І. INTRODUCTION The Information and Publicity Guidelines for Operations Financed from OP Environment, 2007 2013 /OPE/ are aligned with the requirements set out in Council Regulation (EC) No. 1083/2006 of 11 July 2006 laying down general provisions on the, the European Social Fund and the and Commission Regulation (EC) No. 1828/2006 setting out rules for the implementation of Council Regulation (EC) No. 1083/2006 and of Regulation (EC) No. 1080/2006 of the European Parliament and of the Council on the European Regional. The above three Regulations set out the minimum transparency and publicity requirements for operations co-financed from the EU Structural and s. This document has been prepared in line with the Communication Plan for Operational Programme Environment, 2007 2013, the Communication Strategy of the National Strategic Reference Framework of the Republic of Bulgaria (NSRF) and the NSRF Visual Identity Handbook. The Guidelines are aimed at helping OPE beneficiaries prepare, implement and report information and publicity measures and at introducing uniform standards for the visualization of the EU assistance from the (ERDF) or the (CF) provided to beneficiaries through OPE. The beneficiaries of OPE grants are responsible for implementation of the information and publicity measures at project level. Failure to comply with the requirements on information and publicity shall be considered an irregularity and may lead to financial correction. As a general rule, where the information and publicity actions undertaken by a beneficiary are assessed as inadequate or noncompliant with major requirements, the IB or MA of OPE will immediately notify the beneficiary thereof and require that corrective actions are urgently taken. Repeated failure to comply or to implement information and publicity measures may lead to suspension of payments. 3

II. AIM AND SCOPE OF THE INFORMATION AND PUBLICITY MEASURES 1. Aim The beneficiary of an OPE grant contract is responsible for informing the general public about the assistance obtained from the Funds under OP Environment 2007 2013. The aim of the information and publicity measures is to: Increase public awareness about operation s co-financing from OPE; Inform the general public about the role played by the European Union in cooperation with the Member States in the assistance and its results; Ensure transparency of the absorption of EU funds and of the implementation of financed operations; Inform about the source of European co-financing reference to the fund ( or /. 2. Scope The information and publicity measures are binding for all beneficiaries and cover all OPEfinanced operations, regardless of the priority axis under which the assistance is provided. The information and publicity measures planned and the financial resources for their implementation shall be proportionate to both the scope and significance of the operation at regional and/or national level and the total budget of the project proposal. Eligible expenditure for implementation of communication activities shall not exceed 5% of the total approved grant for implementation of the whole operation. For big infrastructure operations whose value exceeds EUR 50 m the limit is set at 1% of the total operation budget. The above restrictions do not apply to operations implemented in fulfilment of the Communication Plan of OPE or to operations with promotional, marketing and public relations objectives and activities. General Principles According to Article 8 of Commission Regulation 1828/2006, every beneficiary of CF or ERDF assistance under OP Environment 2007 2013, shall implement certain information and publicity measures aimed at the general public. 4

The beneficiary shall: - Take measures to effectively inform the general public, in cooperation with the Intermediate Body of OPE, on all matters of information and publicity at project level; - Inform IB in advance and consult it on all media activities prior to the launch of the operation and throughout its main implementation phases; - Inform in an appropriate way national and/or local media about the launch of operations co-financed from CF or ERDF within OPE (for example by press releases, press conferences, radio and TV spots, articles and insertions in the most appropriate papers and magazines and through on-the-spot visits); 5

III. TECHNICAL CHARACTERISTICS OF THE INFORMATION AND PUBLICITY MEASURES 1. Description Beneficiaries implementing operations co-financed from the or the under Operational Programme Environment, 2007-2013, shall inform the general public, the target groups and the project actors that - the operation is financed under OP Environment 2007-2013 - the operation is co-financed from ERDF or CF (depending on the co-financing fund) The following requisite elements need to be visualized in fulfilment of this requirement: The emblem of the European Union (EU) according to the graphic standards (included also in Annex I to Regulation (EC) No. 1828/2006); Reference to the EU - European Union ; Reference to ERDF (applicable to projects cofinanced from ERDF). Reference to CF (applicable to projects co-financed from CF). The logo and slogan of OPE Operational Programme Environment, 2007 2013 and Opportunities for Better Life ; The logo of the National Strategic Reference Framework, 2007 2013. In all measures implemented to ensure the information and publicity of their operations, beneficiaries shall comply with the following technical rules: a) The emblem of the EU The emblem of the EU is presented graphically in the form of the EU flag with the words European Union written in full underneath together with the name of the respective fund from which the operation is co-financed and/or Cohesion Fund. Major rules for creation of the emblem and definition of the standard colours: Symbolic Description Against a background of blue sky, twelve golden stars form a circle representing the union of the peoples of Europe. The number of stars is fixed, twelve being the symbol of perfection and unity. 6

