1 OREGON MUTUAL INSURANCE COMPANY DEPT: DATE: BULLETIN NO: June 10, 2009 Regional Office 2140 SUBJECT: TO: All OMI & WesPro Washington Personal Lines Agents Homeowners Program Changes For new Homeowner and Manufactured Homeowner policies and renewals for both Oregon Mutual and Western Protectors, we are implementing our PCS (Personal Characteristic Score) Homeowner Program, similar to our PCS Auto Program. These changes will be effective August 1, The PCS program incorporates a wider range of risk characteristics in the rating process, creating a better match between premium and the individual risk. These include but are not limited to: Age and value of dwelling Number and types of claims Payment history These characteristics are used to generate a PCS rating factor which will be used in conjunction with an insurance credit score and other rating elements to determine the policy premium. The rate impact of this change will vary based on the individual characteristics of each risk. PCS factors that will have the greatest impact on pricing are credit score, (or risks with no score or considered a no hit where an insured cannot be identified sufficiently to produce a score), prior losses, and payment history. We have increased our base rates and adjusted our territory relativities to account for the upward trend in the loss ratio we have experienced in our homeowner program. We have adjusted our pricing to be more attractive at higher home values, and also adjusted the deductible credit to be more moderate as values increase. As part of this change we will begin utilizing a new fire protection classification system which will improve our ability to accurately verify the protection status of properties. To accomplish this we have employed a new service, FireSafe, to be sure that we don t misclassify new business. FireSafe enables us to electronically verify the driving distance from a responding fire station and whether the home is located within the limits of a municipality or protected suburb. Distance from a responding fire station and availability of a fire hydrant is a sound method of determining fire exposure. With FireSafe, the responding fire station is already mapped for you. As new fire stations are added or existing ones closed they are automatically included in the FireSafe database via a quarterly update. FireSafe Protection Classifications Within City = Protected. Property is within the city limits and within 5 miles of a responding fire station. Within Protected Suburb = Suburban Protected. Property is outside of city limits, but within 5 miles of a responding fire station and has verifiable hydrants within 1,000 feet. NOTE: To receive the Protected or Suburban Protected classifications and proper rate when using BizLink or comparative rating systems you must answer yes to the question within city limits. Within Fire District = Partially Protected. Property is within 5 miles of a responding fire station, but the dwelling is outside the city limits. No hydrants within 1,000 feet. Unprotected = Property is more than 5 miles from a responding fire station. Renewal policies will initially convert using the ISO protection class levels, but over time we will verify fire protection and correct any inaccurate rating. Existing policies will convert as follows: ISO PC 1-7 Protected (P) ISO PC 8-9 Partially protected (PP) ISO PC 10 Unprotected (U) Because some renewal policies have been in force for years, the level of fire protection may have changed since they were first written and never updated. If a policy renews as unprotected (U) and there is a responding fire station BULLETIN Page 1 of 2

2 within 5 miles, or partially protected (PP) and the home is now within the municipality limits or within 5 miles of a responding fire station with a verifiable hydrant within 1000 feet, please contact your Personal Lines Underwriter, who will review and amend the policy. Form changes We have clarified the coverage provided under Oregon Mutual Replacement Cost Provision Expanded Coverage form H156 and Functional Replacement Cost Loss Settlement H163W. Some time ago we sent an advisement to you which broadened the Homeowners 3 to automatically increase the limit for theft of guns from $2,000 to $15,000 and motorized vehicles from $2,500 to $10,000. We have changed Amendatory Endorsement H159W to incorporate this enhanced coverage into the Oregon Mutual HO3 contract. This enhanced coverage continues to apply in Western Protectors, with form changes scheduled for later on in the year. Unscheduled silverware is now incorporated into form G0265H Optional Coverage C Higher Limits and may be increased in increments of $100 for both Oregon Mutual and Western Protectors. Policies that have the previous forms will automatically be converted. Credit score notification We have made some minor changes to the credit score notification. Washington regulation requires that we provide score information at renewal even if the credit score has not changed, and the revised renewal notification should help make that clear. New credits available A Gated Community Credit. A policyholder is eligible for this credit if the residence is located within a community that is completely surrounded by a minimum six foot fence with all entrances secured by either a twenty-four hour manned security guard station, or a resident card or key-lock control. Credit is applied to the basic premium. A