Use of Non Personal Information and League Results City Tennis League reserves the right publish and make open to the public the results of your league play. This information includes but is not limited to, your match history, league standings, statistics, city and home courts. Match results are not personal to a single player. They are the shared results between you and other members in your division, league and market. Displaying match results is required to preserve and maintain the historical integrity of the league standings and statistics. This information will not be removed for any reason as it would distort the results for the entire league. Customer Communication City Tennis League may send out periodic e-mails related to service you requested, or upcoming events. Members may elect to unsubscribe to these notices at any time. Members that choose to actively participate in a league season may not choose to unsubscribe to emails that directly pertain to the current season of play as they are considered an essential part of the service you have chosen.

City Tennis League Participant Waiver and Assumption of Risk In consideration of the services provided by City Tennis League, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree, represent and warrant that: A. Waiver and Assumption of Risk: 1. I understand tennis entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, but are not limited to: Slipping and falling; exhaustion; temperature exposure; collision with or being hit by other tennis players; striking obstructions; equipment failure; adverse weather conditions; serious injury to bones, joints, ligaments, muscles, tendons and other aspects of the neurological system, vascular and/or musculoskeletal system 2. I have voluntarily registered to participate in the City Tennis League. I expressly agree and promise to accept all of the risks existing in this activity, and I elect to participate in spite of the risks. 3. I have consulted with physicians and other medical advisors and, taking into account their advice have made my own determination whether I will engage in playing the tennis league. 4. I have adequate insurance to cover any injury or damage I may cause or suffer while participating in City Tennis League, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 5. I am solely responsible for evaluating each facility I play at to ensure it meets my standard of safety and playability. I understand by playing the match, I agree to do so at my own risk and release City Tennis League as well as any host facility of any liability for injuries arising from my participation.
B. Covenant not to Sue, Release and Indemnification. I, for myself and for my heirs, legal representatives, and assigns, in consideration of my participation in City Tennis League, covenant with City Tennis League, its officers, directors, employees, shareholders, agents and/or representatives to never institute any suit or action at law or equity against City Tennis League, its officers, directors, employees, shareholders, agents or representatives, by any reason of any claim I have now or may hereafter acquire relating to any present or future accidents or injuries occurring to me as a result of my participation in City Tennis League. I HEREBY EXPRESSLY RELEASE, WAIVE AND DISCHARGE for myself and my heirs, legal representatives, and assigns, City Tennis League, its officers, directors, employees, shareholders, agents or representatives, from any and all claims, causes of action or liability for death, personal injury or property damage of any kind or nature whatsoever arising out of or in the course of participating in City Tennis League, even though that liability may arise out of the negligence or carelessness of City Tennis League, its officers, directors, employees, shareholders, agents and/or representatives. This release and waiver extends to all claims of every kind or nature whatsoever, foreseen or unforeseen known or unknown, I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS City Tennis League, its officers, directors, employees, shareholders, agents and representatives from any loss, liability, damage, and/or cost they may incur due to my participation in City Tennis League whether caused by the negligence or carelessness of City Tennis League, its officers, directors, employees, shareholders, agents and/or representatives. I HAVE CAREFULLY READ THIS PARTICIPANT WAIVER AND ASSUMPTION OF RISK AGREEMENT AND UNDERSTAND IT TO BE A RELEASE AND WAIVER OF ALL CLAIMS AND CAUSES OF ACTION FOR MY INJURY OR DEATH OR DAMAGE TO MY PROPERTY THAT OCCURS WHILE PARTICIPATING IN CITY TENNIS LEAGUE AND IT OBLIGATES ME TO INDEMNIFY THE PARTIES NAMED FOR ANY LIABILITY FOR INJURY OR DEATH OF ANY PERSON AND DAMAGE TO PROPERTY CAUSED DUE TO MY PARTICIPATION IN CITY TENNIS LEAGUE.
