1 COUNTY COMMISSIONERS MINUTES WEDNESDAY, NOVEMBER 18, 2015 The Board of County Commissioners met today in their weekly Commissioners Meeting. Present at today s meeting were: Dennis P. Commissioner Stuckey announced the approval of October 14, 2015 Commissioners Meeting Minutes. Commissioner Stuckey announced the postponed approval of October 7, 2015 Commissioners Meeting Minutes, October 21, 2015 Commissioners Meeting Minutes and October 28, 2015 Commissioners Meeting Minutes. Commissioner Stuckey re-announced a Special County Commissioners Meeting will be held on Tuesday, December 1, 2015 at 6:00 p.m. at the Lancaster County Government Center, 150 North Queen Street Annex, first floor conference room, for the purpose of discussing the proposed 2016 County budget. Public participation is invited. Letter of Commendation for Dave Mueller Chief Juvenile Probation Officer of the Year Award in Pennsylvania Dave Mueller, Director, Juvenile Probation and Parole Commissioner Martin stated that he has worked side by side with Dave for years and he can say that he is truly a class act and valuable member of the County government team. Commissioner Martin further stated that he is a man who has a passion and commitment for the community he is charged with protecting but also the kids he s working with to turn their lives around and serve. Commissioner Martin stated that he is always

2 -2- Letter of Commendation for Dave Mueller Chief Juvenile Probation Officer of the Year Award in Pennsylvania (Continued) looking for new things and have seen the results of his efforts in community based care by driving down very expensive out of county placement costs and getting better results to reduce juvenile recidivism. Commissioner Martin stated that it has been a real honor to work with him over the years and wishes him the best moving forward noting that he knows the Juvenile Probation office will continue to be very well led. Commissioner Lehman stated that he doesn t think that he can say it any better than Commissioner Martin did. Commissioner Stuckey congratulated Dave for all his hard work and all the support he s given the C ounty and juveniles over the years. Commissioner Stuckey stated that they are very proud to present this Letter of Commendation to him. Lancaster County Convention Center Marketing Consortium Presentation Kevin Molloy, Executive Director, Lancaster County Convention Center Mark Moosic, General Manager, Lancaster County Convention Center Josh Nowak, Director of Marketing and sales, Lancaster County Convention Center Jacyn Thompson, Director of Convention Sales, Lancaster County Convention Center Marketing Consortium. Mr. Molloy provided an overview of the economic data collection system they plan to implement that will track the direct spend of those who visit Lancaster County for events at the Convention Center to help determine their economic value. Commissioner Martin stated that when looking back at the collaboration agreement a lot of the focus was to drive down what they were spending on debt however, on the flip side of it, it is this type of growth that also helped cure this situation and is importance to the health of that facility movi ng forward and everything else it imp acts. Commissioner Martin stated that it sounds like they have a lot of great things in the works and that he likes the direction they are g oing to get an idea of what the spend is. Commissioner Martin asked how this fits into the bigger picture now that they are in a little over a full year into the agreement, noting that right now they are getting 100% of the hotel tax and asked how they are doing from what they bud etged, which they took a very conservative approach to how they budgeted the rate of growth of the hotel room, how that has been performing a year later. Mr. Molloy stated that it is performing well and that they are better than 5% and reported that in June they were at 9% but fell and became flat in the second half of the year but with that, they will have collections this year equal to what year five was supposed to be. Commissioner Martin noted their efforts to attract more T ier 1 (larger) event and reported that they had approval to add another 100 beds to the hotel and asked where they were in the process. Commissioner Martin noted the appeal of being able to offer a group 400 beds in one hotel instead of offer ing them 300 here and 100 somewhere else. Mr. Molloy responded that he cannot speak for Penn Square Partners but that he knows they are moving forward with it and reported that the Convention Center Authority voted last M arch to include the developed space to be part of the Condominium Association. Commissioner Martin stated that it does not affect the County or the guarantee so they don t hear as much about that but that it is good to hear. Commissioner Martin noted that in the Collaboration Agreement a lot of people s finances that are intertwined, especially on the revenue piece. Commissioner Martin noted that December 31, 2016 is a pretty big date to some people in terms of the test and asked if they are on target right now with regard to Discover Lancaster receive funding back starting in December 2017, which fits into the broader picture of marketing this whole destination. Mr. Molloy responded that it is and that they have a full year to do, but he would like to say that between what they have budgeted and where they ve seen revenue going, they will receive revenue greater than the projections that were outlined when this whole agreement was set forth. Commissioner Martin stated that that is outstanding. Commissioner Lehman asked when they expect to have collected enough economic data to be able to make a report to the public on the economic impact of the Convention Center and