Newly Purchased Home Credit of 10%. This applies to homes that have been purchased by the owner within two months prior to the effective date of the policy. This credit gradually decreases over a four-year period. If the home also qualifies for the new home construction credit, the policy will receive whichever credit is greater. This credit does not apply to manufactured homes. Other changes and enhancements to our Oregon Mutual Homeowner and Manufactured Homeowner Programs We have added the following endorsements to the Oregon Mutual Homeowner and Manufactured Homeowner policies at no additional cost: Homeowner Accidental Death Benefit M0005H, Refrigerated Food Products H155, and Sports Equipment M0030H. (These coverages were previously limited to Western Protectors). Coverage for golf carts is available in Oregon Mutual on a named peril basis, rather than as an Inland Marine coverage. Coverage for Golfer s equipment continues to be available on the Scheduled Property endorsement. We are introducing new optional Liability and Physical Damage Coverage for Oregon Mutual policyholders who own All-Terrain vehicles. This is available for new business and renewals effective August 1, 2009 Commission for this new program The existing Homeowner commission of 15% for new and renewal business will apply. Washington SB 5417 Flood Disclosure for Dwelling Fire and Homeowner policies With this notification we will be implementing flood disclosures on both our Dwelling Fire and Homeowner declaration pages. The initial advisement, located in the lower right hand corner of the declaration page, tells the policyholder to see the reverse side (located at the top) for information on flood coverage. 3 OREGON MUTUAL INSURANCE COMPANY H156 (7-09) REPLACEMENT COST PROVISION EXPANDED COVERAGE WITH BUILDING CODE UPGRADE COVERAGE (Coverage A Residence and Coverage B Detached Garages Only) For an additional premium, your policy is amended as follows: Our liability under this provision is subject to the terms of HOW MUCH WE PAY FOR LOSS OR CLAIM in the General Policy Provisions. 1. This provision applies only to the primary residence located on the insured premises, covered under Coverage A - Residence, and detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises. The building must have a permanent foundation and roof. THIS PROVISION DOES NOT APPLY TO: a. domestic appliances; b. all carpeting, curtains, and drapes, whether permanently installed or not; c. detachable building items including screens, awnings, storm doors and windows, and window air-conditioners; or d. outdoor structures (other than detached garages used solely for private garage purposes). Outdoor structures include (but are not limited to) swimming pools, fences, paved areas, submersible pumps, and sump pumps. 2. For the purpose of this provision, HOW MUCH WE PAY FOR LOSS OR CLAIM, Items 1.a. and 1.e. (1-3) and REPLACEMENT COST PROVISION are deleted and replaced by: a. Replacement Cost (1) If there is a covered loss to the Coverage A - Residence and/or Coverage B detached garages used solely for private garage purposes and the covered loss exceeds the applicable Coverage A - Residence limit or Coverage B - Related Private Structures on the Premises limit, respectively, shown on the declaration and/or endorsement, for the purpose of settling these covered losses only: (a) The most we will pay in any one loss, including Ordinance or Law coverage, is 150% of the applicable Coverage A - Residence and/or the Coverage B - Related Private Structures on the Premises limit shown on the Declaration and/or endorsement but only to the extent the Coverage B loss is to a detached garage used solely for private garage purposes. (2) Loss to the Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises will be settled at replacement cost without deduction for depreciation. We will pay no more than the lesser of the following amounts for like construction and use: (a) The replacement cost of that part of the Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises damaged or destroyed; (b) The necessary amount actually spent to repair or replace the damaged or destroyed Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises; or (c) The limit of liability under this policy that applies to the applicable Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises, respectively. b. Coverage provided by this endorsement (subject to a limit) includes additional costs that may result from enforcement of any Ordinance or Law regulating the construction, repair, or demolition of the Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises. The Ordinance or Law limit shown on the Declaration page is our maximum combined limit for both the Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises. c. If the Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises are not repaired or replaced at the same site, we will not pay more than the amount it would have cost to repair or replace the building at the original site on a replacement cost basis, subject to applicable limits. Provisions 2. a. - c. listed in this endorsement apply only if you elect to repair or replace the damaged or destroyed Residence building and/or detached garage. H156 (7-09) Page 1 of FRM

