Red Bull Foxhunt 2016 Terms & Conditions (Qualifier time-trials and Main Event) (Together the Event ) The qualifier time-trials and main event race are to be run by Red Bull Company Limited whose registered address is 155 171 Tooley Street, London, SE1 2JP ("Red Bull"). The qualifier time-trials, the main event and all use of Red Bull s website www.redbull.co.uk (the Website ), is governed by these Terms & Conditions. By entering the Event, you agree to these terms and conditions. 1 How to Enter 1.1 You must enter via www.redbull.co.uk/foxhunt by clicking through to ticketweb and purchasing your competitor ticket entering all the requested details and submitting your application. 1.2 The competition is open to anyone aged 16 or over. Anyone under the age of 18 must have written consent from a parent or guardian, which must be shown at on registration on site at the Event 1.3 The Event shall be open for entry from 9:00 am 18 th August 2016 until Friday 30 th September 2016 midnight or until all of the spaces have been filled. 1.4 An entry fee of 40.00 is compulsory in order to enter the Event. 1.5 This is a mountain bike race, thus all competitors must compete on a mountain bike suitable for the terrain, motorised bikes or components will not be permitted to take part. 1.6 There are 200 places available for the Event. Red Bull reserves the right to alter the number of places at any time. 1.7 This is a female only race. 2 The Qualifiers and Main Event Race: the process 2.1 All registered riders who complete the time-trial qualifiers will be taken to the Main Event race. The purpose of setting a qualifying time is determine your position on the start line for the Main Event. 2.2 The Event will take place from 09:00am 05:00pm on Saturday 1st and Sunday 2 nd October 2016. You must be available to compete on these dates. Red Bull reserves the right to alter the times of qualifiers and the Main Event race at any time. 2.3 You will be responsible for the cost of all travel and accommodation associated with your trip to the Event unless you choose to camp on site, which is included in your competition fee, which allows you up to 2 nights stay on site with your own camping gear and equipment. The only food provided by Red Bull will be two meals for each competitor on each of the race days. 2.4 Camping is available from the Friday night through to Sunday. 2.5 All participants must sign a Red Bull s standard form disclaimer prior to racing. If participants are under 18, a parent or guardian will need to sign on their behalf. All participants must wear a helmet.
3 Prizes 3.1 The winner of the Event will win: a bespoke Red Fox Hunt Trophy. 3.2 All participants that make it to the Main Event will receive a goody bag. 3.3 The Prizes are as stated and they cannot be sold or exchanged for cash, goods or services. Unless specifically agreed in writing by Red Bull, the Prizes are not transferable and must be taken by the winner in person. 3.4 Any Prizes that are mistakenly credited to you remain Red Bull s property, which you must return. 4 Data Protection and Publicity 4.1 In the following, the term Personal Data describes all data kept in connection with your name. 4.2 Red Bull may process your Personal Data itself, within the Red Bull Group or through outside data processors who will process data on its behalf in accordance with all relevant data protection regulations. 4.3 Red Bull and its affiliated companies will, as a general policy, not transmit Personal Data to third parties without your explicit consent. In particular, Personal Data will not be sold, leased or traded. However, in cases in which Red Bull is required to transmit Personal Data to an outside data processor in connection with the Event, Red Bull will only transmit as much Personal Data as is necessary in order to fulfil its tasks set out under these Terms & Conditions. In such cases, Red Bull will require and make sure that our partners treat all Personal Data in a confidential manner and according to all relevant data protection regulations as well as to delete such Personal Data immediately as soon as their specific tasks have been fulfilled in connection with the Event. Please note that Red Bull does not have complete control over the compliance with this obligation and that Red Bull cannot be held responsible for possible infringements by its partners to the extent that it is legally permissible. 4.4 Since Red Bull operates globally, this may mean Red Bull could transfer your personal information to other countries, including countries outside the European Economic Area in accordance with all relevant data protection regulations. 4.5 Personal Data will only be used for purposes in connection with this Event and will only be retained by Red Bull, its affiliated companies and its mandated data processors for as long as is necessary to fulfil the original or directly related purpose for which it was collected in connection with the Event. This might include a period of time after the conclusion of the Event in order to distribute prizes or to fulfil tax related or any other legal queries. 4.6 Provided you give us prior permission, Red Bull its affiliated companies and partners and/or third parties may contact you, to provide you with newsletters and other communications regarding Content, Services, offers, promotions and events via email or text message that may be of interest to you. These messages will be sent to you based on your messaging preferences. To revoke consent for third party communications, please follow the unsubscribe mechanism made available by the third party. 4.8 Red Bull, its affiliated companies and its mandated data processors shall process your Personal Data securely and take appropriate security measures to protect the Personal Data. 4.9 Red Bull does not knowingly collect information from persons below the age of 14. 4.10 Winners may be requested to take part in promotional activity and Red Bull reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity. Winners may be required to take part in further reasonable promotional activities. 4.11 The entered Personal Data shall always be accurate. You should keep your data up to date in order for Red Bull to notify you in case they you won a prize. Red Bull will ensure that your personal data is not used if we know that it is not accurate. 4.12 Red Bull and its contractors may contact you via email, phone or otherwise in relation to the Event. 4.13 At any time, you have the opportunity to require the amendment and/or the deletion, entirely or partly, of such Personal Data. In such a case, Red Bull will ensure the deletion of such data as soon as feasible. 4.14 At any time, you also have the right to request information about the Personal Data we are keeping. 