Heraldic Description On an azure field a circle of twelve golden mullets, their points not touching. Geometric Description The official emblem of the EU has the form of a bule rectangular flag of which the fly is one-and-a-half times the length of the hoist. The twelve gold stars situated at equal intervals form an invisible circle whose centre is the point of intersection of the diagonals of the rectangle. The radius of the circle is equal to one third of the height of the hoist. Each of the stars has five points which are situated on the circumference of an an invisible circle whose radius is equal to 1/18th of the height of the host. All stars are upright, i.e. with one point vertical and two points in a straight line at right angles to the mast. The cirlce is arranged so that the stars appear in the positions of the hours on the face of a clock. Their number is invariable. Regulation Colours The flag is in the following colors: - PANTONE REFLEX BLUE for the surface of the flag; - PANTONE YELLOW for the stars. Four-Colour Process If the four-colour process is used, the two standard colours shall be recreated by using the four colours of the four-colour process: - PANTONE YELLOW is obtianed by using 100% Process Yellow. - PANTONE REFLEX BLUE is obtained by mixing 100 % Process Cyan and 80 % Process Magenta. 7

Internet In the Internet-palette PANTONE REFLEX BLUE corresponds to colour RGB:0/0/153 (hexadecimal: 000099) and PANTONE YELLOW to colour RGB:255/204/0 (hexadecimal: FFCC00). Monochrome Reproduction Process Using black: outline the rectangle in black and print the stars in black and white. Using blue (Reflex Blue): this colour is used 100 % as background and the stars are reproduced in negative white. Reproduction on a Coloured Background If there is no alternative to a coloured background, put a white border around the rectangle, the width of the border being 1/25th of the height of the rectangle. 8

It shall be at the same level with the national flag. IV. REQUISITE INFORMATION AND PUBLICITY MEASURES a) Billboards The beneficiary shall put up a billboard at the site of the operation fulfilling the following conditions: - the total public contribution to the operation exceeds EUR 500 000; - the operation consists in the financing of infrastructure or of construction operations. The billboard shall necessarily mention the contribution from the European Union and from the state budget and shall include the following textual and visual information: Name of the operation; The emblem of the EU and reference to the European Union, or (depending on the financing fund) this information shall take up at least 25% of the billboard area; The logo and slogan of OPE; The logo of NSRF; Total operation value in BGN; Information about the amount of European and national co-financing in BGN. Operation start and completion dates. Beneficiary s logo/emblem/heads and the amount of beneficiary s co-financing (if any) may be visualized on the billboard. Template of a billboard: 14

The billboard shall be put up in an appropriate place at or near the construction site where it can be easily noticed by the public. It shall be mounted before the official groundbreaking ceremony. The design of the billboard shall be coordinated with the IB of OPE. For big infrastructure operations with value above EUR 50 m it shall be coordinated with MA of OPE. At least one billboard shall be put up as a minimum. For linear operations for which the public contribution exceeds EUR 50 m minimum two billboards shall be put up at different spots. The billboards shall be replaced by permanent explanatory plaques not later than six months after the operation is completed. b) Permanent explanatory plaques Beneficiaries shall put up permanent explanatory plaques that are visible to the general public (agreeing with the size of the building or place) for operations that fulfil the following conditions: - the total public contribution to the operation exceeds EUR 500 000; - the operation consists in the financing of infrastructure or of construction operations. The plaques shall contain the same basic elements as specified above for the billboards but without reference to the operation start and completion dates. The plaques shall be put up within one week after the billboard is removed. The plaque design shall be coordinated with IB of OPE. For large infrastructure operations with value exceeding EUR 50 m it shall be coordinated with MA of OPE. At least one explanatory plaque shall be put up as a minimum. For linear operations for which the public contribution exceeds EUR 50 m minimum two plaques shall be mounted at different spots. c) Information plates For operations with value below EUR 500 000 beneficiaries shall put up information plates at places visible to the general public (agreeing with the size of the building or place). The minimum admissible size of the plate is 70 x 50 cm. The plates shall include the same basic elements as specified above for the billboards. The plates shall be put up within one month after the OPE grant contract is concluded. d) Publicity events The beneficiary shall organize minimum two publicity events for operations whose total public contribution exceeds EUR 100 000. Appropriate formats include press conferences and/or information days to promote the operation. The publicity events shall be announced in an appropriate way in advance by disseminating press releases to the mass media and/or by publishing a promotional and information block in a regional or national printed media. The selection of media s scope (regional or national coverage) 15

