CITY OF MOUNTLAKE TERRACE RESOLUTION NO. A RESOLUTION OF THE CITY OF MOUNTLAKE TERRACE ESTABLISHING FEES AND DEPOSITS APPLICABLE TO CIVIL ENGINEERING CONSTRUCTION APPLICATIONS AND PERMITS, AND ESTABLISHING FEES APPLICABLE TO LAND USE AND DEVELOPMENT APPLICATIONS, AND REPEALING RESOLUTION NO. 715 WHEREAS, the City has determined to set forth a schedule of fees to cover the costs of civil engineering construction permits and land use s; and and WHEREAS, Chapter 3.150 MTMC authorizes fee schedules to be adopted by resolution; WHEREAS, pursuant to MTMC 3.150.090, changes to the fee schedule will be considered upon completion of a cost of service study every three years, and annual adjustments will be made to reflect the Seattle Area Consumer Price Index (CPI); and WHEREAS, the City studied the cost of development services and the City Council last approved new fee schedules effective 2013; and WHEREAS, in 2015, the City studied the cost of development services and the City Council considered new fee schedules at a work session on December 3, 2015 and a public meeting on December 7, 2015; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOUNTLAKE TERRACE, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Civil Engineering Construction Permit and Deposit Schedule. A Civil Engineering Construction Fee and Deposit Schedule is approved, adopted and established as herein set forth. Civil Engineering Construction Permits and Deposits Engineering Construction Permits The permit fee includes plan check and inspection fees. A base fee is the minimum amount due at time of. Hourly rates apply to plan check and inspections. Final fees paid are the greater of the base fee or actual number of hours required. Deposits are intended to cover hours needed in excess of those included in the nonrefundable base fee. Additional deposits may be required and must be submitted upon request by the City based on the City s estimate of the number of hours anticipated to finalize the permit.

The fee is non-refundable, subject to the refund provisions. The plan check and permit fee are each considered of the fee including filing fee. Hours are tracked and billed for based on actual hours spent or as set forth in city code regulating civil permit plan check and inspections, Chapter 13.05 MTMC, whichever applies (see Other Permit Fees). ** City Engineer is authorized to make a determination on the estimated number of hours for plan review and inspection to establish initial permit fee and deposit to be paid. Costs Outside Consultants. Costs for use of outside consultants are approved, adopted and established as herein set forth. For use of outside consultants for plan checking, inspections, or both, the cost shall be the actual cost to the City, in addition to the permit fees and any other fees required by this resolution. Section 4. Effective January 1, 2016 Hourly Rate. Effective January 1, 2016, the hourly rate on the fee schedule shall be $141. Section 5. Effective January 1, 2017 Fee Schedule Adjustments. Effective January 1, 2017, a new 2017 fee schedule shall be provided by the Community and Economic Development Department to reflect adjustments to the fees based on the Seattle Area Consumer
Resolution No. Establishing 2016 Fees Page 7 of 7 Price Index for All Urban Consumers during the past one-year period, with resultant figures rounded up to the next whole dollar. Section 6. Effective January 1, 2018 Fee Schedule Adjustments. Effective January 1, 2018, a new 2018 fee schedule shall be provided by the Community and Economic Development Department to reflect adjustments to the fees in the 2017 fee schedule based on the Seattle Area Consumer Price Index for All Urban Consumers during the past one-year period, with resultant figures rounded up to the next whole dollar. Section 7. Repealer Resolution. Resolution No. 715 of the City of Mountlake Terrace is hereby repealed effective Midnight, December 31, 2015. Section 8. Fees Nonrefundable - Exception. All fees shall be non-refundable, except that the Department Director may allow a refund for withdrawn s when the following circumstances are present: 1) a written request for a refund, stating reasons for withdrawing the, has been made to the Planning Official; 2) not more than 28 business days have lapsed since the was submitted; 3) the Department Director has determined that substantive staff review of the has not begun; and 4) the refund is not more than 80% of the fee paid by the applicant. Any filing fee is nonrefundable in all cases. Section 9. Repealer. All ordinances or resolutions or parts of ordinances or resolutions of the City of Mountlake Terrace in conflict herewith, be and the same are hereby repealed. Section 10. Effective Date Resolution. The Civil Engineering Construction Fee and Deposit Schedule and the Land Use and Development Application and Deposit Fee Schedule shall take effect and be in force on and after Midnight, December 31, 2015 and shall remain in effect until amended, revised or repealed and replaced by a subsequent fee schedule(s).
