1 RESOLUTION NO. 86 A RESOLUTION OF THE GOVERNING BOARD OF THE VALLEY REGIONAL FIRE AUTHORITY ESTABLISHING A RETIREE MEDICAL BENEFIT WHEREAS, the Valley Regional Fire Authority (Authority) is a political subdivision of the State of Washington, created and established pursuant to Chapter of the Revised Code of Washington (RCW); and WHEREAS, the Governing Board of the Authority has determined that it is in the best interest of the Authority and its employees to establish a retiree medical benefit (benefit) for its employees; and WHEREAS, the Authority has determined that this program provides a cost savings greater than the cost of the benefit. NOW THEREFORE, THE GOVERNING BOARD OF THE VALLEY REGIONAL FIRE AUTHORITY, DOES RESOLVE AS FOLLOWS: Section 1. A retiree medical benefit shall be established with the following stipulations: 1. The benefit will be available to employees of the Authority, except those that participate in the LEOFF 1 retirement system, will become effective on January 1, 2012 and is not retroactive; Page 1

Employees must be at least 53 years old on the date of retirement and they must have at least 25 years of service within a State of Washington Department of Retirement System plan, or a combination of age and years of service which equals 78 or greater. The finals years (sixty service months) of service in the authorized retirement system must have been with the Authority; 3. The benefit rate will be $440 per month, payable into the individual retiree's VEBA plan; 4. The benefit will end after 12 years, upon the employee's eligibility for Medicare, or upon the death of the employee, whichever occurs first; 5. The benefit will be limited to 5 (five) employees per calendar year. Availability will be by seniority and/or in the order of receipt of the intent to retire by the VRFA based on the terms identified in Section 6. Employees will provide at least 3 months notice of their retirement date. The retirement date must be in either the current or following calendar year. Notice of retirement for the following calendar year can be made beginning on October 1 of the current calendar year; Page 2

3 7. If an employee gives notice of retirement to the Authority and subsequently does not retire on the stated date, the benefit will be forfeited forever for said employee and; 8. The Authority and Local agree that this is a permissive subject of bargaining for represented employees that may not drive any future negotiations to impasse. Section 2. If any section, subsection, sentence, clause or phrase of this Resolution is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of the Resolution, as it being hereby expressly declared that this Resolution and each section, subsection, sentence, clause or phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that anyone or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. Administrative Authorization. The Administrator of the Authority is hereby authorized to implement such administrative procedures as may be necessary to carry out this directive. Section 4. Effective Date. This Resolution shall be in full force and effect upon passage and signatures heron. Page 3
