On the other hand, TNT would like to offer even more certainty. This is why we developed a product that gives you the right to compensation on the basis of the full value of your goods instead of the weight. In short, thanks to these solutions you can entrust us with your valuable shipments with equanimity. 2

3 Pantone 021C Liability according to the legal framework Damage & loss of goods during transport 1. General Unlike normal liability law anyone who is to blame for causing damage to someone else, has to reimburse this damage the liability for damage and loss of goods during transport is laid down by the CMR Convention for road transport and the Montreal Convention for air transport. Both conventions are internationally binding. In other words, no contractual derogatory stipulation can be agreed. Although the conventions in principle only apply to international transport, the CMR Convention also applies to Belgian national transport (Act of 3 May 1999). 2. The basic principle Both conventions presume that the receiving party (the transporter upon collection and the addressee upon delivery) must check the amounts and external condition of the goods. Any shortcomings and damage must immediately be mentioned on the consignment note. If this is not done, it shall be presumed that the goods were delivered in a complete and undamaged state. Please note: stamps with the standard message Subject to later control are not accepted as a valid condition. The transporter must also be held in default. 4. Correct shipping The sender is obliged to provide a packaging that is fit to travel and to guarantee the correctness of data on the consignment note or to check the data if the consignment note has been drawn up by a third party, including the transporter. 5. Compensation In case of damage or loss and provided that a valid proof of default was served, the transporter will have to pay compensation. This compensation is limited to the value of the lost and damaged goods and to approximately 10 per kilogram damaged or lost weight. If it concerns air transport, this maximum comes to approximately 20. The maximum amounts of 10 and 20 are determined every month on the basis of international exchange rates and published in the financial newspapers under section SDR. The transporter is not liable for any consequential damages. In case of late delivery the transporter only has to compensate damage, which is the freight cost at the most. The sender must declare the transporter in default within 21 days for road transport and within 14 days for air transport. 3. Written proof of default If hidden loss or damage has occurred, the receiving party must inform the transporter of this in writing within seven days. The recipient will also have to prove that the damage or loss was caused by the transporter. If something still goes wrong and goods are damaged or lost, then TNT offers you the possibility of fully compensating the damage instead of following legislation in the CMR Convention and the Convention of Montreal. An overview. 1. Extension of claim limitation period TNT adheres to international agreements the CMR Convention and Convention of Montreal are imperative international law when carrying out transport under the liability regulations of both conventions. The limitation period of 7 days for submitting a claim is however extended to 21 weekdays. 2. All Risk insurance For parcels and pallets Provided that you pay a small surcharge the goods to be sent are covered for their full value against damage and loss during transport. This covers repair and/or replacement of the goods up to the indicated value with a maximum of 25,000. It suffices to tick the Insurance box on the consignment note and to enter the Value to cover the transported goods. Higher values are only possible after prior permission.
