Joining them are other experts who have occupied the highest positions in the area of international tax while they were in service with the Govt. of India and are now advising on the most talked about cases. The Technical Content: The face of international tax is undergoing a rapid change. With India already a signatory to the G20 BEPS Project, it is only a matter of time that India will legislate the recommendations of the Group. The definition of a foreign company having earlier expanded under the Companies Act 2013, taxation of digital economy being hotly debated, attempts to artificially avoid Permanent Establishment being thwarted, and talks about consumption based tax being raised, we are actually transitioning to a new set of concepts and principles for taxation of the foreign companies in India. Then the new Transfer Pricing Guidance including the Country by Country Reporting, would be part of the Indian TP regulations. On the outbound side, the Place of Effective Management deciding the residence and taxation of the foreign companies has a potential to raise many controversies in time to come. A related issue will be the impact on the Foreign
Tax Credit claim in such situations. Besides, we are moving into a new era of global cooperation with the automatic exchange of information giving teeth to the Black Money Law and FATCA and concerted efforts being made to find a way to put in place a Multilateral Treaty. We should also not lose sight of another interesting development on the horizon where the foreign companies are invoking Bilateral Investment Promotion Treaties and resorting to International Arbitration for tax disputes. All these developments are to be tracked and understood in all its dimensions. These have been built into the program to be deliberated at the conference.
