Speedway/Campbell Request t amend the University Area Plan Ntes frm Neighbrhd Leadership Meeting, The meeting began at apprximately 6:30 p.m. with Keri Silvyn and Jim Prtner briefly reviewing recent develpment with this prcess, and explaining the reasns behind the latest updates t ur Request t Amend the University Area Plan ( UAP Amendment ). Keri then walked thrugh these updates, which are briefly described belw. In additin t the update descriptins, we captured the questins psed with crrespnding answers, rganized by page and sectin f the UAP Amendment. UAP Amendment, Page 1: The nly change was t clarify the definitins f Plicy and Guideline. Later in the presentatin, smene psed the questin f whether Plan Tucsn had a definitin fr these terms, which it des nt. Fr the UAP Amendment definitins, hwever, we wrked with Staff t define these terms based n language in the Tucsn General Plan and varius neighbrhd plans. UAP Amendment, Page 3 Transprtatin, Plicy 1 : Clarified the language regarding vehicle access t the site. We als explained that the grcer tenant will likely prvide input n this tpic, s there culd be sme further mdificatins t this language. QUESTION: Will there be a deceleratin lane place n Speedway? This type f detail will be clarified in the Planned Area Develpment ( PAD ) stage f this prcess, if the spacing t the majr intersectin allws it, we hpe that a deceleratin lane will be utilized t help traffic flw and safety in the area. Transprtatin, Plicy 4 : Added language t clarify hw the parking analysis dne in the PAD phase will be used, and that parking calculatins will be based n actual uses at the site. QUESTION: Where will disabled parking be lcated n the site? This is detail that will be clarified in the PAD, but the site will cntain adequate and prperly lcated disabled parking in rder t cmply with all laws and regulatins requiring access fr disabled persns. Crdinatin with and Prtectin f Surrunding Neighbrhds, Plicy 1 : Clarified that the specific details regarding this grup s future participatin in the PAD will be included in the PAD language. UAP Amendment, Page 4 Crdinatin with and Prtectin f Surrunding Neighbrhds, Guidelines 2 & 5 : Added language t clarify ur fllw-up steps after we receive the varius studies. QUESTION: Why isn t nise reverberatin included in these guidelines? We drafted Guideline 5 with nise reverberatin in mind and with the intentin that it

QUESTION: Regarding the University Health Science Center, are yu utilizing the crrect name? We cnsulted with the University regarding this questin, but we will cnfirm the crrect nmenclature with Steve Brigham t make sure this is crrect. QUESTION: Guideline 3 des nt have the same language regarding neighbrhd fllw-up as was added t Guidelines 2 and 5. Can yu please add similar language t Guideline 3 as this is a huge issue t the Jeffersn Park neighbrhd? Yes, we will include such language in Guideline 3. QUESTION: D yu knw hw much water currently cmes ff the site? N, we have nt determined this yet, but it will be required at the time f develpment. COMMENT: Currently the sewer suffers frm a lack f cleansing velcity that allws it t wrk prperly. The suggestin was that we might utilize the excess water frm the site t feed int the sewer system t help address this prblem. Urban Design, Plicy 3 : Prvided additinal detail regarding pedestrian accessibility frm site t surrunding areas. NOTE: We will make all the references t the University hspital cnsistent thrughut the dcument. Als, we will change the term pprtunities t facilities n the third line. QUESTION: Are bicycles mentined in this dcument? Bicycles are nt specifically mentined, but bicycle traffic will be an imprtant aspect f the site and we will cmply with all the required bicycle parking in the PAD. There are, hwever, places in the UAP Amendment that we can insert language regarding bicycle use, and we will d s. QUESTION: What kind f security d yu intend t have in the parking structure? The exact types f security will need t be determined after the building and parking design, which will ccur at the PAD stage. Hwever, we are cmmitted t ding whatever it takes t make the site safe. Als, ur tenants (grcer) and ur clientele will demand that we prvide a safe site. UAP Amendment, Page 5 Urban Design, Plicy 4 : We cmbined the prir Plicies 4 and 5 int ne in rder t clarify that that Exhibit 3.G.2 crrespnds with this plicy language (as well as putting Page 2

