Using the information submitted, we have determined that a revision to the flood hazards depicted in the Flood Insurance Study (FIS) report or National Flood Insurance Program (NFIP) map is warranted. This document revises the effective NFIP map, as indicated in the attached documentation. Page 3 of 5 Issue ate: July 6, 216 ffective ate: July 6, 216 Case No.: 16-2-154P LOM-APP Federal mergency Management Agency Washington,.C. 2472 LTT OF MAP VISION TMINATION OCUMNT (CONTINU) INFOMATION APPLICABL NFIP GULATIONS/ OBLIGATION We have made this determination pursuant to Section 26 of the Flood isaster Protection Act of 1973 (P.L. 93-234) and in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban evelopment Act of 1968, P.L. 9-448), 42 U.S.C. 41-4128, and 44 CF Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIM, and the modifications made by this LOM, are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. MINS We based this determination on the 1-percent-annual-chance discharges computed in the submitted hydrologic model. Future development of projects upstream could cause increased discharges, which could cause increased flood hazards. A comprehensive restudy of your community s flood hazards would consider the cumulative effects of development on discharges and could, therefore, indicate that greater flood hazards exist in this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal or State/Commonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in floodplain areas. If your State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this LOM to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOM by preparing a news release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the information. Because the FIS report establishing the BFs for your community has been completed, certain additional requirements must be met under Section 1361 of the National Flood Insurance Act of 1968, as amended, within 6 months from the date of this letter. Prior to the effective date of this revision your community is required, as a condition of continued eligibility in the National Flood Insurance Program (NFIP), to adopt or show evidence of adoption of floodplain management regulations that meet the standards of Paragraph 6.3(d) of the enclosed NFIP regulations (44 CF 59, etc.). This includes adoption of the current effective FIS report and FIM to which the regulations apply and other modifications made by this map revision. Some of the standards should already have been enacted by your community to establish initial eligibility in the NFIP. Your community can meet any additional requirements by taking one of the following actions: 1. Amending existing regulations to incorporate any additional requirements of Paragraph 6.3(d). 2. Adopting all the standards of Paragraph 6.3(d) into one new, comprehensive set of regulations. 3. Showing evidence that regulations have previously been adopted that meet or exceed the minimum requirements of Paragraph 6.3(d). Communities that fail to enact the necessary floodplain management regulations will be suspended from participation in the NFIP and subject to the prohibitions contained in Section 22(a) of the Flood isaster Protection Act of 1973 (Public Law 93-234) as amended.
