Buy Miles & Win A Hotel Voucher Terms and Conditions A. Duration 1. The Buy Miles & Win A Hotel Voucher ( Campaign ) is organised by Malaysia Airlines Berhad ( MAB ) and will run from 20 August 2018 until 30 September 2018 ( Campaign Period ). B. Eligibility and Participation 1. Any person who has fulfilled the criteria below is eligible to participate in this Campaign ( Participant ): a. Be 18 years old or older; b. Be an Enrich member. c. Non-member can register for membership via Malaysia Airlines website at https://www.enrich.malaysiaairlines.com/enrichwebsite/signup and must register before buying Enrich Miles ( Buy Miles ) during the Campaign Period. d. An Enrich member must purchase a minimum of 1,000 Enrich Miles or up to a maximum of 50,000 Enrich Miles per transaction during the Campaign Period. A maximum of 150,000 Enrich Miles can be purchased per calendar year per Enrich member. 2. The following are NOT eligible to participate in the Campaign: a. Permanent and/or temporary employees or immediate family members and relatives of Malaysia Airlines, its affiliates and subsidiaries; and b. Representatives, vendors and/or agents (including advertising and promotion agents) of Malaysia Airlines. c. Enrich members who have purchased a maximum of 150,000 Enrich Miles per calendar year. 2. The mechanics of the Campaign are as follows: a. Participant must Buy Miles via Malaysia Airlines website at https://www.malaysiaairlines.com/in/en/enrich/buy-miles.html within the Campaign Period which is from 20 August 2018 to 30 September 2018. b. Participant who successfully Buy Miles is eligible for a lucky draw entry ( Lucky Draw ) to win a hotel stay voucher worth up to USD700. c. One (1) Participant will be randomly selected and in no particular order as a Lucky Draw Winner ( Winner ) on a weekly basis as per following : 1

Multiple purchases are allowed in this Campaign but each Participant are only eligible to win one (1) Prize for the duration of the Campaign. e. The Winners will be notified by email ( Winning Notification ) within ten (10) working days from the closing date of each Week or such other date as decided by MAB at its absolute discretion. The Winning Notification will include instructions on how to claim the Prize. C. Prize 1. A total of six (6) Winners will each receive one (1) complimentary voucher ( Hotel Voucher ) worth up to USD700.00 ( Prize ) for one (1) night stay from Worldhotels or Langham Hotel and Resort. 2. To claim the Prize, the Winners must refer to the full terms and conditions stated on the Hotel Voucher. 3. The Winners must select one (1) of the participating hotels from the list of applicable hotels by Worldhotels or Langham Hotel and Resort. 4. The Prize is subject to the following terms and conditions: The Prize excludes travel between the Winners home to hotel and vice versa. Flights, hotels, transfers and other relevant arrangement and expenses from Winners home to hotel and vice versa are to be managed by the Winner and are at their own cost. The Prize does not include any additional taxes and incidental charges of a personal nature, such as room service, mini-bar and in-room movies, incidentals or service charges are the responsibility of the member and must be paid by the member directly to the hotel and in accordance with the payment terms and conditions of such hotel. The one (1) night stay validity is stated on the Hotel Voucher and must be made within the validity period. The validity is final and no appeal will be entertained for extension of validity under any circumstances. No credit or change will be given on the unused portion of the Hotel Voucher. Any additional charges over and above the value of the Hotel Voucher must be settled with the hotel directly on departure. 2
Redemption is subject to room availability and prior reservation is required at least 10 working days from the dates requested. The Hotel Voucher has no cash value, non-refundable and nontransferable. No extension of validity will be allowed. Reservation must be made directly via email to the respective Hotel. MAB will not be liable if the voucher cannot be used within the validity due to non-availability of hotel rooms. The original Hotel Voucher must be presented to the front desk upon checkin. If the voucher cannot be produced upon check-in, then payment must be made for the booked accommodation based on the daily Best Available Rates. In this instance, the Hotel Voucher can be used at a future date (before the expiry date). The Hotel Voucher is not replaceable if lost, stolen or destroyed, photocopied or altered in any way and will not be accepted by respective Hotel or be otherwise redeemable. The Winner shall settle any claim, dispute or question arising in connection with the use of the Hotel Voucher directly with the respective Hotel at which the Hotel Voucher is used. MAB shall bear no responsibility for resolving such disputes or for the dispute itself. Should any dispute arise, the decision of Worldhotels, Langham Hotel and Resort, or MAB will