OBJECTIVE As you are aware, provisions of the Competition Act, 2002 (as amended by the Competition Amendment Act 2009) was enacted with the objectives of ensuring free and fair competition in market by prohibiting anti-competition agreement, abuse of dominant position and by regulating competition. As of now all the three components of the Act viz. (i) Prohibition of Anti-competitive agreements (ii) Prohibition of abuse of dominance by enterprises or group and (iii) regulation of certain combinations (Merger and Acquisition) have come into force. Some of the provisions were made effective in the year 2003. Thereafter further provisions of that Act have been made effective in the years 2007, 2009 and 2011. Provisions relating to Prohibition of anti-competitive agreements, prohibition of abuse of dominant position, enquiry into agreements or abuse of dominant position, competition advocacy etc. had been brought into effect from 20 th May 2009 and thereafter the remaining provisions relating to Combinations i.e., Section 5, 6, 20, 29, 30, 31, 43 to the Competition Act have been brought into effect from 1 st June 2011. The Competition Commission of India (CCI) has been recently delivered some important decisions relating to aspects of Competition Law on Complaints made by parties regarding
formation of Cartels, Anti-competitive agreements, Abuse of dominance by enterprises or groups and have been penalizing heavily for cartel like agreements for collusion and bid rigging. Emergence of Competition Law jurisprudence in India is of recent development and any interpretation of various provisions of Competition Law by CCI is likely to have a lasting impact on the future of implementation and enforcement of this Law. It has therefore become imperative for the corporate executives and professionals such as Lawyers, Chartered Accountants and Company Secretaries to know the relevant provisions and working of the Act and the rules and regulations made there-under, as also their implications and impact thereof on their business activities and environment.
