DISCUSSION Background In June 2016, the City Council authorized the Interim City Manager to execute a consultant services agreement with Rincon Consultants, Inc. ( Rincon ) to prepare an environmental impact report ( EIR ) for the draft Novato General Plan 2035. At the time, the City Council was asked to consider a request to analyze modifying the Novato Industrial Park Master/Precise Development Plan to allow additional building floor area and height for biotechnology and life science uses. By unanimous vote, the City Council authorized the additional analysis in the General Plan EIR. In January 2017, the Community Development Department returned to the City Council with more detailed information regarding the development intensity and zoning modifications proposed to support biotechnology/life science uses in select areas of the Novato Industrial Park. Staff presented the City Council with two development scenarios consisting of 300,000 and 500,000 square feet of additional floor area for biotechnology/life science uses, as well as allowing an increased building height limit of 68-feet for such uses. The City Council supported analyzing both proposed build-out scenarios and the height increase in the General Plan EIR on a three (3) to two (2) vote (Ayes: Athas, Lucan, and Fryday; Nays: Eklund and Drew). In September 2017, the City Council authorized the City Manager to amend the City s contract with Rincon Consultants to prepare the additional environmental analysis required for the biotech/life science development scenarios. BioMarin, Inc., provided a deposit of $56,767.00 to cover the costs of the additional environment analysis. 1 cc18_007 1

Revised Scope of Work Amendment No. 2 W-Trans, the traffic consultant working on the General Plan EIR, has performed preliminary traffic modeling for the biotech/life science development scenarios. Based on early modeling results, it appears the 500,000 square-foot development scenario could prove to require costly modifications to components U.S. 101. Conversely, there appears to be sufficient existing traffic capacity to accommodate expanded biotech/life science development above the 300,000 sq. ft. scenario. Recognizing the City and broader community have identified the attraction and retention of biotech/life science uses as being highly desirable (Novato General Plan 2035 Program EV 1b), staff recommends the traffic analysis for the General Plan EIR be expanded to include additional traffic modeling to identify the level of biotech/life science floor area above 300,000 square feet that can be reasonably accommodated without triggering the need for major infrastructure improvements, such as modifying components of U.S. 101. This additional analysis would be informative with respect to the carrying capacity of existing circulation infrastructure and provide flexibility to develop a range of project alternatives for the General Plan EIR. Staff is also recommending W-Trans perform additional work tasks including examining new data from the Institute of Transportation Engineers (ITE) regarding trip generation rates associated with the mix of uses (office, labs, and manufacturing) common to biotech/life science uses and testing traffic operations with implementation of transportation demand management (TDM) measures (e.g., shuttle service, rideshare programs, etc.). Rincon has developed an amended scope of work and budget to perform the additional circulation analyses. This information is provided as Exhibit A to the attached resolution. The additional circulation analyses were not anticipated at the time staff requested the first EIR contract amendment in September 2017. At that time, the analysis of the biotech/life science proposal was thought to be best conducted by focusing on high and low development scenarios taken from employment projections for the local biotech industry. There was a sense one of the scenarios would likely prove to reach the capacity of the circulation system serving the industrial park area. As staff has learned, the local circulation system has capacity somewhere between the 300,000 and 500,000 square foot development scenarios. Staff believes the recommended analyses would provide a clearer picture of traffic capacity by performing additional modeling, correcting for new information on trip generation rates for biotech uses, and more precisely quantifying the effect of applying TDM measures to the traffic model. All of these efforts would lead to more informed decision making with respect to establishing a floor area ratio for biotech/life science uses. Revised Budget Rincon is requesting $11,758.00 to have W-Trans perform the additional circulation analyses. The total cost of the EIR would increase from $279,507.00 to $291,265.00. 2 2

