The Corporation of the Municipality of West Grey Public Works Department Tender for Crushing, Hauling and Spreading of Granular "A" Gravel - 2015 1. This contract is for crushing, loading, hauling and spreading of Granular "A" crushed gravel, at a rate price per metric tonne at the Glenelg Patrol and loading, hauling and spreading at the Bentinck and Normanby Patrols. Additional screening may be required to meet graduation. Material shall conform with the requirements of OPSS 1001 and 1010. 2. West Grey is asking contractors to tender the loading, hauling and spreading of crushed gravel in the Normanby Patrol from the Redford Pit on Concession 4-5 (Bentinck) and tender the loading, hauling and spreading in the Bentinck Patrol from the Kaufman Pit on Concession 10 (Bentinck). The gravel in the Glenelg Patrol will be crushed, loaded, hauled and spread from the Glenelg Pit on Glenelg Road 23. The location of the material to be crushed will be available from the Road Supervisor. 3. The crushed gravel will be placed on roads in the northern half of the Normanby, Bentinck and Glenelg Patrols at depth of 100 mm to 150 mm or as directed by the Road Supervisor. 4. The Municipality will provide compaction and dust suppressant as required. 5. The crushed granular material will be subject to testing and must conform to requirements for Granular "A" in OPSS 1001 and 1010. Crushed material not meeting these specifications will be rejected. 6. Specifications and tender forms are available at the Municipality of West Grey Municipal office. 7. Tenders are due in the Municipality of West Grey Municipal Office, Durham, Ontario, by eleven o'clock a.m. March 24 th, 2015. (Faxed tenders will not be accepted). 8. Tenders will be opened within seven days thereafter and the contract awarded within that period or shortly thereafter. 9. The gravel contract must be completed before October 1 st, 2015 at the Normanby, Glenelg and Bentinck Patrols. Any agreement to the contrary must be confirmed in writing by the Council of the Corporation. Failure to have the work completed will result in Liquidated Damages charges of $500.00 per calendar day until the completion of the project. 10. Payment will be made on a per metric tonne basis, truck measurement. Each 1

truck shall have a predetermined capacity, and the loading of each truck shall be kept to not less than the predetermined capacity. Each truck shall bear an Identification Number followed by predetermined capacity of the truck. Symbols and capacity shall be of such size as to be easily read by the Inspector. Load tickets shall be used and marked at the dumping by the Inspector. No gravelling shall be carried on in the Inspector's absence. The Director of Infrastructure & Public Works or his representative shall determine the capacity of each truck. Loads shall be levelled on demand. Gravel Hoppers only and a minimum of six trucks and hoppers each day to be used for spreading gravel. 11. Bid price(s) shall include applicable taxes and shown separately. 12. Statutory Holidays shall be observed. 13. Entrance to the pits must be maintained by the Contractor. 14. The Contractor shall open and close the pits to the satisfaction of the Director of Infrastructure & Public Works or his designate. 15. The work to be performed under this contract or any part thereof shall not be assigned or sublet by the Contractor without the written permission of the Corporation. 16. It is further agreed that the said written authority shall not under any circumstances relieve the Contractor of his liabilities and obligations under the contract. 17. The Corporation reserves the right to limit the capacity of loads, especially when being hauled over bridges and culverts. 18. The Contractor shall during the progress of the work, use all proper precautions for the prevention of accidents and shall indemnify and save harmless the Corporation from all suits and actions and all costs and damages occasioned by the acts, negligence, or carelessness of the Contractor or his agents or employees. 19. Tenders must be accompanied by a certified cheque drawn in favour of the Treasurer of Municipality of West Grey in the amount of 10% of the tender. The proceeds of this cheque shall, upon acceptance of the tender, constitute a deposit which shall be forfeited to the Corporation if the Contractor fails to do the work as outlined in the documents, or also fails to meet any of the conditions as set out in the documents. 20. No material will be processed or delivered to parties other than the 2

