1 Minnesota Zoo Foundation 2015 Beastly Ball Raffle (the Raffle ) Official Rules A PURCHASE IS REQUIRED TO ENTER AND WIN THIS RAFFLE. Up to two thousand, five hundred (2,500) Raffle tickets will be sold (each, a Ticket ). The odds of winning are dependent upon the total number of Tickets sold during the Raffle Period (defined below). RAFFLE PERIOD: The Raffle begins at open of business on April 1, 2015 and ends at 2:00 p.m. Central Time ( CT ) on August 31, 2015 (the Raffle Period ). Raffle Period is subject to the hours of operation at the Minnesota Zoo (the Zoo, located at Zoo Boulevard, Apple Valley, MN 55124). Please visit (the Website ) for Zoo hours of operation. ELIGIBILITY: The Raffle is open only to legal residents of the state of Minnesota who are twenty-one (21) years of age or older (each, an Entrant ). The Entrant who is selected as the potential grand prize winner ( Grand Prize Winner ) must be a U.S. Licensed driver at the time for which the grand prize ( Grand Prize ) is awarded. He/she must also have a unique, personal and valid social security number for the Sponsor (defined below) to report the tax liability associated with acceptance of the Grand Prize. Valid social security numbers will be determined by Internal Revenue Service ( IRS ) requirements as further defined in the Prize Claims section of these Official Rules. Managers and employees of the Minnesota Zoo Foundation ( Sponsor or Charity ), the Chicago Region Toyota Dealers Association, Toyota Motor Sales, U.S.A., Inc., Twin Cities Toyota Dealers ( Grand Prize Donor ), Saatchi & Saatchi North America, Inc., and each of their respective parents subsidiaries, affiliates and related companies, dealers, advertising and promotion agencies, consultants and agents, and any others engaged in the development, production, execution or distribution of this Raffle, including National Sweepstakes Company, LLC (the Independent Administrator ), are not eligible to participate. Raffle is subject to all federal, state and local laws and regulations. Raffle is void outside the state of Minnesota and wherever else restricted or prohibited by law. TO PARTICIPATE: In order to be eligible for a chance to win the Grand Prize in this Raffle, Entrants must purchase a Ticket. Tickets are available at a cost of $20.00 each and may be purchased by cash, check, debit card, traveler s check, cashier s check, or money order. Credit cards are not accepted. Tickets must be purchased during the Raffle Period via one of the following methods: (a) Via the Guest Services Desk at the Zoo; (b) From a volunteer via the vehicle display at the Zoo; (c) From a Board member, who may be selling Tickets at various events and functions during the Raffle Period; (d) From a Zoo or Zoo Foundation employee, who may be selling Tickets during the Raffle Period; or (e) Via Telephone by calling (952) between the hours of 9:00 a.m. CT and 5:00 p.m. CT, Monday through Friday during the Raffle Period. 1

2 Upon purchasing the Ticket, Entrants must complete the lower half of the Ticket (the Stub ) in its entirety, including his/her first and last name, mailing address, city, state, zip code, telephone number (including area code) and address. Completed Stubs must be submitted to the representative for which the Ticket was purchased (i.e. the representative at Guest Services, the Zoo volunteer, board member, Zoo or Zoo Foundation employee). Note: If you order by telephone your Stub will be completed by the representative and mailed to you directly. Each Stub is considered one (1) entry into the Raffle. Each entry into the Raffle constitutes an equal chance to win. Ticket payments may only be made in person or by telephone (via the telephone number listed above). Payments may not be made through the U.S. Postal Service or any other method other than what is listed herein. A person is not required to purchase more than one Ticket and/or pay for anything other than the Ticket in order to participate in the Raffle or win the Grand Prize. There is no limit to the number of Tickets a person can purchase during the Raffle Period. WINNING: The Raffle drawing will be held after 2:00 p.m. CT on August 31, 2015 at the Zoo. For the drawing, one (1) Grand Prize Winner will be selected at random from among all eligible entries received during the Raffle Period. Odds of being selected as the Grand Prize Winner will depend upon the total number of eligible entries received. The random drawing will be conducted by the Sponsor whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. NOTIFICATION: The Grand Prize Winner need NOT be present to win. The potential Grand Prize Winner will be notified by the Sponsor via and/or telephone within twentyfour (24) to forty-eight (48) business hours of the random drawing. Potential Grand Prize Winning notifications will not be left on answering machines / voic if notified by telephone. In the event the Sponsor cannot reach the potential Grand Prize Winner after two (2) attempts have been made, or if it is determined by the Sponsor that the potential Grand Prize Winner is not eligible in accordance with these Official Rules, an alternate Grand Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Raffle Period and he/she will be notified as outlined above until one (1) Grand Prize Winner is confirmed. Once confirmed, the Grand Prize Winner will be required to complete Required Documents as further defined in the Prize Claims section below. PRIZE CLAIMS: Except where prohibited, potential Grand Prize Winner must sign and return to the Sponsor, within fourteen (14) days of receipt, an Affidavit of Eligibility/Liability/Publicity Release form (the Release ) and an IRS Form 5754 in order to claim the Grand Prize (collectively, the Required Documents ). If the potential Grand Prize Winner fails to sign and return the Required Documents within fourteen (14) days from receipt, the potential Grand Prize Winner forfeits his/her right to the Grand Prize an alternate Grand Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Raffle Period. The Required Documents must be completed and returned to the Sponsor prior to delivery of the Grand Prize. The Grand Prize is taxable as income and Grand Prize Winner is solely responsible for any taxes on the Grand Prize, including, but not limited to all applicable federal, state and local taxes. Potential Grand Prize Winner must report income to the IRS via the Form In the event it is deemed during the verification process that potential Grand Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Grand 2

