I. BID REJECTION CRITERIA In addition to BRC criteria vide SECTION D of General Terms and Conditions for Global Tender ( MM/ GLOBAL/E01/2005), the following clause will be applicable against this tender : (A) TECHNICAL 1.0 Bidder s Qualification OR 1.1 The bidder shall be an Original Equipment Manufacturer (OEM) having experience in manufacturing of Inflatable Packers. 1.2 The bidder shall be an authorized dealer of OEM. 2.0 Bidder s Experience 2.1 In case, the bidder is an Original Equipment Manufacturer (OEM) 2.1.1 The bidder shall be a Manufacturer of Inflatable Packers and shall be in the business of manufacturing the packers continuously for the last 5 years as on Bid Closing Date of this tender. Documentary evidence in the form of valid API 11D1 certification in the period of last five (5) years from the Bid Closing Date shall be submitted by the bidder. 2.1.2 The bidder shall have the credential of successful execution & completion of at least 02 (two) orders for supplying minimum 30% of tendered quantity of Inflatable packers against each order during the currency of last 5 (five) years preceding from the bid closing date of this tender to any reputed Oil and gas Industry. The bidder shall submit details of the previous supply of such equipment in a tabular format as shown below: SL NO Client / Customer Name and Address Order No / Contract No. Date of order Technical specs & quantity supplied Order Completion date Supporting document (to be enclosed) Clause No. 2.1.2 is not applicable for bidders who have already supplied inflatable packers to OIL. 2.2 In case the Bidder is an authorized dealer of OEM, the following criteria shall be met by the Bidder: 2.2.1 The Bidder shall confirm with necessary supporting documents for supply of Inflatable Packers from Packer Manufacturer (OEM) who meets the qualification requirements stipulated under clauses 2.1.1 & 2.1.2 above. 2.2.2 Bidder shall enclose an Authorisation Certificate with back up Warranty & Guarantee from the Inflatable Packer Manufacturer (OEM) to quote against this tender. 2.2.3 The bid shall be rejected in case of any change of the proposed OEM after submission of the bid. 2.2.4 The bidder shall have the credential of successful execution of at least 02 (two) orders for supplying minimum 30% of tendered quantity of Inflatable packers against each order during the currency of last 5 (five) years preceding from the bid closing date of this tender to any E & P Company. The bidder shall submit details of the previous supply of such equipment in a tabular format as shown below: SL NO Client / Customer Name and Address Order No / Contract No. Date of order Technical specs & quantity supplied Order Completion date Supporting document (to be enclosed) 2.2.5 NOTE: a) Possession of a supply order without complete execution or partially completed order will not be considered as previous experience of the bidder with respect to the Bidder s Experience criteria. b) In support of the experience as noted in paras 2.1.1, 2.1.2 and 2.2.4 above, the bidder shall submit the following documents: i) Copy of the Purchase Order ii) Performance report from the clients 3.0 GENERAL: 3.1 The Bidder shall confirm in their bid meeting all the points noted under technical qualification criteria as stated in the enquiry and shall also submit all necessary supporting documents, technical details, literature etc. as indicated in the enquiry along with the bid failing which the offer shall be rejected. 3.2 Bidder shall quote for full quantities against the tender. Bids received for Part quantities shall be rejected. 3.3 Bidder s response to all NIT stipulations shall clearly be defined. Bidder shall furnish specific details/specifications of all major components, systems with Make & Model, etc. Generalised response like - As per NIT Specifications / Technical Leaflet, Noted, Accepted or in any similar fashion is not acceptable. (B) COMMERCIAL: 1.0 Bids are invited under Single Stage Two Bid System. Bidders shall quote accordingly under Single Stage Two Bid System. Please note that no price details should be furnished in the Technical (i.e. Unpriced) bid. The Unpriced Bid shall contain all techno-commercial details except the prices which shall be kept blank. The Priced Bid must contain the price schedule and the bidder s commercial terms and conditions. Bidder not complying with above submission procedure will be rejected. 2.0 Bid security of US $ 3,000 or Rs. 1,35,000 shall be furnished as a part of the TECHNICAL BID. Any bid not accompanied by a proper bid security in ORIGINAL will be rejected without any further consideration. For exemption for submission of Bid Security, please refer Clause No. 9.8(Section A) of General Terms and Conditions for Global Tender. The Bid Security shall be valid for 270 days from the date of bid opening. 