1 DIRECTOR OF SAFETY & SECURITY EMPLOYMENT CONTRACT School Year THIS CONTRACT is made this 20th day of September, 2016, by and between the Board of Education of O Fallon Community Consolidated School District No. 90 (hereinafter referred to as the Board ), and Mark Berry (hereinafter referred to as the Director of Safety & Security ), pursuant to a Motion of the Board at a meeting of the Board held on September 20, 2016 as found in the Minutes of that meeting. W I T N E S S E T H : For and in consideration of the mutual promises hereinafter contained, it is covenanted and agreed by and between the parties as follows: 1. Term. The Board hereby employs Mark Berry as the Director of Safety & Security in and for O Fallon Community Consolidated School District No. 90 for a period of, commencing from the agreed upon start date as per board approval through and including June 30, The annual contract of 210 days will be prorated for the school year based on the agreed upon start date. The contract may then be renewed or extended on or before June 30, Duties. The duties and responsibilities of the Director of Safety and Security shall be all those duties incident to the Director of Safety and Security as set forth in the job description for such position attached hereto and incorporated herein as Exhibit A. In addition, the Director of Safety and Security shall perform such other duties normally performed by an employee in like position as from time to time may be assigned to the Director of Safety and Security by the Superintendent of Schools or the Board. The Director of Safety and Security must hold and maintain a permit to carry a concealed weapon in the State of Illinois. 3. Salary. In consideration of the performance of the duties of the Director of Safety and Security, the Board shall pay to the Director of Safety and Security as base annual salary, the total sum of Sixty Thousand Dollars ($60,000), which amount shall be payable in substantially equal installments in accordance with the payroll procedures of

2 the District. This amount shall be prorated for the school year based on the agreed upon start date. 4. Evaluation. The Director of Safety and Security shall be evaluated by the Superintendent of Schools in conformance with established Board policy. Annually, but no later than June of each year, the Superintendent of Schools shall review with the Director of Safety and Security, the Director of Safety and Security s progress toward established goals and working relationships among the Superintendent, the Board, the faculty, the staff and the community, and shall consider the Director of Safety and Security s annual salary for the next subsequent year of the Contract. 5. Extension at End of Term. At the time of the annual evaluation and assessment under this Contract, the Board and the Director of Safety and Security shall engage in discussions from which the parties may mutually agree to extend the employment of the Director of Safety and Security. If the Board determines not to extend the Contract, the Board shall notify the Director of Safety and Security in writing so that the Director of Safety and Security receives the notice not later than April 1, Discharge for Cause. Throughout the term of this Contract, the Director of Safety and Security shall be subject to discharge for cause provided, however, the Board shall not arbitrarily or capriciously call for dismissal and the Director of Safety and Security shall have the right to service of written charges, notice of hearing and a hearing before the Board. Failure of the Director of Safety and Security to fulfill the obligations agreed to in this Contract will be good and just cause for discharge. If the Director of Safety and Security is to be accompanied by counsel at such hearing, all such personal expenses shall be paid by the Director of Safety and Security. Failure to comply with the terms and conditions of this Contract shall also be sufficient cause for purposes of discharge as provided in this Contract. 7. Disability. Should the Director of Safety and Security be unable to perform the duties and obligations of this Contract, by reason of illness, accident or other cause beyond the Director of Safety and Security s control and such disability exists for a period of more than six (6) months, the Board, in its discretion, may make a proportionate deduction from the salary stipulated. If such disability continues more than one (1) year, or if such disability is permanent, irreparable or of such nature as to make the 2

3 performance of the Director of Safety and Security s duties impossible, the Board, at its option, may terminate this Contract, whereupon the respective duties, rights and obligations of the parties shall terminate. 8. Termination of End of Contract Term. The termination at the end of the term of this Contract shall be as provided by law. 9. Termination by Agreement. During the term of this Contract, the Board and the Director of Safety and Security may mutually agree, in writing, to terminate this Contract. 10. Referrals to Director of Safety and Security. The Board and its individual members collectively and individually shall refer promptly all criticisms, complaints and suggestions called to their attention to the Director of Safety and Security for study and recommendation. 11. Sick Leave. The Director of Safety and Security shall be entitled to thirteen (13) days of sick leave annually. Sick leave shall be subject to such other provisions as may be contained in School District policies, rules and regulations. 12. Personal Leave. The Director of Safety and Security shall be entitled to three (3) days of personal leave annually. Personal days shall not be cumulative. 13. Medical Insurance. For the remainder or 2016 the Board shall pay $620 per month toward Employee only insurance; $840 per month toward Employee Plus Spouse/Child; or $918 per month toward Full Family medical insurance available through the Board s group insurance carrier. Beginning January 2017 the Board shall pay $645 per month toward Employee only; $865 per month toward Employee Plus Spouse/Child or $943 per month toward Full Family for major medical insurance coverage available through the Board s group insurance carrier. 14. Criminal Records Check. Pursuant to the 105 ILCS 5/ , boards of education are prohibited from knowingly employing a person who has been convicted of committing or attempting to commit the named crimes herein. If a fingerprint based criminal records check required by Illinois law is not completed at the time this Contract is signed, and the subsequent investigation report reveals there has been such a conviction, this Contract shall immediately become null and void. 3

4 15. Other Work. With the prior approval of the Superintendent, the Director of Safety and Security may undertake consultative work, speaking engagements, writing, lecturing or other professional duties and obligations. 16. Professional Meetings and Dues. With approval in advance by the Superintendent, the Director of Safety and Security shall be authorized to attend appropriate professional meetings at local and state levels, the expenses of said attendance to be incurred by the District in accordance with District policy. In addition, the Board shall pay the cost of the Director of Safety and Security s annual membership dues in one (01) professional organization of the Director s choice. 17. Mileage and Expenses. The Board shall pay 44.5 cents per mile to the Director of Safety and Security for vouchered reimbursable mileage expenses incurred by the Director of Safety and Security while using the Director of Safety and Security personal vehicle for the conduct of approved District business. Reimbursement shall be pursuant to the District s policies, rules and regulations. The Board shall pay $100/month toward the Director s professional use of a personally owned cell phone. 18. Notice. Any notice required under this Contract shall be in writing and shall become effective on the day of mailing thereof by first class, registered or certified mail, postage prepaid, addressed: To the Board: President, Board of Education O Fallon Community Consolidated School District No E. This Contract contains all the terms agreed upon by the parties with respect to the subject matter of this Contract and supersedes all prior agreements, arrangements and communications between the parties concerning such subject matter whether oral or written. 20. Agreement Governed by Illinois Law. This Contract is executed in Illinois, and shall be governed in accordance with the laws of the State of Illinois in every respect. 4

5 21. Survival of Contract. This Contract shall be binding upon the parties hereto, their successors and assigns. 22. Savings Clause. If any portion of this Contract is deemed to be illegal or unenforceable, the remainder thereof shall remain in full force and effect.