4.15 You can contact Red Bull with regard to privacy questions as follows: privacy@uk.redbull.com 5 Event Rules 5.1 The qualifier and Main Event race will be run at Red Bull s sole discretion. You must comply with the Event rules, as communicated by Red Bull or its Event partners from time to time. 5.2 We reserve the right to suspend or terminate your access to the Website and services, and to refuse entry into the Event. Red Bull s decision is final and no correspondence will be entered into. 5.3 We reserve the right to change the Event rules and these Terms and Conditions from time to time. If we do so, we will always have the most up to date terms and conditions on the Website and in the case of a discrepancy between these terms and conditions and those on the Website, the Website terms and conditions will apply. Your continued use of the Website will constitute your acceptance of the new rules and/or Terms and Conditions. 5.4 All intellectual property rights in the images and materials on the Website, and used in the services provided by Red Bull vest in Red Bull and no person may make any use of them without Red Bull s express permission. 6 Grant Of Rights 6.1 The entrant hereby assigns and grants to Red Bull including its parents, subsidiaries, affiliates and partners any and all rights, title and interest in and to all entries and materials submitted to Red Bull in connection with any
Event, including your voice, image, photograph, statements, biographical information, performances, name and likeness and including any user generated content (collectively, "Entry Materials") under current and future law to the broadest extent possible according to applicable law. To the extent that rights are not assignable, the entrant hereby grants to Red Bull the irrevocable, worldwide, perpetual, exclusive, transferable and unlimited rights (unlimited in terms of territory, time or purpose) to copy, distribute, transmit, publish, perform, display, make derivative works from, exploit, and otherwise use the Entry Materials in any known or yet unknown kind of use. This includes in particular but is without any payment or notice to the entrant. If a court or any other authority finds that the exclusive grant above is not fully effective for any reason, the Entrant hereby grants to Red Bull the irrevocable, worldwide, perpetual, non-exclusive, transferable and unlimited rights (unlimited in terms of territory, time or purpose) to copy, distribute, transmit, publish, perform, display, make derivative works from, exploit, and otherwise use the Entry Materials in any known or yet unknown kind of use without any payment or notice to the entrant. Entrant waives any and all moral rights (sometimes referred to as droit moral or similar terms) in the Entry Materials in favor of Red Bull. The conveyances and licenses in this section include in particular but are not limited to the following rights: the broadcasting right, the right of making available to the public (download/ondemand-rights), the film theatre right (cinematic/exhibition right), the video rights, the right of distribution and copying, the right of alteration and dubbing, the right of promotion, the merchandising right, the publishing right and the stage drama, radio drama and audio/talking book rights. Furthermore, Red Bull acquires the right to make any alterations, intermissions, deletions, cuts or other modifications in and to the Entry Materials and the exclusive right to exploit such altered version in any matter. Red Bull and its parents, subsidiaries, affiliates and partners shall be enabled to exploit the Entry Materials without any limitations and regardless of the medium via which the exploitation takes place. Red Bull is however not obliged to make use of these rights. 6.2 Red Bull is further irrevocably entitled to assign the rights entirely or in part to any third parties and to grant any sublicenses respectively rights of exploitation and/or exploitation permissions or to exercise the rights in its own name or through third parties. 6.3 The sole consideration for this comprehensive assignment and grant of rights shall be to get the chance to win a prize in the Event. 7 Cancellation Policy 7.1 Red Bull reserves the right to make alterations to the Event which are not material in nature and no refunds will be available in respect of non-material alterations. A material change is a change to an Event which in the reasonable opinion of Red Bull, makes the Event materially different to the Event which entrants could reasonably expect. Changes to start times will not be a material change. A material change is judged by reference to the nature and billing of each Event. 7.2 It is the responsibility of the entrant to check the Event website for news of any cancellation, postponement or alteration of the Event. Information on such matters will be made available on behalf of Red Bull as soon as reasonably practicable on the Event website. Customers are advised that the website cannot always be updated immediately and that circumstances giving rise to cancellation or alterations can sometimes arise immediately prior to an Event.
7.3 Red Bull reserves the right to make alterations to the Event including, but not limited to times, dates, programmes and places, due to unforeseen circumstances including, without limitation, force majeure, safety and security concerns or decisions from any competent authority. 7.4 Subject to Clause 7.5, once you have purchased an entry place, it cannot be returned, refunded or exchanged. 7.5 Nothing in these Terms and Conditions shall limit your statutory rights. 8 Liability and Indemnities 8.1 Except in the case of death or personal injury arising from its negligence, or in respect of fraud, and so far as is permitted by law, Red Bull and its associated companies and agents and distributors exclude responsibility and all liabilities, whether direct or indirect, arising from: (a) (c) any postponement or cancellation of the Event; and any act or default of any supplier, which are beyond Red Bull s reasonable control. 8.2 Red Bull does not accept responsibility for any liability arising from technical incompatibility, problems relating to the internet, or technical difficulties of any kind. 8.3 Entrants are responsible for the safe storage of their equipment and Red Bull, to the fullest extent permitted by law, excludes liability for loss and/or damage of equipment during the Event. 8.4 Red Bull shall not be liable, whether in tort, contract, misrepresentation or otherwise for loss of profits, loss of anticipated savings, loss of goods, loss of use, loss or corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses. 8.5 You agree to indemnify Red Bull against all liabilities, claims and expenses that may arise from any breach of your agreement with Red Bull. 9 Jurisdiction 9.1 The event and these Terms and Conditions are governed by English Law. England & Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions.