3.0 Bidders must confirm that Goods, materials to be supplied shall be new, of recent make, of the best quality & workmanship and shall be guaranteed by the Seller for a period 18 months from the date of despatch/shipment or 12 months from the date of receipt at destination, whichever is earlier against defects arising from faulty materials, workmanship or design. Defective goods / materials or parts notified rejected by OIL shall be replaced immediately by the supplier at the supplier s expenses at no extra cost to OIL. 4.0 Performance Bank Guarantee: Performance Bank Guarantee shall be applicable as per Section-'A', Para 10.0 of "General Terms & Condition" (MM/GLOBAL/01/2005). Successful bidder will be required to furnish a Performance Bank Guarantee @10% of the order value. The Performance Bank Guarantee must be valid for one year from the date of shipment/despatch. Bidder must confirm the same in their Technical Bid. Offers not complying with this clause will be rejected. 5.0 The prices offered will have to be firm through delivery and not subject to variation on any account. A bid submitted with an adjustable price will be treated as non-responsive and rejected. 6.0 Validity of the bid shall be minimum 180 days. Bids with lesser validity will be rejected. 7.0 Bids received after the bid closing date and time will be rejected. Similarly, modifications to bids received after the bid closing date & time will not be considered. Page 4 of 6
8.0 Offers received without Integrity Pact duly signed by the authorised signatory of the bidder will be rejected. 9.0 No offers should be sent by Telex, Cable, E-mail or Fax. Such offers will not be accepted. II. BID EVALUATION CRITERIA (BEC) : The bids conforming to the specifications, terms and conditions stipulated in the enquiry and considered to be responsive after subjecting to the Bid Rejection Criteria will be considered for further evaluation as per the Bid Evaluation Criteria given below : A. TECHNICAL: All materials as indicated in the material description of the enquiry should be offered. If any of the items are not offered by the bidders, the offer will not be considered for evaluation. B. COMMERCIAL: 1.0 If there is any discrepancy between the unit price and the total price, the unit price will prevail and the total price shall be corrected. Similarly, if there is any discrepancy between words and figure, the amounts in words shall prevail and will be adopted for evaluation. 2.0 For conversion of foreign currency into Indian currency, B.C. selling (Market) rate declared by State Bank of India, one day prior to the date of price bid opening shall be considered. However, if the time lag between the opening of the bids and final decision exceed 3(three) months, then B.C. Selling(Market) rate of exchange declared by SBI on the date prior to the date of final decision shall be adopted for conversion and evaluation. 3.0 Other terms and conditions of the enquiry shall be as per General Terms and Conditions for Global Tender. However, if any of the Clauses of the Bid Rejection Criteria / Bid Evaluation Criteria (BEC / BRC) mentioned here contradict the Clauses in the General Terms & Conditions of Global Tender of the tender and/or elsewhere, those mentioned in this BEC / BRC shall prevail. 4.0 To ascertain the substantial responsiveness of the bid OIL reserves the right to ask the bidder for clarification in respect of clauses covered under BRC also and such clarification fulfilling the BRC clauses must be received on or before the deadline given by the company, failing which the offer will be summarily rejected. III. Standard Notes: 1.0 The tender is invited under SINGLE STAGE-TWO BID SYSTEM. The bidder has to submit both the TECHNICAL and COMMERCIAL bid through electronic form in the OIL s e-tender portal within the Bid Closing Date and Time stipulated in the e- Tender. The Technical Bid is to be submitted as per Scope of Work & Technical Specification of the tender and Commercial bid as per the Online Commercial Bid format. Commercial bids of only those bidders will be opened whose offers are found technically acceptable. The technically acceptable bidders will be informed before opening of the "COMMERCIAL BID". 2.0 In Technical Bid opening, only Collaboration Folder ( C folder ) will be opened. Therefore, the bidder should ensure that Technical bid is uploaded in the C-Folder link (collaboration link) under Un-priced Bid Tab Page only. No price should be given in above C folder, otherwise the offer will be rejected. Please go through the help document in detail before uploading the document. 3.0 All the Bids must be Digitally Signed using Class 3 digital certificate (e-commerce application) with organisation name only as per Indian IT Act obtained from the licensed Certifying Authorities operating under the Root Certifying Authority of India (RCAI), Controller of Certifying Authorities (CCA) of India. The bid signed using other than Class 3 digital certificate, will be liable for rejection. 4.0 OIL reserves the right to allow Small Scale Sectors registered with NSIC purchase preference facility as admissible as per existing Government Policy. The bidders are requested to check the latest position on the subject on their own and OIL does not accept any liability whatsoever, on this account. 5.0 Price should be maintained in the online price schedule only. The price quoted in the online price schedule only will be considered. 6.0 General terms and conditions of Global tender (document MM/GLOBAL/E- 01/2005) is enclosed. 7.0 The items covered by this tender will attract custom duty on merit.