depends on operation s specifics and its significance local or national. Preliminary information on the event shall be published also in beneficiary s Internet site. Posters and/or an information banner (transparency), providing information about the name of the operation, the total budget, the amount of EU contribution from the respective fund and the co-financing from the national budget, shall be put up in appropriate places in the hall. The opportunity to fly the flags of the European Union and the Republic of Bulgaria in the hall should be used. For operations whose value exceeds EUR 50 m, the beneficiary shall organize one publicity event per year (an information day or a press conference) with the participation of media representatives to present information on operation s progress. A press release containing an overview of operation s progress shall be drawn up and disseminated after the event. The text shall be published in beneficiary s Internet site. The date of the publicity event shall be coordinated with MA of OPE. All documents, publications and publicity and information materials for the event shall fulfil the visualization requirements set out in these Guidelines (e.g. press releases, participation certificates, promotional and information blocks, multimedia presentations, posters, etc.). e) Official ceremonies The beneficiary shall organize official ceremonies for the effective launch of the operation groundbreaking and site opening, for projects fulfilling the following conditions: - the total public contribution for the operation exceeds EUR 500 000; - the operation consists in the financing of infrastructure or of construction operations. The ceremonies shall be prepared and organized in coordination with IB of OPE. For big operations whose value exceeds EUR 50 m, the activities, the program and the list of official guests shall be coordinated with MA of OPE in advance. f) Internet The beneficiary shall publish in an appropriate place in its Internet site detailed information on the operation approved for financing from OPE. The publication shall be released within two days from the date on which the grant contract is signed. The material shall contain, as a minimum, the following information: Name of the operation; Value of the operation; Amount of the European and the national contribution; Purpose of the operation; Major activities and implementation phases of the operation; Expected results (deliverables); Implementation period; Project manager contact information; as well as such other information as the beneficiary may deem appropriate. The publication shall include all requisite elements of the visualization of operations financed from OPE. The Beneficiary shall publish in its Internet site all press releases to the mass media which have been disseminated for the operation. The publication of an Internet banner with a link to the official site of OPE shall be a requisite requirement. The banner visualizing the logo of OPE is downloadable from programme s Internet site at: http://ope.moew.government.bg/. It is recommended that the banner be positioned at an appropriate place in the home page. The banner should be active throughout the whole period of implementation of the operation. g) Printed information materials The beneficiary shall produce printed information materials (leaflets and booklets) for operations whose total public contribution exceeds EUR 100 000. The minimum requirement is to have minimum one type of booklet or leaflet printed in 200 copies and disseminated. The design of the printed information materials shall include all requisite elements of the visualization of operations financed from OPE. An additional requirement is to include also the official site of OPE: http://ope.moew.government.bg/. 17

h) Promotional films The beneficiary shall organize the production of a promotional film for the construction of the project, for operations fulfilling the following requirements: - the total public contribution for the operation exceeds EUR 50 000 000; - the operation consists in the financing of infrastructure or of construction operations. A text explaining that the production has been realized with financial assistance from ERDF or CF financed by OPE shall be visualized and dubbed at the beginning and at the end of the film in the form of a headpiece or in another appropriate form. The visualization shall include the emblem of the EU and reference to the European Union, reference to the fund, the logo and slogan of OPE and the logo of NSRF. The minimum time length of a headpiece shall be 5 seconds. It is recommended that the beneficiary organize broadcasting of the finished production in a regional or national TV programme. The beneficiary may request assistance from MA of OPE for organizing and broadcasting the promotional film. h) Information stickers When purchasing machines and/or equipment which are to be permanently mounted in relation to or as a result of operation s implementation, the beneficiary shall fix a sticker at an appropriate place on the surface of the equipment. The sticker shall visualize the emblem of the EU, reference to the European Union, reference to the co-financing fund, the logo and slogan of OPE and the number of the OPE grant contract. ADDITIONAL MEASURES TO ENSURE TRANSPARENT IMPLEMENTATION OF OPE-FINANCED OPERATIONS The transparent management of EU funds is a major requirement of the European Commission which guarantees to a large extent the public support for the implementation of an operation. In that light, the timely provision of comprehensible information about an operation is crucial to its successful implementation. А) Transparency in organizing open procedures under the Law on Public Procurement (LPP) A key phase in the implementation of any operation is the organization and conducting of a contractor selection procedure. With due regard to the European and national public procurement 18