4 3. You must notify us within 90 days of the start of: a. a new building valued at $5,000 or more; or b. additions to or remodeling of a covered building which increase its value by $5,000 or more. You must pay the additional premium due for the increase in value. If you do not notify us within 90 days, we pay no more than the limit for the covered buildings excluding the value of the additions and improvements. 4. When the cost to repair or replace exceeds the lesser of $2,500 or 5% of the applicable limit on the damaged building, we are not liable for more than the actual cash value of the loss until actual repair or replacement is completed. You may make a claim for the cash value of the damaged property before repairs are made. A claim for any additional amount payable under this provision must be made within 180 days after the loss. 5. Section I Exclusion. When earthquake coverage is purchased (by separate endorsement), coverage is limited to the Coverage A and B amount purchased. This endorsement does not provide replacement cost coverage for Coverage A - Dwelling and Coverage B - Related Private Structures on the Premises for the peril of earthquake. 5 OREGON MUTUAL INSURANCE COMPANY H163W (7-09) FUNCTIONAL REPLACEMENT COST LOSS SETTLEMENT WITH BUILDING CODE UPGRADE COVERAGE WASHINGTON (Coverage A Residence and Coverage B Detached Garages Only) For an additional premium, your policy is amended as follows: Our liability under this provision is subject to the terms of HOW MUCH WE PAY FOR LOSS OR CLAIM in the General Policy Provisions. Functional replacement cost means the amount which it would cost to repair or replace the damaged building with less costly common construction materials and methods which are functionally equivalent to obsolete, antique or custom construction materials and methods used in the original construction of the building. 1. This provision applies only to the primary residence located on the insured premises, covered under Coverage A - Residence, and detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises. The building must have a permanent foundation and roof. THIS PROVISION DOES NOT APPLY TO: a. domestic appliances; b. all carpeting, curtains, and drapes, whether permanently installed or not; c. detachable building items including screens, awnings, storm doors and windows, and window air-conditioners; or d. outdoor structures (other than detached garages used solely for private garage purposes). Functional replacement cost (1) If there is a covered loss to the Coverage A - Residence and/or Coverage B detached garages used solely for private garage purposes and the covered loss exceeds the applicable Coverage A - Residence limit or Coverage B - Related Private Structures on the Premises limit respectively shown on the Declaration and/or endorsement, for the purpose of settling these covered losses only: (a) We will provide functional replacement cost insurance, up to 125% of the applicable Coverage A - Residence limit and/or the Coverage B - Related Private Structures on the Premises limit stated on the Declaration and/or endorsement, but only to the extent the Coverage B loss is to a detached garage used solely for private garage purposes. (2) Loss to the Coverage A - Residence and/or detached garages used solely for private garage purposes, covered under Coverage B - Related Private Structures on the Premises will be settled at functional replacement cost without deduction for depreciation. We will pay no more than the lesser of the following amounts for functionally equivalent construction. (a) The necessary amount actually spent to repair or replace the damaged or destroyed Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises on a functional replacement cost basis. However, if this amount is less that the actual cash value of that part of the damaged building, we will settle the loss on an actual cash value basis; or (b) The limit of liability including functional replacement cost under this policy that applies to the applicable Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises, respectively. b. Coverage provided by this endorsement (subject to a limit) includes additional costs that may result from enforcement of any Ordinance or Law regulating the construction, repair, or demolition of the Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises for any one occurrence. The Ordinance or Law limit shown on the Declaration page is our maximum combined limit for the total of both the Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises. c. If the Coverage A - Residence and/or Coverage B - Related Private Structures on the Premises are not repaired or replaced at the same site, we will not pay more than the amount it would have cost to repair or replace the building at the original site on a functional replacement cost basis, subject to applicable limits. Even if more than one person has an insurable interest, in the property covered, we pay no more that the lesser of: (1) The amount of your interest in the property; or (2) The functional replacement cost. Provisions 2.a. - d. listed in this endorsement apply only if you elect to repair or replace the damaged or destroyed Residence and/or detached garage. e. If you decide not to repair or replace under functional replacement cost, settlement will be made according to Actual Cash Value. This means there may be a deduction for depreciation. 