PRODUCT DISCLOSURE SHEET (PDS) Read this Product Disclosure Sheet (PDS) before you decide to take up the Bank Guarantee-i (BG-i). Be sure to also read the terms and conditions of the product and seek clarification from your institution if you do not understand any part of this document or the general terms BANK MUAMALAT MALAYSIA BERHAD Bank Guarantee-i (BG-i) Date: [To be filled in by Business Unit Personnel] 1. What is this product about? It is a Bank Guarantee (BG-i) facility on behalf of the customer to contract awarder/third parties. Kafalah is a contract made between the Bank and the customer which the Bank agreed to discharge the liability of a third party in the case of default by customer. This product is package with a Shariah-compliant term financing in case of any default. 2. What is the Shariah concept applicable? It is based on Shariah concept Kafalah. Kafalah refers to a contract where the guarantor conjoins the guaranteed party in assuming the latter s specified liability. Under this concept, the Bank as guarantor shall issue a BG-i to the contract awarder/third party on behalf of the company/firm which signifies a guarantee for the implementation of specified project/contract. 3. What do I get from this product? A guarantee on specified liability required by contract awarder/third party in fulfilling the contract. Specific Kafalah to meet your requirements as follows: Supplier Bond Performance Bond Advance Payment Guarantee Tender Bond Other Guarantee Illustration: Guarantee value: RM5,000.00 BG Fees: 1.8% p.a. on the value of the Guarantee Letter. Guarantee Period: 12/18/24/36 months (Depends on Contract amount and tenure including claim period defect liability period as specified in Letter of Award) from issuance date or contract period whichever earlier. Note: The above example is only for illustration. The illustration may not show the specific circumstances or obligations of each BG-i. 4. What are my obligations? By depositing a sum of monies to the bank as a security for the required issuance of Bank Guarantee-i, Customer/Applicant has to fulfill the contract awarder/third party s requirement as specified in the contract/agreement. In the event of non fulfillment of contract / agreement, the bank has a right to liquidate the security deposited by the Customer/Applicant upon claimant by the contract awarder / beneficiary. Illustration: Payment to the bank can be in the form of cheque by mail, cheque / cash deposit at Branch or by interbank GIRO from any participating bank branch or online banking. Note: The above example is only for illustration. The illustration may not show the specific circumstances or obligations of each BG-i. 5. What are the fees and charges I have to pay? a) Stamp Duties As per the Stamp Duty Act 1949 (Revised 1989) b) Legal Fee / Company searches:

As charged by lawyer (if applicable) c) Takaful/Insurance coverage Takaful/Insurance coverage is mandatory if the asset is given as security for the financing. (if applicable) d) Fees and Charges/Commission Please request from your Trade Sales representative for the Bank s Standard Charges on Trade Financing products. If there are any changes in fees and charges that are applicable to your financing facility, the Bank will notify you at least 21 calendar days prior to the effective date of implementation. 6. What if I fail to fulfill my obligations? We will liquidate your Kafalah as claimed by the contract awarder/third party and you must compensate the Bank equivalent to the amount paid within 10 working days. If your account remains unpaid, it shall be classified as Non-Performing Financing (NPF). This will affect your further utilization of other banking facilities with the Bank. Legal action will be taken if you fail to respond to reminder notices. The security may be enforced and you will have to bear all costs. You are also responsible to settle any shortfall after the security is enforced. Legal action against you may affect your credit rating leading to credit being more difficult or expensive to you. 7. Do I need a guarantor / collateral? We will evaluate this requirement and advise you on this before we offer the BG-i facility. 8. What do I need to do if there are changes to my contact details? It is important that you inform us on any changes in your contact information to ensure that all correspondences reach you in a timely manner. Changes in your business/company s contact details should be formally submitted in writing and duly authorized by the company s authorized signatories. 