norms beneficiaries shall fulfil the following minimum requirements on the publicity and transparency of the open procedures under LPP: 1. Publication of the notice in the official printed media of the EU /Official journal/, in accordance with the thresholds laid down in LPP; 2. Publication of the notice in the State Gazette and in the Internet site of the Public Procurement Agency; 3. Publication of the notice in beneficiary s Internet site; 4. Publication of the tender documents in beneficiary s Internet site; 5. For operations whose value exceeds EUR 50 m, the link to the tender documents published in beneficiary s Internet site shall be sent to the MA of OPE for publication in the OPE site at www.ope.moew.government.bg; 5. Publication of information about the date, time and place of opening of submitted proposals in beneficiary s Internet site; 6. Upon expiry of the statutory deadlines, publication in beneficiary s Internet site of information on: the subject of procurement, the number of submitted proposals, the name of the selected contractors, the value of the procurement and the implementation deadline. Where the selected contractor is a consortium of two or more companies, the names of all members of the grouping shall be included. 7. For operations whose value exceeds EUR 50 m, a special ceremony shall be organized for signing of the contract with the selected contractor and media representatives shall be invited. After the event is closed, a press release including information about the subject of the contract, the name of the selected contractor, the price and the implementation deadline of the contract shall be prepared and disseminated. The text shall be published also in beneficiary s Internet site. The event activities shall be coordinated with MA of OPE in advance. 8. Upon completion of the contract by the selected contractor the beneficiary shall publish in its Internet site a brief outline of implemented activities and achieved results and of amounts paid under the contract. B) Transparent communication with representatives of the mass media and of nongovernmental organizations The representatives of the mass media and of non-governmental organizations are a major guarantor of publicity and transparency in the absorption of EU funds. The timely provision of replies to questions on the operation put forward by such representatives shall be regarded as a positive sign by the European partners as well as by the general public in Bulgaria. In that light, there is a need of cooperation and partnership with the representatives of the above target groups throughout the implementation of operations. Good communication with them is a guarantee for the transparent absorption of the funds from OPE. In the work with journalists due regard should be given to the fact that the media are the main communication channel for ensuring visibility of the operation and a key factor for the successful implementation of the information and publicity measures. In the work with representatives of the non-governmental sector due regard should be given to the fact that the partnership principle is fundamental to handling resources from the Structural and s. Partnership enhances the development capacity and the efficient implementation of operations and contributes to improved awareness of the target groups. 19

In the light of the foregoing, any unreasonable refusal by a beneficiary to provide access to information related to an operation financed from OPE shall be regarded by MA of OPE as non-compliance with the requirements on information and publicity and shall be considered an irregularity. 20

V. ADDITIONAL INFORMATION AND PUBLICITY MEASURES MA of OPE supports the implementation of additional communication measures to promote the operation, further to the minimum required. When selecting communication activities, channels and tools, due regard should be given to the specifics of the operation and the needs of the target groups, as well as to the available budget. The implementation of additional information and publicity measures shall fulfil all requirements set out in these Guidelines. To facilitate beneficiaries, an outline of the requirements to the most common promotional and information materials and communication tools is presented below. a) Printed information materials: booklets, leaflets, flyers, information bulletins, posters, diplomas and certificates from organized training shall include: - the emblem of the EU; - the logo of ERDF and/or CF; - the logo and slogan of OPE; - the logo of NSRF; - the name of the operation being implemented; - the wording The operation is financed from the and from the state budget of the Republic of Bulgaria under Operational Programme Environment, 2007 2013. or The operation is financed from the and from the state budget of the Republic of Bulgaria under Operational Programme Environment, 2007 2013. - the address of the Internet site of OPE http://ope.moew.government.bg/. Invitations, folders, notebooks and journals, writing pads and other office supplies shall include: - the emblem of the EU; - reference to the European Union - reference to ERDF or CF or Cohesion Fund; - the logo and slogan of OPE; - the Internet site of OPE http://ope.moew.government.bg/. 21

