1 Erie County Medical Center Corporation RFP # Addendum Number 1 Erie County Medical Center Corporation Addendum Number 1 to RFP # FAMILY MEDICAL LEAVE ACT AND NEW YORK STATE PAID FAMILY LEAVE PROGRAM ADMINISTRATION The deadline for submission has been extended to: Thursday, February 23, 2017 at 11 a.m. EST. The following questions were submitted to the Designated Contact: 1. Does the group currently have an FMLA Program in place? How is FMLA administered currently? FMLA is currently administered in house. 2. How many employees are going to be covered? All ECMC employees which is approxmiatley 3, Is there a fully insured STD, DBL, or LTD currently in place that can be quoted on? This is not a part of the RFP at this time. 4. Is there a census you will be sharing? ECMC will not be sharing this at this time. 5. The FMLA shows 0% for MWBE- Was that in error? Upon re-evaluation, ECMCC determined that no goals should be assigned to this opportunity. 6. Since the Paid Family Leave Program is integrated into New York State Statutory Disability Law, are you asking for third party claims administration for disability self-insurance benefits as well, or just FMLA and Paid Family Leave? 1 P a g e

2 We are asking for third party administration for FMLA and Paid Family Leave, not disability insurance. 7. Does ECMCC provide statutory and/or enhanced disability benefits to its employees? As a public benefit corporation, ECMC is not required to provide statutory disability benefits. 8. Please confirm the total number of employees that would be covered under this contract. 9. Can you provide the breakdown between full-time and part-time employees? Roughly 7% of ECMC s staff is part time 10. Is ECMCC currently administering FMLA in house? If not, who is the incumbent vendor and for how long have they been providing services to ECMCC? 11. If applicable, are there any service issues with the incumbent vendor? Not applicable. 12. If applicable, what is the current annual cost of services for outsourcing FMLA? Not applicable. 13. If outsourcing for the first time, does ECMCC have an annual budget for this new program? If yes, can you share what the annual amount is? 14. Please define what the expectation is for the administration of New York State Paid Family Leave? Is the awarded vendor expected to get involved with payment to the employees? Awarded vendor would be expected to verify eligibility and report on time used if approved. Involvement for payment to employees by the awarded vendor would be determined by the awarded vendor s program. 15. Please confirm that the MWBE participation goal is 0%. What is the expectation for MWBE participation since it is still part of the evaluation criteria? Please clarify. Five additional points will be awarded to any of the responding firms that indicate the use of NYS Certified MWBE firm(s) and correctly notates that use of those firms on Exhibit A-1 the Utilization Plan. 16. 3 17. Total number of females? 18. What is ECMC s Incidence rate? 19. Please provide 3 years of historical loss information? 20. Percent of intermittent and continuous leaves? 21. Number of data feeds required? Number of data feeds required would be determined by the needs of the vendor who is awarded the contract, in addition to the systems in house we would need to supply. 22. Number of vendors ECMC is currently working with to support absence program? 23. Does ECMC outsource benefits? If so, who is the provider? 24. Effective date of program? Will be determined based on implementation schedule developed with awarded firm. 25. Who currently manages STD? Please see response to question number Does plan stipulate that WC run concurrent with FMLA? Yes, workers compensation would run concurrently with FMLA where applicable. 27. Please advise the number of current open leaves. 28. Please advise the average number of new leaves in a 12 month period for each of the last three to five years. 29. Exhibit A notes that the Contract Goal for MWBE is zero percent (0%); however, the Evaluation Criteria indicates MWBE Participation is valued at 5 points. Is ADAAA administration part of scope of RFP Currently, only FMLA administration is in scope. 39. Do you have 24/7 real time access to claim files today Do employees have access to an employee portal giving complete access to their specific claims 13.? 41. Is employee Health part of the RTW process Yes employee health is part of return to work process. 42. Do you know avg. duration of a intermittent and a continuous claim? 4 P a g e

5 43. Can we quote a disability, short term disability, long term disability or life insurance along with the FMLA? When quoting FMLA, some carriers require having one of these products along side of them. ECMC is not seeking quotes for these products at this time. 44. Workers Compensation insurance policies cannot have third parties as an additional insured. The waiver of subrogation language will be fine, but I know from experience that the Additional Insured language cannot be added only for the workers comp policy on any certificate. Would you be able to adjust? Additional insure is not required for Worker s Comp. This will be revised before execution of contracts following bids. 5 P a g e