be final. Failure to claim the Prize within the manner and period stipulated in the Winning Notification will result in forfeiture of the Prize and the Winner will have no claim whatsoever against MAB, its agents and/or employees. MAB shall not liable for any additional or incidental costs, taxes, expenses, charges, fees, losses or damage incurred. Malaysia Airlines, its agents and employees shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from the Prize. MAB shall not be liable or responsible for any loss or damage suffered by the Winners or their travelling companion if the Winners or their travelling companion does not utilize the Prize as a result of any statutory requirements not met, Government travel warning or advisory applicable to the destination country and/or countries. MAB shall have no obligation to substitute any alternative prize, cash equivalent or other compensation where the Winners and/or their travelling companion fails to utilize the Prize for any reason. 5. Reasonable efforts will be made to contact the Winner. If the Winner cannot be contacted within fourteen (14) working days after the from the closing date of each Week, MAB reserves the right to offer the Prize to the next Participant based on the judges sole and absolute discretion. 6. Should a Participant s contact details change during the Contest Period, it is the Participant's responsibility to notify MAB directly and update their contact details in Enrich Account. 7. The Prize is non-refundable and non-exchangeable for cash or kind whether in part or in full. 3
D. General Terms For Campaign 1. All transportation, accommodation, personal costs and/or any other costs and/or related expenses that are incurred to participate in this Campaign is the sole responsibility of the Participants. 2. MAB reserves the right to use, reproduce, edit and distribute materials submitted for this Campaign for publication and/or display in any media format and any media channels without obtaining further prior permission and payment of any fees or royalty to the Participant. 3. MAB reserves the right to use the Participant s name, images, comments, materials relating to this Campaign for the purpose of any announcement or promotional or marketing purposes in any media format and any media channels without any fee being paid. The Participant shall hold MAB free and harmless from any claims and/or liabilities whatsoever resulting from the usage or the reproduction of the submitted materials by MAB. This clause shall survive the expiration of this Campaign Period. 4. MAB, at its sole and absolute discretion, reserves the right to disqualify any Participant and revoke or forfeit any Bonus Miles at any stage of the Campaign without prior notice if: (a) The participant is not an eligible Participant; (b) The Participant fails to fully comply with the Terms and Conditions stipulated herein; (c) Entries are incomplete; (d) The Participant breaches any of the Terms and Conditions or other rules and regulations of the Campaign or violates any applicable laws or regulations; (e) MAB has, at its sole discretion, any reason whatsoever to believe that such Participant has attempted to undermine the operation of the Campaign in any way whatsoever, including but not limited to fraud, cheating or deception. 5. MAB s decision on matters relating to the Campaign shall be final and absolute. No discussion, correspondence, enquiry, appeal or challenge by any of the Participants in respect of any decision of MAB shall be entertained. 6. MAB, its affiliates, subsidiaries, agents, employees, representatives, retailers, distributors, dealers as well as its advertising, creative, media, digital, design and other creative agencies of MAB, shall not be liable for any loss or damage whatsoever suffered (including but not limited to loss of opportunities and any indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from participation in this Campaign. 7. The Terms and Conditions of the Campaign shall be construed, governed and interpreted in accordance with the laws of Malaysia. 8. All rights and privileges herein granted to MAB are irrevocable and not subjected to rescission, restraint or injunction under any and all circumstances. Under no circumstances shall the Participant have the right to injunctive relief or to restrain or otherwise interfere with the organisation of the Campaign, the production, distribution, exhibition and/or exploitation of the Campaign and/or any product based on and/or derived from the Campaign. 4
