1 STELLING MINNIS PARISH COUNCIL MINUTES of MEETING held on 6 th July 2016 Present: Cllrs, Hubble (chaired meeting), Day, Dimmock, Haffenden, Stephen and Watts. SDC & KCC Cllr Carey. Also present Mr N Smith (Clerk, took minutes) and 1 Parishioner. Cllr Hubble opened the meeting and read the statement on filming and recording during the meeting. 1. APOLOGIES FOR ABSENCE SDC Cllr Hollingsbee Cllr Johnson (work reasons) 2. TO RECEIVE DECLARATIONS OF INTEREST ON AGENDA ITEMS 2.1 Disclosable pecuniary interests (DPI). 2.2 Other significant interests (OSI). 2.3 Voluntary announcements of other interests. No interests were declared. 3. MINUTES OF MEETING Held on 4 th May Were approved subject to an amendment to be added at the end of 7.2.1, requested by Cllr Day, under item I have sent over 100 individual letters from local residents in support of Lyminge Pharmacy to our MP Damian Collins. Proposed Cllr Haffenden and seconded Cllr Day. All agreed. The minutes were duly annotated with the amendment and signed. 4. MATTERS ARISING (not included in other agenda items) 4.1 Synopsis of discussion by SMVH committee on Broadband to be given to Cllrs. Cllr Stephen reported that SMVH committee did not want to be involved in or responsible for any provision of Broadband in the Village Hall. 4.2 Request of SMVH Committee to include SMPC on distribution list for minutes of Meetings. Clerk reported that he had made a request to the SMVH secretary, but had not received a response, to date. 4.3 Request SDC to advise on Council Tax Bands for the 2 properties forming Meadow View. Clerk reported that he had contacted the rating and valuation team and had received confirmation that 1 of the properties was now valued at property band A from 1/4/16. SDC Cllr Carey was able to confirm that the 2 nd property had now also been valued at band A. 5. QUESTIONS FROM MEMBERS OF THE PUBLIC OR COUNCILLORS. No questions were raised. 6. CORRESPONDENCE 6.1 To table items of late correspondence. 6.2 Items circulated for information Shepway Licensing Policy Statement Consultation. Noted Shepway Community Chest Cllr Hubble confirmed that a business case would be made to seek funding for improvements to the Rose & Crown triangle from the Community Chest KALC Shepway Area Committee minutes of April meeting and agenda for 16 th June meeting. Noted SDC Town and Parish Council user Group minutes of 11 May meeting. Noted. 545
2 6.3 Items acted on: KALC cost cutting survey. Clerk confirmed that he had completed the survey and outlined responses given on topics of refreshments and documentation. 6.4 Items for discussion KALC training and development policy template. Will need to be further considered after March 2017, if new Clerk is to seek professional qualification and if Council wishes to become a Quality Council SDC Planning Validation Requirements. Clerk reported that a Design and Access statement was no longer a requirement for Householder applications Music event 30 July, Jubilee Farm. Brought to Clerks attention by Elham PC. SDC Cllr Carey reported that Lyminge PC were very supportive of the event and that SDC would be likely to licence the event on application, if there was not a history of any problems. She said that the event seemed to be very well thought out including provision of bus transport from Canterbury. Clerk was asked to seek to have the Jubilee Farm brown sign on Stone Street pointing to Curtis Lane, re-aligned to point towards Six Mile Garage, which was actually the best route to Jubilee Farm SDC Otterpool development. Thought that this could have an indirect impact on SMPC. SDC Cllr Carey outlined the reasons why SDC had purchased the land and was seeking development. Development would include all infrastructure and because it would provide Shepway's housing needs for 30 years, would benefit other Parishes by restricting development in their areas as such needs would have been met. The land is currently farmed and income exceeds purchase costs CPRE - Government must stop unnecessary Greenfield development. Discussed at great length. Cllrs felt that whilst the principle of no development on Greenfield sites was an ideal, there would be instances where it could be beneficial, with Stonegate Farmers potential development being cited as an example because it is an unused concreted agriculture site on which residential and light commercial development would benefit the communities. Clerk to draft a response to CPRE. 7. PLANNING 7.1 To table late planning applications received for consideration. 