3 EU telecoms/digital policy and regulation directly impact your business The European institutions may seem remote to some, but it s the European Commission that: Puts forward the Telecoms Framework for all national telecom legislation Determines the 'markets which national regulators examine Evaluates national market analyses and vetoes decisions of national regulators The European Parliament and Council negotiate the legislation put forward by the Commission BEREC, the European Regulators Group, is developing EU-wide positions on key issues and is establishing best practice guidelines on regulation of fixed and mobile markets Telecoms regulation impacts operator business models in both short and medium term and is the key enabler of market entry and expansion for challengers ECTA is actively influencing policy & regulation on behalf of its members and is recognised as a major stakeholder: Listen to what stakeholders think about ECTA. 3

4 The pro-competitive & challenger community must act now! Between 1994 and 2012, competition was a priority in EU institutions as the key driver of innovation and investment Today, there is a danger that EU institutions and national decision makers deprioritise the procompetitive approach as they shift their focus towards investment Incumbent operators are stepping up and dedicating enourmous financial and human resources to influence Brussels decision making If the EU telecoms regulatory framework changes to favour incumbents, the impact on national markets and operators will be unprecedented. This is a real risk which already materialises in the draft Electronic Communications Code Pro-competitive voices must become more united and speak up... Loudly! 4

We have successfully influenced EU policy and brought about change: The European Commission s Digital Single Market strategy recognises that effective competition is a key driver of efficient network investments Anti-competitive aspects of the European Commission s 2013 Single Market Proposal deleted by the EP and then also by the Council The legislative process was reduced to roaming and net neutrality Key wholesale markets especially markets 4 and 5 maintained on the list of Relevant Markets as distinct markets (now markets 3a and 3b) Positive outcomes from submission of ECTA letters to the Article 7/7a process with involvement of members Effective ECTA intervention in national implementation cases upon request by members High-Level Dialogue of Member States on Connected and Automated Driving Every year, we secure multiple meetings for ECTA member CEOs and with senior representatives from the EU institutions Recently Vice-President Katainen, Vice-President Ansip, Commissioner Oettinger and Commissioner Vestager Previously President Barroso, Vice Presidents Viviane Reding and Neelie Kroes Director Generals and Deputy Director Generals Influential Members of the European Parliament e.g. Pilar Del Castillo, Miapetra Kumpula-Natri, Michał Boni, Kaja Kallas, Gunnar Hökmark, Adina-Iona Vălean, etc. 7
