The authority for whether positions are in the classified or unclassified service is based in statute, so it is the Legislature that makes that determination. When the State Civil Service System was first enacted in 1941, all but the highest level of positions were required to be in the classified service. However, the unclassified service has expanded over the years as agency enabling statutes and provisions of the Civil Service Act have been amended. Essentially, for HR purposes, there are two types of both classified and unclassified positions: regular and temporary. For the classified service, regular classified positions count as, are benefits eligible, and are the default type of position in the State workforce, in accordance with K.S.A. 75-2935 (2). These are the only types of positions that can attain permanent status under the Civil Service Act. Conversely, temporary classified positions do not count as, are not benefits eligible and are limited to 999 hours of work in a given 12-month period. These positions are authorized by K.S.A. 75-2945, and the subject of Kansas Administrative Regulations (K.A.R. s) 1-2-85 and 1-6-25. In the unclassified service, unclassified regular positions count as, are benefits eligible and are those positions which are specifically named or identified in either K.S.A. 75-2935 or in agency specific statutes. For example: 75-2935. Classified and unclassified services. The civil service of the state of Kansas is hereby divided into the unclassified and the classified services. (1) The unclassified service comprises positions held by state officers or employees who are: (m) all attorneys for boards, commissions and departments; 75-3745c. Director of personnel services; creation and administration of division of personnel services. There is hereby established, within and as a part of the department of administration, a division of personnel services, the head of which shall be the director of personnel services... The director of

Statutory Basis for Positions February 25, 2014 Page 2 personnel services and the assistant director of personnel services shall be in the unclassified service of the Kansas civil service act and shall be appointed by the secretary of administration. If an unclassified position is not specifically named or identified in K.S.A. 75-2935 or other agency specific statutes, the only other basis for an unclassified position is subsection (1)(i) of K.S.A. 75-2935. This subsection provides that persons temporarily employed or designated by the legislature or by a legislative committee or commission or other competent authority to make or conduct a special inquiry, investigation, examination or installation can be in the unclassified service. Over the years, this provision has come to be relied upon as a general source of authority for unclassified positions that are not specifically named or identified elsewhere in either K.S.A. 75-2935 or in agency specific statutes. The requirement that persons are to be temporarily employed has been interpreted broadly to mean that since these positions are not classified and employees in these positions cannot attain permanent status under the Civil Service Act, they are therefore temporary. These are the so-called non- unclassified positions or as they are also commonly referred, unclassified temporary positions. I hope this information has been helpful.
