RESPONSES TO DOWNTOWN MERCHANTS CONCERNS TO DOWNTOWN PARKING Hui Lai, Traffic Engineer presented the staff report for this item. He covered the issues raised by Mr. Dave Kerai regarding lack of lighting by the parking meter on 186 th Street and lack of free parking for employees. William Rawlings, Interim City Manager stated that staff could explore ideas on programs for employee parking and have it back on a future meeting. Hui Lai, Traffic Engineer covered the issue regarding reducing the parking citation fee. Mr. Dushon of Ashoka Restaurant complained that the parking fee of $1.50 was too high. Councilmember Manalo stated that the city debated the fee for a long time and other cities were surveyed. He said that the city is on the low end compared to other cities. He said that he thought $1.50 was reasonable. Mr. Dushon inquired as to what time enforcement is for parking meters. Pradeep Elayath, Administrative Service Manager replied from 10:00 a.m. to 8:00 p.m.. Mayors Flowers stated that the survey done included coastal cities or big metro cities. Mayor Pro Tem Lima stated that it was up to the merchants to provide parking for their customers or reimbursement to the customers. Venkatesh Koka stated that the parking meters are hurting the residents. He commented to charge a resident $40.00 for a parking permit is too high and why should they be charged this amount since the city created the parking issue. Mayor Flowers requested of Mr. Lai the reasoning for no parking meters on 186 th Street. Mr. Lai responded to the inquiry. Mayor Pro Tem Lima wanted to clarify that there would be no charge for residential permit. Councilmember Canales wanted to clarify that the city did not create a parking issue. He said the city is trying to work with the success of the businesses and by doing so a parking deficiency was created. He said that the city would be proactive in rectifying the issues. Mayor Flowers inquired if $40.00 for a residential permit was discussed. Kevin Ennis, City Attorney replied by saying yes but the Ordinance was drafted at no cost. He said the Ordinance was put on hold but could be brought back before the City Council. Page 2

Mayor Flowers stated that it was important to hear from the merchants. She said that she didn t vote for the parking meters but now that it is here we need to make the best of it. She said that the City Council needs to hear from the merchants and work with them. Mr. Bhindi stated that the meters are here so we need to work with them. He said that he received positive feedback from his customers. He said they commented that they can now find parking. He said the only issue with the meters is the three hour time limit and suggested extending the hours. He said employee parking will have an impact on customer parking. He said that he was interested in customer validation. Mayor Pro Tem Lima stated that he thought the time could be changed to unlimited. Mr. Lai stated that the time could be adjusted. He said that a three hour time limit was determined to prevent merchants and employees from parking on for 8 hours or unlimited time. Mayor Flowers inquired about tokens. Mr. Elayath replied that tokens have been ordered. Roger Patel stated that a lot of his concerns were already brought up by others. He said one of the things on his list was for food to go customers and what they pay. He also suggested reducing the parking fee from $1.50 to $1.00. Councilmember Canales inquired if a quarter could be used for a certain time limit. Mr. Elayath replied that one quarter in the parking lot would be for 15 minutes and 10 minutes on the street. He said if a credit card is used then $1.50 is the minimum. Mayor Pro Tem Lima inquired if a single quarter could be used. Mr. Elayath replied by saying yes. Mayor Pro Tem Lima made a motion to continue item but motion failed due to lack of second. SECONDED BY COUNCILMEMBER CANALES TO DIRECT STAFF TO PREPARE ORDINANCE LOWERING THE CIVIL PENALTY AMOUNT OF $58.00 TO $40.00 AND DIRECTION TO STAFF TO BRING BACK RECOMMENDATIONS ON ISSUES RAISED AND ENFORCEMENT OF FINES STARTING MAY 14, 2013. AYES: COUNCIL/BOARDMEMBERS: Canales, Lyon, Manalo and Flowers NOES: COUNCIL/BOARDMEMBERS: Lima 4. PROPOSED SUBLEASE OF MTA RIGHT OF WAY FROM MR. KOKA FOR A PUBLIC PARKING LOT AND RELATIONSHIPS TO PROPOSED DEVELOPMENT APPLICATIONS Mayor Pro Tem Lima abstained from this item. Hui Lai, Traffic Engineer presented staff report for this item. Kevin Ennis, City Attorney suggested continuing the item to allow the Interim City Manager to become familiar with the project and work with staff addressing the issues. Venkatesh Koka submitted drawings of the two different parcels. He said that he has a signed lease from MTA and that he has started paying. He said that the Cerritos side is a very small portion. He said that he thought this was all worked by staff and if it needs to go back before the Planning Commission it will take another 3 months. He inquired if the lease from MTA was wrong in regards to parts of Artesia and Cerritos. Kevin Ennis, City Attorney stated that the Artesia zoning map and the official General Plan does not have the same line lineation and that needs to be addressed with the City of Cerritos on their understanding. He said that some of the required actions would involve substantial amendments to the zoning code. He also stated that the lease does not provide for long duration use. He said that there are multiple applications that cannot be expedited. Councilmember Canales stated that time should be taken to study this item. Mayor Flowers stated that the City Attorney wants everything to be in order and then move forward at one time on all items. She said this doesn t mean it won t happen. Councilmember Manalo stated that he thought this was a good thing and it is a winning situation. He said that he agreed with having the Interim City Manager review this item. Councilmember Lyon stated that he agreed. Mayor Pro Tem Lima welcomed Bill Rawlings to the City. He stated that the library event was excellent. He stated that he participated in the ABC Education Foundation. He said that the Chamber of Commerce has over 110 members. Councilmember Lyon welcomed Bill Rawlings to the City. He commented on how great the library event was. Mayor Flowers welcomed Bill Rawlings to the City. She said the members of the Baudik Sansar (Intellectual World, Nepal) were interested in becoming more involved in the community and were interested in attending events.