Corporation of the Municipality of West Grey. 21. In addition too but not superseding the conditions above, the following Ontario Provincial Standard Specifications shall apply: OPSS 314 OPSS 1001 OPSS 1010 OPS General Conditions of Contract dated August, 1990 22. The Municipality of West Grey requires a copy of the Vehicle Insurance, CVOR and WSIB Clearance Certificate prior to hiring contractors. If these items are not submitted your tender will not be considered. 23. Tenders may be rejected for any of the following reasons: (a) Bids received after closing date; (b) Bids received on other than the tender form supplied; (c) Bids not completed in ink or by typewriter; (d) Incomplete bids (e) Qualified or conditional bids; (f) Bids not properly signed and sealed. 24. Contractors may bid on Item No. 1; Item No. 2; Item No. 3; or all items. The lowest tender may be awarded to each item. 25. I/We, the Contractor, have carefully examined the provisions, specifications and conditions referred to in the preceding schedule, which is attached hereto as part of this tender, and have carefully examined the sites and locations, by personal investigation and research and will make no claim against the said Corporation by reason of estimated or representation of any officer or agent of the said Corporation and accept the said provisions, specifications and conditions and for the prices set forth in this tender, hereby offer to furnish all machinery, tools, apparatus and other means of construction, to furnish all other materials, except the supply of gravel which shall be provided by the Municipality, and to complete the work in strict accordance with the provisions, specifications and conditions referred to in the said schedule. I/We the undersigned hereby declare that I/we is covered and in good standing with Workplace Safety & Insurance Board. Attached to this tender is a certified cheque in the amount of 10% of the tender made payable to the Treasurer of the Municipality of West Grey, as required in the Information to Bidder. The proceeds of this cheque shall, upon the acceptance of the Tender, constitute a deposit which shall be forfeited to the Corporation if the Contractor fails to meet any of the conditions as set out in the documents. It is also understood and agreed that the tender with the Contractor's signature attested therein, shall constitute a legal and binding agreement between the Corporation of the Municipality of West Grey and the said Contractor. Contractor Health and Safety Agreement It is our objective at the Municipality of West Grey, to provide all persons within our workplace, the opportunity to work in a safe environment. It is the Municipality s Policy to totally eliminate all accidents through Health and Safety Standards. All Employees, Contractors, Subcontractors, Suppliers and any other Service Providers to our projects must co-operate and make all reasonable efforts to ensure the maximum protection and minimum inconvenience to the general public, occupants, and the environment. The Municipality of West Grey believes the following ideals must be accepted and followed in order to ensure safety on our projects. Any Contractor hired by the Municipality must ensure that their employees have safety training and certificates equal or exceeding the requirements set forth in the current Occupational Health and Safety Act and current regulations. The Contractor(s) on the project must work in conjunction with the Municipality s appointed Health and Safety representatives. All Contractors must follow Health and Safety policies set forth by the Municipality. The Contractor must report and investigate all incidents, and near accidents to the Site representative, and Health and Safety representatives immediately. Health and Safety policies will be reviewed and be part of all pre site and site meeting agendas and will have the Contractor as well as the Municipality represented. Health and Safety issues will always be given immediate attention by the Municipality, its representatives, contractors and subcontractors. All applicable current and environmental legislation/regulation(s) are considered a minimum requirement; All employees, contractors/sub-contractors, suppliers and visitors/residents must immediately report unsafe conditions, incidents, and accidents to the Project/Site Supervisor or the Municipality of West Grey s Occupational Health and Safety Officer; Failure to adhere to one of the above stated requirements would jeopardize the Health and Safety of all. Through a safety conscious workforce, the quality of work and production will ensure safe and timely project completion. ALL accidents will be investigated to determine the causes and corrective actions to prevent recurrence. Disciplinary Action in the form of: Step 1 verbal warning Step 2 written warning Step 3 notification to the Ministry of Labour re: Project Violations/termination of the Legislation/regulation(s), and unsafe work practices. 6

The Municipality takes pride in the commitment of our employees and contractors, and will take the necessary steps to ensure Health & Safety on all projects. Acknowledgement I have read and received a copy of the Contractor Health and Safety Agreement and agree on behalf of to comply with the requirements of the Occupational Health & Safety Act and Regulations for Construction Projects. I will also take all necessary precautions to ensure the Health and Safety for our employees, suppliers and sub-contractors while on the project and ensure that they are provided with and are aware of the preceding requirements.
