1 TERMS & CONDITIONS POSSIBLE TENDER CLAUSES 1. Kwikstage / Cuplock materials to form independent / Birdcage / Tower / Scaffolds in m lifts, excluding any adaptions to provide (type of access) for trade as follows: 2. MATERIALS a) 100% materials to be supplied; these to be erected and dismantled each in one operation, but not to cover any area more than once. b) 100% materials to be supplied; these to be erected and dismantled to the progress of your work, but not to cover any area more than once. c) 100% materials to be supplied; these to be erected to the progress of your work and dismantled in one operation, but not to cover any area more than once. d) 100% materials to be supplied; these to be erected in one operation and dismantled to the progress of your work, but not to cover any area more than once. e) ( %) materials to be supplied; these to be erected in one operation then dismantled and re-erected to remaining elevation(s) to the progress of your work, but not to cover any area more than once. 3. CORRECT DIMENSIONS As we have not visited the site, or examined drawings, this price is subject to the above dimensions being correct. 4. EXCLUSIVE OF SCAFFOLD BOARDS This quotation is exclusive of scaffold boards. Should you require us to supply these, we can do so at our current hire rates. Page 2

2 SYSTEMS 5. NUMBER OF SCAFFOLD BOARDS We to supply and place once only No. of Scaffold Boards. Any further movement of these to be your responsibility. NOTE: The boards are the Customer s responsibility for the duration of the contract. Should they be damaged or lost, they will be charged for at the current sale price. 6. OVERTIME This quotation is based on our men working a normal five-day week and is subject to claim outside of this period. 7. PAVEMENT Main contractor to ensure that the necessary permission for scaffolds to encroach upon pavements be granted in writing prior to our work commencing, and for the fixing and maintaining of lights and/or any other ongoing requirements. 8. CRANE 9. TIES We have free use of crane and/or hoist for the raising and lowering of our materials. You are to provide adequate openings to enable us to tie in our structure. You are also to make weatherproof where necessary and make good on completion. NOTE: It is the client s responsibility to ensure that these ties are not removed or altered in any way for the duration of the contract. 10. PLATFORM COVERING Customer to be responsible for supplying, placing and removing any platform covering required - i.e. plastic sheeting, chipboard or ply. Page 3

3 11. ROOF Although we shall take responsible care, we regret that we cannot accept responsibility for any damage caused by or arising out of work off/over this roof. 12 EXCLUSIVE OF CRADLES This quotation is exclusive of cradles. Should you require us to supply these, we can do so at our current Hire rates. 13. ADJOINING PROPERTY You will be responsible for obtaining the necessary permission for us to have access to and erect from an adjoining property. This is to be obtained in writing prior to our work commencing. 14. FIXTURES AND FITTINGS Although we shall take reasonable care, we regret that we cannot accept responsibility for damage caused to fixtures and fittings over which scaffold is erected. 15. ACCESS TO BASE AREA Main contractor to ensure that the base area be reasonably clear for access, compacted and capable of withstanding the extra imposed loading. 16. EXTRA IMPOSED LOADING Main contractor to ensure that the slab/roof upon which our scaffold is based be capable of withstanding the extra imposed loading. Page 4

4 17. ESCALATION 18. VAT a) This quotation is based upon rates ruling at the date of our initial quotation. Any gazetted wage increase will be claimed for and must be allowed for by yourselves. b) (Haylett) Escalation of quoted prices to be charged in accordance with the BCAC (Haylette) Group 4 Adjustment Provision c) (Seifsa) Escalation of quoted prices to be charged in accordance with SEIFSA price and indices tables, CAA Labour, I-Materials, L- Transport. This quotation is exclusive of V.A.T. when invoiced. This will be added to the quoted price 19. RETENTION As the scaffold does not form part of the permanent structure, retention shall not be withheld when payment is made. 20. PROVISION OF LIGHTS Main contractor to ensure that adequate lighting be provided prior to our work commencing, and for the lighting to be maintained during erection/dismantling. 21. PROTECTIVE FAN PLEASE NOTE: The protective fan is solely for the purpose of providing protection to persons and/or property below and is not for loading or access for workmen. Will you therefore kindly ensure that your workmen and those of your other subcontractors are notified accordingly. Page 5

