( EA USA ) is the provider of the services listed below ( the Services ), which are part of the GEICO PORTFOLIO ID Protection Program IDP ("IDP"). These IDP Terms and Conditions ( Agreement ) set forth the terms and conditions applicable to your use of the IDP Program as a Member. These terms and conditions are a legally binding contract between you and EA USA. By enrolling in the IDP Program and/or by using any of the IDP Services (a) you as the Primary Member and each participating Member in your family agree to this Agreement on behalf of yourself and all other Members and (b) all other Members agree to this Agreement. Any Member who does not agree to these terms and conditions is not authorized to use the Services. By enrolling in the IDP Program and/or by using any of the IDP Services (a) you as the Primary Member on behalf of yourself and all other Members, and (b) each Member using any of the IDP Services declare under penalty of perjury that the information provided to IDP is true and correct to the best of your or such Member s knowledge and belief. A Definitions: A Primary Member means an individual person who has purchased IDP and is duly enrolled in compliance with the terms of enrollment. A Primary Member must be at least 18 years of age to purchase IDP and a citizen or legal resident of the United States of America. A Member means a Primary Member, a spouse/domestic partner and any Dependent Children who are in compliance with the terms of enrollment in IDP. A Member must be a citizen or a legal resident of the United States of America. Dependent children means unmarried children from the moment of birth, including natural children, stepchildren and adopted children primarily dependent upon the Primary Member for maintenance and support, and who are under age 19 or under age 25 if enrolled as a full-time student or unmarried children regardless of age who are incapable of self-support because of a mental or physical disability. A Single Program includes proactive 3-bureau Credit Monitoring, credit reports and TransUnion credit score, Identity Monitoring enrollment, one license for Online Data Protection (installation on up to 3 computers) along with full prevention, detection and resolution services for the Primary Member. A Couple Program includes proactive 3-bureau Credit Monitoring, credit reports and TransUnion credit score for two adults Primary Member and spouse/domestic partner. It also includes two adult Identity Monitoring enrollments, one license for Online Data Protection (installation on up to 3 computers) and full prevention, detection and resolution services for two adults. A Family Program includes proactive 3-bureau Credit Monitoring, credit reports and TransUnion credit score for two adults Primary Member and spouse/domestic partner. It also includes two adult Identity Monitoring
enrollments, up to 4 additional Identity Monitoring enrollments for dependents/children, one license for Online Data Protection (installation on up to 3 computers) and full prevention, detection and resolution services for the entire family (two adults plus dependents). Effective Date means the date after sale. Purchase Date means the date when the Primary Member purchases the IDP Program. Renewal Date means each annual anniversary of the Effective Date. B Prevention and Detection Services Members have access to the following services upon IDP enrollment: 24-Hour Access: Members will have toll-free access to the multilingual EA USA Coordination Center in Bethesda, Maryland, 24 hours a day, 365 days a year. 3-Bureau Credit Monitoring: The Primary Member will have access to 3 Bureau Credit Monitoring with alerts throughout the term of the program in addition to TransUnion unlimited credit report. It also provides one-time access to credit reports from the three Credit Bureaus upon initial Primary Member sign up. This Service shall be available to the Primary Member only under the Single Program and the Primary Member and one additional Member under the Couple and Family Programs. Education: Educate the Member on how Identity Theft occurs and advice on protective measures to take to avoid further occurrences. Information Kit: Offer to send by postal or email an ID Theft Protection Kit that explains the many facets of the crime and provides prevention advice and resolution forms. Opt-out Services: Assist the Member in opting out of pre-approved credit card offers, direct mailing campaigns, and marketing phone calls through www.optoutprescreen.com. Identity Monitoring: Access to Identity Monitoring Identity Monitoring for one year to include: Internet Surveillance with Compromised Credential Monitoring which monitors the underground economy to uncover Members exposed sensitive information. Internet Surveillance scours compromised machines, networks and web services to determine if Member s personal identifying information (i.e. name, address or Social Security number, a medical insurance card or an email address) appears and alerts the Member. The data that is monitored includes: Social Security numbers (if available), names, addresses, emails and date of birth, wallet items (i.e. credit cards, medical insurance card), login credentials including emails and passwords. Data is monitored in the following areas: Malicious Command & Control Networks, Black Market Forums, Known Compromised Machines & Servers, Phishing Networks and Exploited Websites. Identity Monitoring is provided by InfoArmor, Inc.. Online Data Protection Suite Services EA USA shall provide users with software to be installed on a PC or on a laptop and that is designed to protect activities conducted on the internet ( Online Data Protection Suite ). The Online Data Protection Suite only operates on the Windows operating system. If you have a Windows partition on your Mac, you can use the software, but it is not supported under OS X operating systems.
