FOREIGN WORKERS COMPENSATION SCHEME (FWCS) Product Disclosure Sheet (Please read this Product Disclosure Sheet before you decide to take out this insurance. Be sure to also read the general terms and conditions.) 1. What is this product about? This insurance scheme is approved by the Ministry of Human Resources to cover all foreign workers against employment accidents as provided under Section 26(2) of the Workmen s Compensation Act 1952. All employers are required by the Act to insure all their foreign workers otherwise they are guilty of an offence and shall be liable, on conviction, to a fine not exceeding RM20,000 or to imprisonment for a term not exceeding 2 years of to both. 2. Who is eligible? Eligible persons for insurance under this policy are those present and future full-time foreign worker employees of policyholder, between the ages of eighteen (18) to sixty (60), and possessed a valid working permit issued by the Labor Department. 3. What are the covers/benefits provided? This policy covers:- Section 1 Workmen s Compensation Insurance This section covers your workmen against personal injury by accident or disease arising out of and in the course of employment with the following benefits:- Coverage a) Death b) i) Permanent Total Disablement ii) Permanent Partial Disablement iii)temporary Disablement iv)medical Expenses Section 2 Repatriation Expenses Benefits Pays a maximum sum of RM25,000 Pays a maximum sum of RM23,000 as per the First Schedule of the Workmen s Compensation Act. Pays in accordance with the First Schedule of the Workmen Compensation Act. Pays in accordance with Section 8(e) of the Workmen s Compensation Act. Pays in accordance with provisions of the Workmen s Compensation Act This section indemnify you for the actual repatriation expenses incurred or RM4,800 whichever is lesser, in the event your workman dies or suffers permanent total disablement. Section 3 Personal Accident Insurance (Off-Work Hours) This section pays your insured workman for personal injury sustained in an accident which occurs outside the working hours, with the following benefits - Coverage a) Death b) Permanent Disablement Benefits Pays a maximum sum of RM23,000 Same as section 1 (b) as above 1

4. How much premium do I have to pay? The premium is RM72.00 per workman, inclusive of RM5.00 service fee for each workman for the electronic link-up system provider (SPPA) 5. What are the fees and charges that I have to pay? What are some of the key terms and conditions that I should be aware of? DUTY OF DISCLOSURE Pursuant to Paragraph 4(1) of Schedule 9 of the Financial Services Act 2013, if you are applying for this Insurance for a purpose related to your trade, business or profession, you have a duty to disclose any matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of your contract of insurance, refusal or reduction of your claim(s), change of terms or termination of your contract of insurance. The above duty of disclosure shall continue until the time your contract of insurance is entered into, varied or renewed with us. You also have a duty to tell us immediately if at any time after your contract of insurance has been entered into, varied or renewed with us any of the information given in the Proposal Form (or when you applied for this insurance) is inaccurate or has changed. PERIOD OF INSURANCE The Period of Insurance as specified in the Schedule is the period that your workmen are in your immediate employment. Cover will cease from the time the workman leaves Malaysia and resumes upon his/her return to Malaysia. CLAIMS In the event of any accident which may give rise to a claim, you must:- a) Report the accident immediately to the Labour Department. b) Give notice in writing within 10 days of the accident to us stating the circumstances of the accident and the nature of the injury. Compensation payable as assessed by the Commissioner in accordance with the Act shall be paid within 7 days of receipt by the Company of such assessment Note: The list above is non-exhaustive. 7. What are the major exclusions under this policy This policy does not cover:- a) Common Law Liability b) War, terrorism and nuclear risks c) Asbestosis d) Fines, penalties, punitive damages awarded by a court of law. You may cancel your policy by giving written notice to us. Upon cancellation, you are entitled to a refund of the premium based on the conditions as stated in the policy contract. 9. Pastikan anda membaca terma dan syarat syarat am polisi.) 1. Apakah produk ini? Skim insurans yang diluluskan oleh Kementerian Sumber Manusia untuk menyediakan perlindungan kemalangan pekerjaan kepada pekerja asing sebagaimana diperuntukkan di bawah Seksyen 26(2) Akta Pampasan Pekerja 1952. Semua majikan dikehendaki oleh Akta untuk menginsuranskan semua pekerja asing mereka di bawah skim ini, jika tidak mereka adalah melakukan suatu kesalahan dan boleh dikenakan, disabitkan, boleh didenda tidak melebihi RM 20,000 atau dipenjarakan selama tempoh tidak melebihi 2 tahun atau keduaduanya. 2. Siapakah yang layak? Mereka yang layak untuk insurans di bawah polisi ini adalah pekerja asing sepenuh masa kini dan masa depan pemegang polisi, yang berumur antara lapan belas (18) hingga enam puluh (60) tahun, dan mereka mempunyai permit kerja yang sah yang dikeluarkan oleh Jabatan Buruh. 3. Apakah perlindungan/ manfaat yang disediakan? Polisi ini melindungi:- Seksyen 1 Insurans Pampasan Pekerja Bahagian ini meliputi pekerja-pekerja anda daripada kecederaan peribadi akibat kemalangan atau penyakit yang timbul daripada dan dalam masa menjalankan pekerjaannya dengan manfaat berikut;- Perlindungan a) Kematian b) i) Hilang Upaya Menyeluruh dan Kekal ii) Hilang Upaya Separa dan Kekal iii)hilang Upaya Sementara iv)perbelanjaan Perubatan Manfaat Membayar jumlah maksimum RM25,000 Membayar jumlah maksimum RM23,000 seperti dalam Jadual Pertama Akta Pampasan Pekerja Membayar menurut Jadual Pertama Akta Pampasan Pekerja Membayar menurut 8(e) Akta Pampasan Pekerja Membayar menurut peruntukan Akta Pampasan Pekerja Seksyen 2 Perbelanjaan Penghantaran Pulang Seksyen ini mengganti rugi anda bagi perbelanjaan menghantar balik tertanggung yang sebenar sehingga RM4,800 yang mana lebih rendah, sekiranya pekerja itu meninggal dunia atau mengalami hilang upaya menyeluruh dan kekal. 4