9. MAB reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions without any prior notice. 10. These Terms and Conditions will prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign. 11. The main language of the Terms and Conditions shall be the English language. Any translation to any other language than English shall be for convenience only. Should there be any discrepancies between the English Terms & Conditions and the translated version, the English Terms & Conditions shall prevail. 12. By virtue of an entry to the Campaign, the Participants signify their absolute and unconditional acceptance and agreement to all the Terms and Conditions stipulated herein. 13. MAB reserves the right to cancel, terminate or suspend the Campaign without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by MAB of the Campaign shall not entitle the Participants to any claim or compensation against MAB, its agents and employees for any and all losses or damages suffered or incurred by the Participants as a direct or an indirect result of the act of cancellation, termination or suspension thereof. 14. MAB will not be held responsible for any typographical errors or misprint under these Terms and Conditions. E. General Terms For Buy Miles 1. Enrich Members may Buy Miles which may be redeemed for Enrich Award Flights (flight on Malaysia Airlines, oneworld airlines and partner airlines), as top up for Miles + Cash redemption, redemption seat upgrades on Malaysia Airlines operated flights, Golden Lounge Access vouchers and Enrich RM50 vouchers for Temptations In-flight shopping. 2. Buy Miles can only be purchased at a minimum of 1,000 Enrich Miles per transaction with a maximum of 50,000 Enrich Miles per transaction. 3. A maximum of 150,000 Enrich Miles can be purchased per calendar year per Enrich member. 4. Buy Miles may be purchased at a rate of USD 0.025 per mile. The local equivalent rate shall apply for purchases made in countries outside Malaysia. 5. Buy Miles have a 3-year validity term which will expire at the end of the month in which it was purchased, in the third year. 5
6. After successful completion of payment transaction, Malaysia Airlines will credit the Buy Miles purchased into the Enrich member s account within 1 to 3 days. 7. Buy Miles do not count towards Elite Tier Status qualification. 8. Miles purchased is non-refundable. 9. Buy Miles is not available for purchase at Malaysia Airlines Call Centre & ticket offices. 10. The use of Buy Miles is subject to the Terms and Conditions of the Enrich programme. 11. Malaysia Airlines reserves the right at its sole discretion to vary or amend any of the terms and conditions herein at any time, without any prior notice. 12. Buy Miles transactions are processed by Malaysia Airlines partner Loylogic Rewards FZE and its affiliates, including Loylogic Inc ( Loylogic ). 13. In order to process the Buy Miles transactions, Enrich members have to provide their personal data including name, email address and credit card information. Enrich members consent to their personal data being collected and processed by Malaysia Airlines and Loylogic and such personal data being shared with third party providers for the purpose of processing and completing necessary transactions, including advising Malaysia Airlines of the number of points to be credited into Enrich accounts. Malaysia Airlines and Loylogic shall not be liable for any incorrect personal data received or submitted as governed by Loylogic s Privacy & Cookies Policy and Malaysia Airlines Personal Data Privacy Policy. 14. Consent to Transfer and Use: Enrich members have further acknowledged and agreed that by providing Loylogic with any personal or proprietary information, Enrich members hereby give their consent to the transmission of such personal or proprietary information over international borders for the purpose of processing the relevant transactions. Enrich members hereby give their further consent to the use of such personal data on an anonymized basis for statistical objectives. 15. Malaysia Airlines shall not be liable for any disruption during the Buy Miles transaction, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of any disruption, reasonable effort shall be used to remedy the disruption and resume the Buy Miles transaction on a fair and equitable basis to Enrich members. 16. Malaysia Airlines reserves the right to cancel, terminate or suspend the purchase of Buy Miles without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by MAB shall not entitle any Enrich member to any claim or compensation against Malaysia Airlines, its agents and employees for any and all losses or damages suffered or incurred as a direct or an indirect result of the act of cancellation, termination or suspension thereof. 6
17. The Terms and Conditions herein shall be construed, governed and interpreted in accordance with the laws of Malaysia. Members agree to submit to the exclusive jurisdiction of the Courts of Malaysia over all matters arising from this Buy Miles transaction. 18. Malaysia Airlines reserves the right to reverse or remove any Buy Miles credited into an Enrich member s account incorrectly or not in accordance with these Terms and Conditions at any time without prior notice. 19. By participating in this Buy Miles transaction, it is deemed that the Enrich members have read and agreed to be bound by these Terms and Conditions. Any breach of these Terms and Conditions may, at Malaysia Airlines' absolute discretion, result in forfeiture of any of miles purchased. 20.