7.2 To table planning applications dealt with since last meeting including decisions by Planning Authority Y16/0383/SH Land adjoining The Paddock, Bossingham Road. Construction of B1 use unit. SMPC voted no objection 7:0. Note added to restrict any conversion to residential accommodation + fencing looks Urban. SDC approved with time, material and commercial use only restrictions Y16/0469/SH Sarradown House, Minnis Lane SMPC No objections 7:0. SDC Approved with time and material conditions Y16/0421/SH St Mary s Church Stelling car parking access. Noted that Kent Highways now had no objections to the revised arrangements. SMPC Approve 7:0. Not yet decided by SDC Y16/06321/SH Newlands, Curtis Lane. Currently on circulation to Cllrs Y16/0654/SH Timbercombe, Minnis Lane Currently on circulation to Cllrs. Missing drawings now obtained. 7.3 To table decisions by Planning Authority on applications dealt with before last meeting. 546
3 7.4 Other planning matters: Stonegate Farmers. Cllr Hubble reported that the developers had advised that a planning application had been made for demolition of buildings on the site. Clerk advised that to date it had not been sent to SMPC. Mention was made of the need to ensure a legal definition for the low cost/starter homes etc. was included in any planning application approval conditions, to ensure that these could be enforced in law if necessary. SDC Cllr Carey said that the conditions must be legally enforceable. Cllr Dimmock to advise Clerk of contact information from a planning course he had attended. Clerk to ascertain correct terminology which would be acceptable to SDC planners and be legally binding. Late addition to agenda, agreed by Cllrs Meadow View. Cllr Haffenden advised Council that the owners of the Minnis had made a charge on Meadow View for the access, over Stelling Minnis Common, from the two residential properties on site. He advised that the existing access was for agricultural access rights. Residential access rights would not include commercial vehicle rights and the owners would appreciate advice of any such activity. It was noted that Kent Highways were now supportive of the 50mph speed limit on Stone Street in the vicinity of the site. 8. WEB SITE 8.1 Update. Webmaster advised that a video of 10K run had been added to that page. This will be removed at the end of July because of server space taken up. All Kent Parishes web site may start charging for their services does not affect SMPC, although we do have just one page to link to our own web site Now confirmed that KCC will absorb any charges. No change needed to the Kent Parishes web page. 8.2 Off site safe storage of all Parish Council data. Clerk advised that in addition to local back-up he was now also using Drop Box. 9. STELLING MINNIS COMMON 9.1 Fencing proposal update. Cllr Haffenden reported on the Visit by Minnis Managers and owner to Epping Forest re their Invisible Fencing; they saw cattle being trained to use the fencing and grazing within the enclosed areas; the grazier had not yet been able to visit a site with similar fencing. Now is the time to explore all opportunities for grazing the common. Nothing had yet been decided. The existing time limited fencing agreement expires in Feb 2017, however he had received assurances that as long as an active application was in place DEFRA would not enforce removal of the fencing. 9.2 Other Stelling Minnis Common matters. None 10. REPORTS 10.1 Kent County Council. KCC Cllr Carey said that she was sorry she had missed the APM in May, but there were 2 on the same evening, she had attended every previous APM since being elected as KCC Cllr. She said that HMG had just announced their decision on the Lorry Park at M20 J11, which was the option with direct access and exit to the M20 this was considered to be the best of the options offered by Highways England. Highways England had permitted development rights, so there would not be a planning application to either SDC or KCC Shepway District Council. SDC Cllr Carey gave Cllr Hollingsbee s apologies and reported on the proposed Otterpool development (see 6.4.4). She also reported that SDC had taken 547