The Online Data Protection Suite: EA USA s Online Data Protection Suite is provided by SentryBay Limited and includes the DataScrambler and PhishBlock software. DataScrambler: DataScrambler software protects against Trojans and Spyware that attempt to steal confidential information by capturing keystrokes or mouse-clicks. The DataScrambler is inserted into a user s browser and shows the actual keystrokes being replaced by fake keystrokes, providing a visual display of how user information is being continuously protected. PhishBlock: PhishBlock software provides protection against fraudsters targeting users personal information via fake websites. PhishBlock detects phishing sites the very first time they are loaded by a user and overlays a warning page to inform the user. InfoArmor, Inc. and SentryBay Limited are independent third-party providers of their respective services and are not affiliated with EA USA. C Identity Theft Resolution Services: Upon notification of an identity theft of a Member and receipt of a duly completed and executed authorization form from the Member, EA USA treats each Identify Theft as an emergency and will perform for the Member any or all of the following steps necessary to attempt to undo or prevent further damage: 24-Hour Access: Members will have toll free access to the multilingual EA USA Coordination Center in Bethesda, Maryland, 24 hours a day, 365 days a year. Credit Report Review: Obtain all pertinent credit information and history in Real Time with the Member including review of the Member s credit report in Real Time to determine if a fraud or theft has occurred. For the purpose of the IDP program, the term Real Time shall mean in current time. ID Theft Affidavit Assistance: Provide the Member with an ID Theft Affidavit ( Affidavit ), answer any questions with regard to completing the Affidavit and submit the Affidavit to the proper authorities, credit bureaus, and creditors on the Member s behalf. Credit and Charge Card Replacement Assistance. Contacting Creditors: Obtain from the Member a list of creditors to be notified and contact them with separate itemized fraudulent account statements for each fraudulent occurrence. Inform Police/Legal Authorities: Assist the Member in reporting the fraudulent activity to the local authorities and forward a report of the fraudulent activity to the Member s creditors. Fraud Department Notification: Assist the Member in notifying the fraud department of the Member s creditors. Three- Credit Bureau Notification: Notify all three major credit-reporting agencies to obtain a free credit report for the Member, place an alert on the Member's records with the agencies and obtain a list of additional creditors from them. Credit Freeze: Place a security freeze on the Member s credit records in states where such laws apply, at the request of the Member. In some states the payment of a fee is required in order to place the Credit Freeze. The Member is responsible for such fee. Submit Forms to Creditors: Submit the Affidavit to the Member s creditors requesting cancellation of card(s) and an issuance of a new one(s).
