The Chairman sent a letter to Francis Benjamin, Chair of the Associate Development Organization (ADO) regarding the county s recent decision to contract with the Port of Whitman County for ADO services. 067015 15. 067016 The Chairman convened the hearing for a proposed revision to the above matter regarding public facilities improvement funds. Bob Lothspeich noted an increase in these funds from.08% to.09% as authorized by the state means an additional $30,000 in revenue for Whitman County. No other comments were received from those in attendance. The hearing was adjourned. Commissioner Finch moved, Commissioner Partch seconded the motion and it carried to sign the ordinance. BOARD OF COUNTY COMMISSIONER FOR WHITMAN COUNTY, WASHINGTON ORDINANCE NO. 067016 AMENDING TITLE 3 OF THE WHITMAN COUNTY CODE CHAPTER 3.25 SALES AND USE TAX FOR PUBLIC FACILITIES WHEREAS, the Washington State Legislature adopted Laws of 1999, Chapter 311, enacting Enrolled SHB 2260 and amending R.C.W. 82.14.370, and thereby granting to Whitman County the ability to participate in a tax sharing program with the State in which Whitman County may obtain.08% of the sales and use taxes collected by the State pursuant to R.C.W. Chapter 82.08 and Chapter 82.12; and WHEREAS, the Whitman County Commissioner did on June 9, 1999 enact Resolution NO. 055093 agreeing to participation in this program and establishing Chapter 3.25 to the Whitman County Code entitled Sales and Use Tax for Public Facilities for the purpose of financing public facilities in Whitman County; and, WHEREAS, the 2007 Washington State Legislature enacted E2SSB 5557 increasing the 0.08% rural county sales and use tax used for economic development to 0.09%; and, WHEREAS, the Board of County Commissioners did provide the statutory public notices and did hold a public hearing on June 25, 2007, allowing for public participation in the determination to amend the current ordinance; and, WHEREAS, at the conclusion of the said public hearing and after due consideration, the Board of County Commissioners passed a motion to adopted the attached proposed amendment to the Whitman County Code, as being in the best interests of the citizens of Whitman County. IT IS HEREBY ORDERED that Whitman County Code, Title 3, Chapter 3.25 entitled SALES AND USE TAX FOR PUBLIC FACILITIES, as attached hereto, is hereby amended and collection of the new rate shall become effective August 1, 2007. 3

Finch, Commissioner Michael Largent, Commissioner CHAPTER 3.25 SALES AND USE TAX FOR PUBLIC FACILITIES Sections: 3.25.010 Purpose 3.25.020 Tax Imposed 3.25.030 Rate 3.25.040 Deduction from State Tax 3.25.050 Collection 3.25.060 Establishing a Fund for the Tax Proceeds - Purpose 3.25.070 Effective Date and Duration 3.25.080 Severability 3.25.010 Purpose: Pursuant to R.C.W. 82.14.370 as amended by Laws of 1999, Chapter 311 enacting Enrolled SHB 2260, Whitman County is now eligible to participate in a tax sharing program with the State of Washington in which the County may collect sales and use taxes of.08% which shall be deducted from the States share of such sales and use taxes pursuant to R.C.W. chapter 82.08 and R.W. chapter 82.12 and paid over to the County for use in financing public facilities within the county. 3.25.020 Tax Imposed: The sales and use tax provided for in R.W. 82.14.370, as now or hereafter amended, is hereby imposed which is in addition to the other taxes authorized by law and shall be collected from those persons who are taxable by the state under R.W. Chapter 82.08 and R.W. Chapter 82.12 upon the occurrence of any taxable event within the County. 3.25.030 Rate: The rate of said tax shall be nine one-hundredths percent (0.09%) of the selling price in the case of a sales tax or the value of the article used in the case of a use tax. 4

3.25.040 Deduction From State Tax: As provided by R.C.W. 82.14.370 as amended by Laws of 1999 and 2007, Chapter 311, enacting Enrolled SHB 2260 and E2SSB 5557, the tax imposed under Whitman County Code 3.25.020 shall be deducted from the amount or tax otherwise required to be collected or paid over to the Washington State Department of Revenue under R.C.W. Chapter 82.08 or R.C.W. Chapter 82.12. 3.25.050 Collection: The Department of Revenue shall perform the collection of such tax on behalf of the County at no cost to the County. 3.25.060 Establishing a Fund for the Tax Proceeds - Purpose: The moneys collected under this Ordinance shall be forwarded to the Whitman County Treasurer for deposit into the County Treasury in a special revenue fund which is hereby created and hereafter recognized as the Whitman County Public Facilities Improvement Fund for financing public facilities of the County of Whitman. 3.25.070 Effective Date and Duration: A. The sales and use tax authorized by this Ordinance shall become effective August 1, 1999, and shall remain in effect for a period of twenty-five (25) years or as R.C.W. 82.17.370(4) maybe further amended. B. The effective date of the amended ordinance shall be August 1, 2007. 3.25.080 Severability: If any portion of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances is not affected. 11:00 a.m. Recess. 11:30 a.m. Tim Davis and Brandon Burch. D067016A The following Classification Committee recommendations were presented to the commissioners in an effort to simplify the current 10-year old system: 1) Conduct salary survey every third year instead of every year, 2) Eliminate 87% of market and base the Committee s annual recommendation at 100% and, 3) Remove 3-year average from the survey calculations. The committee is also working on two other items: 1) Modifying the comparables list and, 2) Modifying the grade/step matrix. 5

Once the committee completes these processes, they will report back to the Board. Commissioner Partch suggested the possibility of blending a simpler system with our system. Commissioner Finch commented that the Committee s recommendations are well taken. He agreed a much simpler system is needed but he also understood the reality that development is needed in the county to continue to fund the Classification System. Opening development in the Corridor and rural housing is a step in the right direction. The Committee s recommendations have been taken under advisement. 11:30 a.m. Recess. 12:40 p.m. Board Business Continued/Executive Session. Commissioner Finch moved, Commissioner Partch seconded the motion and it carried to go into executive session with the above individuals until 2:00 p.m. for a personnel matter. 2:35 p.m. Return to Open Session/Tammy Lewis, ADO Coordinator. Present: Hillary Hamm and Joe Smillie. 067017 Tammy Lewis gave an overview of Palouse Economic Development Council (PEDC) activities in Whitman County over the past 1-1/2 years. Ms. Lewis mentioned she has met with the Port and is working on different budgets and how the ADO will work in the future. Her focus will be primarily community development with some business recruitment as in the past. Commissioner Partch said although the county has contracted with the Port for ADO services, the county would still like to remain in the PEDC. Tammy will be working for the PEDC who will contract with the Port for ADO services. The commissioners have been extremely happy with Ms. Lewis work and would like to see her services expanded to 32 hours/week. One concern in reviewing the proposed budget is that no miscellaneous expenses are reflected and he would like to see $1,000 allocated to that category in the 32-hour proposal. The proposal would allow for the continued housing of this position in the Extension Office. The commissioners indicated they would also like to receive a report every 2 months. Commissioner Finch will make these recommendations to the PEDC at their meeting tomorrow. 2:55 p.m. Recess. 6