4 enforcement action against illegal HGV fly parking and that in a recent survey SDC had the lowest level of such parking in Kent. She spoke on the Places and Polices plan would go to Cabinet on 14 th September for approval before being published for a six week period of public engagement during October & November. She outlined the places and policies process for new Cllrs. Cllr Hollingsbee had attended the 100 year Commemoration Service of the Battle of the Somme at The Step Short Arch on 1 st July and had laid a cross for casualties we were aware of for our Ward and particularly for Stelling Minnis:- 1. Private Ernest Keeler of Stelling Minnis 2. Corporal Edward Dale of Ivy House, Stelling Minnis 10.3 KALC Shepway Area Committee. No Cllrs attended the last meeting SDC Planning Users Group. No Cllrs attended the last meeting Kent Community Police. No report received from the PCSO 10.6 Minnis Managers. Refer to item Stelling Minnis Village Hall. Cllr Stephen provided a written report at Appendix A. There were no events planned for the summer Stelling Minnis Windmill. Cllr Hubble reported that the Museum opening and the work done were amazing. The Museum is now fully open and various parties of Senior Citizens, school children and other clubs had visited. The Windmill Fete was a success again. Agreed that Clerk should send appropriate congratulatory letters to both Mill & Museum committee and the Fete organisers Other reports Footpath Warden. No report received from Martin Hart Tree Warden. Cllr Dimmock had nothing to report. 11. HIGHWAYS 11.1 Speed limit reduction on Bossingham Road (Minnis Lane to Split Lane) KCC Highways have declined to instigate the limit no evidence of any crash risk Improvements to triangle outside Rose & Crown Highways costs had now been confirmed by Kent Highways at 2K. Cllr Hubble and Clerk will now put together a business case for funding Split Lane, signage to deter large vehicles. Cllr Haffenden reported that he had ensured delivery drivers were given clear instructions on which farm entrance to use Pot Holes Bossingham Road had been both repaired and resurfaced. Formal notice of the road closure for repairs had not been received. Church Lane to be re-surfaced date not yet given. 12. FINANCE 12.1 Update of account for 2016/17 including payments received. RFO updated Council or the bank account status to date. Balance at bank was 7, and after allowing for unpresented cheques ( ) available funds at 31 st May 2016 was ; the end of year prediction was 5,580.47p, allowing for VAT refund and second half payments of Precept and grant Accounts for payment Payments made to be ratified Mickleprint printing APM agenda pack ACRK membership 2016 (as per budget) Payment was approved. Proposed Cllr Haffenden and seconded Cllr Day. All agreed Accounts for payment Clerk Salary Net (Includes National Pay award from 1/4/16) Clerk expenses (Admin costs) Payment was approved. Proposed Cllr Day and seconded Cllr Watts. All agreed Requests for funding. A late request for funding was received Revd. Lynne Rogers for St Mary s Church towards the cost of restoration of the Elizabeth Denward memorial plaque. Clerk said he had pointed Revd. Rogers towards some funding options from both SDC and 548
5 KCC. Agreed that Cllrs would consider the request and make a decision at the September meeting External audit 2015/16 Sent to auditors. Report not expected back till August Application form to be used for small grant requests. Clerk has this in hand Defibrillator unit in Shop provision of external case for 24/7 accessibility. Steve Moores has been asked again about a case. No price given yet. 13. BROADBAND IN STELLING MINNIS VILLAGE HALL The view of Stelling Minnis Village Hall committee had been reported under 4.1.1, the topic to be deferred to September SMPC meeting. 14 PENDING VACANCIES 14.1 Clerk 14.2 RFO 14.1 and 14.2 advertised in July & August Parish Mag and also on web site Councillor casual vacancy Clerk outlined the process to fill a mid-term casual vacancy, which could not commence until formal notice of resignation had been received. 15 ADDITIONAL QUESTIONS FROM COUNCILLORS OR MEMBERS OF THE PUBLIC. 16. DATES OF NEXT MEETINGS 2016: 7 September, 2 November, 2017: 11 January, 1 March, 3 May (AGM), 17 May (APM). There being no other business the meeting was closed at 9.30pm.
