection with the stunt experience. 7.18 Stunt master class will be conducted in English, an alternative activity of the same value will be arranged if the Winner and nominated passenger are not fluent in English. 7.19 If the Winner chooses not to attend the Stunt Experience, an alternative activity of the same value will be arranged with prior notice to the Travel Agent at the stage of trip fulfilment and/or booking. 7.20 Grand Prize is given on an As Is basis, which is non-refundable, non-transferable, non-exchangeable for cash or other kinds, whether in part or in full. 7.21 In the unlikely event that the Grand Prize (or part of it) should become unavailable (due to a force majeure or element(s) of the Grand Prize not being suitable for the winner etc.) and the Grand Prize Winner agrees that Travel Agent reserves the right to substitute a prize which may determine as being of equal value. 8. General 8.1 SMS sent by Principal Cardmembers to 66628 for registration purpose shall be deemed as consent to participate in the Campaign. By participating in the Campaign, Principal Cardmembers: a) agree to be bound by the terms and conditions herein; b) agree that all records of transactions captured by Maybank s system within the Campaign Period shall be accurate and conclusive; 6

c) agree that Maybank s decision on all matters relating to the Campaign and the list of Winner shall be final and binding on all Principal Cardmembers. No further appeal or further correspondence will be entertained; d) agree that any reversal of qualified spend shall be excluded; e) authorize Maybank to publish their names, photos taken or other information provided by him / her for current and future advertising and publicity purposes in any advertising or publicity material relating to the Campaign without any compensation; f) agree to access Maybank website at www.maybank.com.my to view the terms and conditions and are deemed to have agreed with any changes or variations to the terms and conditions herein and seek clarification from Maybank should any of the terms and conditions be not fully understood; and g) shall not be entitled to claim for any compensation against Maybank for any and all losses and/or damages directly or indirectly suffered or incurred by his/ her participation in the Campaign including but not limited to any inconveniences, injuries or accidents suffered by the Winner and Nominated Passenger during the trip to and from New York City, New York, United States of America. 9. Maybank Privacy Notice 9.1 By participating in this Campaign, Principal Cardmembers agree and consent to allow his/her personal data being collected, processed and used by Maybank in accordance with Maybank Privacy Notice, which may be viewed on www.maybank.com.my ( Maybank s Privacy Notice ). 9.2 In addition and without prejudice to the terms in the Maybank s Privacy Notice, Principal Cardmembers agree and consent to his/ her personal data or information being collected, processed and used by Maybank for: a) the purposes of the Campaign; and b) marketing and promotional activities conducted in such manner as Maybank see fit in any media including but not limited to any form of advertising or publicity media and materials such as audio and/or visual recordings published through newspapers, television networks, radio stations or online and digital media and on the Internet, without further express consent from the Winner and Nominated Passenger. Marketing and promotion activities include without limitation the use and/or publication of any details provided in and/or in connection to the entries, interviews material as well responses and related photographs. In this regard, Winner agrees to co-operate and participate without further express consent and/or payment or consideration, in all reasonable advertising and publicity activities of Maybank in relation to the Campaign. 10. Maybank reserves the right to: 10.1 disqualify any non-eligible Principal Cardmembers at its sole discretion from participating in the Campaign; including but not limited to Principal Cardmembers with payment due for thirty (30) days or more, whose accounts are suspected to have been operated fraudulently and/ or closed by Maybank; 10.2 forfeit the Grand Prize in the event there is reversal of qualified retail spend or termination of Maybank Card account(s) during the Campaign Period or noncompliance with the terms and conditions herein; and/or 7

10.3 withdraw/cancel, suspend, extend or terminate the Campaign earlier in whole or in part, and/or to vary, supplement, add, delete, modify or amend the terms and conditions herein, wholly or in part at its sole discretion, by way of posting on www.maybank.com.my, or in other methods which Maybank deems practical, by giving twenty one (21) days prior notice to Principal Cardmembers on such variation, supplemental, deletion, modification or amendment, as the case may be, to these terms and conditions. 11. Maybank shall not be liable and responsible for: 11.1 any failure or delay in transmission of sales transactions by Visa International Incorporated, MasterCard Worldwide, American Express, merchant establishments or any party which may result in the Principal Cardmembers being omitted from the Campaign; or 11.2 any default of its obligation under the Campaign due to any force majeure event which include but not limited to act of God, war, riot, lockout, industrial action, fire, flood, drought, storm, or any event beyond the reasonable control of Maybank. 11.3 The terms and conditions herein shall be governed by and construed in accordance with the laws of Malaysia and the Principal Cardmembers agree to submit to the exclusive jurisdiction of the Courts of Malaysia. 11.4 In addition to the terms stipulated above, Cardmembers agree that the general terms and conditions in the Cardmembers Agreement shall be read together with these terms and conditions as an entire agreement.