3. You must notify us within 90 days of the start of: a. a new building valued at $5,000 or more; or b. additions to or remodeling of a covered building which increase its value by $5,000 or more. You must pay the additional premium due for the increase in value. If you do not notify us within 90 days, we pay no more than the limit for the covered buildings excluding the value of the additions and improvements. 4. 7 OREGON MUTUAL INSURANCE COMPANY H159W (7-09) AMENDATORY ENDORSEMENT WASHINGTON Coverage C Personal Property, 1. Limitations on Certain Property If form H003 (6-95) is attached to your policy, Coverage C Personal Property, 1. Limitations on Certain Property is amended as follows: Item e. is increased to $15,000 for loss by theft of guns and gun accessories; and Item h. is increased to $10,000 on motorized vehicles not designed or licensed for public roads and used to service the insured premises or for assisting the handicapped. Tree Root Damage The following exclusion is added to EXCLUSIONS THAT APPLY TO PROPERTY COVERAGES listed in the policy: 18. Tree Root Damage - We do not pay for damage to property arising directly or indirectly out of or caused by tree roots. Tree root damage includes, but is not limited to: a. pressure from any root system to a foundation, patio, pavement, wall, retaining wall, driveway, hardscapes, other hard-surfaces, fence; b. damage to underground drains, drainage system, septic tanks, underground service pipes, water pipes, pipes, or c. growth of trees, shrubs, plants or lawns whether or not such growth is above or below the surface of the ground. If any of the perils listed in exclusion 18 above cause water to escape suddenly and accidentally from a plumbing, heating, air conditioning system, household appliance, or fire protective sprinkler system within your dwelling, we cover loss not otherwise excluded to the dwelling or separate building caused by water but not for deterioration, rust, mold, wet or dry rot due to the presence of water over a period of time. If loss is caused by water or steam not otherwise excluded, we will cover the cost of tearing out and replacing any part of the dwelling or separate building necessary to repair the system or appliance. We do not cover the system or appliance from which water or steam escaped. This endorsement is part of your policy. It supersedes and controls anything to the contrary. It is otherwise subject to all other conditions and terms of the policy. H159W (7-09) FRM

8 OREGON MUTUAL INSURANCE GROUP G0265H (7-09) COVERAGE C HIGHER LIMIT ON CERTAIN PROPERTY The Limitations on Certain Property Under Coverage C are amended as shown below: Property a. money, bank notes, bullion, coins, medals, and numismatic property; Increased Limit b. gold other than goldware, silver other than silverware, platinum, securities, commercial paper (commercial paper means drafts, checks, certificates of deposit, and notes other than bank notes, including negotiable orders of withdrawal), stamps, philatelic property, tickets, accounts, deeds, evidence of debt, and passports; c. jewelry, watches, and precious and semiprecious stones and gems; d. silverware, goldware, pewterware and items plated with gold or silver. This Does Not Increase the Coverage C Personal Property Limit. G0265H (7-09) FRM

9 OREGON MUTUAL INSURANCE COMPANY H231 (8-06) GOLF CART COVERAGE Make or Model Serial or Motor Number Limit PRINCIPAL PROPERTY COVERAGES 1. We cover the golf carts listed above for direct physical loss caused by: a. a peril insured against described under Coverage C; or b. collision or overturn. Collision means the accidental contact of the golf cart with another vehicle or object, however, we do not pay for loss or damage caused by contact with the roadbed or ground that is not the result of overturn of the covered golf cart. 2. This coverage does not apply to golf carts: a. while used to carry persons for a charge, rented to others, or used for other business purposes; or b. while used in racing, speed, pulling or pushing, demolition, or stunting activities or contests or in the practice or preparation for such activities or contests. 3. All of the terms of Coverage C apply to these golf carts unless otherwise stated in this endorsement. 4. The limit shown on the declarations for Coverage C does not apply to the golf carts listed above. We will pay no more for loss to a golf cart listed above than the limit shown in this endorsement for that golf cart. 5. Under Personal Property Not Covered, the exclusion for motorized vehicles does not apply to the golf carts listed above. 6. Under Personal Property Not Covered, the following is added with respect to the golf carts listed above: We do not cover loss or damage to golf cart tires or tubes caused by collision, unless the loss or damage is coincidental with other damage to the golf cart. 10 OREGON MUTUAL INSURANCE GROUP G0095H (2-07) ALL-TERRAIN VEHICLE LIABILITY COVERAGE ONLY Coverage L - Personal Liability and Coverage M - Medical Payments to Others apply to bodily injury or property damage arising out of the ownership, maintenance, use, loading or unloading of the following all-terrain vehicles while off the insured premises. Year, Make & Model CC Serial or Motor Number With respect to these all-terrain vehicles, the definition of insured includes any person or organization legally responsible for an all-terrain vehicle owned by an insured. (This does not include a person or organization using or having custody or possession of the all-terrain vehicle without the permission of the owner.) THIS INSURANCE DOES NOT APPLY TO AN ALL-TERRAIN VEHICLE WHILE: a. used to carry persons or property for a charge, rented to others or used for any other business purposes; b. used in any racing, speed, pulling or pushing, demolition or stunting activity, contest or in the practice or preparation for such activity or contest. 