after they have made the report, will they continue to collect data and make reports to the public or will this be a one -time snapshot. Mr. Molloy reported that he hopes that all priority 1 and 2 events will be measured during the period of the Collaboration Agreement and that he would like to think they will go beyond that but has to look at value versus expense because it is not cheap to collect the data. Commissioner Lehman stated that given the large amount of public investment put into this project, he thinks there is a reasonable need for reporting on what the economic impact is of this project and he thinks the public would appreciate, and in some cases probably expects it. On motion of Commissioner Martin, s econded by Commissioner Lehman, it was agreed for the County of Lancaster, acting on behalf of the District Attorney s Office, to approve the following: Grant Award With: Pennsylvania Commission on Crime and Delinquency (PCCD) Harrisburg, Pennsylvania To accept a continuation grant award for year two of Byrne Justice Assistance Grant funding for the Advancements for Improved Forensic Investigations. Grant funding will be used to expand the use of the County s 3D scanner project by purchasing the following: three Enhanced Laser Scanner Data Collectors/Software Controller and Leica Cyclone Survey, Register and Publisher software for each data collector which will allow multiple detectives to review and work with scanner data at the same time; purchase of one Leica External Camera Kit with camera and lenses which will provide higher quality photo overlays on the scanned data; and build two TV carts for presenting 3D generated evidence in court. Not to exceed $79, for the period October 1, 2015 through September 30, 2016 (100% PCCD/JAG funding). Commissioner Martin asked who is building the carts and if they are being built for protective purposes so no one can damage the equipment. Dale Brubaker responded that they will protect from damage noting that each cart will have three televisions on them, one large and two smaller ones on wings on either side. Mr. Brubaker explained that the intent is for the jury, the legal counsel and the judge to all see the evidence at the same time. Mr. Brubaker reported that they will use a contractor associated with the DA s office to build the carts.

3 -3- Grant Award on Behalf of the District Attorney s Office (Continued) Commissioner Lehman reported that when they had the first demonstration at one of their meetings he learned what an amazing piece of equipment this is and further noted that the efficiency of it when investigating a crime scene is huge. Commissioner Lehman stated that there are other benefits to it as well such as the use in the courtroom and having folks see the evidence at the same time. Commissioner Lehman stated that he is glad they are getting a second year grant and complimented them on only requesting the amount of money that they needed which he thinks speaks well of how they approach spending money here in Lancaster County. Commissioner Stuckey thanked Mr. Brubaker for his work on this and on the many other grant opportunities he brings before the board. RESOLUTION NO. 69 OF 2015 On motion of Commissioner Lehman, s econded by Commissioner Martin, it was agreed for the County of Lancaster to approve the following budget adjustments: REVENUE ACCOUNT: District Attorney s Office: Grant No A6311 B $79, (+) EXPENDITURE ACCOUNT: District Attorney s Office: Grant No A7532 B $79, (+) RESOLUTION NO. 70 OF 2015 On motion of Commissioner Martin, seconded by Commissioner Lehman; WHEREAS, Requests for Proposals were issued by the County of Lancaster, on behalf of the Controller s Office, for the following services: Financial and Compliance Audit for a three year base period with two one-year extension options and Triennial Fund Audit for a one year base period; and WHEREAS, Sealed proposals for the Financial and Compliance Audit and the Triennial Fund Audit were opened on Thursday, September 10, 2015; and WHEREAS, An evaluation team comprised of members from the Children and Youth Agency, Commissioners Office and Controller s Office reviewed and scored proposals based on technical merit, participated in vendor interviews, reviewed references and additional questions and answers were asked of the vendors; and WHEEREAS, After extensive review and consideration, the County s evaluation team has recommended the proposals received from SB & Company, LLC for the Financial and Compliance Audit and Reinsel Kuntz Lesher LLP for the Triennial Fund Audit. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF LANCASTER COUNTY, PENNSYLVANIA to authorize the approval and execution of contracts with the following companies, for the services and amounts specified, which were determined to be the best qualified proposals received during the County s evaluation process. Contracts Awarded To: For: Amounts: SB & Company, LLC Financial and Compliance Audit for a three year base period, Hunt Valley, Maryland November 19, 2015 through November 17, 2018 with two one-year extension options: 2015 Financial and Compliance Audit $102, Financial and Compliance Audit $106, Financial and Compliance Audit $109, Reinsel Kuntz Lesher LLP Triennial Fund Audit for a one year $ 9, base period, November 18, 2015 through November 17, Commissioner Martin congratulated them noting that Commissioner Stuckey was the Controller the last time this went out to bid about eight years ago. Commissioner Martin stated that the fact that they are able to see over 30% savings in each of the categories show that competition still works and that he looks forward to getting good results. Commissioner Martin thanked them for their leadership in this and to the whole team for another smooth process.

