1 City of Corpus Christi Arts & Cultural Commission PO Box 9277 Corpus Christi, Texas (361) REQUEST FOR QUALIFICATIONS Collier Pool Public Art Project Budget: $17,500 Deadline for Submittal: January 5, 2017 Call Summary The City of Corpus Christi Arts & Cultural Commission seeks to commission a permanent exterior public artwork that will serve as a functional shade structure and create an iconic location marker to the pool. Budget Description The total award for an artist contract is $17,500. All costs associated with the public art project including, but not limited to, artist design fee, structural engineering and permitting fees, insurance, materials, fabrication, transportation, installation, building or site modifications, travel to and from the site, per diem expenses, project documentation, contingency to cover unexpected expenses and any other costs related to the project are covered by this budget. Selected semi-finalists will be invited to present concept design proposals and will receive $500 as an honorarium for the creation and presentation of the design proposal. Project Description Located at 3801 Harris Drive, Corpus Christi, Texas, 78411, Collier Pool is a 4,000 square foot lap pool with a new 1,009 square foot children s pool and 1,000 square foot splash pad. The new children s area will include a slide, cascades, and miscellaneous water features. New buildings will include office space, public restrooms with changing facilities, and a mechanical pump room. The entire pool area will be surrounded by fencing with one main entrance in and out of the pool facing Harris Drive. Collier Pool is located in a residential neighborhood and is surrounded by Collier Park which includes a playground area, basketball hoop, a shelter, picnic spaces with grills, a dog station

2 and over 5 acres of open field with some mature trees. There is an adjacent parking lot for use by pool patrons, but no other play or park structures within close proximity to the pool entry. The Public Art opportunities at this site include a shade structure either outside the pool entrance or inside the pool area in the corner of the children s splash pad. Possible locations are identified in blue on the conceptual rendering below. Exact dimensions for both areas are provided on the architect s site plan in Exhibit A. The artwork must be accessible to the public, enhance the identity of the pool, create shade, and may create a seating area. As an exterior project the work must be durable and able to withstand exposure to high winds, heat, sun, salt, and rain. Exterior projects are expected to last for no less than twenty years and require little annual maintenance. For public safety reasons, the artwork should not contain sharp objects or edges. Conceptual Rendering P Possible Public art location Possible Public art location Artist Eligibility The Arts & Cultural Commission (ACC) requests qualifications from professional visual artists at least 18 years of age who live in the state of Texas. Artist must have the skills and experience commensurate with the responsibility of successfully completing a major public art installation.

3 Specifically excluded are works of art done by: students under the supervision of art instructors to satisfy course requirements; the design architect or members of the design architect s firm; City employees and their immediate family; Art Selection Panel members, or artists who are members of, or related to members of, the Arts and Cultural Commission. The artist selected for the public art project must be able to meet all insurance requirements as described in Exhibit B. If artist is a sole proprietor and does not have more than three (3) people working under them the Worker s Compensation portion of the insurance requirements can be waived. Selection Process The Arts and Cultural Commission has appointed an Art Selection Panel consisting of two visual arts professionals, two community representatives, a representative from the project s architectural firm, a Parks & Recreation Department representative and an ACC member. The Art Selection Panel is not obligated to select any of the work proposed. Selection will be based on the majority vote of the panel members. Initial Review. The Art Selection Panel will review the initial materials submitted by artists and select semi-finalists who will be invited to submit concept design proposals. Each semi-finalist will be compensated $500 for the creation and presentation of their concept design proposal. Final Review and Selection. The Art Selection Panel will review the concept proposals from the semi-finalist artist(s), and (if possible) select one. The Art Selection Panel s recommendation will be forwarded to the Arts and Cultural Commission for approval and, in turn, recommended to the City Council for final approval. A contract between the artist(s) and the City will be executed upon City Council approval. Selection Criteria Artist and or artwork will be selected on the basis of Qualifications, as demonstrated by past work The appropriateness of the proposal to the particular project Structural integrity of the proposed artwork, including resistance to general wear or theft Cost and ease of future maintenance The ability to withstand exposure to high winds, heat, sun, salt, and rain The probability of successful completion Application All applications for this project must include: One (1) flash drive of at least 6 and no more than 10 digital images of artist s work with description. (PowerPoint presentation with images and work description is preferred) One (1) set of printed images with work description corresponding to the digital images on the flash drive. Letter of interest which briefly outlines the interest in this specific opportunity and demonstrates an ability to successfully complete a project of this scale. Current professional resume with artist s phone and contact information. Three (3) references familiar with your work, including phone and contact information for each.