11 OREGON MUTUAL INSURANCE GROUP G0062H (2-07) MISCELLANEOUS SCHEDULED PROPERTY We cover the classes of personal property indicated below by a limit. This coverage is subject to all policy terms that apply to property coverage unless amended by this endorsement. See attached G0062H Schedule. Recreational Motor Vehicles $ $ $ NEWLY ACQUIRED PROPERTY We cover newly acquired property provided that it is of a class already covered under this endorsement and for an amount not more than 25 percent of the limit for that class of property or $10,000, whichever is less. The insured must report this newly acquired property to us within 30 days of acquisition and pay any additional premium from the date acquired. PERILS INSURED AGAINST 1. Horses, Ponies and Project Animals - We insure for: a. Death or destruction which results directly from: 1) fire and lightning; 2) windstorm, cyclone, tornado, hail, explosion, riot, riot attending a strike, civil commotion, aircraft, objects falling from aircraft, and smoke; 3) earthquake, flood, and collapse of bridges or culverts; 4) collision or derailment or overturn of a vehicle on which the insured property is being transported; collision with other vehicles except those owned or operated by the insured or by any tenant of the insured; 5) standing, sinking, burning, or collision of vessels, including General Average and salvage charges incurred; 6) accidental shooting, except by the insured or employees of the insured; 7) drowning; 8) artificial electricity; 9) attack by dogs or wild animals; 10) collapse of building. b. Theft, but excluding escape or mysterious disappearance. 2. All Other Classes of Property (Other than Horses, Ponies, and Project Animals) - We insure for all risks of physical loss to the described property unless otherwise excluded. WE DO NOT PAY FOR: a. Loss or damage caused by wear and tear, gradual deterioration, insects, vermin, inherent vice, latent defect, mechanical breakdown, or faulty manufacture; b. Loss or damage caused by corrosion, rust, dampness, freezing, extremes of temperature, or overheating; c. Damage sustained due to or resulting from any repairing, restoration, or retouching process; G0062H (2-07) Page 1 of FRM

Breakage, unless caused by any of the following perils: fire, lightning, aircraft, theft or attempted theft, cyclone, tornado, windstorm, earthquake, flood, explosion, malicious damage, or collision, derailment or overturning of conveyances; e. Loss of market, damage or deterioration arising from delay; f. Loss by disappearance; loss or shortage disclosed upon taking inventory; or unexplained loss; g. Loss resulting from any electrical injury or disturbance to electrical appliances, devices, or wiring from artificial causes unless fire ensues, and if fire does ensue, we shall be liable only for its proportion of loss caused by such ensuing fire; and h. As respects recreational motor vehicles, 1) loss or damage caused by or resulting from use of the recreational motor vehicle in any business or occupation, or while rented to others; 2) loss or damage caused by or resulting from the operation of a recreational motor vehicle in any racing, speed or jumping contest or in practicing or preparation for any such contest. EXCLUSIONS THAT APPLY TO MISCELLANEOUS SCHEDULED PROPERTY In addition to the exclusions contained in the General Policy Provisions - Exclusions That Apply to Property Coverages, we do not pay for any loss resulting directly or indirectly from misappropriation, secretion, conversion, infidelity or any dishonest act on the part of the insured or other party of interest, their employees or agents, or others to whom the property may be entrusted (except carriers for hire). HOW MUCH WE PAY FOR LOSS OR CLAIM 1. Valuation - Unless otherwise stated in this endorsement, the value of the covered property is not agreed upon but shall be ascertained at the time of loss or damage. We pay the least of the following amounts: a. The actual cash value of the property at the time of loss; b. The amount for which the property could reasonably be expected to be repaired or replaced (to the extent practical) with property substantially identical to the property lost or damaged; c. An amount not greater than the insured's interest in the property; or d. The applicable limit. 2. Deductible - The deductible under How Much We Pay for Loss or Claim is amended by this endorsement. We will pay for loss insured under the provisions of this endorsement less the deductible amount indicated for that class of property on the schedule. 3. Coinsurance - We will pay no more than the amount the loss bears to the actual cash value of the property described at the time of loss. 4. Loss to a Pair or Set - In case of a loss to a pair or set, we may elect to: a. repair or replace any part to restore the pair or set to its value before the loss; or b. pay the difference in the actual cash value of the pair or set just before the loss and the actual cash value just after the loss. 5. Restoration of Limit of Liability - The limit under this endorsement shall not be reduced except for a total loss of a scheduled article.