4 -4- Resolution No. 70 OF 2015 (Continued) Commissioner Lehman stated that competition does work noting that this is a five year period and he hopes going forward that they will bid it out again in five years. Commissioner Lehman stated that he hopes they get into the routine of bidding out things like the audit to make sure they are getting the best competitive price and the best service that they can. Commissioner Lehman congratulated Controller Hurter and Purchasing for moving this forward. Commissioner Stuckey thanked Linda Schreiner, the Controllers Office and Purchasing for heading the process and making the recommendation. Commissioner Stuckey stated that they are happy to support it. RESOLUTION NO. 71 OF 2015 On motion of Commissioner Lehman, seconded by Commissioner Martin; WHEREAS, Requests for Proposals were issued by the County of Lancaster, on behalf of Facilities Management, for custodial services for the following County locations for a two year base period with two one-year extension options: Lancaster County Government Center, Lancaster County Courthouse, Adult Probation and Parole, Youth Intervention Center, Forensics Center, and the Public Safety Training Center; and 26, WHEREAS, Sealed proposals for the above-mentioned custodial services for the County of Lancaster were opened on Wednesday, August NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF LANCASTER COUNTY, PENNSYLVANIA to authorize the approval and execution of a contract with Cleanteam Building Services, Inc., Lemoyne, Pennsylvania, which was the lowest and/or best proposal received, for custodial services for the following County locations: Lancaster County Government Center, Lancaster County Courthouse, Adult Probation and Parole, Youth Intervention Center, Forensics Center, and the Public Safety Training Center. The total contract amount shall not exceed $943, for a two year base period, December 28, 2015 through December 27, 2017, with two one-year extension options, subject to the filing of a performance bond. Commissioner Martin thanked them noting that this is a difficult process and anytime it impacts employees they are sensitive to that. Commissioner Martin stated that they are thankful for their service over the years and expressed his hopes that there will be opportunity for many of them to join the new team. Commissioner Martin reported that they have a hybrid system right now that is partially privatized, with 80% of square footage with a private company that was costing about $160,000 year and the reaming 20% square footage handled in-house and costing close to $500,000 a year. Commissioner Martin stated that with budgets being so tight, they have to look at these types of things and reported that they ve been very pleased with the company. Commissioner Martin noted that they put this out to bid every so often. Commissioner Martin stated that he believes they will continue to get good service but also in terms of efficiency of how their dollars are spent as well as for the taxpayers, he thinks this is the right way to go. Commissioner Martin thanked those involved for a very long process and a lot of analyzing with this. Commissioner Lehman asked if the estimated savings is for the two year base period. Ms. Schriener responded that it is. Commissioner Lehman asked if there were option years, if they did any estimation on what the additional savings would be if option year three and four were exercised by the county. Mr. Sload responded that there would be reoccurring annual savings to the county if the option years are exercised. Commissioner Lehman stated that it is never an easy decision to outsource a service or function when employees are impacted. Commissioner Lehman stated that the decision today to outsource custodial services is absolutely positively not a reflection on the employees who work for the County. Commissioner Lehman stated that they are a group of committed, dedicated professionals who have absolutely served Lancaster County well and should not be reflected in any negative light whatsoever as a result of the decision made today. Commissioner Lehman stated, having said that, government must always be looking for efficiencies and to save money where it can. Commissioner Lehman stated that some of the audience probably heard him do one of his favorite rants in the midst of the great recession that government gets it wrong and only looks for efficiencies when the economy is in the tank, which is the absolutely worse time for government to look for efficiencies. The time for government to look for efficiencies is every single day and sometime that means that government can do things more efficiently in-house, like bringing in Children and Youth Attorneys in house, but here it is more efficient and cost effective for the County to have custodial services outsourced. Commissioner Lehman stated that they need to continue to look at efficiencies in that comprehensive way where sometimes it will be outsourcing and other times might be bringing something back in-house and they need to be open to these efficiencies on both sides if government is ever going to be as efficient as they possible can. Commissioner Lehman again thanked the employees for their service and that no decision today should be viewed as a negative on them and what they provided and their dedication to the County. Commissioner Stuckey thanked the employees noting that it is not a reflection on them but it is their responsibility to cut costs and keep or improve efficiencies. On motion of Commissioner Martin, s econded by Commissioner Lehman, it was agreed for the County of Lancaster, acting on behalf of the County Prison, to approve the following: Agreement With: Support for Prison Ministries Lititz, Pennsylvania To provide chaplaincy services to inmates incarcerated at the County Prison.