5 I. EXHIBITOR S LIABILITY INSURANCE EXHIBIT B INSURANCE REQUIREMENTS A. Exhibitor must not commence work under this contract until all insurance required has been obtained and such insurance has been approved by the City. Exhibitor must not allow any subcontractor, to commence work until all similar insurance required of any subcontractor has been obtained. B. Exhibitor must furnish to the City s Risk Manager and Director of Parks and Recreation one (1) copy of Certificates of Insurance with applicable policy endorsements showing the following minimum coverage by an insurance company(s) acceptable to the City s Risk Manager. The City must be listed as an additional insured on the General liability and Auto Liability policies by endorsement, and a waiver of subrogation endorsement is required on all applicable policies. Endorsements must be provided with Certificate of Insurance. Project name and/or number must be listed in Description Box of Certificate of Insurance. TYPE OF INSURANCE 30-day advance written notice of cancellation, non-renewal, material change or termination required on all certificates and policies. COMMERCIAL GENERAL LIABILITY including: 1. Commercial Broad Form 2. Premises Operations 3. Products/ Completed Operations 4. Contractual Liability 5. Independent Contractors 6. Personal Injury- Advertising Injury AUTO LIABILITY (including) 1. Owned 2. Hired and Non-Owned 3. 6 C. In the event of accidents of any kind related to this contract, Exhibitor must furnish the Risk Manager with copies of all reports of any accidents within 10 days of the accident. II. ADDITIONAL REQUIREMENTS A. Applicable for paid employees, Exhibitor must obtain workers compensation coverage through a licensed insurance company. The coverage must be written on a policy and endorsements approved by the Texas Department of Insurance. The workers compensation coverage provided must be in statutory amounts according to the Texas Department of Insurance, Division of Workers Compensation. An All States Endorsement shall be required if Exhibitor is not domiciled in the State of Texas. B. Exhibitor shall obtain and maintain in full force and effect for the duration of this Contract, and any extension hereof, at Exhibitor's sole expense, insurance coverage written on an occurrence basis by companies authorized and admitted to do business in the State of Texas and with an A.M. Best's rating of no less than A- VII. C. Exhibitor shall be required to submit renewal certificates of insurance throughout the term of this contract and any extensions within 10 days of the policy expiration dates. All notices under this Exhibit shall be given to City at the following address: City of Corpus Christi Attn: Risk Manager P.O. Box 9277 Corpus Christi, TX D. Exhibitor agrees that, with respect to the above required insurance, all insurance policies are to contain or be endorsed to contain the following required provisions: List the City and its officers, officials, employees, and volunteers, as additional insureds by endorsement with regard to operations, completed operations, and activities of or on behalf of the named insured performed under contract with the City, with the exception of the workers' compensation policy; Provide for an endorsement that the "other insurance" clause shall not apply to the City of Corpus Christi where the City is an additional insured shown on the policy; Workers' compensation and employers' liability policies will provide a waiver of subrogation in favor of the City; and Provide thirty (30) calendar days advance written notice directly to City of any, cancellation, non-renewal, material change or termination in coverage and not less than ten (10) calendar days advance written notice for nonpayment of premium.

7 E. Within five (5) calendar days of a cancellation, non-renewal, material change or termination of coverage, Exhibitor shall provide a replacement Certificate of Insurance and applicable endorsements to City. City shall have the option to suspend Exhibitor's performance should there be a lapse in coverage at any time during this contract. Failure to provide and to maintain the required insurance shall constitute a material breach of this contract. F. In addition to any other remedies the City may have upon Exhibitor's failure to provide and maintain any insurance or policy endorsements to the extent and within the time herein required, the City shall have the right to order Exhibitor to stop work hereunder, and/or withhold any payment(s) which become due to Exhibitor hereunder until Exhibitor demonstrates compliance with the requirements hereof. G. Nothing herein contained shall be construed as limiting in any way the extent to which Exhibitor may be held responsible for payments of damages to persons or property resulting from Exhibitor's or its subcontractor s performance of the work covered under this contract. H. It is agreed that Exhibitor's insurance shall be deemed primary and non-contributory with respect to any insurance or self insurance carried by the City of Corpus Christi for liability arising out of operations under this contract. I.
