2 PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON CASE NO SWF-PC COPPER RIDGE LANDFILL, LLC STAFF REVIEW OF ESCROW ACCOUNTS AND CLOSURE COSTS Comes now the Staff of the Public Service Commission of West Virginia by Linda S. Bouvette, Counsel, and submits to the Cornmission a summary of its review of the closure and post-closure landfill escrow accounts for the McDowell County Landfill now operated by Copper Ridge Landfill, LLC. Based on information provided by Copper Ridge Landfill, LLC, its engineer and the West Virginia Division of Environmental Protection, Staff believes the current escrow amount of $0.79 per ton ($0.53 per ton for closure costs and $0.26 per ton for post-closure costs) is reasonable and sufficient to ensure adequate funds to properly close the landfill and provide post-closure monitoring. Staff made the following findings: 1. As of December 28, 2017, the landfill has a remaining capacity of 28,031,380 tons and will take 479 years to reach capacity based on an estimate prepared by Copper Ridge s engineer. (Exhibit A.) 2. The current escrow fund balance is $390, (Exhibit B.)

3 3. The current Escrow Agreement needs to be signed by Copper Ridge Landfill, LLC by adding an addendum signature page. (Exhibit C.) 4. A new cell is being constructed at the landfill at an estimated cost of $625,650. (Exhibit D.) 5. Copper Ridge s engineer estimates the closure cost of the landfill to be $1 8,498,800. The post-closure cost is estimated at $529,500. (Exhibit E.) Staff will prepare an Addendum signature page for execution by Copper Ridge Landfill, LLC.
