1 Terms and Conditions: Holm Oak Win a Trip to Tasmania 1. Information on how to enter and prize form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry. 2. The promoter of this Competition is Wizard Wines Pty Ltd (the "Promoter") (ABN: ) 11 West Bay Road, Rowella, TAS 7270 (Holm Oak Vineyards). 3. Entry is only open to Australian residents aged 18 years or over. By entering this promotion you are certifying that that you are over 18 years of age. Employees, and their immediate families, of the Promoter and its agencies associated with this promotion are ineligible to enter. Residents of the Northern Territory are ineligible to enter the promotion. 4. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant for tampering with the entry process or for submitting an entry not in accordance with these Terms and Conditions of Entry. 5. The competition commences 12:00am Australian Eastern Standard Time (AEST) on Wednesday, 14 November 2018 and closes at 11:59pm AEST on Thursday, 31 January 2019 ("Competition Period"). 6. T o enter the Competition you must: a. Spend $100 for 1 entry in the draw through Holm Oak Cellar Door (11 West Bay Road, Rowella, TAS 7270) or online at b. Provide contact details ( address, postal details, contact number) which may be used for future communications. All details provided by the entrant must be complete and accurate at the time of Registration for the entry to be deemed valid and eligible to enter the Competition. All participants warrant that information provided by them at the time of Registration is true and accurate. Any false or misleading information may result in any participant being ineligible to participate in the Promotion. Any entrant found to have provided any false or misleading information will be automatically disqualified and their entries (and any prize won) will be automatically voided. Should an entrant's contact details change during the Promotional Period, it is the entrant's responsibility to notify the Holm Oak Vineyards. Holm Oak Vineyard s decision as to the operation of the Competition is final, and no correspondence will be entered into. 7. For each $100 spend on wines purchased you will receive one entry. Multiple entries are permitted. 1

2 8. Winner Selection: There is one prize winner drawn from all valid entries received during the promotional period. 9. The draw will take place on Friday, 8 February 2019 at 11 West Bay Road, Rowella, TAS 7270 at 12.00pm AEST. 10. The winner will be notified by telephone and notified in writing by on Monday, 11 February 2019 and the name of the prize winner will be displayed for 28 days on the Holm Oak Wines website The winner will have six months from the date of the draw to redeem the prize. Timing is subject to confirmation from Holm Oak Wines. 12. In the event that a prize winner is unable to be contacted, the Promoter will retain the prize for three months from the date of the original draw. If any prize is not claimed within three months a redraw will be conducted on Wednesday, 8 May 2019 subject to any written directions given from a regulatory authority. In the event of any winner in the unclaimed prize draw, they will be notified by within two days of the draw and their name will be displayed on the Holm Oak Wines website and Facebook page. 13. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into. PRIZES 14. The Prize Winner will receive an overnight trip for four to Holm Oak Wines in Rowella, Tasmania. The prize includes: Return airfares for 2 people to Launceston, Tasmania valued at $500 2 nights accommodation valued at $500 Dinner one night valued at $300 3 days car hire valued at $200 Tasting and lunch at Holm Oak Vineyards valued at $100 Food and beverage walking tour of Launceston with Taste Walk Talk valued at $300 TOTAL VALUE $ Departure will be from the winner s closest capital city airport (Sydney, Melbourne, Brisbane, Canberra, Hobart, Adelaide or Perth only) to Launceston Airport and on the return leg from Launceston Airport to the winner s closest airport. 17. The Prize winner and their guests must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure. 2

The Prize Winner and their guests are responsible for all other expenses including spending money, meals, drinks, transfers (unless specified) laundry charges, activities, incidentals, taxes, energy charges, gratuities, service charges, travel insurance, items of a personal nature, in room-charges and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances 19. The prize is subject to hotel and flight availability at the time of booking. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made. 20. Air tickets are available on the regular scheduled services of the Promoter s desired airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. 21. All prizes are subject to the airlines and other suppliers booking conditions and availability. Once bookings are confirmed and ticketed, cancellation charges apply and will be the sole responsibility of the winner. 22. All prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. 23. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee paid to you. 24. All entries will be entered into a database and the relevant party may use the entrants name and for future marketing purposes. By opting in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes they should contact the Promoter. 25. No component of the prizes can be transferred or redeemed for cash. In the event that the prize, or any part of the prize, becomes unavailable due to circumstances beyond the Promoter's control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation 3

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, un-authorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) Any tax liability incurred by a winner or entrant; and/or (f) Use of a prize. 27. If for any reason an act, agent or event beyond the reasonable control of the Promoter (including but not limited to vandalism, tampering, fraud, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism) prevents this promotion from proceeding in the manner described in these terms and conditions, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant and/or (b) cancel, terminate, modify or suspend the promotion subject to any direction or requirement from any regulatory authorities. 28. Holm Oak Vineyards reserves the right to disqualify any participant who does not comply with these Terms & Conditions or who has, in the opinion of Holm Oak Vineyards, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Holm Oak Vineyards. Where Holm Oak Vineyards has reason to believe that any entrant has breached any of the terms and conditions of the Competition, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition, Holm Oak Vineyards will disqualify such entrant and may take legal steps to recover damages or other compensation for any loss or harm suffered as a result of the offender s actions. Where the winner is disqualified under these provisions (Disqualified Winner), the Disqualified Winner will forfeit its prize entirely and a second draw will take place at Holm Oak Vineyards discretion. 4

Holm Oak Vineyards reserves the right to refuse to allow the winner to take part in any or all aspects of the Prize if Holm Oak Vineyards determines, in its absolute discretion, that the winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. The winner of the Competition may be required to sign any legal or other documentation as requested by Holm Oak Vineyards, including any separate legal releases or indemnities. Failure to sign such documentation may mean that winner is not permitted to claim any part of the Prize. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by Holm Oak Vineyards its absolute discretion. By accepting the Prize, the winner agrees to participate in and co-operate as required with all reasonable promotional and marketing requests relating to the Prize, including but not limited to, being interviewed and photographed, filmed with the Prize. The winner consents to Holm Oak Vineyards use of his or her image, voice or other recording in marketing or promotional material, without charge. 30. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Holm Oak Vineyards ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, Holm Oak Vineyards may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any written directions given under State laws or regulations. Holm Oak Vineyards is not responsible for any technical errors, that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries or Registration details.