Medical Identity Theft Resolution: This assistance includes help with fraudulent medical claims placed in the Member s name and medical care that was received fraudulently by another individual in the Member s name. Replacement of Identification: Assist the Member in notifying the appropriate banks or agencies to replace stolen or missing items such as ATM cards, driver's license, Social Security Card or passport. ID Theft Protective Measures Assistance: Help with filing or submitting paperwork for special ID Theft Protective measures specific to the Member s state of residence. Translation Services: Translate when necessary such as when the Member is overseas and needs help communicating with the local police in order to file a report of an Identity Theft incident. Emergency Cash Advance: Provide emergency cash advance (up to $500 USD) when theft occurs 100 miles or more away from the primary place of residence. Such cash advance shall be secured by the Member using a valid credit card. Any advance made to the Member, not otherwise secured by a valid credit card and paid to EA USA by the credit card company within 30 days of such advance must be reimbursed by the Member to EA USA within 30 days from the date such advance is made. Thereafter, any amount due to EA USA will accrue interest at a rate of 1.5% per month. Notwithstanding anything to the contrary herein, EA USA shall be under no obligation to advance funds not otherwise secured by a valid credit card. Emergency Travel Arrangements/Journey Continuation: In the event of an identity theft incident that occurs while a Covered Member is traveling, EA USA shall help the Covered Member make emergency travel arrangements, including airline, hotel, and car rental reservations. The Subscriber or Covered Member is responsible for payment of all tickets, accommodations and rentals arranged. Before the provision of this service, EA USA shall obtain a Satisfactory Guarantee of Reimbursement from the Covered Member. A Satisfactory Guarantee of Reimbursement means the ability to debit or credit a Covered Member s valid credit card in the amount required. Creditor Follow-Up: When needed, follow up with creditors to ensure that the matter has been properly handled. Status Update: On a weekly basis, until the file is closed, contact the Member with an updated status report. D Fee: The Primary Member may select between monthly or annual payment of the program fee(s). The annual fee is due in full at the time of purchase. The monthly fee is due every month. Non-payment of the applicable fee will result in termination of Services effective on the date the payment was due. As a service to its Members, EA USA employs technology that automatically recognizes payment card updates and allows EA USA to execute payment on the updated card on file in the Primary Member s account.
E Cancellation Policy: IDP may be cancelled by the Primary Member at any time provided that the Primary Member or any Member (If enrolled in a Couple Program) has not enrolled in 3-Bureau Credit Monitoring and provided that the Member has not used any of the Services. Cancellation is effective 48 hours after the request from the Primary Member. Refunds of any payments made, by the Primary Member to IDP are subject to IDP s Refund Policy as outlined below. To cancel your IDP Program, please contact EA USA by phone, fax or e-mail at the numbers provided in the IDP website. F Refund Policy: If the Primary Member has selected annual payment, the annual fee may be refunded only within the first ten (10) days from the Purchase Date provided that the Primary Member or any Member (if enrolled in a Couple Program) has not enrolled in 3-Bureau Credit Monitoring and provided that the Primary Member or any Member (if enrolled in a Couple Program) has not used any of the Services. Refunds will be made to the same form of payment originally provided by the Primary Member at the time of enrollment. If the Primary Member has selected monthly payment, no refunds will be issued. Cancellation will stop monthly billing and Members will cease to receive Services starting on the cancellation date. Cancellation is effective 48 hours after the request from the Primary Member. If the Primary Member cancels the IDP Program after ten (10) business days from the Purchase Date, he or she is not entitled to any refund of payments made to the IDP Program. If the Primary Member notifies EA USA of his or her intention not to renew membership at any time prior to the Renewal Date, the program will not be renewed and no additional fee will be incurred. G Term: The program is effective on the day after sale and is active for one year provided that the Primary Member has paid the total amount of the applicable annual or monthly fee ( Initial Term ). Thereafter, the program renews automatically for additional one (1) year terms unless the Primary Member gives notice of his or her intention not to renew at any time before the Renewal Date ( Renewal Term ). The Primary Member must pay the total amount of the applicable annual or monthly fee, depending on which payment option the Primary Member has chosen, for each additional term. Please see Refund Policy above.
