1 PUBLIC MEETING - REZONING APPLICATIONS In accordance with the provisions of the Planning Act, S.O., 1983, a Public Meeting was held by the Bracebridge Municipal Council on November 23rd, 1988 in the Municipal Council Chambers, commencing at 7:30 p.m. to consider rezoning applications (Kruckel), (Curtis{Remax)), (Marcinkowski), (HiView Motel), {Rodwell (Alice)), (Ursano), (Britton), (Berenger Property Group (Beatty)). All members of the Bracebridge Municipal Council were in attendance. (a) (Curtis-Remax) This application was held concurrently w~_th a meeting of the District Municipality of Muskoka to consider Official Plan Amendment #79 which included the property that is the subject of this rezoning application. (ii) Margaret R. French, Principal Planner for the District Municipality of Muskoka, the application does not conform to the District Official Plan, as amended, noting however, that an amendment is before the District Planning Committee (Amendment #79) to alter Plan and suggesting a clause be added to the by-law making the rezoning by-law subject to the approval of this amendment. Ross Curtis & Doug Morrison, on behalf of the applicant, attended the meeting and made representation with respect to the application. Mr. Bill Hamblin, Wellington Street, Bracebridge, on behalf of Betty Hamblin, advised the meeting that when he sold his property he was told it was not going to be used commercially. He was advised that his former property was not included in this rezoning application. Mr. Bruce Lougheed, 8 Southview Crescent, Bracebridge, made enquiries concerning the use of the back of the property and the amount of rock on the site. 2 (ii) Margaret R. French, Principal Planner for the District Municipality of Muskoka, the application generally conforms to Plan of the Muskoka Planning Area. (iii) CN, requesting that the proposed rezoning incorporate a 30 metre setback as set out in their requirements for a secondary main line and that the development agreement incorporate provisions for their standards for noise, vibration and safety. French, Principal Planner, Plan of the Muskoka Planning Area and further requesting that Council consider the option of requiring the provision of full municipal services as set out in a memo from the District Public Work's Department which accompanied their letter. 3 Doug Morrison of Cambrian Planning Consultants, on behalf of the applicant, attended the meeting and made representation with respect to the application, explaining the plan and the situation concerning existing lodging rooms in the basement. Mr. Morrison outlined that this building has been inspected and discussed with fire safety officials. (e) (Rodwell - Alice Street) (ii) Margaret R. French, Principal Planner, (iv) R.E. Heaton and Ida M. they are in support of submitted. (Jones) Heaton, the rezoning application as Dave Rodwell, applicant, attended the meeting and made representation with respect to the application and indicated that it is his intention to provide this type of development for retirement homes, considering their limited size and noted that the proposal meets all zoning requirements and that the view of the building from each of Alice and,'ioodward Streets would appear to be a single family dwelling. Mr. Bob Frewin, 136 Front Street, noted that the homes adjacent to the subject property are too close and that this type of development, being a duplex, would not fit in with the existing homes in this area any more than it would fit in one of the new subdivisions. 4 Mr. Joseph Ursano, applicant, attended the meeting and made representation with respect to the application, noting that he only wants to regularize the existing situation within the subject building. Mr. Bob Frewin, 136 Front Street, Bracebridge, noted that this application is right beside the application for a similar rezoning made last Spring which was refused by the Municipal Council and noted that the apartment that presently exists within the building was created without approval by the previous owner. He noted that he is opposed to this application for the same reasons as for the previous application on an adjacent lot and advised the Committee that there are plenty of multiple residential units in the area now. Other information definitions of R1 lived in this unit was provided to the meeting concerning the Special compared to R2 and as to who has in the past. (g) (Britton) (ii) Margaret R. 5 (iv) Ministry of the Environment asking that their Ministry be assured that no remnants of the previous fuel depot business have contaminated the soil on the property, requesting a consultant provide a study for their review. accomplish the purpose required, and advised that the Ministry of the Environment have noted to him that their letter does not constitute an obj ection and that a consultant's report on the soil is already being carried out. Mr. Chris Tarrant and Pat Martin, attended the meeting and outlined their proposal, noting that the lot coverage that they propose is much lower than that allowed by the existing by-laws, more parking than required is being supplied and noted that they are very sensitive to the docks on the river issue. He pointed out that they have provided for seven (7) docks for the fourteen (14) units and pointed out that in their opinion, this proposal is a much better use of this land than its present use. Mr. Steve Newroth, 157 Holditch Street, Bracebridge, advised the Committee that he is not at all opposed to the development but is concerned about safety on the Muskoka River. He noted that the river at this particular location is about 1/2 as wide as it is in front of the Riverside Inn and that he has experienced a great deal of erosion on his propoerty which is located across the river from the subject property. Mr. Newroth suggested that the same ratio for docks to units be applied to this development as for the Riveredge development. Mr. Stan Ridings, Box 2613, 205 Holditch Street, Bracebridge, advised the meeting that he endorsed Mr. Newroth's points of view. Mr. Lorne Askin, Holdi tch Street, Bracebridge, said that he felt the project was a fine one but suggested that all the docks be made similar to those in other projects on the same side of the river. Chris Tarrant responded to some of these concerns, noting that two units have been added to their original plan but that the building perimeters have not been changed. He also pointed out that the docks proposed are 7 feet wide by 20 feet long and result in an angle parking formation into the bank of the river. Mr. Newroth again addressed the meeting, presenting letters wi th respect to the proposal from Mr. Gil Scott and George Usaty. Both commenting that they are concerned with the allowance for dockage at the river bank as shown in the proposal. Mr. Newroth pointed out that the river is 100 feet wide at this particular point and the area that is available to boat traffic is reduced by 20 feet on each side due to the sand bank of the river. Mrs. Ridings, 205 Holditch Street, stated that private homes on the opposite side of the river, ranging in frontage from 100 to 140 feet, only have one dock and that the dockage shown on the proposed plan is just too much for the frontage of the property.