QUESTION: In the last meeting, it was explained that the height alng Speedway Blvd. and Campbell Ave. will be 6-8 stries, but here yu shw 10-12. Why? We are asking fr a 10-12 stry envelpe in these areas t allw fr step-backs frm the streets and architectural creativity in design. The heights adjacent t the street will be lwer (likely 6-8 stries) and the heights will step back as the building mves away frm the street. The 10-12 stry envelpe request allws ur architects flexibility t design and scale the building apprpriately. Design quality fr this prject is key, as we feel we can design an elegant building that is apprpriate fr this site. The PAD prcess will include mre specificity abut this design. QUESTION: The PAD prcess allws fr 10% administrative changes t the building design, s will yu use this t increase the building s height? While the PAD may allw fr a 10% administrative change, we will specifically write int the PAD that height cannt be increased administratively, and can nly be changed thrugh the legislative prcess. Furthermre, this height limit is stated as a plicy within this UAP Amendment, and as such it is cnsidered a firm-standard that culd nly be changed thrugh anther plan amendment. Urban Design, Guidelines 1-4, 5 : Changed shuld t will in these guidelines. UAP Amendment, Page 6 Urban Design, Guideline 8 : We added this language t insure that we think abut the pedestrian cnnectivity between the fur crners, and hw peple will mve arund this area bth in the lng-and-shrt term. Our intentin is nt t prject an idea f what will be n the surrunding crners, just t cntemplate pedestrian traffic t these areas as they further develp. Fllw-up Questins After the presentatin was cmplete, the neighbrhd leaders asked the fllwing questins: D yu intend t acquire the prperty t the west (later clarified as the Babcck apartments wned by the Arizna Bard f Regents ( ABOR )): We d nt intend t acquire that land nr d we believe ABOR is ffering it fr sale. This UAP Amendment is fr ur prperty nly (see Exhibit 3.G.1, Sub-Area 1). This amendment des allw fr us t enter int a public/private partnership with ABOR prir t the PAD rezning. If any private develpment were t ccur utside f ur prperty, that develpment wuld need t g thrugh the full public prcess (plan amendment, then rezning). What can yu d with the eastern strip f land adjacent t Campbell Ave.? We d nt have any current ability t utilize this area, nr are we lking at this area as buildable Page 3

What is the purpse f a public/private partnership t avid zning? A public/private partnership is nt a way t get arund zning regulatins, and it wuld be subject t at least sme regulatin. ABOR, as a public educatinal institutin, is exempt frm zning when its prperty is being used t further its gvernmental, public purpse. Arizna case law, hwever, explains that this exemptin begins t erde nce the prperty is used fr ther, nn-gvernmental purpses, called prprietary uses. If ABOR decides t develp the prperty adjacent t ur site, r enters int a public/private partnership with us, the uses included n the prperty will determine the extent t which the zning regulatins apply. Is it pssible that ABOR will becme a partial wner in the prject? Prbably nt; hwever, it is pssible that we culd enter int a public/private partnership with ABOR. This UAP Amendment allws us t incrprate this partnership int the PAD withut ging thrugh anther plan amendment. The University knws what we are ding, and they als knw the timing issues. Market frces are pushing us frward, and ur mving frward may be changing the internal discussins at the University. Will the adjacent prperties (ABOR land) be allwed t cnstruct a building f 250 feet? Nt by virtue f this plan amendment (hwever, if ABOR prceeds under its gvernment functins, it des nt need t cmply with lcal regulatins). The height allwance we are asking fr is strictly limited t ur site fr private develpment, and as described in Exhibit 3.G.2. If ABOR jins ur prject, then the height allwances n its prperty wuld be addressed in the PAD and/r be exempt. Will the building envelpes extend t the ABOR prperty? N, if ABOR jins ur prject, we will wrk with them t determine what they need, and wrk with yu all t reach an acceptable limit. The building heights wuld need t cmply with the plan amendment, except fr thse prtins f the prject used exclusively fr a University purpse and wuld nt be subject t zning regulatin. What is the timeframe fr the University/ABOR t jin the prject? ABOR wuld have t make a decisin within apprximately the next 3 t 6 mnths. COMMENT (nt related t the dcument): Cuncilmember Kzachik is very cncerned abut recent cyclist and pedestrian accidents (including the fatality f a fur year ld), especially in light f the prpsed Entertainment District, which will increase nnvehicle traffic. Please keep this in mind fr yur plan. This is a gd suggestin, and we will lk thrugh this dcument t see where we can include language regarding pedestrian and bicycle safety. COMMENT: It is imprtant that this prject be seen as a cmmunity advantage, a place where peple can gather, a Prad-like place. A vibrant pedestrian space at the grund flr is vital t this prject. Page 4

While we cannt legally exclude students, we can assure yu that ur target market is nt students, and we will nt be renting by the bed (as is being dne at the new student husing west f campus). We have nt made the determinatin yet whether t rent r sell the residential units, but in either case it will be dne n a per unit basis. COMMENT: Page 1 refers t the units as residential cndminiums. As we are nt sure f whether these will be apartments r cndminiums, we will change this language.