5 -5- Resolution No. 71 OF 2015 (Continued) Not to exceed $82, for the period January 1, 2016 through December 31, Commissioner Martin stated that they have to provide this service and have to meet all religious needs and also do scree nings and check for licensing of pastors and coordinate visits. Commissioner Martin stated for confirmation that this is flat funded. Mr. Shiffer responded that it is. 6 Philadelphia, PA Personal Care Expenses $3.00/day -6- Lancaster County Commissioners Meeting Agreements on Behalf of Children and Youth and Juvenile Probation and Parole (Continued) Youth Services Agency ACT Camp (Boys) Jim Thorpe $153.50/day Jim Thorpe, PA ACT Camp (Girls) Kunkletown $153.50/day Ms. Crystal Natan congratulated Mr. David Mueller on receiving the Chief Probation Officer of the Year in PA noting the great working relationship they ve had over the years and that she is proud to be a team member with him. Ms. Natan noted that the budget impasse is starting to impact their providers as they have not been able to pay many of their providers who are continuing to serve their children and have them in placement. This has taken a financial toll on some of the providers. Ms. Natan reported one specific provider who will not have funds beyond December 1 and at that time they will be turning the children back over to the County and we will have to find other placements. Ms. Natan reported that they currently have nine children, six from Children and Youth and three from Juvenile Probation and Parole which is a specialized program for young sex offenders. Although all the providers are very committed to serving the children, this is something they are hearing more and more. Commissioner Martin asked if this is a residential facility. Ms. Natan responded that it is a specialized foster care setting so it is a foster home but with specialized treatment for certain behaviors. Commissioner Martin asked if they would still be placed with foster families if they can find homes that meet those needs or if a place cannot be found they would be moved to the Youth Intervention Center s Shelter. Ms. Natan responded that is correct noting that many of them would be hard to place. Commissioner Martin noted that they knew that the shoe would drop eventually, recognizing that they are only talking about one today but that they have many providers and that if this becomes a larger issue, they only have so much room and so many options and that this could potentially become a public safety issue. Mr. Mueller thanked the Board of Commissioners for recognizing him noting that one thing he has always enjoyed is his relationship with the Board of Commissioners. Mr. Mueller explained that, working in the judicial branch of government, there are often things happening above him that put stress between the branches of government, but that he has always felt welcomed with this board and stated that they have always given him a great deal of respect and that they are all pulling in the same direction. Mr. Mueller acknowledge his relationship with Crystal Natan explaining that in his mind, the child welfare budget is one child welfare budget no matter what system they are in and that often the children will cross over systems. Commissioner Lehman stated that Dave said it best it can be said, that it is all about the kids. Commissioner Lehman continued to state that he thinks Mr. Mueller s recognition reflects what is really in his heart and that it is what it made it easy for them to recognize him because of who he is and what he has done and continues to do for the County and kids here in Lancaster County. Commissioner Stuckey congratulated Dave and noted that they appreciate the cooperation between the two departments. Commissioner Stuckey expressed his concern with having to find facilities for these children within the county noting that it will be no small task and that he hopes something can be done in Harrisburg soon to relieve the pain that has been building all the time. Commissioner Lehman provided comment on the budget only as it relates to impacts on counties recognizing that there are also impacts on school districts and other organizations. Commissioner Lehman stated that part of the reason this budget impasse has not been as loud as the others is that county government and service providers have held things together because they care about what they do. Commissioner Lehman further stated that as both Commissioner Martin and Ms. Natan indicated, they are really getting to the end of that where things are really going to start to break and fall