1 Win a SX Holiday to the 2014 Australian Motorcycle Grand Prix Terms and Conditions 1. Instructions on How to Enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. 2. Entry is open to residents of Australia aged 18 years and over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Incomplete, indecipherable, or illegible entries will be deemed invalid. 5. Competition commences on 21/08/14 at 0:01am (AEST) and closes on 06/10/14 at 23:59pm (AEDST). The draw will take place at 11.00am (AEDST) on 08/10/14 at Bauer Trader Media 73 Atherton Road, Oakleigh VIC, 3166 Australia. The winner will be notified in writing and by telephone using the contact details given in their entry on 10/10/ This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into. 7. Entrants may enter more than once. To enter, entrants must purchase an Australasian Dirt Bike magazine (1411 Nov). To enter, individuals must then complete the entry forms found within this issue and fill out the original coupon. 8. Along with this coupon, entrants must answer the following question in 25 words or less : Who is your favourite supercross rider of all time and why? a. Original coupons only are to be posted to: ADB Super cross Comp Locked Bag 12, Oakleigh, VIC Entrants can also enter at and follow the prompts to enter the competition. The online form must be filled out with name, surname, address and entrants must answer the following question in 25 words or less : Who is your favourite supercross rider of all time and why? 10. This offer is not valid in conjunction with any other offer.

2 11. All entries will be judged by the editors of Australasian Dirt Bike, and the winning entrant will be chosen at the sole discretion of the editors. The editors decision is final and no discussion will be entered into. 12. One (1) winning entry from all valid entries received will be deemed the major prize winner and will win: SX Holiday to the 2014 Australian Motorcycle Grand Prix Event Package. This includes: 2 x Return economy flights from the nearest capital city to Melbourne, valued up to $2000 Four night s accommodation in Melbourne, valued at $1000 Melbourne Airport transfers, valued at $900 2 x 3 day General Admission tickets, valued at $320 2 x 3 day catch a coach return transfer, valued at $468 2 x Weekend Supercross Grandstand tickets to watch all the Supercross battles, valued at $160 2 x guided tour of the MotoGP Paddock, valued at $ Total prize package valued at $5,148 (AUD). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner. Prize must be redeemed in full and as a package. Dates of the prize are Thursday 16 th October- Monday 20 th October, 2014 inclusive. 14. Unless expressly stated in these terms and conditions all other expenses (including but not limited to travel to and from the departure/arrival points, transfers, spending money, additional meals, tips, taxes (excluding airline/airport taxes), excess baggage fees and room service or minibar charges) will be the responsibility of the winner as incurred. 15. The winners must each be over the age 18 years to redeem the prize. 16. It is strongly recommended that adequate travel insurance for the duration of the trip be organised by the winner and their companion (at their own expense). The cost of any such insurance will not be borne by the Promoter. 17. The prize cannot be taken in conjunction with any other travel offer 18. All components of the prize must be taken together. 19. No extension on the validity date of this prize will be permitted. Once booked, any changes requested by the winner or their companion to the booking may incur a cancellation fee or amendment fee at the cost of the winner. 20. The winner (and his/her companion) must depart from and return to the same point of departure and travel together. Prize is subject to the standard terms and conditions of individual prize and service providers.

3 21. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. 22. Prices quoted are recommended retail and are correct at time of publishing and can be changed at any time subject to market fluctuation. Promoters and publishers take no responsibility for market price fluctuations. 23. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 24. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner. 25. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT, AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING WITHOUT LIMITATION PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in a prize is at entrants own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of motor vehicles / motorcycles (or parts of them) colliding with other motor vehicles, motorcycles, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth), hereby exclude, release and forever discharge the Promoter, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), Dorna Sports S.L and all its affiliate companies, Dorna Worldwide Freight Services b.v., Dorna Worldwide S.L., Externpro S.L., Motor Medical Team S.L.; Federation Internationale de Motorcyclisme, International Events Services SL, Promotor Special Events Worldwide SL, National Motorcycle Federation, PI Circuit Pty Ltd, PI Graydens Pty Ltd, PI Sunrise-McGuigan Pty Ltd, PI Visitor Centre Pty Ltd, PI Operations Pty Ltd, Linfox Property Group Pty Ltd, Fox Group Holdings Pty Ltd, International Road Racing Teams Association, Motorcycling Australia Ltd and Motorcycling Victoria, teams, service companies, national and international officials, race direction, clerks of the course, sporting technical stewards, timekeepers, marshals, sponsors, all VIP guests from the above mentioned bodies, all other interested parties for their rights and interests involved in the conduct, promotion and organisation of the Event, and their respective personnel (Associated Entities) from all liability for any present or future claim, loss, damage, cost or expense arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with attendance at the Event or participation in Recreational Services (as defined below) at the Event, including participation in a prize.

4 To the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that (in the event that they are a Winner) to the extent to which they participate at the Event and/or in the prize in: (a) a sporting activity or similar leisure time pursuit; or (b) an activity that: (i) involves a significant degree of physical exertion or physical risk; and (ii) is undertaken for the purposes of recreation, enjoyment or leisure, (Recreational Services) including, without limitation, participation in a prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law. WARNING: If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Terms and Conditions. NOTE: The change to your rights as set out in these Terms and Conditions, does not apply if your death or injury is due to gross negligence on the supplier s part. Gross negligence is defined in the Australian Consumer Law and Fair Trading Regulations 2012 (Vic). For the purpose of these Terms and Conditions the supplier will mean and include the Associated Entities. Nothing in these Terms and Conditions generally affects your rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding consumer guarantees, implied conditions and warranties to the extent that such consumer guarantees, implied conditions or warranties cannot be excluded by law. A reference to legislation or to a provision of legislation includes a modification or reenactment of it, a legislative provision substituted for it and a regulation or statutory instrument issued under it. Without limiting any other release or limitation of liability contained in these Terms and Conditions, to the extent permitted by law, the Associated Entities will not be liable for any indirect or consequential loss (including but not limited to loss of earnings) suffered by any entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or a prize. 26. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as

5 well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter. 27. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The components of the Prize may alter for reasons beyond the Promoter s control. The Prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the Prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the Winner. 28. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier s requirements 29. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s. 30. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments. 31. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit. 32. As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 33. The Promoter is not responsible for any incorrect or inaccurate information, either The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes). 35. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize 36. Any cost associated with accessing the promotional website is the entrant s responsibility and is dependent on the Internet service provider used. 37. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion. 38. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry. 39. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation. 40. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ( Non-Excludable Guarantees ). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 41. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 43. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All entries become the property of the Promoter. It is a condition of entering the promotion that the entrants agree to be interviewed, photographed and filmed or the use of their or entry (including their photograph) at any time by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Australasian Dirt Bike (including but not limited to the magazine, website, IPAD edition, social media pages etc or any other form of media it deems suitable) without further remuneration or reference to the participant.
