2 INTRODUCTION The IT Department of George I. Sanchez Charter School is publishing a Request for Proposal ("RFP") soliciting a written Proposal from responsible firms (hereinafter called company, vendor, proponent, or proposer) qualified to provide Dedicated 100 MEG Internet Access. PROPOSAL PROCESS The following provides information on how and where to submit a Proposal and other pertinent information regarding this RFP. Proposers are required to read and comply with these instructions. This RFP is issued by: George I. Proposals will not be accepted after this date and time. Proposals submitted that are not in accordance with the terms and conditions of this RFP will not be considered for evaluation or award. Tentative Schedule of Events 1/16/2015 RFP Release Date 1/20/2015 Scheduling of Site Surveys Begins 2/20/2015 Deadline for Questions by 12:00 Noon 2/23/2015 Proposal Due Date Conferences Conferences and Site Surveys may be scheduled between 1/20/2015 and 2/20/2015 by contacting Michael Seuffert at it@aama.org. Period of Performance The Scope of Services shall be performed within the Schedule of Events, which will be mutually negotiated in a resulting Agreement, but must begin no earlier than July 1, 2015 and end no later than June 30, Proposal Requirements and Conditions You may submit proposals via at it@aama.org or deliver in printed format by the due date and time. 3 Consideration of Proposals Proposals will be evaluated on the basis given in the RFP and as shown in the Proposal. George I. Sanchez Charter School reserves the right to reject any and all Proposals, to re-issue the RFP, modify or change the form of the solicitation or any combination thereof, to waive technicalities, or proceed to Contract for the services otherwise in the best interest of the George I. Sanchez Charter School. Irregular Proposals Proposals will be considered irregular if they show any omissions, alterations of form, additions, or conditions not called for, unauthorized alternate Proposals, or irregularities of any kind. However, George I. Sanchez Charter School reserves the right to waive any irregularities and to make the award in the best interests of George I. Sanchez Charter School. Rejection of Proposals George I. Sanchez Charter School reserves the right to reject any or all Proposals, and all Proposals submitted are subject to this reservation. Proposals may be rejected, among other reasons, for any of the following specific reasons: Proposals received after the time set for receiving Proposals. Proposal containing any irregularities. Unbalanced value of any items. Proposal is incomplete or the Proposer does not have SPIN number. Proposer does not have documented ability to dual and discount bill as required by SLD / USAC 1/16/2015 Page 3 of 7

4 Evaluation Criteria The following criteria will be used to evaluate each Proposal. A major deficiency in any one area may disqualify a Proposal submission. In assessing the relative value and quality of each Proposal, a Decision Matrix will be utilized in which point values will be assigned in a range from zero to the maximum point weighting for each classification. The maximum score is 100 points. Criteria Points Total Monthly Cost 70 Construction / Installation Cost 10 Previous Vendor in Good Standing 20 Proposal Acceptance All accepted proposals are dependent on George I. Sanchez Charter School s Form 471 acceptance by USAC / SLD resulting in the applied for Funding Commitment. Payments All billing should be done using the Discount Method. Vendors shall bill USAC / SLD directly for the approved funding commitment amount. George I. Sanchez Charter School shall only be billed for the difference between the accepted quote and the funding commitment amount. 1/16/2015 Page 4 of 7

5 Proposal 100 MEG Dedicated Internet Access George I Sanchez Charter School is seeking to increase its Internet Access Bandwidth from existing Dedicated 50 MEG Ethernet Internet to 100 MEG Dedicated Access. Vendors are asked to submit quotes for a monthly charge on a three year agreement as well as any applicable installation or construction cost. If the vendor quote requires onsite construction then vendors need to agree to comply with Insurance Requirement listed in Appendix A. 1/16/2015 Page 5 of 7

6 Appendix A Insurance Requirements INDEMNITY WAIVES ALL CLAIMS OR CAUSES OF ACTION AGAINST AAMA AND EACH OF THE FOREGOING, ITS AFFILIATED ENTITIES, DIRECTORS, OFFICERS, MEMBERS, MANAGERS, AGENTS, REPRESENTATIVES, CLIENTS, CHARTER SCHOOL STUDENTS, GUESTS AND EMPLOYEES (THE "AAMA INDEMNITEES") AND HEREBY INDEMNIFIES AND HOLDS HARMLESS THE AAMA INDEMNITEES FROM ALL CLAIMS OR CAUSES OF ACTION ARISING OUT OF DAMAGE TO ANY PROPERTY OR INJURY TO OR DEATH OF, ANY PERSON IN, UPON, OR ABOUT AMMA'S HOUSTON PROPERTY CAUSED BY, RESULTING FROM, ARISING OR GROWING OUT OF OR IN ANY WAY CONNECTED WITH.'S CABLING PROPOSAL AND CONTRACT, SPECIFICALLY QUOTE NUMBER, OR THE OPERATIONS OR ACTIVITIES OF THE AAMA INDEMNITEES, INCLUDING, WITHOUT LIMITATION, THE SOLE, CONTRIBUTORY OR CONCURRENT NEGLIGENCE OF THE AAMA INDEMNITEES, BUT EXCLUDING THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE AAMA INDEMNITEES. IT IS THE EXPRESSED INTENTION OF AAMA AND THAT THE INDEMNITY PROVIDED IN THIS SECTION IS AN INDEMNITY BY TO INDEMNIFY AND PROTECT THE AAMA INDEMNITEES FROM THE CONSEQUENCES OF THEIR OWN CONDUCT WHETHER OCCURRING AS THE SOLE OR A CONCURRENT CAUSE OF AN ACT OR EVENT GIVING RISE TO AN INDEMNITY OBLIGATION HEREUNDER. Insurance Requirements a. shall carry and pay premiums for the following insurance types, limits, endorsements, and requirements: Commercial General Liability: $1,000, combined single limit, bodily injury, personal injury and property damage, per occurrence Personal and Advertising Injury: $1,000,000 per occurrence Employers Liability: $1,000, each accident/policy/employee Automobile Liability: $1,000, combined single limit covering all owned, non-owned, leased and hired vehicles. Workers Compensation: Texas Statutory Benefits General Aggregate: $1,000, aggregate per location Products and Completed Operations Liability: $1,000, aggregate Fire Legal Liability: $100, per fire Umbrella Liability: $1,000, per occurrence and in the aggregate providing excess coverage over Employers Liability, Commercial General Liability and Automobile Liability AAMA and each of the foregoing, its affiliated entities, directors, officers, members, managers, agents, representatives, clients, employees and charter school student shall be 1/16/2015 Page 6 of 7

7 named as Additional Insureds in all of the policies listed above, except Workers' Compensation. A Waiver of Subrogation endorsement in favor of AAMA shall be issued on all policies. Each policy required shall contain an endorsement that it will be primary over any collectible insurance insuring AAMA. The Certificate of Insurance shall state that the applicable polices have been endorsed as required herein. All required insurance will be placed with carriers licensed to do business in Texas and have a rating in the most current edition of A.M. Best's Property Casualty Key Rating Guide that is reasonably acceptable to AAMA. AAMA shall be provided thirty (30) days written notice of cancellation or non-renewal. The Certificate of Insurance shall be sent directly to AAMA by either the insurance broker or insurance companies. Receipt of the Certificate of Insurance from is not acceptable. b. No later than five days before the start of the installation shall furnish to AAMA a certificate of insurance evidencing the existence of all insurance coverages and limits required herein and including the Additional Insured and Waiver of Subrogation endorsements and an endorsement that the policies will be primary over any collectible insurance insuring AAMA. 1/16/2015 Page 7 of 7