FISCAL IMPACT The cost of the additional circulation analyses would be paid from the General Fund. RECOMMENDATION Adopt resolution. ALTERNATIVES 1. Adopt the attached resolution authorizing the City Manager to amend the contract with Rincon. 2. Adopt the attached resolution with revisions authorizing the City Manager to amend the contract with Rincon. 3. Do not authorize the City Manager to amend the contract with Rincon. 4. ( Rincon ) to prepare an environmental impact report (EIR) for the draft Novato General Plan 2035, including analysis of a proposal to amend the Novato Industrial Park Master/Precise Development Plan to allow expanded building floor area and height for biotech/life sciences uses; WHEREAS, on January 10, 2017, the City Council was presented more detailed information regarding the development intensity and building height proposed for the Ignacio and Hamilton Industrial Parks, which are part of the Novato Industrial Park Master/Precise Development Plan, including two development scenarios of 300,000 and 500,000 square feet of additional floor area for biotech/life science uses and allowing a maximum height limit of 68-feet for the same; WHEREAS, on January 10, 2017, the City Council authorized the City Manager to amend the consultant services agreement with Rincon to include in the scope of services for the 2035 General Plan EIR the analysis of the two development scenarios and maximum building height described above; WHEREAS, preliminary traffic modeling performed for the life science/biotech development scenarios indicates the 500,000 sq. ft. development scenario could prove to require costly modifications to components of U.S. 101 and there appears to be sufficient existing traffic capacity to accommodate expanded life sciences/biotech development above the 300,000 sq. ft. scenario; WHEREAS, there is a desire to amend the consultant services agreement with Rincon to include additional circulation analyses to identify the level of life science/biotech floor area that can be reasonably accommodated above 300,000 square feet without triggering the need for major infrastructure improvements, such as modifying components of U.S. 101; and WHEREAS, Rincon submitted an amended scope of work and budget to perform the additional circulation analyses; cc5126 4

WHEREAS, Rincon is requesting a budget amendment of $11,758.00 to complete the additional tasks identified in its revised scope of work, bringing the total cost of the General Plan EIR to $291,265.00. A detailed description of our revised scope of work, schedule, and additional fee estimate to accommodate this request is provided below for your consideration. Revised Scope of Work The revised scope of work for the EIR would include providing the City supplemental traffic analysis for the Industrial Parks MPA. This supplemental analysis will be included in the stand-alone traffic memorandum to analyze the Industrial Parks MPA. The following describes the main tasks or work products associated with the revised scope of work. Task A: Industrial Parks MPA Additional Traffic Analysis (prepared by W-Trans) As part of Task A of Amendment #1, W-Trans will complete analyses examining the potential traffic impacts associated with 300,000 and 500,000 square feet of added biotechnology uses in the Industrial Parks MPA, as well as an evaluation of potential transportation demand management (TDM) measures that could help to reduce the traffic levels generated by major biotech campuses in the area. City staff now requests additional analysis be completed to help determine the maximum amount of added development that can reasonably be accommodated without triggering the need for major infrastructure improvements. The analysis will build in a TDM trip reduction percentage that would presumably be required of future campus developments. The analysis will also re-examine the applied trip generation rates based on newly-available data from the Institute of Transportation Engineers (ITE), as well as additional E n v i r o n m e n t a l S c i e n t i s t s P l a n n e r s E n g i n e e r s 6

City of Novato General Plan EIR Amendment #2 information from potential biotech applicants regarding the proportion of different uses (office, laboratory, and manufacturing) expected at biotech campuses. These two adjustments will require coordination with Staff and possibly the potential biotech expansion applicants; it is assumed that one conference call and one meeting in Novato will be needed. As contemplated under Amendment #1, the memorandum will primarily consist of LOS tables and supporting text describing the results, and would include evaluation of the following intersections: 1. Ignacio Boulevard/Alameda del Prado 2. US 101 S/Ignacio Boulevard-Enfrente Road 3. US 101 N/Bel Marin Keys Boulevard-Nave Drive 4. Bel Marin Keys Boulevard /Commercial Boulevard 5. Bel Marin Keys Boulevard /Digital Drive 6. US 101 N/Nave Drive The results of the analysis will identify the approximate amount of added biotechnology uses in the MPA that can reasonably be accommodated (along with buildout of the forthcoming General Plan land uses) before requiring a major infrastructure investment, and to identify the corresponding intersection and corridor levels of service. That development level would then be carried forth into the General Plan EIR s analysis of Industrial Parks MPA scenarios. The draft traffic analysis memorandum will be discussed with Staff either by teleconference or in person at City Hall. Schedule and Cost The estimated timeframe for completing the Industrial Parks MPA Additional Traffic Analysis (Task A) is four to five weeks with a kickoff in early January and completion in early February 2018. Based on this, the estimated timeframe for completion of the full Revised General Plan Traffic Study (Task B of Amendment #1) including the General Plan buildout (with Industrial Parks MPA) and the Alternative (General Plan without Industrial Parks MPA) is 8 to 10 weeks following confirmation from Staff of the Industrial Parks MPA development level to be assumed in the EIR. The Administrative Draft EIR (including the additional analysis from Amendment #2) would be completed within four weeks after completion of the Traffic Study. Page 2 7