Recommendation: Considering the specifics of offset printing, the minimum number of copies of printed information materials should be 200 pcs. A smaller number of copies make the unit cost considerably higher and economically disadvantageous. b/ Promotional materials Cups, t-shirts, umbrellas, conference bags, CDs, etc. shall include: - the emblem of the EU; - reference to the European Union; - reference to ERDF and/or CF (if technically possible); - the logo and slogan of OPE; Pens, pencils, flash memories (USBs), badges and other small promotional articles shall include - the emblem of the EU and reference to the European Union; and/or - the logo and slogan of OPE. Recommendation: Considering the specifics of the respective printing technologies, the minimum number of promotional articles shall be 50 pcs if screen printing is used (for textile and plastic articles) and 100 pcs if pad printing is used (plastic, wood and glass articles). A smaller number of articles would increase the unit cost and be economically disadvantageous. c/ Banners and promotional panels The design of banners and promotional panels: - the emblem of the EU; - the logo of ERDF and/or CF; - the logo and slogan of OPE; - the logo of NSRF; - the name of the operation being implemented; - the value of the operation (including European and national contribution) in BGN; - reference to Operational Programme Environment,. Recommendation: Considering that banners and promotional panels are not disposable, they should be made of vinyl with large format digital printing. The above list of publicity and information materials and carriers is indicative and not exhaustive. The type and number of copies and articles of promotional and information materials beyond the minimum required shall be entirely at beneficiary s choice. 22

The principles described apply in a similar manner to the information disseminated electronically (e.g. internet sites, electronic messages, etc.) or by audiovisual means. d) Public statements, presentations and interviews In public events and interviews of beneficiary s representatives in relation to the operation, the statements and speeches shall highlight the role of the Community for the implementation of the operation through Operational Programme Environment, 2007 2013. It would be a good thing to mention if possible the amount of the OPE grant. e/ Paid publications and broadcasts All paid publications and broadcasts (promotional blocks, promotional spots, headpieces, coverages, films, PR materials, etc.) shall contain minimum the following information: - the name of the operation, - beneficiary s name, - the total operation value, - reference to OPE full name, - reference to the co-financing fund full name. The printed and video materials shall visualize as a minimum the emblem of the EU and the logo and slogan of OPE. Note: All above recommended measures to ensure publicity of operations financed from OPE form an indicative set of measures which can be supplemented with other appropriate communication tools chosen by the beneficiary and described in the application form. VІ. REPORTIONG OF INFORMATION AND PUBLICITY MEASURES The beneficiary shall record all possible evidence of implementation of the publicity and information measures for the purposes of subsequent reporting and monitoring of the operation. When reporting on the implementation of the operation beneficiaries shall submit to the IB (within the quarterly report for the last quarter of the yearр within the progress report when submitting a payment request, and within the final report on the implementation of the operation) a completed table including indicators for implementation of the communication activities. Evidence of the implemented information and publicity measures shall be enclosed to the final report. Evidence includes photos of requisite billboards or plaques, list of participants, programme of the event, samples of promotional and information materials, audio or video 23

records, press clipping, etc. related to the implemented information and publicity measures. The beneficiary shall keep copies of all additional printed or audiovisual materials produced for the project. These can be photos, copies of articles, links to Internet sites, copies of information materials (booklets, leaflets, posters, etc.) produced and disseminated, as well as other appropriate evidence. The beneficiary shall collect and keep evidence of the media coverage of events. These include copies of printed publications, video or audio records of TV or radio programmes, links to the archives of online information agencies or at least Print Screen a photo of the news on the day of its publication. The quantitative reporting of major operations within the meaning of Regulation 1083/2006 is done using the table below incorporated by reference to the quarterly report for the last quarter of the year, within the progress reports when submitting a payment request and within the final report on the implementation of the operation.