Seksyen 3 Insurans Kemalangan Diri (Diluar Waktu Bekerja) Seksyen ini membayar kecederaan diri pekerja yang dialami dalam sesuatu kemalangan yang berlaku di luar waktu kerja dengan manfaat/faedah yang berikut:- Perlindungan a) Kematian b) Hilang Upaya Manfaat Membayar maksimum RM23,000 Sama seperti Seksyen 1 (b) di atas 4. Berapa premium yang harus saya bayar? Kadar Premium ialah RM72.00 bagi setiap pekerja, termasuk RM5.00 yuran perkhidmatan bagi setiap pekerja bagi perkhidmatan elektronik link-up system pembekal (SPPA) 5. Apakah kos dan caj lain yang harus saya bayar? Jenis Jumlah Duti Setem Cukai Perkhidmatan (CBP) Komisen dibayar kepada pengantara insurans (jika ada) RM10.00 (per polisi) 6% daripada jumlah bayaran premium serta perkhidmatan 10% daripada premium (termasuk dalam premium) 6. Apakah di antara terma dan syarat-syarat penting yang patut saya ketahui? KEWAJIPAN PENDEDAHAN Menurut Perenggan 4 (1) Jadual 9 Akta Perkhidmatan Kewangan 2013, jika anda memohon insurans ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion anda, anda berkewajipan untuk mendedahkan apa-apa perkara yang anda tahu akan mempengaruhi keputusan kami dalam menerima risiko dan menentukan kadar dan terma yang dikenakan, dan apa-apa perkara yang munasabah yang boleh dijangka, jika tidak ia boleh menyebabkan pembatalan kontrak insurans, keengganan atau pengurangan ganti rugi, perubahan terma yang dikenakan, atau penamatan kontrak insurans anda. Kewajipan pendedahan di atas hendaklah diteruskan sehingga kontrak insurans anda dimeterei, diubah atau diperbaharui dengan kami. Anda juga mempunyai kewajipan untuk memberitahu kami dengan serta-merta jika pada bila-bila masa selepas kontrak insurans anda ditandatangani, diubah atau diperbaharui dengan kami (atau semasa permohonan insurans ini), apa-apa maklumat yang dinyatakan dalam Borang Cadangan tidak tepat atau sudah berubah. TEMPOH INSURANS Ini adalah tempoh yang dinyatakan dalam polisi adalah tempoh pekerja bekerja terus dengan anda tetapi tidak termasuk tempoh apabila pekerja itu pulang ke Negara asalnya. Perlindungan akan ditamatkan pada masa pekerja meninggalkan Malaysia dan bersambung semula setelah dia pulang semula ke Malaysia. 5

TUNTUTAN Sekiranya berlaku apa apa kemalangan yang mungkin menimbulkan tuntutan, anda mesti:- a) Laporkan kemalangan itu dengan serta-merta kepada Jabatan Buruh. b) Beri notis secara bertulis dalam masa 10 hari dari tarikh berlakunya kemalangan itu kepada kami dengan menyatakan perihal kemalangan dan jenis kecederaan. Pampasan yang kena dibayar seperti dinilai oleh Pesuruhjaya mengikut Akta hendaklah dibayar dalam tempoh 7 hari dari penerimaan oleh Syarikat penilaian itu. Nota: Senarai ini tidak lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh terma dan syarat di bawah polisi ini. 7. Apakah pengeculian utama di bawah polisi ini? Polisi ini tidak melindungi:- a) Undang-Undang Am Liabiliti b) Perang, keganasan, risiko nuklear c) Asbestosis d) Denda, penalti, ganti rugi punitif dijatuhkan oleh mahkhamah Nota: Senarai ini tidak lengkap. Sila rujuk kepada kontrak polisi untuk senarai penuh terma dan syarat di bawah polisi ini. 8. Bolehkah saya membatalkan polisi? Anda boleh membatalkan polisi ini dengan memberi notis bertulis kepada pihak kami. Selepas pembatalan, anda layak mendapat pemulangan premium berdasarkan kepada syarat-syarat seperti yang dinyatakan dalam kontrak polisi. 9. Apa yang perlu saya buat jika ada perubahan dalam butir hubungan saya? Adalah penting untuk anda memaklumkan kepada kami sekiranya terdapat apa-apa perubahan dalam butiran kontrak anda untuk memastikan semua surat-menyurat sampai kepada anda tepat pada masanya. 10.
