Last Updated 09/21/15 #Snaps4Peace Photo Competition Contest Guidelines Eligibility The #Snaps4Peace Photo Competition (the Contest ) is only open to persons who are U.S. residents ages 18 through 35 years old at the time of submission. Void outside the 50 United States and the District of Columbia and void in Arizona. Additionally, the Contest is void where prohibited by law. To be eligible to be a Winner (defined below), the entrant (or, if a minor, the entrant s parent or guardian) must agree to these Official Rules. You must also meet certain eligibility criteria, outlined below. Contest Sponsor and Administrator Generation Progress, a project of the Center for American Progress, is the Contest s Sponsor and Administrator. We are located at 1333 H St., NW, 10 th Fl., Washington, D.C. 20005 Agreement to Official Rules Participation in this Contest constitutes entrant s full and unconditional agreement to these Official Rules and Sponsor s and judges decisions, which are final and binding in all matters related to this Contest. These Official Rules are subject to change. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Contest begins on Monday, September 21, 2015 at 12:00:00 a.m. Eastern Standard Time ( EST ) and ends on Friday, October 2, 2015 at 11:59:59 p.m. EST (the Contest Period ). Sponsor s computer is the official time-keeping device for the Contest. Originality (out of 5 points) Connection to the Theme (out of 5) Artistic Merit (out of 5 points) Artwork must be the original idea of, and fully authored by, the entrant. Entries: Entries can be submitted via Instagram or Twitter using the hashtag #Snaps4Peace. Entrants must also keep with them releases showing the permission to use the image of any real or intellectual property or persons included in their entries. No material owned or created by a third party may be submitted. All entries become the property of the Center for American Progress. As set forth below, by submitting an entry, you grant Sponsor the right to use, publish and otherwise display the work or permit the work to be used by others. Publicity: By participating, where allowed by law, all participants to an entry grant the Sponsor exclusive permission to use their names and likenesses in connection with promotion of this Contest and for all other uses and waive any claims to royalty, right, or remuneration for such use. By entering, you acknowledge that Sponsor may, but has no obligation to, use or post your entry online or in other media. Content Restrictions: By completing the registration and submitting your entry, you agree that your entry conforms to the rules and requirements set forth herein and that the Sponsor, in its sole discretion, may remove and disqualify your entry at any time and for any reason, including if it believes, in its sole discretion, that your entry fails to conform to these rules and requirements in any way. The entry does not contain material that violates or infringes another s rights, including but not limited to privacy, publicity or intellectual property rights, nor does it infringe on another s copyright or trademark rights; The entry does not contain brand names or trademarks, unless authorized; The entry does not contain photos or artwork not created by entrant, unless authorized in writing by the copyright holder; The entry does not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or libelous; The entry does not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and The entry does not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where the entry is created. By submitting an entry, you warrant and represent that: it is your original work and has been legally created, it has not been previously published or distributed in any media, it has not been entered in or won previous contests or awards, that you have obtained permission from any person whose name, likeness, or contribution is used in the entry and that if such person is below the age of majority in their state of residence, your entry includes parental permission for each such minor (as evidenced by our release); you have obtained all rights required to submit your entry, including without limitation, copyrights, and, that you have received prior written permission from all participants; publication, duplication or distribution of the entry via various media including Web posting, will not infringe on any third party rights; and you will indemnify and hold harmless the Sponsor from any claims and damages (including reasonable attorneys fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your entry, or your conduct in creating your entry or otherwise in connection with this Contest. Sponsor s Rights to Your Entries All entries will become the exclusive property of Sponsor, and none will be returned. By submitting an entry, you irrevocably grant Sponsor and its respective agents an unlimited, worldwide, perpetual, unconditional, gratis license and right to edit, modify, adapt, distribute, stream, post, publish, broadcast, reproduce, encode, store, copy, transmit, publicly display, exhibit, and or otherwise use or reuse (without limitation as to when or to the number of times used) the entry, in whole or in part, including any persons or likeness embodied therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion) in any way, and may use them in any and all media, now or hereafter devised, worldwide in perpetuity, without attribution, compensation, permission or notification to you, your successors or assigns, or any other entity, and without notice, review, or approval from you or any other party.
Furthermore, although Sponsor is not under any legal or contractual obligation to do so, Sponsor reserves the right to review and/or edit any and all entry elements deemed by Sponsor, in its sole discretion, to be prohibited, inappropriate, offensive, infringing or otherwise unacceptable. Should Sponsor edit any such elements, you are not relieved from responsibility for compliance with these rules. By entering this Contest, you agree to grant Center for American Progress an irrevocable, perpetual, worldwide, free license to my entry for use in all media in any form, including alterations and modifications. Sponsor is not responsible for lost, late, incomplete, damaged, invalid, un-intelligible, garbled, delayed, inaccurate or misdirected entries,, or entries not received for any reason; all of which will be disqualified. Sponsor reserves the right to, but is not obligated to, monitor/screen entries prior to posting them online. By entering, you acknowledge that Sponsor has no obligation to use or post your submitted entry. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. Entrants also agree to sign all other legal forms deemed necessary by Sponsor to establish Sponsor s ownership of the right, title and interest in and to the entry and of the transferred copyrights and Moral Rights of Authors waived under these Official Rules. Winners may also be required to sign a liability and publicity release. Judging to Determine Winner(s) All eligible entries received during the Open Call for entries will be judged by a panel of judges made up of Sponsor s staff and in its sole discretion, according to the criteria listed above. The panel will determine one (1) Winner. The judges decisions are final and binding in all matters relating to this Contest. If Sponsor does not receive a sufficient number of eligible or qualified entries, Sponsor reserves the right not to select a Winner for any or all divisions, in Sponsor's sole discretion. Prizes Subject to compliance with these Official Rules and Sponsor s requirements, prizes will be distributed as follows: The Winner will receive one Generation Progress swag care package. The estimated value of this prize is $50. In the event that any of the prizes become unavailable for any reason, Sponsor will make best efforts to substitute another prize, which will in Sponsor s sole discretion be of comparable value and type.
Other selected entries may also be reposted by Generation Progress Notification The Winner will be notified by direct message, telephone and/or email no later than October 10, 2015. Taxes Any valuation of prize(s) stated above is based on available information and the value of any prize awarded to a Winner may be reported for tax purposes as required by law. Each Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that are not specifically provided for in the Official Rules. LIMITATIONS OF LIABILITY AND RELEASE Sponsor: disclaims all liability for the inability of any person to complete or submit an entry or submission due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond our control, or otherwise. For all contests, we disclaim all liability for any delays, misdelivery, loss, or failure in the delivery of any entry or item. Sponsor is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant s ability to participate in the Contest, and any injury or damage to an entrant s or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest, or any injury, loss or damage arising from the acceptance, use, misuse of any prize or any prize related travel or activity. is not liable in the event that any portion of the Contest is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a Force Majeure Event ). Should a Force Majeure Event occur, Sponsor may, but is not obligated to, exercise reasonable efforts to publicize the winning entries and deliver all or part of the prize or make a reasonable substitution in its sole discretion. Waiver By participating in the Contest, each entrant waives any and all claims of liability against the Sponsor, its employees and agents for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, including while claiming the prize.
Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any of Sponsor s rights nor a waiver of any obligation required of an entrant. Privacy Any personally identifiable information that you submit will used and collected in accordance with Sponsor s privacy policy. Disputes and Jurisdiction Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Court of the District of Columbia. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the Contest if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. In the event of termination, a notice will be posted online and entries will be judged from among all eligible entries received prior to termination. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.