5 22. INVOICING a) We shall invoice 2/3 rds of the total contract price when erection of scaffolding is complete and remaining 1/3 rd on dismantling of scaffold. b) We shall invoice on a pro rata basis for the duration of the contract. These terms will be set out in writing. 23. INSURANCE CLAIM In the event that, having regard to the terms of this contract, the Client or a third party is entitled to claim compensation from the Owner in respect of damage to the Client s or such third party s property, the Client or such third party shall be obliged to give the Owner written notice within a period of 7 (seven) days from the date upon which the event giving rise to such claim has occurred, failing which the rights of the Client or the third party to claim such compensation shall lapse and/or be deemed to have been waived by the Client or the third party. The Client hereby undertakes to advise all relevant third parties of the aforegoing provision of this clause, failing which the Client shall indemnify the owner against any claim by any third party. 24. LOST / DAMAGED MATERIALS Hirer to be responsible for all our materials, from first day of delivery to last date of collection. NOTE: Our materials are not insured whilst in your possession, therefore any equipment damaged, lost or stolen will be charged for as per our Contract Conditions. 25. LEAD TIME We would require a minimum of working days notice prior to the commencement of our work. Page 6

6 26. PERMIT DELAYS We will not be held responsible for any delays caused through no fault of XTREME with particular reference to the issuing of work permits. We reserve the right to claim for time spent awaiting permits at the appropriate dayworks rates. 27. EXCLUSIVE OF ALTERATIONS & MODIFICATIONS This quotation is for the erection and dismantling of scaffolds once only and specifically excludes modifications and alterations to scaffold. Changes to the scaffolding will only be carried out by XTREME after receipt of a written site instruction and will be subject to claim. 28. INCLEMENT WEATHER No claim will be entertained for discounts or free hire for inclement or unacceptable weather should this delay the contract. 29. PROOF OF DELIVERY On contract jobs (i.e. we provide materials, transport and labour), delivery notes signed by our staff will be deemed to be proof of delivery to site. Any losses of material will be for the Customer s account. 30. AVAILABILITY Due to our current workload, this price and job is dependent on availability of materials and labour as well as transport availability and cost. 31. ENGINEERS INSPECTION ( Seating Stands and Public Access) Customer to be responsible for obtaining and costs of Engineering Inspection and Stability Certificates if required by local authorities. A copy of the Inspection Certificate to be lodged with XTREME prior to your using the stand. Should the Customer require XTREME to provide an Engineers Inspection and Stability Certificates, this can be arranged by us. Cost to be agreed in writing and covered by the official order. The cost of the Engineers Inspection and Stability Certificate is not included in the contract price. Page 7

7 32. SEATING EQUIPMENT. All equipment used in the erection of the seating stand will be standard hire equipment. XTREME will not entertain any claims whatsoever for damaged or soiled clothing. 33. CUSTOMER PARTICULAR FORMS (C.P.F) Customers are to fill in CPF Forms and forward to us (completed) before any work will be carried out. Allow plus minus 3 days for credit check reports to be done. 34. TERMS OF PAYMENT PLEASE NOTE: Our terms of payment are STRICTLY 30 DAYS FROM DATE OF INVOICE. Should payment not be received 30 days from date of invoice, interest will be charged at 2% above prime, pro rata d on a daily basis on the outstanding amount. 34 ACCOMMODATION a) The client is to provide acceptable accommodation for our men ( no) at the client s expense. We will provide food monies for our men for the duration of the job. b) We have allowed for accommodation and food money for men. This is for days/nights and is included in the contract price. Any period over the allowed number of days/nights will be for the client s account. Page 8

8 35. OFFICIAL ORDER No contract/hire/sale will be undertaken without an official order, unless alternative, acceptable arrangements for payment have been made. 36. HANDOVER We will issue Handover Certificates for each job. The client s signature is then deemed to be proof of Delivery as well as acceptance of the scaffold. Please read Handover Certificate. Mandatory inspections as prescribed by the O.H.S. Act should follow. 37. BUILDER S ANNUAL HOLIDAY When the contract duration extends through the Builder s Annual Holiday, this time is deemed to be part of the contract period.
