Endorsements The following list of Endorsements forms part of the Terms and Conditions of this policy. Where the Business has declared more than one activity then the Endorsements applicable to each activity are clearly identified. Endorsements Applicable to Scaffolding Contractor 22_1. Heat Work Exclusion We shall not be liable in respect of Injury or Damage to property caused by or in connection with the application of heat by the use of: (a) electric, oxy-acetylene welding or other welding or flame cutting equipment (b) tar, bitumen or asphalt heaters (c) blow lamps, blow torches or hot air guns (d) angle grinders (e) or any other work that requires, uses or produces open flames or any other sources of heat or sparks that could ignite flammable or combustible materials undertaken by You and Your Employees elsewhere other than at Your own Premises 127. Spectator Stands and Seating Exclusion The Policy does not indemnify the Insured in respect of claims arising from or in connection with the manufacture, sale, supply, hire, erection, repair or use of spectator stands or seating. XSL21. Hazardous Locations Exclusion This Policy does not indemnify the Insured in respect of any claim arising in connection with any work on or in: (a) docks, harbours or railways; and/or (b) watercraft or offshore gas or oil installations; and/or (c) chemical or petro chemical works, oil or gas refineries or storage facilities; and/or (d) aircraft, airports or airfields; and/or (e) power stations; and/or (f) nuclear power stations; and/or (g) any installation where nuclear processing is undertaken; and/or (h) towers, steeples, chimney shafts, blast furnaces, viaducts, bridges, flyovers, tunnels, dams, reservoirs, motorways, quarries, mines or collieries XSL401. Products Liability Insurance Exception: The Company will not indemnify the Insured against liability arising directly or indirectly in connection with (i) Products sold or supplied by the insured to the United States of America, Canada or any territory within their jurisdiction and/or (ii) Products which to the best of the Insured s knowledge and belief are intended by the Insured or any other party to be and are in fact sold or supplied to the United States of America, Canada or and other territory within their jurisdiction. If notwithstanding the above exclusion the Company incurs liability to pay any sum as a result of judicial process in the courts of law in the United States of America or Canada then the Insured shall repay to the company all such sums which the company would not have been liable to pay but for such a process. XSL405. ASBESTOS EXCLUSION This Policy does not apply to any loss demand claim or suit arising out of or related in any way to asbestos or asbestoscontaining materials.

The Company shall have no duty of any kind with respect to any such loss demand claim or suit. XSLB02. Bona Fide Sub Contractor Condition It is a condition precedent to liability under this policy that all sub-contractors have Public Liability Insurance in respect of their liability at law for injury or damage arising in connection with the business described in this policy and that i) The Limit of Indemnity of the Public Liability insurance be not less than the limit given under this policy and shown on the policy schedule (or amended by subsequent endorsement) in respect of any one claim or number of claims arising out of one cause. ii) Such insurances have been extended to indemnify the Insured as Principal against all liability for such injury or damage In the event of a claim the Insured shall provide documentary evidence of the Public Liability insurance held by the bonafide sub-contractor at the time of his appointment to work for the Insured. Policy Endorsements

XSL404. Casualty & General Endorsement Notwithstanding anything contained herein to the contrary, for the purpose of interpreting this Policy the Primary Policy specified in the Schedule will be deemed to read as shown below in the following particulars: Section Two Public/Products Liability : Cover and Jurisdiction The Company will indemnify the Insured: (a) against legal liability for damages and claimant s costs and expenses in respect of Accidental Bodily Injury and Accidental Damage to Property occurring during the Period of Insurance within the Territorial Limits and in connection with the Business; (b) against legal liability for damages and claimant s costs and expenses in respect of Accidental Bodily Injury and Accidental Damage to Property occurring during the Period of Insurance within the Territorial Limits and in connection with the Business arising out of any Products; and in respect of Legal Costs incurred with the written consent of the Company in connection with any occurrence which is or may be the subject of indemnity under (a) and (b) above; provided always that no indemnity will be afforded by the Company in respect of any judgement, award or settlement made in any country or territory outside the United Kingdom, the Channel Islands or the Isle of Man (or to any order made anywhere in the world to enforce such judgement, award or settlement either in whole or in part) unless the Insured has requested that there shall be no such limitation and has accepted the terms offered by the Company in granting such cover which offer and acceptance must be signified by an endorsement attaching to this policy. Exclusion 1. Pollution & Contamination directly or indirectly caused by or arising from seepage, pollution or contamination of any kind, or for the cost of neutralising, containing, removing or cleaning-up any substance causing or resulting from any incidence of such seepage, pollution or contamination other than such liability directly caused by any sudden, unintended, and unexpected event which occurs in its entirety at a specific moment in time and place during the Period of Insurance; Exclusion 6. Professional Services arising from any breach of professional duty, or any wrong or inadequate advice (other than given in connection with the Insured s Products), design or specification produced or provided by the Insured for a fee. Extension 8. Data Protection Act The Company will indemnify the Insured and if the Insured so requests any Employee, director or partner of the Insured against legal liability arising under Section 13 of the Data Protection Act 1998. For the purposes of this extension damage and/or distress within the meaning of such Act shall be deemed to be Bodily Injury. Provided that the Insured: (a) is registered in accordance with the terms of such Act or has applied for registration which has not been re-fused or withdrawn; (b) has taken all reasonable care to comply with the requirements of such Act. This extension will not apply to: (a) the costs of replacing, reinstating, rectifying or erasing data; (b) legal liability arising from or caused by any deliberate act or omission of the Insured or any person entitled to indemnity if the result thereof could reasonably have been expected by the Insured or such other person having regard to the nature and circumstances of such act or omission; (c) the payment of fines or penalties; (d) claims arising out of the circumstances notified to previous insurers or known to the Insured at the inception of this policy; (e) legal liability in respect of which indemnity is provided by any other insurance.