3 Prize, potential Grand Prize Winner will be disqualified and another Grand Prize Winner selected as outlined above. Valid social security numbers will be determined by IRS requirements. Acceptance of the Grand Prize constitutes permission for Sponsor, Grand Prize Donor and/or their designees to use the Grand Prize Winner s name, address, photograph, testimonial or other likeness and/or Grand Prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, the Grand Prize Winner to the greatest extent permitted by law. GRAND PRIZE: One (1) Grand Prize of a 2015 Toyota Rav4 automobile will be awarded (the Vehicle ). The manufacturer suggested retail price (the MSRP ) of the Grand Prize is $28,784 (Vehicle color, options and accessories to be determined at the sole discretion of the Sponsor). Grand Prize Winner must have and provide a valid US Driver s License and provide proof of existing car insurance coverage (Comprehensive or Liability) at time of delivery. Grand Prize Winner is required to comply with all applicable federal, state and local laws, rules and regulations, including but not limited to licensing and insurance requirements. The Grand Prize is taxable as income and all taxes associated with the Grand Prize (including but not limit to income taxes) are the sole responsibility of the Grand Prize Winner. The sales tax, title and licensing of the Vehicle is the sole responsibility of the Grand Prize Winner. Grand Prize Winner will be solely responsible for any applicable registration, and insurance fees and any other expenses not listed herein related to receipt, possession, acceptance and use of the Grand Prize. Vehicle Delivery: Grand Prize Donor shall not be responsible for delays in availability of the Vehicle, and final awarding of the Vehicle is subject to availability. Grand Prize Donor however, shall use all reasonable efforts, subject to availability, to award the Vehicle within one hundred and eighty (180) days after receipt of the Required Documents as further defined in the Prize Claims section above. The Grand Prize Winner shall be responsible for picking up the Vehicle personally at a Dealership located in the Twin Cities area. The Grand Prize Winner shall be solely responsible for all travel or transportation costs, associated with winning and retrieving the Vehicle, except as otherwise provided herein. In the event the Grand Prize Winner resides more than ninety (90) miles from the Dealership, the Vehicle shall be delivered to a mutually agreed upon location within ninety (90) miles of the Grand Prize Winner s legal residence at the Grand Prize Donor s sole cost. The Grand Prize Winner shall bear all risk of loss or damage to the Vehicle after it has been delivered to the specified delivery site. The Grand Prize Winner must personally retrieve the Vehicle within thirty (30) days of written notification from the Grand Prize Donor and must present adequate personal identification and evidence of legally required insurance at time of retrieval, or an alternate Grand Prize Winner will be selected from among the remaining non-winning eligible entries received during the Raffle Period. In such case, the original Grand Prize Winner s rights to the Vehicle shall be automatically forfeited without compensation of any kind. The Vehicle will be delivered solely with the express written limited warranties set forth in the Vehicle s applicable Owner s Guide, which warranties shall run for the term set forth in said Owner s Guide. The depiction of the Vehicle in any advertising or promotional materials or physical display may not reflect the actual vehicle delivered to the Grand Prize Winner. GENERAL CONDITIONS: Should any portion of the Raffle be, in Sponsor s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, 3

4 terminate, modify or suspend the Raffle and conduct the Raffle in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted at the Website. In such event, Sponsor reserves the right to award the Grand Prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Raffle or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS. RELEASE: By participating in this Raffle, Entrants agree to release and hold harmless Sponsor, the Chicago Region Toyota Dealers Association, the Grand Prize Donor, Toyota Motor Sales, U.S.A., Inc., Saatchi & Saatchi North America, Inc., and each of their respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, dealers, distributors, advertising, promotion, and fulfillment agencies, including the Independent Administrator, consultants and legal advisors (collectively, the Released Parties ) from and against any claim or cause of action arising out of participation in the Raffle or receipt, redemption or use of the Grand Prize. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) unauthorized human intervention in any part of the entry process or the Raffle; (b) electronic or human error which may occur in the administration of the Raffle or the processing of entries; (c) any property loss, damage, personal injury or death, in connection with the Grand Prize provided pursuant to this Raffle and/or any person s participating in the Raffle; provided, however that Grand Prize Donor shall be solely responsible for any express limited warranties specifically set forth in the applicable Owner s Guide of the Grand Prize Vehicle. (d) any printing or typographical errors in any Raffle-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (if applicable); or (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software. All federal, state and local regulations apply. ENTRANTS PERSONAL INFORMATION: Information collected from Entrants is subject to Sponsor s privacy policies, located at WINNER S LIST: For the name of the Grand Prize Winner, please submit a self-addressed, stamped envelope for receipt no later than by October 31, 2015 to 2015 Beastly Ball Raffle, PO Box 10505, Rochester, NY OFFICIAL RULES: A copy of these Official Rules may be obtained at the Guest Services Desk at the Zoo during the Raffle Period. 4
