QUESTIONS 1. Question: Considering that this proposal is for a product supply contract and no actual work will be performed onsite by the vendor, would you consider amending the insurance requirements of proposal No , Item 4 of page 3; Excess/Umbrella Liability Insurance? Response: Insurance requirements will not change. Please submit any unacceptable contract and insurance terms under Tab H of the proposal for consideration. 2. Question: Considering that this proposal is for a product supply contract and the product is produced and supplied by a vendor located outside of the State of Pennsylvania, would the Authority waive the requirement to solicit for participation of Minority and Disadvantaged Business Participation, since such participation in this proposal would not be practical? (The product is produced out of state, shipped in from out of state, and delivered. No other work is performed in the State other than final delivery of the product). If a waiver is not feasible, how would the Authority like the Solicitation of Participation and Commitment Form and/or Request for Waiver/Reduction of Participation Form for Public Bids MDBE/WDBE/DSDBE be filled out and these circumstances noted as such? Response: A waiver is sufficient, see attached Exhibit A. 3. Question: Considering that this is proposal is for a product supply contract as opposed to an ongoing service or long-term construction contract, would the Authority consider waiving the requirement to provide three (3) years of financial statements as stated on page 4, item #14 titled Financial Statement (Tab D)? The supply references requested in the proposal should be sufficient to demonstrate the proposer s ability to handle the Non-Urea Deicing/Anti-Icing Solid Compound Addendum One RFP No Page 1

2 minor purchase volumes required under this contract. Response: The financial requirements have been waived as long as vendor supplies required reference information located under item #11 of the Proposal Form. 4. Question: I wanted to obtain a copy of the SAE AMS 1431D SPEC as required in the bid (RFP). Response: See attached, Exhibit B. 5. Question: Regarding the insurance requirements listed on page 4 of the RFP, would the Authority consider removing the highlighted language of Item #9? 9. The Philadelphia Parking Authority, The City of Philadelphia, The Commonwealth of Pennsylvania its agents, employees, representatives, officers and directors individually and collectively, shall be added as ADDITIONAL INSUREDS on the policies as noted above even for claims regarding their Sole negligence. s coverage shall be primary and non-contributory to any other coverage available to Philadelphia Parking Authority, including, without limitation, coverage maintained by Philadelphia Parking Authority wherein Philadelphia Parking Authority is named insured, and that no act of omission shall invalidate the coverage. Response: Insurance requirements will not change. Please submit any unacceptable contract and insurance terms under Tab H of the proposal for consideration. 6. Question: Do we need to have a Philadelphia business license to bid? Response: An Activity License is needed to conduct business within Philadelphia. It was formerly known as the Business Privilege License. Prior to applying for any additional business licenses in the City of Philadelphia, you will first need to obtain an Activity License. This includes businesses that are located outside the city limits but do some or all of their business activity in the City.