apart. Commissioner Lehman stated that it is truly unfortunate that those who will be impacted by this are those who need services and in his mind that is unconscionable. Commissioner Lehman stated that the folks in Harrisburg should be ashamed of themselves because it is long past figuring out how to get a State budget in place and as things linger he hopes and prays that they do come to a resolution so that the folks that should never have been impacted by this budget impasse to begin with, will not be impacted by it any further than they already have. On motion of Commissioner Martin, s econded by Commissioner Lehman, it was agreed for the County of Lancaster, acting on behalf of the Purchasing Department, to approve the following: 1. Agreement With: Constellation De Pere, Wisconsin To lock in the Basis Pricing for transportation of natural gas from the pipeline into the Natural Gas utilities system for high volume transport to the following County locations: Lancaster County Government Center, Lancaster County Courthouse, Youth Intervention Center and the Prison. $0.545 DTH for a three year period commencing January, Agreement With: South Jersey Energy Hammonton, New Jersey To lock in the Basis Pricing for transportation of natural gas from the pipeline into the Natural Gas utilities system for low volume transport to the following County locations: Adult Probation and Parole, Forensics Center, and the Public Safety Training Center. $1.06 DTH for a three year period commencing January, Commissioner Martin thanked Mr. Klinger noting that the process he has put in place with Providence is night and day different for them in terms of purchasing energy with all its volatility and markets. Commissioner Martin reported that it has become a much smoother process and one that has also yielded a savings. Commissioner Martin congratulated Mr. Klinger and Providence.

7 -7- Agreements on Behalf of the Purchasing Department (Continued) Commissioner Lehman added his appreciation. Commissioner Stuckey thanked Mr. Klinger and pointed out that because of natural gas they project some savings for next years and that it is benefiting Pennsylvania in terms of counties and municipalities. On motion of Commissioner Lehman, s econded by Commissioner Martin, it was agreed for the County of Lancaster to enter into Contracts of Sale of Agricultural Conservation Easements with the following property owners: Name/Township Type of Easement County Share State Share Michael S. Buckwalter Perpetual $0.00 $282, East Donegal Township The Commissioners also certify that the Michael S. Buckwalter property, consisting of acres, is located in an Agricultural Security Area in East Donegal Township. Name/Township Type of Easement County Share State Share Nelson K. and Mary L. Ginder Perpetual $0.00 $342, Rapho Township The Commissioners also certify that the Nelson K. and Mary L. Ginder property, consisting of acres, is located in an Agricultural Security Area in Rapho Township. Mr. Knepper reported that, including these two farms and the County s total, they will have preserved 912 farms on 77,382 acres. Commissioner Lehman noted that they are bargain sales which enable them to leverage County dollars. On motion of Commissioner Martin, s econded by Commissioner Lehman, it was agreed for the County of Lancaster, acting on behalf of Behavioral Health/Developmental Services (BH/DS), to approve the following: Amendment No. 7 to HealthChoices Behavioral Health Agreement With: Commonwealth of Pennsylvania Department of Human Services Harrisburg, Pennsylvania This amendment is specific to the Department of Human Services implementation of a Pay for Performance Program commencing January 1, 2016 for all Primary Contractors, with the ultimate objectives of improving the quality of healthcare and reducing Medical Assistance expenditures through greater integration and coordination of behavioral health and physical care services. Term: Effective January 1, Commissioner Martin state that these are very expensive categories they are addressing. Commissioner Martin reported that they will put these higher standards not just medical assistance but on all the funded programs that flow through HealthChoices, and that he hopes that it will have a good ripple effect to make those dollars to go a lot further. Mr. George agreed. On motion of Commissioner Lehman, s econded by Commissioner Martin, it was agreed for the County of Lancaster, acting on behalf of Behavioral Health/Developmental Services (BH/DS), to approve the following: 1. Amended Agreement Cerebral Palsy Association of Chester County, Inc.