H Renewal Term: After the Initial Term, the program renews automatically for additional one (1) year terms unless the Primary Member gives notice of his or her intention not to renew before the Renewal Date. The Primary Member must pay the total amount of the applicable annual or monthly fee each additional year. Please see Refund Policy above. EA USA will send a renewal notice to the Primary Member two weeks prior to the Renewal Date to inform him or her that the IDP membership will automatically renew for the same annual or monthly fee in the same form of payment that was originally provided unless the Primary member provides notice of intent not to renew prior to the Renewal Date. I Limit of Liability: By enrolling in the IDP program and/or by using any of the Services, you, as Primary Member, and each Member agree that the total and exclusive liability of EA USA and its employees, officers, directors, attorneys, agents, assigns and third-party contractors (the EA USA Parties ) to any Member for any claims, demands or damages relating to or arising out of IDP, the provision of Services or any failure to provide Services, shall be limited to the refund of the amount paid to EA USA by the Member for the annual fee set forth in Section D, above, during the term of enrollment of the Member ( Limit of Damages ). You, as Primary Member, and each Member agree to indemnify and hold the EA USA Parties harmless for all damages, costs and expenses, including reasonable attorneys fees and costs, incurred by EA USA in or relating to any legal proceeding brought by or on behalf of any Member for any claim, demand or damages in excess of the Limit of Damages. Notwithstanding any other provision of this Agreement, in no event shall EA USA be liable to you or any Member for any exemplary or punitive damages, any remote or consequential damages or any damages not arising directly and proximately from the provision of Services, regardless or whether or not such damages were reasonably foreseeable by EA USA at the time of the provision of Services or the Member s enrollment in the IDP program. J Limitations and Exclusions: Identity theft(s) discovered by Members prior to enrollment in the Program are not eligible for service. Member acknowledges and agrees that EA USA is neither an insurer nor provider of insurance and that nothing in IDP is intended to provide a policy of insurance to any Member. EA USA does not guarantee that its intervention on behalf of the Member duly enrolled in IDP will result in a particular outcome or that its efforts on behalf of the Member will lead to a result satisfactory to the Member. EA USA Services do not include, and EA USA shall not assist the Member for, thefts involving non-us bank accounts. EA USA provides the Services in all countries of the World. However, EA USA may determine that Services cannot be provided in certain countries or locales because of situations such as war, natural disaster or political instability. EA USA will attempt to assist a Member consistent with the limitations presented by the prevailing situation in the area.
EA USA shall not be responsible for failure to provide, or for delay in providing Services when such failure or delay is caused by conditions beyond its control, including but not limited to labor disturbance and strike, rebellion, riot, civil commotion, war or uprising, nuclear accidents, natural disasters, acts of God or where rendering Services is prohibited by local law or regulations. The Online Data Protection Suite software is designed to protect the Member online, but like all products designed to combat malicious software, EA USA cannot guarantee that the software will be 100% effective. Neither EA USA nor the licensor nor the supplier that a Member purchased such software from guarantee that the software will be free of all errors or bugs, or free from interruption or failure. Member users should not consider the software as the sole means of protecting themselves from identity theft and they should take other prudent measures to reduce risk such as the use of up-to-date anti-virus software, safekeeping of passwords, careful use of payment cards and the shredding of important documents. Member users acknowledge and agree that, while the supplier of the software may guarantee that the software is of satisfactory quality and is reasonably fit for the purpose for which it is supplied, each Member is responsible to verify that the software selected is suitable for their purposes in the context of their overall approach to the risk of identity theft. Neither EA USA nor the licensor nor the supplier are responsible for any problems arising from or relating to the unsuitability of the software for the Member user s purposes unless that is due to the supplier s misrepresentation or misdescription or some other breach of duty on the part of the licensor or the supplier or on the part of EA USA. K Governing Law and Jurisdiction: This Agreement shall be deemed to be made in the State of Maryland and shall in all respects be interpreted, construed and governed by and in accordance with its laws without application of conflicts of law provisions. For any disputes arising out of this Agreement, the parties irrevocably submit to the jurisdiction of the local and federal courts located in the State of Maryland, which shall serve as the exclusive forum for the purposes of any suit, action or other proceeding, except for a suit by EA USA seeking injunctive relief, which EA USA may pursue in any appropriate forum.