9. Where can I get assistance and redress? Merupakan akujanji/jaminan pihak Bank terhadap pihak ketiga yang di buat berdasarkan undang-undang. Akujanji/Jaminan ini menjamin pembayaran sejumlah wang yang telah di tetapkan kepada pihak ketiga seandainya berlaku kegagalan pihak yang dijamin menjelaskan hutangnya atau tidak melakukan sesuatu obligasi undang-undang sebagaimana yang dipersetujui. 2. Apakah Konsep Syariah yang diguna pakai? Konsep Syariah yang diguna pakai ialah Kafalah. Kafalah merupakan kontrak yang mana penjamin menanggung liabiliti tertentu pihak yang dijamin. Di bawah konsep ini, Bank sebagai penjamin hendaklah mengeluarkan JB-i untuk kontrak pihak ketiga bagi pihak syarikat/firma yang melambangkan jaminan bagi pelaksanaan projek/kontrak yang dinyatakan. 3. Apa yang saya dapat daripada produk ini? Satu jaminan liabiliti yang dinyatakan diperlukan oleh kontrak pihak ketiga/awarder dalam memenuhi keperluan kontrak. Kafalah khusus untuk memenuhi keperluan anda seperti berikut: Bon Pembekal Bon Pelaksanaan Jaminan Pembayaran Pendahuluan Bon Tender Lain-lain Jaminan Ilustrasi: Nilai Jaminan: RM5,000.00 Yuran JB : 1.8% p.a. pada nilai Surat Jaminan Tempoh Jaminan: 12/18/24/36 bulan (Bergantung kepada jumlah dan tempoh Kontrak termasuk tempoh liabiliti tuntutan kecacatan tempoh sebagaimana yang dinyatakan dalam Surat Anugerah) dari tarikh pengeluaran atau tempoh kontrak yang mana terdahulu. Nota: Contoh di atas hanya untuk ilustrasi. Ilustrasi mungkin tidak menunjukkan keadaan tertentu atau obligasi setiap JB-i. 4. Apakah tanggungjawab saya? Dengan mendepositkan sejumlah wang sebagai jaminan bagi penerbitan Jaminan Bank, Pelanggan / Pemohon mesti memenuhi syarat dan keperluan kontrak / pihak ketiga seperti yang dinyatakan dalam kontrak / perjanjian oleh pihak pemberi kontrak. Dalam keadaan kegagalan memenuhi keperluan kontrak / perjanjian, pihak bank mempunyai hak untuk mencairkan deposit Pelanggan / Pemohon bagi tujuan tuntutan oleh pihak pemberi kontrak. Ilustrasi: Pembayaran kepada pihak bank boleh dibuat dalam bentuk cek melalui pos, cek / deposit tunai di Cawangan atau melalui GIRO antara bank dari mana-mana cawangan bank yang mengambil bahagian atau perbankan dalam talian. Nota: Contoh di atas adalah hanya untuk ilustrasi. Ilustrasi tidak boleh menunjukkan hal keadaan tertentu atau kewajiban masing-masing JB-i 5. Apakah yuran dan caj yang saya perlu bayar? a) Duti Setem Seperti yang termaktub di Akta Setem 1949 (Disemak 1989)

b) Kos Guaman / Syarikat mencari: Sebagaimana yang dituduh oleh peguam (jika berkenaan) c) Perlindungan Takaful / Insurans Perlindungan Takaful / Insurans adalah wajib sekiranya aset tersebut diberikan sebagai jaminan untuk pembiayaan (jika berkenaan) d) Yuran dan Caj / Komisen Sila berurusan dengan Pengurus Perhubungan anda untuk mendapatkan bayaran standard Bank untuk produk dan perkhidmatan pembiayaan perdagangan. Pihak Bank akan memberitahu pelanggan sekurang-kurangnya 21 hari sebelum tarikh perlaksanaan sekiranya terdapat sebarang perubahahan pada yuran dan caj yang berkaitan dengan pembiayaan pelanggan. 6. Bagaimanakah jika saya gagal untuk memenuhi tanggungjawab saya? Kami akan mencairkan Kafalah anda seperti yang didakwa oleh kontrak pihak ketiga/awarder dan anda mesti membayar ganti rugi bersamaan dengan amaun Bank yang dibayar dalam tempoh 10 hari bekerja. Jika akaun anda masih belum dibayar, ia hendaklah diklasifikasikan sebagai Pembiayaan Tidak Berbayar (NPF). Ini akan memberi kesan kepada penggunaan kemudahan perbankan dengan Bank. Tindakan undang-undang akan diambil sekiranya anda gagal untuk bertindak balas terhadap notis peringatan. Keselamatan boleh dikuatkuasakan dan anda akan menanggung semua kos. Anda juga bertanggungjawab untuk menyelesaikan sebarang kekurangan selepas jaminan itu dikuatkuasakan. Tindakan undang-undang terhadap anda boleh memberi kesan kepada pengurangan kredit anda yang membawa kepada kredit yang lebih sukar atau mahal untuk anda. 7. Adakah saya memerlukan penjamin/cagaran? Kami akan menilai keperluan dan menasihati anda tentang ini sebelum kami menawarkan kemudahan JB. 8. Apa yang perlu saya lakukan jika terdapat perubahan dalam butiran peribadi saya? Adalah penting untuk anda memaklumkan kepada Bank mengenai sebarang pertukaran maklumat untuk menghubungi anda bagi memastikan anda menerima semua surat-menyurat tepat pada masanya. Perubahan dalam butiran hubungan perniagaan/syarikat anda harus secara rasmi dikemukakan secara bertulis dan yang diberi kuasa oleh penandatangan yang diberi kuasa syarikat. 9.
