Please note that you will be unable to invest until we have received the necessary document(s) as described in Step 2 or Step 3 as appropriate. Step 2 (individual investors only) If you are an individual investor(s), please attach certified proof of identity e.g. a copy of your passport, driving licence or identity card. Please ensure that this true copy is certified by your Bank, Notary/Solicitor, Doctor, Embassy, Police or other competent authority operating in a country whose rules on the prevention of the laundering of proceeds derived from criminal activities are equivalent to those applying in Luxembourg. 6 SECTION 5: PAYMENT & DECLARATIONS 5.1 PAYMENT SETTLEMENT Settlement is required on the dealing day. TELEGRAPH TRANSFERS Investments must be settled by telegraphic transfer. For payment in US Dollars, Sterling, and Euro, settlement should be made quoting the applicant s name to the appropriate correspondent bank (see below). For payments in other currencies, applicants should first contact the RBC Dexia Investor Services Bank SA in Luxembourg for instructions before arranging settlement. I/we expressly agree that the Select Fund or RBC Dexia Investor Services Bank SA may, in the event of a dispute before a court in Luxembourg or a foreign court, prove at any time the receipt of instructions given by fax and the method of execution of the said orders - irrespective of the civil or commercial nature of such instructions - by testimonies, notes taken by its employees or presentation of faxes, related thereto or other documents or vouchers deemed appropriate. In a case of instructions given in accordance with the above-mentioned procedure, it is noted that RBC Dexia Investor Services Bank SA is not in a position to verify the original signatures; furthermore, it may prove difficult or impossible to detect forgery. 8 5.4 CORPORATE INVESTORS If you sign the application form on behalf of a corporate body, warrant that you have due authority to do so. A corporation should sign under the hand of duly authorised official(s) whose representative capacity should be stated. The company seal should also be affixed where one exists. 5.5 JOINT APPLANTS If several persons sign this application form the account shall be considered as a joint account of which in the event of death of one of the joint holders, the surviving joint holder(s) may dispose under their joint signature(s). 5.6 IMPORTANT INFORMATION The shares are not offered for sale or sold in the United States of America, its territories or possessions and all areas subject to its jurisdiction, except in a transaction which does not violate the Securities Law of the United States of America. The Articles of Incorporation of the Company permit certain restrictions on the sale and transfer of shares to Restricted Persons and the Directors have decided that United States persons shall be Restricted Persons and are defined as follows:- The term United States Person or US Person shall mean a citizen or resident of the United States of America, a partnership organised or existing under the laws of any state, territory or possession of the United States of America, or a corporation organised under the laws of the United States of America or of any state, territory or possession thereof or any estate or trust, other than an estate or trust the income of which, from sources without the United States of America, is not includable in gross income for purpose of computing United States income tax payable by it. The Company shall be entitled to compulsorily repurchase shares held by United States Persons.
